The Arizona Department of Environmental Quality (ADEQ) adopted a rulemaking that remedies deficiencies identified by the U.S. Environmental Protection Agency (EPA) in the state’s New Source Review (NSR) program. The rulemaking updates the ozone and fine particulate matter (PM2.5) National Ambient Air Quality Standards (NAAQS) and applies Title 1 requirements to PM2.5 nonattainment areas, as required by a 2013 court decision. Amendments to the Arizona minor NSR rules remove exemptions from public notice and comment requirements for certain sources, require public notice and comment for all source modifications subject to minor NSR, and correct technical deficiencies. The rulemaking also amends general permit rules in article 5 to reflect minor NSR requirements, amends the state’s new web-based general permitting system, and streamlines certain aspects of the permitting program to ease regulatory burdens. The final rules are effective 21 MAR 17. WASTE LANDFILL METHANE CONTROL. In February, ADEQ held a stakeholder meeting to discuss new changes to federal standards for municipal solid waste landfill methane control. ADEQ is seeking public input regarding state rule revisions required to conform to new federal standards found at 40 Code of Federal Regulation (CFR) Part 60.30f-41f and 40 CFR 60.760-769. Requires the committee to collect information on the environmental impacts of production and disposal of solar energy panels, the lifespan of solar energy panels, and opportunities to expand solar energy panel recycling or reuse in the state. Requires the committee to make recommendations to the governor and legislature related to the impact of renewable energy technology. LAND USE NATURAL RESOURCES SB 1247 Senator Gail Griffin (R) Requires governmental holders of conservation easements to make an annual payment in lieu of property taxes to the local county. Specifies that the annual payment amount be equal to the property tax if the easement holder had not been a governmental entity. OTHER SB 1202 Senator Gail Griffin (R) Consolidates the Office of the State Fire Marshall into the Department of Forestry and Fire Management, and makes conforming changes to state statute. Eliminates a requirement for the State Fire Marshall to compile and maintain a list of state and local rules governing hazardous material management. WASTE WATER HB 2130 Representative Russell Bowers (R) Requires the Department of Environmental Quality to submit an annual report on the state total maximum daily load program. HB 2193 Representative Regina Cobb (R) Establishes the Groundwater Resource Management and Land Credit Task Force. Authorizes the task force to establish a framework and criteria for a property development credit program to encourage appropriate donation, acquisition, and use of conservation areas to support the maintenance of groundwater and other ecological resources in exchange for development credits. SB 1165 Senator Karen Fann (R) Amends an exemption to the general prohibition on drilling new wells in active management areas in cases citing cost considerations. Requires the landowner requesting an exemption provide supporting cost documentation. Page 3 of 22 Region 9 Western Review March 2017 Army Regional Environmental & Energy Office AIR PORTABLE FUEL CONTAINER REGULATION. The California Air Resources Board (CARB) adopted amendments to its Portable Fuel Container Regulation, Title 13 California Code of Regulation (CCR) Section 2467. The amendments require certification fuel to contain 10 percent ethanol; harmonize aspects of CARB’s portable fuel container certification and test procedures with those of the EPA; revise the certification process; and streamline, clarify, and increase the robustness of CARB’s certification and test procedures. The final rule (page 22) is effective 1 APR 17. 2015 AIR MONITORING NETWORK RESULTS. The California Department of Pesticide Regulation released the final report for its 2015 Air Monitoring Network Results. In 2011, the department implemented a multi-year statewide air monitoring network to measure pesticides in various agricultural communities. The goals of the air monitoring network are to provide data that helps to assess potential health risks, develop measures to mitigate risks, and measure the effectiveness of regulatory requirements. MOJAVE DESERT: ORGANIC SOLVENT DEGREASING. The Mojave Desert Air Quality Management District is proposing to revise local Rule 1104, Organic Solvent Degreasing. The revisions would update rule applicability, definitions, volatile organic content limits, control equipment requirements, cleaning equipment requirements, work practices, exemptions, and test methods. The revisions are intended to align the current rule with changes to state and federal requirements. SAN DIEGO: FEES. The San Diego Air Pollution Control District is proposing to adjust flat and hourly fees specified in local Rule 40, Permit and Other Fees, and local Rule 42, Hearing Board Fees. The fees, which are used to cover the costs of the county air pollution control program, have not been updated in several years. A public hearing is scheduled for 15 MAR 17. Comments are due the same day. SAN JOAQUIN VALLEY: 2017 INTEGRATED PM2.5 PLAN. The San Joaquin Valley Air Pollution Control District is developing a single attainment plan that addresses the 1997, 2006, and 2012 NAAQS for PM2.5 and is requesting public input on the plan development. The district will conduct multiple workshops and reconvene the Public Advisory Workgroup, which consists of representatives from the regulated community, community advocates, and state and federal advisors. A workshop was held 9 MAR 17. For more information, click here. VENTURA COUNTY AIR QUALITY MANAGEMENT PLAN. CARB is requesting public comment on the 2016 Ventura County Air Quality Management Plan for the 75 parts per billion (ppb) 8-hour ozone NAAQS. If adopted, CARB will submit the 2016 plan to EPA as a revision to the California State Implementation Plan (SIP).
