Infrastructure Delivery Plan

for 1. Introduction

1.1. An Infrastructure Delivery Plan (IDP) is a key supporting document in Amber Valley’s Local Plan (part 1). It forms part of the evidence base and informed the preparation of the plan itself. It sets out the transport, physical, social and green infrastructure required to support the Borough’s future growth up to 2028.

1.2. There will be significant levels of growth in terms of housing and other development and it is essential for the Council and its partners to deliver the services necessary to achieve timely, sustainable and effective infrastructure to meet the needs of all residents in the future.

1.3. The information in this document has been produced in collaboration with various infrastructure providers operating in the Borough and is discussed in more detail in the next chapter.

1.4. Local Plans should be supported by an adequate, up-to-date and relevant evidence base about the economic, social and environmental characteristics and prospects of Amber Valley. The National Planning Policy Framework (NPPF), paragraph 162, states in relation to infrastructure that:

“Local planning authorities should work with other authorities and providers to:

• Assess the quality and capacity of infrastructure for transport, water supply, wastewater and its treatment, energy (including heat), telecommunications, utilities, waste, health, social care, education, flood risk and coastal change management, and its ability to meet forecast demands; and • Take account of the need for strategic infrastructure including nationally significant infrastructure within their areas.”

1.5. The 2008 Planning Act 1 defines infrastructure as including roads and other transport facilities; flood defences; schools and other educational facilities; medical facilities; sporting and recreational facilities; open spaces; and affordable housing. This list is not exhaustive; and other types on infrastructure will be considered as part of this document.

1.6. Successful implementation of the Amber Valley’s Local Plan depends therefore not only on the actions of Amber Valley Borough Council but also upon co-ordinated and sustained action from a wide range of other organisations. This requires shared objectives, and involves ensuring related strategies are consistent with the plan and that there is co-ordinated action to effectively deliver essential physical, social, environmental and economic infrastructure on time.

1.8. Numerous documents have established a baseline for current infrastructure capacity and helped to identify initial infrastructure needs associated with further growth. It has also improved the understanding by a wide range of organisations of the infrastructure issues and encouraged partnership working, with the focus on delivery. The range of facilities required to support development in the Local Plan (part 1) has been identified and used to develop an infrastructure schedule.

1.9. This Plan is a ‘living’ interim document, and as such there is ongoing monitoring of infrastructure requirements and dialogue with developers and infrastructure providers. Where necessary the Infrastructure Delivery Plan will be updated and new priority schemes included. There is some outstanding information required to identify the infrastructure requirements of some of the proposed strategic sites, how this infrastructure is to be provided and when it will be provided. However, it should be noted that three of the strategic sites proposed for allocation at Outseats Farm, Alfreton; Radbourne Lane, Mackworth and Coppice Farm, Ripley now have planning permission. The infrastructure requirements for these sites have therefore already been established and will be secured via Section 106 agreements.

2. Scope of the Infrastructure Delivery Plan

2.1. The aim of the IDP is to establish what infrastructure needs to be delivered, when and by which provider to support future development. In addition, it also considers what the priorities for delivery are. Where appropriate, the source of funding and the possible cost of infrastructure is provided. The costs are based on the best available information at the time of publication and may be subject to change.

2.2. The IDP has been integrated and co-ordinated with a range of national, regional and local plans and programmes that impact on spatial planning. The IDP is an evolving document that will be updated regularly.

2.3. The IDP will be the focus for meeting the infrastructure priorities of Amber Valley. It should not bee seen as a ‘shopping list’ of priorities but as a tool to ensure that the Local Plan and the strategic sites are deliverable and every effort is being made to make the Local Plan viable. Therefore a scheme to classify the priorities has been implemented. The following classification states the importance of each scheme to the delivery of the plan:

• High (Fundamental to development, without which the strategy would not be deliverable) • Medium (Identified as a priority, which would make the strategy sustainable) • Low (Full range of infrastructure required to create a sustainable place, that would assist in ensuring sustainability of the strategy)

2.4. Councillors will also play a role in determining prioritisation of the infrastructure required.

3. Methodology

3.1. In addition, a Derby Housing Market Area Infrastructure Group was established to ensure consistency between each IDP and the County Councils adopted infrastructure Plan. An officer from Erewash Borough Council also attends meetings of this group.

3.2. The process began as a desk-based study to determine existing provision, plans and strategies for each infrastructure provider.

3.3. Alongside this, a review of existing planned capital and infrastructure investment, as detailed in various plans and strategies for each infrastructure category, was undertaken to identify existing plans for infrastructure investment and improvement within the Borough.

3.4. This research and review process will continue following the publication of the Local Plan (part 1). It is intended that information will be collected from service providers continuously, particularly in respect of specific sites and areas where development may be allocated.

3.5. In preparing the Local Plan (part 1), the Council has engaged in discussions with infrastructure providers. Whilst in some instances it has been difficult to gain a response from some providers, all reasonable attempts have been made to contact them.

4. Delivery Mechanism

4.1. For successful implementation of the IDP there are a number of challenges that need to be overcome:

• There is a requirement for a strong commitment to delivery across a wide range of organisations • A requirement for partner organisations and stakeholders to have greater integration and co-ordination of the investment decisions • The need for improved management of existing physical infrastructure assets and the way new assets are delivered • Investment in additional infrastructure to meet not only the challenges of growth but also that of deficiencies in existing infrastructure.

4.2. With public sector financial cuts and changing funding schemes it is less certain what resources will be available to spend on infrastructure. With this in mind there are still some possible streams:

• New Homes Bonus • Business rates and Tax Increment Financing (TIF) • Regional Growth Fund • Growing Places • Service-specific grants

4.3. A reduction in the Council’s Budget will have a significant impact on local service delivery. This IDP therefore provides an important means of co- ordinating resources between partners, the council and developers to ensure timely and efficient delivery of infrastructure to support development.

4.4. The majority of funding for infrastructure is anticipated to come from Developer Contributions. Policies in the Local Plan explain the role of Developer Contributions. The IDP will inform what contributions towards infrastructure may be sought from development. At present, these are secured through Section 106 agreements, in line with the CIL regulations 2010, which states that planning obligations should be:

• Necessary to make the development acceptable in planning terms • Directly related to the development • Fairly and reasonably related in scale and kind to the development.

4.5. Although currently such developer contributions are being raised through Section 106 agreements, all three of the Derby HMA local authorities are working towards introducing a Infrastructure Levy (CIL) Charging Schedule.

4.6. A Community Infrastructure Levy could bring several advantages in delivering infrastructure to support development:

• The CIL will be a better mechanism to facilitate the collection of funds towards strategic infrastructure, which is often critical to development of the area, which may be difficult to attribute to a single site • Income from CIL is unringfenced and will allow the Council and its partners greater flexibility to prioritise and phase infrastructure delivery • The fixed nature of CIL charges brings more certainty to developers, the Council in terms of how much developers will pay, allowing the Council and Partners to plan their income an potential expenditure • This could help development to be viable, as it could increase confidence from all partners in ensuring the development is brought forward and should save time and money spent on administration • If the charge is applicable to a certain type of development, e.g. housing, all developers will contribute and the burden of infrastructure is not passed onto another development or developer • As part of the Neighbourhood Fund, if development takes place in an area which has an adopted Neighbourhood Plan in place, 25% of the funds received from chargeable development in that area will go to that area to spend on Infrastructure. If no Neighbourhood Plan exists, 15% of the funds will go back to fund infrastructure in communities in those areas where development has taken place.

4.7. The introduction of a CIL has to ensure that an appropriate balance has been struck between infrastructure needs and development viability. Therefore further work is being carried out by consultants to establish what is economically viable to bring forward development and provide the necessary infrastructure that is required.

4.8. The implementation of the CIL Charging Schedule will require strong governance to prioritise projects, commissioning and management of delivery and to monitor the process.

4.9. New development will be expected to contribute to the provision of associated infrastructure, whether through Section 106 contributions, CIL or through on-site design. But it is also crucial that current infrastructure deficiencies are also met. Therefore it is important that partners and stakeholders commit resources to implement these programmes and co- ordinate delivery with development.

5. Monitoring and Review Process

5.1. The IDP is a living document and will be required to respond to a number of changing factors. Therefore it should be updated on a regular basis to ensure that new information about plans and programmes is fed into the IDP, to ensure that development continues to remain viable and that infrastructure issues are continuously updated.

5.2. The baseline position in this IDP will allow the Borough Council and its partners to prioritise investment and address funding gaps as the Local Plan is developed.

5.3. Later iterations of this document will set out in more detail the mechanisms needed to monitor the impact of the IDP. These mechanisms are being established to ensure:

• Risks are managed • Reports on the delivery of the Infrastructure Schedule are produced at regular intervals • Annual updating of the Infrastructure Schedule • Inclusion of performance results in the Authority Monitoring Report

5.4. A review should not just be about updating this document, but the importance of Duty-to-Cooperate and partnership working. The exercise of updating should be an exercise to inform the continued advancement of the plan and continuous dialogue of what infrastructure requirements are needed within Amber Valley.

5.5. A review should be conducted on a yearly basis, but updates should be conducted when required.

6. A Spatial Portrait of Amber Valley

6.1 Amber Valley covers an area of over 265 square kilometres and is made up of the four market towns of Alfreton, Belper, Heanor and Ripley, as well as many villages and other smaller settlements. The majority of the Borough’s 122,300 residents live in the four market towns, all of which have experienced economic and social difficulties as a result of the decline of their traditional industries. However, Belper has benefited from its location within the Derwent Valley Mills World Heritage Site and has seen considerable investment through new housing and environmental improvements, as well as becoming increasingly attractive.

6.2 Amber Valley benefits from having good transport connections to other parts of the country. The A38 links the Borough to Derby to the south and to the M1 (junction 28) to the north, whilst the A610 links to Nottingham and the M1 (junction 26) to the south east. The Borough is also well served by the national rail network, with local services to Derby and Nottingham as well as limited direct services to London and other parts of the country.

6.3 The Borough's accessibility makes it an attractive location for commuters, as well as opening up opportunities for shopping and leisure activities in other towns and cities. The decline in the Borough's traditional industrial base has also led to former employment sites being redeveloped for housing, increasing patterns of out-commuting.

6.4 Whilst unemployment levels remain lower than national and regional averages, this masks pockets of higher unemployment, particularly in the eastern wards within Alfreton, Heanor and adjoining settlements.

6.5 The Borough's attractive and diverse landscape, architecture and important heritage features enable many of those living and working in Amber Valley to benefit from a high quality environment. However, other parts of the Borough have suffered from the impact of past land uses and activities on the environment and a balance must be struck between encouraging new development and protecting the environment.

7. Development Strategy for Amber Valley

7.1. The agreed position is for a minimum of 35,354 dwellings to be provided within the Derby Housing Market Area between 2008 and 2028, of which a minimum of 9,400 dwellings will be provided within Amber Valley.

7.2. In planning for 9,400 dwellings in Amber Valley between 2008 and 2028, the Borough Council has taken into account the following:-

• Completed dwellings since 2008, • Existing planning permissions (commitments) for housing as at 1/4/13 • Sites already allocated for housing in the existing Local Plan that have not yet come forward for development, but the Council consider should remain as allocated sites • Making an allowance for housing on land which cannot be readily identified in advance (known as ‘windfall’)

7.3. As at 31 st March 2013, the number of dwellings completed since 2008, the number of commitments (including the proposed strategic sites at Outseats Farm, Alfreton and Radbourne Lane, Mackworth which have planning permission), the number expected to be built on existing allocated sites (including 300 dwellings already allocated on land north of Denby) and the number of dwellings expected to come forward on windfall sites was estimated to total 5,164. This means that the Borough Council needs to identify additional sites to provide 4,236 dwellings, in order to meet the requirement for 9,400 dwellings from 2008 to 2028.

7.4. It is proposed that an additional 3,520 dwellings are provided on five other strategic sites to be allocated in the Core Strategy (part 1 of the Local Plan). These will include Coppice Farm, Ripley (which was granted outline planning permission for up to 360 dwellings on 3 rd June 2013) and 1,500 additional dwellings on land north of Denby, making a total of 1,800 on this site. It is proposed that the remaining requirement for 716 dwellings are provided through allocations in the Site Allocations and Development Management Policies DPD (part 2 of the Local Plan).

7.5. The strategic sites proposed for allocation in the Core Strategy (part 1 of the Local Plan) are :

• Outseats Farm, Alfreton (500) • Newland/Taylor Lane, Heanor (500) • Nottingham Road, Ripley (560) • Alfreton Road, (600) • Coppice Farm, Ripley (360) • Land north of Denby (1,800) • Radbourne Lane, Mackworth (530)

Background into Water and Flooding Infrastructure in Amber Valley

The major reservoirs in the Derwent, Dove Valley and several river abstractions provide the majority of water to the Derby HMA. The Environment Agency’s Catchment Abstraction Management Strategies (CAMS) shows that the resource situation is significantly constrained. The Derby Housing Market Area Water Cycle Study (2010) shows that the vast majority of resource management units in the study area have no water available, are over licensed or over abstracted.

The Outline Water Cycle Study found that rivers within Amber Valley and the wider HMA are at risk from not meeting at least one of the water quality standards set by the Water Framework Directive. The River Derwent has high levels of phosphates, which fails one of the Water Framework Directive standards. Specific Provision initiatives In terms of wastewater treatment, some works (Fritchley, Duffield and Kilburn) are at or may exceed capacity, therefore Severn Trent Water aim to use a combination of demand management and increased extraction.

Discussions have taken place between Derby HMA and water providers to explore the use of SUDs to reduce the amount of surface water run-off.

Background into Waste Infrastructure in Amber Valley

Clinical waste is also collected by the authority and transferred to an incinerator or a suitable landfill site. No incinerators for clinical waste are located in Derbyshire. Specific Provision initiatives The Waste Strategy produced by Derbyshire County Council for a number of districts was adopted in 2006 and is reviewed every five years, the first review will be completed by 2013.

The County Council is currently considering new policies/initiatives to deal with waste at the top end of the waste hierarchy, via the promotion of waste minimisation and prevention. This work is being developed through the joint Derby City and Derbyshire County Waste Plan. Underlying demand trend In 2005, a bi-weekly collection scheme was implemented by the Borough Council, which had the effect that recycling rates increased to 26.9% from 8.11% in 2002/03. A new service was introduced in 2012 which now includes recycling plastic containers, which is very likely to improve recycling rates further.

Household waste collected by Amber Valley Borough Council is taken to Clover Nook transfer Station for disposal.

The one household waste and recycling centre accessible to residents in Amber Valley at Loscoe is considered to be at over-capacity.

With the level of new housing proposed in Amber Valley, there is a need to re-assess the waste capacity of the Borough and attempt to increase the waste infrastructure capacity.

Background into Transport Infrastructure in Amber Valley

The Derby HMA suffers from one of the highest levels of congestion in the region. Particular issues occur at the A38 Derby junctions and the A38 between Derby and Alfreton.

Midland Mainline runs through the Borough, connecting much of the East Midlands, South Yorkshire to London and beyond. It has been stated that this line will need more capacity in the future. Northern Rail provides most of the services to Langley Mill station with their Leeds to Nottingham service, which is around half of the Alfreton services. HS2 will not go through the Borough, but will run adjacent to it, with the closet stations planned at Toton Sidings and Sheffield.

Within Amber Valley there are 6 railway stations at Alfreton, Ambergate, Belper, Duffield, Whatstandwell and Langley Mill. Alfreton and Belper are the most used stations.

The Borough is well served by East Midlands Airport, which is just outside the HMA.

Derbyshire County Council runs community transport schemes (Dial-a-bus/ride) through the Borough for people who cannot use conventional transport.

In terms of public transport, 39 routes run through the Borough, connecting the four main market towns to Derby, Chesterfield and Nottingham.

Specific Provision initiatives A number of schemes are being proposed by the Department for Transport and Derbyshire County Council that could impact and support the Local Plan in delivering the needed infrastructure, with traffic congestion being high within the Derby HMA and Amber Valley

Derbyshire County Council implemented their Local Transport Plan in 2011.

A Rights of Way Improvement Plan has been produced by Derbyshire County Council for 2007-2012.

The East Midlands Airport Master Plan 2006-2030 sets out vision to meet demand for travelling and the UK economy.

Underlying demand trend There is a general underlying trend of increased congestion around the major junctions along the A38, around Derby and at connections to the M1.

With congestion already a feature of many of the roads around the County, the large strategic sites being proposed through the Core Strategy (part 1 of the Local Plan) will increase demand on the roads in and around the four market towns and at Denby. There are 5 designated SSSI’s in Amber Valley- Kedleston Park, Mercaston Marsh and Mugginton Bottom, Shining Cliff Woods, Ambergate and Ridgeway Quarries and Cromford Canal. There are also 7 Local Nature Reserves at Carr Wood, Ripley; Red River, Loscoe; Belper Park, Duffield Millennium Meadows, Cromford Canal and at Oakerthorpe.

There are 45 privately owned cemeteries and 6 public cemeteries, which apart from providing a community service can also be a valued in terms of wildlife conservation and biodiversity

There are 24 allotments. Only 2 are owned by Amber Valley with the others being owned by Town and Parish Councils.

There is 244 hectares of publicly accessible green space that equates to 2.06ha per 100 of the population.

There are a total of 111 of play areas in Amber Valley, but a deficit in facilities still exists.

One of the most important conservation and tourist attractions in the Borough is the Derwent Valley Mills World Heritage Site. This plays a strong conservation, cultural and economic role in the area.

There are over a 1,100 listed buildings in Amber Valley with 28 of these being at risk.

In terms of Waterways, the former Cromford Canal, stretching from the Erewash Canal at Langley Mill, going north and west through Ironville, the former Butterley works at Ripley, Ambergate and Whatstandwell leading towards Cromford is of considerable historic and biodiversity interest. The underground wharf and canal tunnel at the former Butterley Works is now a scheduled monument.

Specific Provision initiatives An open space strategy has been adopted by the Council to encourage open space provision.

The Lowland Derbyshire Biodiversity Action Plan (2011-2020) holds all data on biodiversity and relates to combating the ecological issues in the area. This will be accompanied by a Species Action Plan to provide more guidance on local trends and distributions and actions to aid conservation.

Derbyshire Wildlife Trust Living Landscape approach in the Derwent Valley, Northern Peak Fringe and Linacre, works with organisations where the Trust have identified areas of key habitat and species action as part of their strategic development plan.

The Derwent Valley Mills Heritage Site Management Plan plays a key role in conserving “the unique and important cultural landscape of the Derwent Valley Mills World Heritage Site; to protect its outstanding universal value, to interpret and promote its assets; and to enhance its character, appearance and economic well-being in a sustainable manner.”

The Friends of Cromford Canal Partnership has plans for restoring each section of the Cromford Canal as a navigable waterway in order to maximise the sustainable economic job creation, environmental, tourism, quality of life, nature, conservation, leisure and educational benefits to the Borough and the county. Underlying demand trend Open space is not evenly distributed and therefore some areas have very little open space provision.

There is a current demand for allotments in Somercotes, Duffield and Crich.

The Borough Council’s Play Strategy has highlighted that there are key deficits in facilities based on a minimum travel distance of 600m. This is throughout the Borough with some places having no local provision.
