Publikacija koja je pred čitaocem deo je projekta „Unapređenje kapaciteta lokalnih aktera za upotrebu antikorupcijskih mehanizama“, koji realizovalo Bečejsko udruženje mladih, uz podršku Fondacije za otvoreno društvo, i ima za cilj da približi stanje u oblasti javnih finansija, borbi protiv korupcije i vladavine prava u Republici Srbiji i da predstavi rad nezavisnih institucija kroz praktične primere. Poseban aspekt istraživanja zasniva se na praćenju primene antikorupcijskih zakona na lokalnom nivou, koji prema našem mišljenju nije dovoljno u javnom diskursu, a sadržaj publikacije će pokazati značajan deo problematičnosti tog pitanja. Autorski tim Bečejsko udruženje mladih–BUM– ZBORNIK ISTRAŽIVANJA | 7 (Ne) ažurnost Agencije: Javna funkcija i privatni interesi Bečejsko udruženje mladih (BUM) obratilo se Agenciji za borbu protiv korupcije 14. oktobra 2016. godine postavljajući nekoliko, za građane opštine Bečej, ključnih pitanja u vezi sa transparentnošću i ažurnošću rada te institucije, a sve povodom postupanja u predstavkama koje je udruženje upućivalo u nekoliko navrata. Obraćanje BUM-a Agenciji je usledilo nakon što je u Skupštini opštine Bečej konstatovana ostavka direktora Javnog preduzeća „Komunalac“ Bečej Norberta Kovača, ali i zbog dvojice funkcionera opštine Novi Bečej, za koje je, posle se potvrdilo, sumnja u povrede Zakona o Agenciji za borbu protiv korupcije bila opravdana. Drugim rečima, u predmetima koji su na inicijativu BUM-a pokrenuti pred Agencijom za borbu protiv korupcije, izostalo je blagovremeno informisanje javnosti, odnosno građana, a za jedan sumnjamo da bi bez podsećanja Agencije da se „pozabavi“ predmetom, isti ostao u fioci. Krenimo redom. Slučaj Kovač – kad lokalni parlament utihne Agencija za borbu protiv korupcije utvrdila je da je Norbert Kovač, koji je do početka oktobra 2016. godine bio direktor Javnog preduzeća „Komunalac“ Bečej, više puta povredio Zakon o Agenciji za borbu protiv korupcije i doveo sebe u sukob interesa. Kovaču je zbog povreda zakona izrečena mera javnog objavljivanja preporuke za razrešenje sa javne funkcije direktora JP „Komunalac“ Bečej, dok je on u međuvremenu podneo ostavku na tu funkciju. Zbog sumnji da je Kovač postupao suprotno propisima, Bečejsko udruženje mladih se Agenciji za borbu protiv korupcije obratilo još ranije. U Rešenju Agencije za borbu protiv korupcije od 26. septembra 2016. godine navodi se da je Norbert Kovač postupio suprotno odredbama člana 35. stav 1. Zakona o Agenciji za borbu protiv korupcije na taj način što nije u roku od 30 dana od dana imenovanja na javnu funkciju direktora JP Bečejsko udruženje mladih–BUM– ZBORNIK ISTRAŽIVANJA | 8 „Komunalac“ Bečej preneo svoja upravljačka prava u privrednom društvu „Origo – commerce“ DOO iz Bačkog Petrovog Sela, čiji je vlasnik, na drugo pravno ili fizičko lice koje nije povezano lice, da ih ono, u svoje ime, a za račun funkcionera, vrši do prestanka javne funkcije. Pored toga, Kovač je postupio suprotno odredbama člana 27. i 32. stav 1. Zakona o Agenciji za borbu protiv korupcije na taj način što je Javno preduzeće „Komunalac“ od 2013. do 2015. godine poslovno sarađivalo sa privrednim društvom „Origo – commerce“ DOO iz Bačkog Petrovog Sela, a da o sukobu interesa koji je imao u navedenoj situaciji nije obavestio Agenciju za borbu protiv korupcije. Naime, Agencija je iz dokumentacije javnog preduzeća koju je dobila 16. decembra 2015. godine, a koja sadrži i analitičke kartice, utvrdila da je u periodu od 2013. do 2015. godine između JP „Komunalac“ i „Origo – commerce“ postojala poslovna saradnja i da je ostvaren ukupan promet od 262.250 dinara. Sarađujući sa firmom čiji je vlasnik, kao direktor „Komunalca“, Kovač je doveo sebe u sukob interesa, „podređujući javni interes privatnom i koristeći javnu funkciju za sticanje koristi za sebe i povezano lice, i na taj način ugrozio poverenje građana u savesno i odgovorno vršenje javne funkcije, suprotno odredbama člana 27. Zakona o Agenciji“, kako to piše u Rešenju. Inače, Rešenje Agencije je 3. oktobra 2016. godine stiglo na adresu Skupštine opštine Bečej, devet dana uoči održavanja sednice Skupštine opštine Bečej na kojoj je trebalo da se konstatuje ostavka Kovača, potom da odbornici za v.d. direktora „Komunalac“ Bečej imenuju Željka Plavšića, ali i da lokalni parlament usvoji Odluku o sprovođenju javnog konkursa za imenovanje direktora JP „Komunalac“ Bečej. Bečejsko udruženje mladih–BUM– ZBORNIK ISTRAŽIVANJA | 9 Iako se za skupštinskom govornicom u opštini Bečej tokom zasedanja lokalnog parlamenta može čuti svašta, niko od lokalne vlasti, koja je znala za odluku Agencije, odnosno, koja je obaveštena da je funkcioner čiju ostavku treba da konstatuju povredio zakon, nije našao za shodno da govori na ovu temu. Na naše pitanje zašto Rešenje Agencije nije bilo sastavni deo dnevnog reda 7. sednice SO Bečej održane 12. oktobra, na primer, u formi informacije koja se tokom sednice saopšti odbornicima, kako bi se na taj način odbornici neposredno, a potom i građani opštine Bečej, upoznali sa odlukom Agencije u vezi sa radom lokalnog funkcionera, predsednik Skupštine opštine Bečej Nenad Tomašević odgovora da je Kovač podneo ostavku mnogo pre nego što je rešenje stiglo. -Mi smo kadrovsku komisiju, ako se ne varam, takođe imali pre nego što je to stiglo i gde smo mi tu njegovu ostavku verifikovali. On je neopozivu ostavku podneo iz ličnih razloga, nije naveo zašto, obrazloženje je prvog čoveka lokalnog parlamenta u Bečeju, reči su Tomaševića. Međutim, jasno je da čelnici lokalne skupštine koja je Kovača i imenovala na mesto direktora javnog preduzeća, nisu iskoristili priliku (želeli) da izveste odbornike, a potom i građane o ovom slučaju. Isti ti funkcioneri obavezni su da stvaraju i održavaju poverenje građana u savesno i odgovorno vršenje javne funkcije. Norbert Kovač podneo je ostavku na funkciju direktora Javnog preduzeća „Komunalac“ Bečej 12. septembra 2016. godine. Kako je tri dana nakon toga za portal MojBečej.rs rekao, to je učinio iz ličnih razloga, jer ima privatne poslovne planove koji će zahtevati više vremena i angažmana. Kovač je ostavku podneo nešto više od godinu dana pre isteka četvorogodišnjeg mandata. Bivšem direktoru bečejskog javnog komunalnog preduzeća je zbog povreda Zakona o Agenciji za borbu protiv korupcije izrečena mera javnog Bečejsko udruženje mladih–BUM– ZBORNIK ISTRAŽIVANJA | 10 objavljivanja preporuke za razrešenje sa javne funkcije direktora JP „Komunalac“ Bečej, dok troškove objavljivanja snosi Norbert Kovač. U Rešenju Agencije za borbu protiv korupcije stoji i da izreka i sažeto obrazloženje moraju biti objavljeni u Službenom glasniku Republike Srbije i Službenom listu opštine Bečej. To je i učinjeno, pa se Rešenje Agencije za borbu protiv korupcije objavljuje 3. novembra 2016. godine, u 19. broju Službenog lista

At approximately the same time, after more than 40 years, new geographical zoning of viticulture production areas in Serbia was carried out by the Ministry of Agriculture, Forestry and Water Management. In Serbia, the area of about 25000 ha is under vine, out of which 22150 ha is in Central Serbia and Vojvodina. About 75.7% of total area is used for the production of wine grapes and 24.3 % is used for the production of table grapes. Viticulture zoning divides the territory of Serbia into three wine growing units which comprise 22 regions, 77 wine growing districts and a large number of wine growing oases. Advancement and planned development of viticulture can only be achieved if there is awareness of current state of area under vine, knowledge of assortment, seedling age, potentials of some wine making regions and other necessary conditions. The first documented record of S. nitidifrons from the Balkan Peninsula is provided, as well as keys for both males and females, lists of material examined and distribution maps for each Balkan Syrphus species. Syrphus torvus is new to Croatia. All the studied taxa are widespread throughout the Balkans, except S. nitidifrons, limited to a few mountain localities: Kopaonik Mountain (Serbia), Jahorina Mountain (Bosnia and Herzegovina) and Durmitor Mountain (Montenegro). The need for conservation of S. nitidifrons is remarked. KEY WORDS: Syrphus nitidifrons, keys to species, first records, species distribution Introduction The genus Syrphus Fabricius, 1775 (Syrphinae: Syrphini) comprises medium-sized hoverflies with broad oval abdomen and calypter with hairs on the dorsal side.
