Judicial councils play an essential role in guaranteeing the independence and the autonomy of the judiciary. The underlying rationale for their creation is the need to insulate the judiciary and judicial career processes from external political pressure. In addition to their primary function of safeguarding judicial independence, a growing number of judicial councils have been entrusted with far-reaching powers in the area of promoting the efficiency and quality of justice, and of rationalizing the administration of justice, court management and budgeting. In the report, the Special Rapporteur shows that there is no one-size-fits-all model of judicial council. Each judicial governing body originates from a legal system with distinct historical, cultural and social roots; the specific role of each body varies from one country to the other. The Special Rapporteur shows that the number of judicial councils has increased greatly in recent decades, and estimates that, to date, over 70 per cent of the countries in the world have some form of judicial council. -

Introduction In the summer of 2012, Romania experienced the deepest constitutional crisis in its post- communist history. For the European Union (“EU”), which Romania joined in 2007, the crisis amplified an existential challenge posed by a turn to constitutional authoritarianism in its new member states. Coming after similar developments in Hungary, the Romanian crisis forced the “highly interdependent”2 EU to grapple with the question of how to enforce basic principles of constitutionalism within the states. That challenge would have been unthinkable even a decade earlier. In “A Grand Illusion”, an essay on Europe written in 1996, well before the Eastern expansion of the EU, Tony Judt argued that the strongest argument for such an expansion, which he otherwise did not favor, was that membership in the Union would quiet the “own internal demons” of the Eastern 3 European countries and “protect them against themselves.” It turns out, however, that 1 Associate Professor, Boston College Law School and Director, Clough Center for the Study of Constitutional Democracy. Strategic Report EEA and Norwegian Financial Mechanisms 2009-2014 Romania 1 January – 31 December 2016 1 EXECUTIVE SUMMARY The report provides a detailed overview of the progress achieved in 2016 in the implementation of the 2009-2014 EEA and Norway Grants in Romania, with one year before the ending of the programmes. It was the most significant period for the implementation of projects, with a number of 668 projects being completed by the end of December 2016 of the total number of the 837 contracted on all programmes. Within programmes implemented by beneficiary state POs, most of which have benefited from extensions of the eligibility period, 228 projects of the total number of 386 are already finalized (60%). The achievement of results has also progressed significantly, with many programmes reporting the achievement or surpassing of set targets on outcomes and outputs, as detailed in section 2. In terms of financial implementation of the Grants, at the end of 2016, disbursements made by Donors have reached the level of approximately 90%. The overall level of payments to projects made was of 80% of the amounts received (disbursed by Donors) and 72% of the total budget available. Significant progress can also be perceived in the strengthening of bilateral relations, with important results being obtained through both the fund for bilateral relations at national level and in donor partnership programmes and projects. The Fund for bilateral relations at national level has been allocated to contracted initiatives in proportion of 88%. Nation Branding and National Identity in Romania -An analysis of the ’Discover The Place Where You Feel Reborn’ campaign- Master Thesis Author: Andra-Mihaela Cristea Supervisor: John Hird M.A. Culture, Communication and Globalization February, 2015 Abstract The following thesis want to explore the concept of national identity in relation to the nation brand in Romania. The main focus will be placed on the national brand ’Explore the Carpathian Garden’, with an accent of the latest communications campaign, ”Discover the place where you feel reborn”. Released in June 2014, so far the campaign consists of 3 TV commercials, aired on 6 main national channels; print advertising in local newspapers; and a couple of YouTube videos, which at a first glance seem to be designed for an international audience. However, for this research only the three commercials will be taken into account, since being broadcasted, people are more inclined to be aware of them. Moreover, the target audience so far has been Romanians. The language in which they are narrated is Romanian and no information about them being presented to foreigners is available. Ergo, what this research aims to do is to identify whether a connection between these commercials and the Romanian national identity exists. I have opted for this theme bearing in mind that the campaign belongs to the ’Explore the Carpathian Garden’ brand, a brand whose logo and message were rejected by the Romanian population when they were released to the public in 2010. Hence, I wanted to see if people’s perception about the brand has changed over time, and if these new commercials are better than previous attempts, if they manage to capture the core essence of the national identity. -

If that is their attitude, what will they say to Cameron’s demand to repatriate powers where the Treaties offer no such option? BACKGROUND 1. The importance of JHA. Justice and Home Affairs comprise the power to use the coercive power of the police, and put people in prison. It is therefore a crucial area of government – the key to control of the State. 2. The deep differences between the JHA systems used in the UK and those of our EU partners. Our systems of justice and theirs took separate paths 800 years ago (Magna Carta for us, the Inquisition for them). To this day Habeas Corpus and Trial by Independent Jury, to name two particular British safeguards, are enjoyed nowhere in continental Europe. Their criminal laws are administered entirely by a professional career judiciary, an unaccountable body with vast and fearsome powers, unknown to us. 3. The somewhat volatile political history of our EU partners. The UK has been a stable democracy for over 350 years. Many if not most of our continental partners have known tyranny and violent upheaval within living memory. Is it wise to bind our destiny indissolubly to theirs, in a union where we are a minority?
