Oñati Socio-Legal Series, v. 1, n. 9 (2011) – Autonomy and Heteronomy of the Judiciary in Europe ISSN: 2079-5971 Seven Theses on Spanish Justice to understand the Prosecution of Judge Garzón ∗ JOXERRAMON BENGOETXEA “Something is rotten in the state of Denmark” (Hamlet) Abstract Judges may not decide cases as they wish, they are subject to the law they are entrusted to apply, a law made by the legislator (a feature of heteronomy). But in doing so, they do not take any instruction from any other power or instance (this contributes to their independence or autonomy). Sometimes, they apply the law of the land taking into account the norms and principles of other, international, supranational, even transnational systems. In such cases of conform interpretation, again, they perform a delicate balance between autonomy (domestic legal order and domestic culture of legal interpretation) and heteronomy (external legal order and culture of interpretation). There are common shared aspects of Justice in the Member States of the EU, but, this contribution explores some, perhaps the most salient, features of Spanish Justice in this wider European context. They are not exclusive to Spain, but they way they combine and interact, and their intensity is quite uniquely Spanish. These are seven theses about Justice in Spain, which combine in unique ways as can be seen in the infamous Garzón case, discussed in detail. 40 años de política exterior española: el modelo de la monarquía 1 democrática y su evolución Rosa Mª Pardo Sanz Universidad Nacional de Educación a Distancia (UNED) [email protected] En diciembre de 2014, el gobierno de Mariano Rajoy aprobaba la Estrategia de Acción Exterior española, primer documento de este tipo desde 1975. En su introducción se lee: Durante las cuatro últimas décadas, desde la aprobación de la Constitución, España se ha proyectado hacia el mundo con confianza en sí misma y un claro propósito: reencontrarse con la Europa integrada y recuperar su lugar en la Comunidad Internacional. (…) Pocos ideales colectivos han conseguido movilizar a la sociedad española de forma tan unánime. (…) El objetivo se cumplió (...) La estrategia de reencuentro e integración llega entonces a su fin, se agota al cumplir sus objetivos. (…) La Unión Económica y Monetaria simbolizó hasta qué punto la aspiración se había realizado. Misión cumplida ¿Y ahora qué?2. Semanas antes, al presentar el documento en las Cortes, el ministro José Manuel García Margallo celebraba estos éxitos, pero también apuntaba carencias, como la ausencia de una estrategia explícita “que haga nuestra acción exterior y nuestra política exterior previsibles y conocidas por nuestros socios en el mundo”, que sea fruto del consenso político y que suponga la definitiva adaptación, en instrumentos y medios, de la acción exterior española al nuevo contexto de la globalización y a los cambios geoestratégicos de la última década. En teoría, el flamante documento de estrategia debía cubrir ese vacío3. Pero dos años después, en abril de 2106, el diario El Pais publicaba un editorial titulado “La nada exterior”, denunciando el desdibujamiento de la presencia de España en el mundo, su falta de perfil internacional. -

blogs.lse.ac.uk http://blogs.lse.ac.uk/europpblog/2015/12/16/spanish-general-election-preview-the-pp-may-win-the-election-but-mariano-rajoys-future- is-far-from-secure/ The PP may win Spain’s election, but Mariano Rajoy’s future is far from secure Spain will hold a general election on 20 December, with opinion polls indicating a tight contest between four parties for the largest share of the vote – the governing People’s Party (PP), who have a small lead in most polls, the Spanish Socialist Workers’ Party (PSOE), Ciudadanos (C’s), and Podemos. To mark the election, EUROPP is running a series of articles examining each of the four parties and their campaigns ahead of the vote. In the second article of the series, Javier Astudillo and Marta Romero assess the campaign run by the People’s Party, noting that while they are likely to retain control over the next government, Mariano Rajoy may not survive as Prime Minister if the PP are forced to rely on the support of other parties. The incumbent Spanish People’s Party (PP), led by Prime Minister Mariano Rajoy, will contest the election after being in government with an absolute majority, in addition to controlling until recently most regional governments and main cities. In 2011 almost 11 million citizens (44.6 per cent of the vote) trusted the party to take Spain out of a deep economic crisis that had broken out under that the last Socialist Party government led by José Luis Rodríguez Zapatero (2008-2011). During the first part of their mandate, the government implemented a highly contested economic adjustment package that belied some of their electoral promises (such as raising taxes), and was forced to request from the EU a rescue plan to clean up the Spanish banking system. -

“Behind-the-Table” Conflicts in the Failed Negotiation for a Referendum for the Independence of Catalonia Oriol Valentí i Vidal*∗ Spain is facing its most profound constitutional crisis since democracy was restored in 1978. After years of escalating political conflict, the Catalan government announced it would organize an independence referendum on October 1, 2017, an outcome that the Spanish government vowed to block. This article represents, to the best of the author’s knowledge, the first scholarly examination to date from a negotiation theory perspective of the events that hindered political dialogue between both governments regarding the organization of the secession vote. It applies Robert H. Mnookin’s insights on internal conflicts to identify the apparent paradox that characterized this conflict: while it was arguably in the best interest of most Catalans and Spaniards to know the nature and extent of the political relationship that Catalonia desired with Spain, their governments were nevertheless unable to negotiate the terms and conditions of a legal, mutually agreed upon referendum to achieve this result.
