DLE/261/10 Brookfield Terrace

Question: Councillor N. Bhreathnach “To ask the Manger to bring forward a proposed works programme for the refurbishment of the road and grass verges on Brookfield Terrace work promised by the Manager once the Maretimo Stream works are in place”

Reply: The works programme for the maintenance and restoration of roads is looked after by the Transportation Department. As stated in a reply given at the September Dun Laoghaire Area Committee for Planning and Transportation, Brookfield Terrace can be included for consideration for grant funding from the “Road Restoration & Maintenance Grants” to be allocated by the NRA in 2011. However, the road resurfacing cannot proceed until a new surface water drainage system is installed and this in turn cannot be undertaken until the Carysfort/Maretimo Stream project is completed.

DLE/262/10 Commencement of Maretimo Stream Works

Question: Councillor N. Bhreathnach “To ask the Manager when the promised Maretimo Stream works will commence?”

Reply: It is planned that the Carysfort/Maretimo Stream Improvement Scheme will commence within two months of receiving confirmation from the Department of Environment, Heritage and Local Government that funding for the scheme is in place, assuming no further challenges to the tender award process.

DLE/263/10 Proposed new Sewerage pipe

Question: Councillor N. Bhreathnach “To ask the Manager to respond to the Seapoint Swimmers who would appreciate all available information on a proposed new pipe for discharging sewage to the Bay?”

Reply: Various options are currently being considered that will reduce the overflow volumes at Seapoint. These options include additional surface water sewers and overflow pipes. Currently DLR are constructing a surface water relief sewer on Pakenham Road that will discharge excess surface water from the Monkstown Stream, (that currently enters the combined system), straight to sea.

DLE/264/10 Maretimo Stream Works

Question: Councillor N. Bhreathnach "To ask the Manager given the assurances given by him to the March 2010 meeting of the Council that the Maretimo Stream works would commence in Autumn, will the Manager now report to the Committee on the status of the planned works, on any agreements with land owners outstanding and when in his estimation the works will commence?"

Reply: The current status of the Carysfort/Maritimo Stream Improvement Scheme is that a recommendation for the award of the contract has been received from the consultants and an application has been made to the Department of Environment, Heritage and Local Government to seek confirmation that funding is in place before awarding a contract (as required by Circular L5/09). When confirmation is received, the Council will be in a position to issue the Letter of Intent to the successful tenderer. There is a minimum period of two weeks following this before the contract can be awarded and a further period of approximately one month to complete formalities before the contractor may mobilise and start work on site. However, one of the tenderers has appealed to DEHLG for a review and recommendation on the decision of the council that their tender is non-compliant. It is not known how long this process will take. It is unlikely that the Department will process the confirmation that funding is in place until the issue of the review of non-compliance is complete.

It is estimated that works will commence within two months of receiving the confirmation from the Department, assuming no further challanges to the process.

Wayleave Notices have been issued to all affected landowners. Notice of Entry will be issued once the contract has been awarded.

DLE/265/10 Maretimo Stream Improvement Scheme & Flood relief project

Question: Councillor V. Boyhan “To ask the Manager to set out the current position in relation to contract , finance, and commencement in relation to the Maretimo Stream Improvement Scheme & Flood relief Project, and to provide copies of recent communication on same to and from the Department of Environment , Heritage & Local Government?”

In relation to finance, the scheme is being funded by the DEHLG as part of the Water Services Investment Programme and a reply is awaited to confirm that funding is in place. As the tender award process is not complete it is not possible to provide copies of correspondence with DEHLG, however the following is a summary of recent communications:- 6th August 2010 - Letter from Michael Mangan, Senior Engineer to Water Services Department, DEHLG - enclosing the tenderers written request for referral of decision for review and recommendation, along with 'Statement of Tender Submission' by Senior Engineer

10th September 2010 - Submission of Form WSIP11 to DEHLG - 'Certificate of Director of Services of Proposal to Award the Most Economically Advantageous Tender' (This is the format in which Council apply to the Department for confirmation that funding is in place, as per Circular L5/09)

A general condition on the licences requires that the trade effluent shall not contain active viruses, pathogens and or unsterilised body fluids.

In some cases the trade effluent is treated by precept tablets (bleach) or the use of autoclaves (steam at high temperature) in other cases biological hazardous waste is removed from site by the Licencee.

In cases where there is trade effluent due to MRI, CT, or PET scanning, the R.P.I.I (Radiological Protection Institute of Ireland) may also issue a licence.

Cyto-toxic drugs administered in hospitals during chemotherapy may be metabolised by patients either in hospital or at home. They are not specified individually in licences issued but would be covered by the BOD/COD limits. c)

Question: Councillor V. Boyhan “To ask the Manager to confirm the current sampling points in relation to the quality testing of public drinking water within the remit of this committee in addition: a Indicate frequency of testing b Location of samples c Have Council samples exceed EU standards at any time d Please provide a copy of the most recent drinking water testing results/ report?”

Reply: a. Water quality sampling frequency is carried out in accordance with the requirements of the European Communities Drinking Water (No. 2) regulations 2007. Over 250 locations are sampled annually. b. The regulations require that the sampling locations are chosen at random. c. Samples exceed the parametric value from time to time, but Dun Laoghaire Rathdown County Council has one of the highest compliance rates in the country. All exceedances are available to see on the internet. d. Please find attached the most recent Environmental Protection Agency Report on the water supply in Dun Laoghaire Rathdown:

DLE/268/10 Drainage Installation at Hyde Road

Question: Councillor J. Dillon Byrne “To ask, does the Manager intend now changing the scheme prepared by the Consultants for this Council to enable proper drainage being installed in Hyde Road playing field, to prevent flooding of a number of homes in Hyde Park adjacent to playing field and what attenuation process will be installed?”

Reply: There is no proposal to change the scheme designed by this Councils consultants which has recently gone to public tender. The flood storage proposals provide for a maximum storm-water volume equivalent to a 1 in 100 year design storm. In our Consultant Engineer’s opinion this design will prevent flooding of Hyde Road properties. The storage volume provided also includes a 10% allowance for climate change. This level of flood protection is consistent with the current best practice recommendations contained within the Greater Dublin Sustainable Drainage Scheme (GDSDS) for run-off from development. Storage volumes have been calculated using Microdrainage design software. The proposed flood storage is designed to discharge to the existing public combined sewer on Hyde Road. The system has been designed so as not to be reliant on infiltration or absorption to underlying soils.

DLE/269/10 Public Facilities arising from Shanganagh Waste Water Treatment Plant

Question: Councillor H. Lewis “To ask the Manager to report on any plans for a community gains building and or public facilities arising from construction of the Shanganagh Waste Water Treatment Plant?”

Reply: Consultations by the Community Department have been held with members of the community in the area to identify a suitable project for funding as Community Benefit for this scheme. The proposals are now being developed and costed. Subject to adequate funding being available, these will then be presented to the Members.

DLE/270/10 Contamination Survey

Question: Councillor D. O’Callaghan “To ask the Manager for a progress report on the contamination survey carried out some months ago on a stream/river at old Connaught Ave and to further ask the Manager the number of connections Dún Laoghaire Rathdown Co Council have into this stream taking surface water off Ferndale Road, and other roads in the area?”

Reply: Answer from Water and Waste Services Department regarding contamination survey A series of samples were taken at five locations along the course of the stream. At two of these locations analysis has shown clear signs of pollution. The results at these two locations are consistent with contamination by effluent from septic tanks. An investigation is underway to identify exactly the source(s) of the contamination.

Answer from Transportation Department regarding road drainage There are eight gulleys taking surface water off Ferndale Road in the vicinity of the old cottages (on the left hand side, travelling towards Aravon School from Old Connaught Avenue). These gulleys outfall into the stream which runs under the road at this location in an old culvert .

DLE/271/10 Flood Prevention Works on Clonkeen River

Question: Councillor C. Smyth “To ask the Manager to undertake the following works to ensure the Clonkeen River does not flood at Seafield Court: (a) Raise the bank in the green area beside number (address supplied). (b) Ensure the foliage/grass/weeds are kept maintained in the green area beside (address supplied) to allow the water to flow safely away from Seafield Court to the rear of Bayview Close? (c)Ensure (b) above examined when the screen in the culvert between Bayview and Seafield Court is examined by the Drainage Section?”

Reply: a) The Drainage Dept will investigate with the Parks Dept the feasibility of raising the bank as requested. b) This request has been brought to the attention of the Parks Dept who are responsible to maintain the open space. c) Drainage Dept will liaise with the Parks Dept in relation to the maintenance of the green space.

DLE/272/10 Closure of Laneway

Question: Councillor C. Smyth “To ask the Manager to report on the closure of the laneway to Killiney Beach at Vico Road/Strathmore Road?”

Reply: This laneway was closed as a health and safety measure due to a collapsed sewer which runs the length of the laneway. The sewer has been repaired and relined and it is anticipated that the laneway will be open to the public by the beginning of October at the latest

DLE/273/10 Update on the Dublin Region Watermains Rehabilitation Project

Mr. G. Looney, Senior Engineer introduced Mr. Ronan O’Rourke, Project Manager of the Dublin Region Watermains Rehabilitation Project. Mr. O’Rourke made presentation on this project. He said they will be tackling the areas where the watermains are in most need of rehabilitation first.

Following discussion during which Mr. O’Rourke and Mr. Looney responded to the Members’ questions, the report was NOTED .

DLE/275/10 Polluted pond at Carysfort, Blackrock

It was PROPOSED by Councillor V. Boyhan and SECONDED by Councillor S. Fitzpatrick:

“That the Manager prepares a brief report on the pollution within the pond at Carysfort, Blackrock, detailing the extent of the problem and proposals to remedy same, in terms of a new eco filtration system, which could include marginal plants, etc.”

The following report of the Manager was CONSIDERED:

It is intended to naturalise the pond at Carysford by softening the edges and incorporating additional marginal planting within sections of silted areas to encourage and extend the nesting habitat for wild fowl.

The provision of a viewing point will also be investigated to provide an enhanced view of the pond and its wild life.

Final design details will be finalized once the Maritemo Stream Improvement Scheme is completed and this will be presented to the area committee.

The Waste Enforcement Unit of the Water and Waste Services Department and the Community Section of the Environment, Culture and Community Department are jointly arranging a pre- Halloween bulky household waste collection service this year on Saturdays the 16 th and 23 rd October. The collection service is being managed through the Estate Management Forum and will involve extensive consultation with residents to ensure that the events are well publicised.

Collections are planned in the following Estate Management areas:

16 th October: Loughlinstown; Cois Cairn; Hillview; Sallynoggin.

23 rd October: Kilcross; Ballyogan; Meadowlands/Fitzgerald Park; Sandyford Park/Bearna Park; Moreen/Blackthorn.

DLE/279/10 Installation of Guttering

Question: Councillor M. Baker “To ask the Manager to install some guttering on the recent extension to (details supplied) so as to stop rainwater falling into the neighbours garden next door as this issue is causing a safety problem for the neighbour? When can this work be done?”

Reply: An inspection took place in respect of the dwellings concerned and works to rectify the problem will be carried out by the Maintenance Section with a target completion date of 22 nd September 2010.

DLE/280/10 Permission to refurbish property

Question: Councillor N. Bhreathnach “To ask the Manager to respond positively to the resident (details supplied) with disabilities who has requested permission to refurbish her Council property to a standard which will help her manage her disability?”

Reply: Prior to allocation, alterations to this dwelling were carried out for this tenant which included the provision of an adapted bathroom. A request has now been received from the tenant seeking permission to construct an extension to house a hydrotherapy bath to assist in the pain management of their condition.

To the rear of this dwelling there is a shared paved cobble-lock laneway, which services the full terrace of houses. The back door leads directly from the kitchen onto a concrete footpath area which runs at the rear of the house and onto the service laneway.

The Architects Department has reported, following investigation, that there are a number of drainage AJ's and gullies located in this concreted area and the Council’s drainage records indicate that these drains run under the footpath and cobble-locked service laneway to connect with a main sewer line located in an adjacent laneway.

If an extension was to be constructed at the rear it would project out onto this shared service laneway. The existing drains would have to be built-over or re-located and may interfere with the drainage of the other houses on the terrace and with the use of the shared area in general.

Access to the new extension would also be difficult having regard to space requirements required for use and storage of a specialist mobile hoist needed.

Having regard to the above the Council is not in favour of the construction of an extension in this area, and the tenant has been informed to this effect.

DLE/281/10 Emmet Square, Blackrock

Question: Councillor R. Boyd Barrett “To ask the Manager to carry out repairs on the broken and uneven surface paving of the outlook on Emmet Square and repair or undertake remedial works to deal with cracks in the back walls of Emmet Square facing out into the park, that have recently been reported by residents?”

Reply: (A) The Area Engineer, Road Maintenance will examine the area and arrange to have necessary repairs carried out as soon as resources permit.

(B) Remedial works to the cracks in the back walls were carried out by Housing Maintenance in April 2009. A further inspection has since been undertaken by the area Building Maintenance Inspector and it was reported that no further works are required.

DLE/282/10 Restoration of front garden

Question: Councillor R. Boyd Barrrett “To ask the Manager to restore the front garden of (details supplied) which was damaged during the construction works of the recently completed new Council houses on Pearse St?”

Reply: The Council has been in contact with the resident; there is some uneven ground where the ESB removed a pole as part of the construction works and some low spots along the new boundary wall. The contractor has been asked to level and reseed these areas. The old front railing will also be repainted.

DLE/283/10 Provision of Double Glazing

Question: Councillor S. Fitzpatrick “To ask the Manager to inform this committee whether works will be undertaken on rented accommodation at Library Road, Dún Laoghaire, for the provision of double glazing windows under the Housing Maintenance Programme 2011?”

Reply: There are two rented properties on Library Road and both dwellings are on a current list of properties to be surveyed in respect of the Council’s programme of window replacement.

DLE/284/10 Clearing of rubbish

Question: Councillor S. Fitzpatrick “To ask the Manager to clear the rubbish that has built up on the unclaimed square of land that boarders the back gardens of O’Rourke Park. To also ask the Manager to identify whether the Council own this land and if so to arrange that the shrubbery on this land be cleared. Can this land be integrated into one of the Council resident’s gardens?”

Reply: The Council is currently engaged in establishing the ownership of the land in question. Once this is done appropriate recommendations as to its future accessibility and use will be forthcoming. The possibility of its integration into contiguous properties will be considered in that context.

DLE/285/10 Community Facility - Stonebridge

Question: Councillor H. Lewis “To ask the Manager for the latest update on the timetable for commencing the construction of the community facility for Stonebridge Court and Grove?”

Reply: The Council is hoping to commence construction of this community building as soon as possible however there is no start date available yet. The detailed contract documents are currently being finalised. Once the contractor has been appointed it is expected that construction will take 9 months to complete.

DLE/286/10 Provision of wall and railing at St. Louisa's Park

Question: Councillor D. Marren “To ask the Manager, when will the wall and railing be provided on the entrance to St. Louisa's Park, Blackrock as agreed in the contract?”

Reply: The contract for St. Louisa’s Park included for the construction of wall and railing at the entrance. As work progressed on the construction of the six group houses, work also commenced on an adjoining site by the Alzheimer Society.

The Council’s building contract was completed first and to facilitate continued access to their site it was agreed, at the request of the Alzheimer Society’s Architect, to omit elements from our contract to be completed as part of the Alzheimer’s Day Care Centre contract. The wall at the entrance was included in these works. The Alzheimer Society however has since found themselves unable to complete these works and their building has now been completed and handed over without the agreed works being done.

As this was part of the original contract the Council has re-applied for funding to the Department of Environment, Heritage and Local Government to complete the works and the construction of the wall will commence when this funding is approved.

DLE/287/10 Community Resource Centre - Stonebridge

Question: Councillor D. O’Callaghan “To ask the Manager for a progress report regarding the provision of a Community Resource Centre at Stonebridge, Shankill and to indicate when work on this project will commence?”

DLE/288/10 Building of wall

Question: Councillor D. O’Callaghan “To ask the Manager to state why a small wall which the Council had agreed to build for residents of (addresses supplied) which was part of an agreement entered into between the Council and said residents following the completion of a new Council Social Housing Scheme at St Ann's Court, Shankill and that the Manager without further delay would now complete this agreement?”

Reply: The Housing Department is waiting for the transfer of the property to be finalised before proceeding with the construction of this wall, the matter will be followed up with Legal Services .

DLE/292/10 Provision of Play Area / MUGA

It was PROPOSED by Councillor R. Boyd Barrett and SECONDED by Councillor H. Lewis:

“That this Committee will provide a play area/MUGA for Fitzgerald Park/Meadowlands as part of the final phase redevelopment of the area”

The following report of the Manager was CONSIDERED:

It is intended that the last phase of the redevelopment and rejuvenation of this area will be the construction of affordable housing and alternatives are being examined with a view to bringing forward a proposal. As part of the design public open space will be provided. This space will be overlooked by dwellings fronting onto it in order to provide good passive surveillance. As previously advised however, while a public open space will be provided it is not proposed to provide a specific, sports or play area for the community at this location. The Housing Department would not have the funding available to provide or maintain such a play area/MUGA.

In the past residents of both Fitzgerald Park and Meadowlands (formerly Mountwood) enjoyed a short pedestrian link to the playing pitches and other sports facilities at the Blue Pool (Monkstown Leisure Centre). During the construction of Meadowlands it has been necessary, for health and safety reasons, to close the pedestrian link to this area on a temporary basis. Construction work however is now well advanced on the final phase of Meadowlands and is due for completion at end of 2010 or early 2011. When this occurs the pedestrian link will be reopened. At that stage the residents will have direct access to the sports facilities at Monkstown Leisure Centre. There are also services available to the community at the Mounttwood/Fitzgerald Resource Centre which opened earlier this year.

Following lengthy discussion during which Ms. A. Hegarty, Senior Executive Officer responded to the Members’ queries, it was AGREED that a play area at this location will be CONSIDERED.

DLE/293/10 Architectural Inspection

It was PROPOSED by Councillor D. O’Callaghan and SECONDED by Councillor J. Dillon Byrne:

“That the Manager arranges for an architectural inspection of the roof of a small extension at (address supplied) a rented dwelling and this area committee agrees that any necessary repairs required would be carried out urgently and that a full report be prepared.”

The following report of the Manager was CONSIDERED :

The extension in question at the above address was carried out by the tenant and there is no indication that permission was ever sought or given for such alterations to the dwelling to be carried out. Therefore any works that are required to be carried out are considered to be tenant’s responsibility.

Following discussion during which Ms. A. Hegarty responded to the Members’ queries, it was AGREED that Housing Department will monitor the situation and seek legal advice.

DLE/294/10 Affordable and Social Housing Units

“That the Manager, set out the heads of agreement in relation to the provision of Affordable and Social Housing Units on the Northern site of the former Dun Laoghaire Golf Club Lands. And can the Manager indicate is preference for: Housing on site Housing off site Money in lieu of same Mix off above.”

The following report of the Manager was CONSIDERED:

Planning permission was granted by An Bord Pleanála in relation to Phase IIA of the Northern Site of the former Dún Laoghaire Golf Club lands on the 6 th August 2010. Condition No. 36 of the grant of permission Register Reference D08A/1379 requires the Developer, prior to the commencement of development, to enter into an agreement in accordance with the provisions of Section 96 of the Planning & Development Act 2000, as amended. To date no negotiations have been held with the Developer in relation to compliance with this condition and the Developers have not indicated when they are likely to commence development on site. The duration of this permission is 7 years.

A decision to grant permission has also been made by Dún Laoghaire-Rathdown County Council on 8 th September 2010 in relation to Phase IIB of the Northern Site, although a final grant has not issued to date, Register Reference D09A/0908 refers. Condition No. 25 of the decision similarly requires the Developer, prior to commencement of development, to enter into a Part V Agreement with the Council.

In determining the terms of agreement to be entered into under Section 96(3) of the Acts, the Council will consider the applicant’s proposal having regard to the criteria set out in Section 96(3)(c) and (h) of the Acts and also market conditions prevailing at the time of consideration of the terms of such an agreement. In order for the Council to do so it would require a detailed submission from the Developer to include, inter alia, existing and development land values, construction, development and attributable costs associated with the development.

Following discussion during which Ms. M. Egan, Acting Senior Executive Officer responded to the Members’ questions and said that the situation will be monitored, the motion was AGREED.

DLE/295/10 Removal of gate at Laneway

It was PROPOSED by Councillor S. Fitzpatrick and SECONDED by Councillor D. O’Callaghan:

“That the gate to the old laneway, between the houses on Sallynoggin Road Upper and Pearse Gardens, is removed and a high wall is built in its place to prevent waste from being thrown into this lane”.

The Area Building Maintenance Inspector has carried out an inspection of the area in question and Housing Maintenance has decided that the gate will be removed and a new wall constructed in its place.

DLE/296/10 Warped Front Doors in Council Dwellings

It was PROPOSED by Councillor H. Lewis and SECONDED by Councillor N. Bhreathnach:

“That this Council address the complaints of residents in Emmet Square and St Anne’s Square, Blackrock and other similar Council dwellings, in relation to warped front doors and door frames leading to constant drafts, and carry out the necessary repairs or door replacements”

The following report of the Manager was CONSIDERED :

In 2008 the Housing Department carried out a scheme of external painting and repairs (Planned Maintenance) in all 36 units in Emmet Square. Replacement of front doors, where required, was included in this programme of works. It was found at that time that only one house required to have a door replaced and this was done in December 2008. The Housing Maintenance section has looked at all the inspections that were carried out in Emmet Square since that time and has found that four maintenance requests were logged regarding problems with front doors, of which it was found that only one unit required replacement and this was replaced and fitted on 13 th May 2010. In respect of St. Annes Square, minor repairs were made to the door of one dwelling.

Following discussion during which Ms. A. Hegarty responded to the Members’ questions the motion was AGREED .

DLE/297/10 Provision of Extensions/Alterations to Council Dwellings

It was PROPOSED by Councillor D. O’Callaghan and SECONDED by Councillor S. Fitzpatrick:

“That the Manager report regarding the provision of extensions/alterations to Council rented dwellings in the Dún Laoghaire Area to alleviate overcrowding with reference to the following (a) if the Council are processing new applications. (b) the number of current applications on hand (c) the number of extensions/alterations undertaken in the last two years. And that this Area Committee agrees that the Manager should continue to process any new applications submitted to alleviate overcrowding.”

The following report of the Manager was CONSIDERED:

Good progress has been made in relation to the carrying out of adaptations to meet the needs of disabled tenants, with approximately 45 bathroom alterations being carried out in 2009 and approx 60 in 2010, along with the installation of stair lifts, ramps, banisters and grab rails and the Council hopes to continue this work in 2011.

However there are still a large number of applications on hand for extensions to alleviate overcrowding or to meet the needs of a disabled person. Due to the level of work involved in carrying out these extensions and to the funding required the Council can only carry out a limited number each year and is currently prioritizing applicants who have a disabled need.

In 2009 the Council completed 1 extension to alleviate overcrowding and 2 extensions for a person with a disability. In 2010 the Council will have completed 1 extension to alleviate overcrowding and 5 extensions to accommodate a person with a disability, the overcrowding extension and 4 of the disability extensions are in the Dun Laoghaire area. Work has commenced on initial designs for 6 extensions for disability and these will be completed in 2011, 4 of these extensions are in the Dun Laoghaire area.

There are currently 15 other applications on hand for extensions to meet the needs of a disabled tenant or their family. The Council will continue to progress these applications however it is likely to be a few years before they will all be dealt with.

Three long term voids will also be completed this year, all of which are in the Dun Laoghaire area.

There are currently 49 applications on hand for extensions to alleviate overcrowding. While applications can still be submitted it will be a considerable time before they will be looked at, if it is appropriate the tenants would be advised to apply for a transfer to alternative accommodation.

Following discussion Ms. A. Hegarty responded to the Members’ queries and said that huge improvements have been made and money is available for grants, the motion was AGREED:

DLE/298/10 Installation of Sound-proofing in Brookfield, Blackrock

It was PROPOSED by Councillor R. Boyd Barrett and SECONDED by Councillor H. Lewis:

“That this Council install proper sound-proofing between upstairs and downstairs maisonettes in Brookfield, Blackrock and other similar maisonettes in Dun Laoghaire, where requested by tenants, and specifically install such sound-proofing in (address supplied) as recently requested by the tenants.”

The following report of the Manager was CONSIDERED:

Major refurbishment works were carried out to dwellings in Brookfield Place in approx 1998. Soundproofing was included as part of these refurbishment works and it was carried out in accordance with standards prevailing at that time and in accordance with the drawings submitted by the Housing Department. There is no provision in the 2010 Housing Budget for the installation of extra soundproofing to Brookfield Place.

Could the Manager give consideration to installing a railing around this park so that local families could safely use the space with small children?”

Reply: 1. Arrangements will be made to have the tree in question pruned. 2. Consideration will be given to installing a railing when the 2011 works programme is being drafted.

DLE/301/10 Condition of Booterstown Bird Marsh

Question: Councillor N. Bhreathnach “To ask the Manger to bring forward an up to date report on the condition of Booterstown Bird Marsh answering the following questions; whether the condition of the water is causing concern, whether the bird numbers are being maintained, whether plans to extend viewing points for bird watchers are still on the agenda and whether the Marsh, in the Manager's opinion, can become more accessible, more interesting and more ecofriendly in the future?”

Reply: The Water and Waste Services Dept. sample the Trimlestown Stream, which flows into the marsh, on a quarterly basis. E. Coli was found to be outside the parameters set for bathing water quality. However, all other parameters were found to be within the limits set in the Surface Water Regulations 2009.

The birds using the Marsh are faring very well. A member of BirdWatch Ireland Branch who participates in regular I-webs surveys of the marsh and beach area has confirmed that the Marsh has dramatically improved in bird numbers since they started doing the counts (in 1998) when any of the birds that were using it were roosting rather then feeding and the numbers were very low. The marsh supports good numbers (100s approaching 1000 in some cases) of Dunlin, Knot, Teal and Redshank, which are roosting and feeding in there in the last couple of years. There are also constantly good numbers of Black-tailed Godwit feeding in the Marsh (and in Williamstown Creek) in the last few years, birds which were never seen there when the I-webs counts began in 1998. Early this year there were dozens of snipe roosting in the marsh, whereas in previous counts they often hadn’t been any at all. Two weeks ago 16+ Little Egret, as well as Grey Heron were recorded there. These results would indicate that the water quality in the marsh is at least adequate to support a food web of plants, invertebrates and fish that in turn provides good feeding for birds.

There Council has no current plans to extend the viewing points for bird watchers and make the marsh more accessible. The viewing platform, which is accessed from the Rock Road, is an excellent vantage point for viewing the marsh and there are no other suitable locations for creating additional viewing points. Due to regular tidal inundations and the muddy substratum it supports, the marsh is not safe to walk around or access. Any efforts to make the site more accessible would involve significant construction work that would comprise the nature conservation objectives of the site. The marsh is a designated as a Special Protection Area for birds and is protected under the E.U. Habitats Directive. The work required to improve access would result in loss of important habitat, deterioration in habitat and water quality, and significant disturbance to birds. It should also be noted that An Taisce has a long-term lease on the marsh and is directly responsible for its management. A meeting will be arranged with them to ascertain if they have any proposed plans for the marsh.

DLE/302/10 Clean-Up of Sandycove Point

Question: Councillor R. Boyd Barrett “To ask the Manager to remove weeds and do a general clean-up of Sandycove Point?”

Reply: The area has been added to the works list for the attention of the Cleansing Section and the road will be cleaned in the near future.

DLE/303/10 Establishment of Community Garden in Emmet Square, Blackrock

Question: Councillor R. Boyd Barrett “To ask the Manager to meet with representatives of the residents of Emmet Square, Blackrock to discuss the possibility of establishing a community garden on the former allotments site in Blackrock Park?”

Reply: A policy on Community Garden is being drafted and will be discussed at the December Environment Culture and Community, Strategic Policy Committee. It would be premature to meet with the residents until the policy in place.

DLE/304/10 Provision of details of Sea-water sampling

Question: Councillor V. Boyhan “To ask the Manager to provide details of sampling sea -waters carried out at the following locations in the last 12 months: - Blackrock - Seapoint - Sandycove - Forty Foot - Bulloch Harbour - Killiney Beach - Corbawn Beach and to indicate if there is any reason for concern?”

Reply: The following beaches areas are tested on a regular basis: • Blackrock Bath shore • Seapoint Martello Tower • Sandycove • Coliemore Harbour • Killiney Bay Beach • Corbawn Strand, Corbawn Lane

The results for these locations are in compliance with the Irish National Limits for the period 1 st September 2009 to 1 st September 2010.

DLE/305/10 Inspection of Birch Tree

Reply: This tree will be removed as part of the 2010-2011 Tree Care Programme. If the site is considered suitable, a new tree will be planted at this location.

DLE/307/10 Sweeping of St. Patrick's Terrace

Question: Councillor C. Devlin “To ask the Manager to state why (despite the Road Sweeping Schedule) is St Patrick's Terrace only swept periodically instead of the stated monthly sweep? An individual resident feels that it is only swept when a complaint is made?”

Reply: St. Patrick’s Terrace is scheduled to be swept once a month. The area is swept as per schedule; however there are times due to leave entitlements that the area is missed. When this happens the estate is swept later in the month when the resources are available.

In relation to the lane, due to limited resources, there is no schedule for cleaning laneways, so these laneways are cleaned on an intermittent basis, when required. This lane will be monitored in the future and the mini sweeper will sweep the lane when required.

Reply: The Flags form part of the Metals which is a candidate Architectural Conservation Area. Therefore the conservation of the flags will be assessed when this ACA is carried out.

DLE/311/10 Provision of Mini-Bus

Question: Councillor H. Lewis “To ask the Manager to provide free of charge or at a reduced rate, a minibus to carry a fully supervised voluntary youth group of ten people approximately, from Shanganagh Park House to the Kiltiernan Ski Club, commencing from Friday 1 st October for a period of four weeks?”

Reply: The Sports & Recreation section within dlr Leisure Services have been in consultation with the group from Shanganagh Park on the Sports Development Office Skiing programme. The logistics are being finalized and transport is being provided for the group to travel to Kiltiernan.

DLE/312/10 Overgrown Garden

Question: Councillor D. Marren “To ask the Manager to take action to ensure that the overgrown and vermin infested garden to the rear of a dwelling in private estate (address supplied) ceases to be a health Hazard?”

Reply: This matter has been referred to the Environmental Health Officer who will investigate and determine if there is a health issue at the location referred to. If there is no health issue the Council have no powers in relation to the overgrown garden.

DLE/319/10 Extension of Railing/Handgrip

Motion: Councillor C. Smyth “That the Manager extend the railing/hand grip at the access to the beach/coast from Quinn’s Road, Shankill”

Report: The following 4 items of work were required to improve the access to the Beach at Quinns Road:

• Strengthen the ramp as it was undermined by the elements. This was deemed priority as if the ramp failed it could lead to serious injury and no access to the Beach for a considerable period of time.

• Remove the water flowing down the ramp as this lead to a slippy surface on the ramp.

• Extend the ramp to the Beach, as the jumping or climbing of the platform to gain access to the Beach involved a drop of over 0.5 metres in places.

• Provide a handrail at the existing steps at the top of the access

The first three of these works were undertaken in April and May this year, using up the available budget for work at this location. Estimates of the fourth item have been prepared and the cost is not substantial. If the money is available towards the end of the year, this work will be undertaken; if the money is not available this work will be added to the proposed works for 2011.

DLE/320/10 Consideration of Monorail from Dalkey to Dalkey Island

It was PROPOSED by Councillor J. Dillon Byrne and SECONDED by Councillor S. Fitzpatrick :

“That this Council consider a monorail transporter from Dalkey (Coliemore Harbour) to Dalkey Island, and that special consideration be undertaken re. The Shweeb (abbreviation of Schwebebahn [hanging railway]) invented by Australian Geoff Barnett. - each person pedals a capsule on a rail so the project used no energy to travel.”

The following report of the Manager was CONSIDERED:

Dalkey Island is one of the most picturesque parks in the county and one of the most important in terms of its heritage. The Council is currently addressing the issue of managing the numbers of people visiting Dalkey Island through first the modification the slip way and subsequently providing structured guided visits to the island.

Dalkey Island was recently designated a Special Protection Area (SPA), by the National Parks and Wildlife Service. This is a high-level conservation designation that is primarily aimed at the conservation of birds that inhabit the island, in particular the tern population.

Certain activities are restricted within SPAs and can only be carried out with the consent of the Minister for the Environment, Heritage and Local Government, and these 'Notifiable Actions' vary depending on the type of habitat that is present on the site. In addition an 'Appropriate Assessment' is required for any activity that may significantly affect the SPA.

Given these circumstances it is not considered appropriate to build a monorail at this site.

Following discussion during which Mr. T. Carey, Heritage Officer responded to the Members’ queries and said THAT Dalkey Island is a Special Protection Area, the report was NOTED.

DLE/321/10 Raising of Fence adjoining St. Theresa's, Blackrock

It was PROPOSED by Councillor D. Marren and SECONDED by Councillor J. Bailey:

“That the Manager arranges to raise the fence from the public parks adjoining St Theresa’s (Daughters of Charity), Blackrock in order to reduce incidents of trespassing onto private property.”

The following report of the Manager was CONSIDERED :

The boundary wall in question is in private ownership and as such the Council cannot interfere with it. Discussions have been held with the Daughters Of Charity in the past, when we have considered options to facilitate them in raising the height of their boundary wall. However these efforts were unsuccessful. There is no finance available for the Council to contribute to this work which as previously stated involves a private wall.

Following discussion during which Mr. L. Moore, Senior Parks Superintendent responded to the Members’ queries, the motion was AGREED.

DLE/322/10 Dressing of the Open Grave

It was PROPOSED by Councillor N. Bhreathnach and SECONDED by Councillor J. Bailey:

“That the Manger discuss allowing the families of the deceased being buried in our cemeteries, the option of a dignified "dressing of the open grave", as provided by a company already retained by families to maintain graves(Grave Angels), in Deansgrange and Shankill.”

The following report of the Manager was CONSIDEREDl :

The Cemeteries section have previously considered allowing this service to operate within both Deansgrange and Shanganagh Cemeteries, but have concluded that it is not an option for this Council.

The management of the grave site including preparation for burial, funeral direction and health and safety issues is the responsibility of the Council and it would not be prudent to allow a third party to be involved as this would have implications on the high standard of service that is provided by Council staff. Allowing a third party to be involved would also leave the Council open to further risk and liability should any part of the service not be delivered.

Therefore the Council must refuse to allow this service to operate within its cemeteries.

Following discussion, Mr. L. Moore said this motion had been misunderstood and he will come back with further report.

DLE/323/10 Public Toilets at Peoples Park, Dún Laoghaire

It was PROPOSED by Councillor C. Devlin:

“That the Manager respond to the recent report from a local resident about the public toilets in the Peoples Park, Dún Laoghaire. (details supplied) can the Manager please state what measures will be put in place to ensure that this situation is rectified”

The following report of the Manager was CONSIDERED:

The contract for the cleaning of the public conveniences in Dun Laoghaire has just ended and a new contract has commenced at the start of September 2010. The contractor undertaking the work has changed as part of the new contract and the service provided by the new contractor has so far been satisfactory.

The cleaning will be supervised on a regular basis and any deterioration of the service will be dealt with accordingly.

This motion was AGREED WITHOUT DISCUSSION.

DLE/324/10 Lack of Toilet Facilities at 40 foot, Sandycove

It was PROPOSED by Councillor J. Lewis and SECONDED by Councillor D. Devlin:

“That this Council address the lack of toilet facilities at the 40 ft in Sandycove, following complaints from users, who say the Council’s decision to close the toilet previously located there, is now forcing swimmers to engage in unsanitary toilet practices.”

The following report of the Manager was CONSIDERED:

The existing urinal at the 40ft foot was closed on the recommendation of the Environmental Health Office. Dun Laoghaire Rathdown County Council provides a public toilet facility adjacent to Sandycove baths, a short walk form the 40ft swimming area. There is no proposal for Dun Laoghaire Rathdown County Council to provide a second public toilet facility within this catchment.

Anybody engaging in unsanitary toilet practices would be in breach of public order laws and should be reported to the Garda Siochana.

Following discussion during which Mr. J. Guckian responded to the Members’ queries and said that no funding is available the motion was AGREED .

DLE/325/10 Slip at Sandycove Old Baths

It was PROPOSED by Councillor J. Dillon Byrne and SECONDED by Councillor C. Devlin:

"That this Committee either: a) Repair the old broken slip at the "Ladies Bathing Place" at Sandycove old Baths, to enable disabled persons to use the canoeing opportunities available there, as some are training for Special Olympics, or b) Replace the old slip with a new/or renewed one"

The following report of the Manager was CONSIDERED:

A survey has been carried out at Sandycove Baths with the view to providing disabled persons access to the beach area.

The gradient of the existing slipway is too steep to provide adequate access under the appropriate regulations. To repair this slipway for use by disabled persons will be providing an access for a particular purpose, which would be in direct contravention of the regulations provided for this purpose.

The option of providing a new ramp was also examined. Due to the height difference from the platform to the beach area, a ramp of approximately 35 metres in length would be required to provide adequate access. Considering access difficulty and site conditions this option would have a considerable cost and there is inadequate funding available to undertake this work.

At this point until a refurbishment of the entire Sandycove Baths is to be undertaken, the provision of a large structure to facilitate the ramp, at a substantial cost may be premature and an alternative location with adequate access should be considered.

Following discussion during which Mr. Dara McGowan, Senior Executive Engineer responded to the Members’ questions and suggested that a meeting be arranged with a third party to discuss other options, the motion was AGREED.
