When speaking about legitimizing law we can mainly mean analysis which concerns metaphysical justification for what is called the phenomenon of law. From the metaphysical point of view, the justification of law means indicating the foundation of its existence. It is about seeking (indicating) an esse (essence) basis of law, in line with the task set by the metaphysical analysis, namely seeking an answer to the question: Why does object X exist? And in the answer, there will appear a formula indicating the final reasons for its existenceratio ( essendi). The same ideas that we can find in Adolf Reinach’s principal work,The Apriori Foundations of the Civil Law, provide a possibility of better understanding this important issue of legal philosophy, namely the question of legitimizing law (justifying law). The aim of this article is to present that argument. Keywords: legal phenomenology, legitimizing law, positive law, speech acts theory, soziale Akte. INTRODUCTION The same ideas that we can find in Adolf Reinach’s principal work, The Apriori Foundations of the Civil Law, provide a possibility of better understanding an important issue of legal philosophy, namely the question of legitimizing law (justifying law). If we enrich and complete these ideas with similar remarks from Roman Ingarden’s ontology, we can, in my opinion, give quite a coherent and convincing argument on this issue.     Democracy & Nature, Vol. 6, No. 3, 2000 Aleksandr Bogdanov and Systems Theory ARRAN GARE ABSTRACT The signi cance and potential of systems theory and complexity theory are best appreciated through an understanding of their origins. Arguably, their originator was the Russian philosopher and revolutionary, Aleksandr Bogdanov. Bogdanov anticipated later developments of systems theory and complexity theory in his efforts to lay the foundations for a new, post-capitalist culture and science. This science would overcome the division between the natural and the human sciences and enable workers to organise themselves and their productive activity. It would be central to the culture of a society in which class and gender divisions have been transcended. At the same time it would free people from the deformed thinking of class societies, enabling them to appreciate both the limitations and the signi cance of their environments and other forms of life. In this paper it is argued that whatever Bogdanov’s limitations, such a science is still required if we are to create a society free of class divisions, and that it is in this light that developments in systems theory and complexity theory should be judged. Aleksandr Bogdanov, the Russian revolutionary, philosopher and scientist, has a good claim to being regarded as the founder of systems theory.1 His ‘tektology’, that is, his new science of organisation, not only anticipated and probably in uenced the ideas of Ludwig von Bertalanffy—who must have been familiar with his work,2 but anticipated many of the ideas of the complexity theorists. As Simona Poustlinik commented at a recent conference on Bogdanov: It is remarkable the extent to which Bogdanov anticipated the ideas which were to be developed in systems thinking later in the twentieth century.

All these necrological chronicles do not have the same radiance, the same seriousness, nor the same motivations, but they all agree to dismiss the discipline, which in the past was considered “the queen of the sciences”, with a violence at times comparable to the prestige it commanded at the time of its impunity. Even today, certain philosophers hastily spread the tragic news with contempt for philosophical inquiry, as if its grave solemnity bestowed upon it some obviousness. Thus, Franco Volpi writes: ‘Grand metaphysics is dead!’ is the slogan which applies to the majority of contemporary philosophers, whether continentals or of analytic profession. They all treat metaphysics as a dead dog.1 In this way, the “path of modern thought” would declare itself vociferously “anti- metaphysical and finally post-metaphysical”.

Mazrufunu sahabenin mücadele tarzı doldurmaktadır. Tarih içerisinde görülen Büyük Doğu’nun sahabe devrinden tek farkı zarf değişikliğidir. Fakat zarf, mazrufa (sahabe devrine) nispetle kendini kıymetlendirirken “köle, bir emir subayı” olduğuna vurgu yapar. Yani Allah Resulü (s.a.v.) ve sahabeden intikal eden manaya bağlı kalmak Büyük Doğu’nun esasını teşkil eder. İlkeleri Büyük Doğu’nun mazrufunda pazarlıksız iman, tefekkür, amel ve dava şuuru vardır. Orada “iman” her şeyden öndedir. Mümin, tefekkürden önce “Ne getirdin, götürdün bildirdinse amenna” deme bahtiyarlığına erer. Tefekkür, iman ettikten sonra başlar ve Allah’ın zatı dışında her şeyi kapsamı içerisine alır. Amel imandan sonra gelir ve “salih” olabilmesi için de İslam’ın belirlediği esaslar çerçevesinde kıymetlendirilir. Bütün bunların neticesinde müminde gözünü kırpmadan her şeyini feda edebilecek bir dava ruhu tezahür eder. Sahabe imanla başlayıp dava şuuru ile kemale eren meratibi en güzel şekilde ortaya koyan insanlık tarihinin en muazzez kuşağıdır.

    Appendix E Biographical Sketches of Key Pupils John Godolphin Bennett (1897–1974) was a scientist and philosopher who first met Gurdjieff in Istanbul in 1921 when he was working as an interpreter and personal intel- ligence officer in the British Army. In London that year Bennett began attending meet- ings held by Ouspensky on Gurdjieff’s teaching, and in 1922 he met Gurdjieff again. Bennett made brief visits to Gurdjieff’s Institute at Fontainebleau in February and August of 1923. In the 1930s Bennett formed his own group of followers, and rejoined Ouspensky’s group. In 1946 Bennett established an Institute at Coombe Springs, Kingston-on-Thames in Surrey. After a twenty-five year break Bennett renewed his ties with Gurdjieff in Paris in 1948 and 1949, at which time Gurdjieff taught him his new Movements. In 1949 Gurdjieff named Bennett his ‘official representative’ in England, with reference to the publication of Tales. After Gurdjieff’s death Bennett became an independent teacher, drawing from Sufi, Indian, Turkish, and Subud traditions. In 1953 he travelled through the Middle East hoping to locate the sources of Gurdjieff’s teach- ing among Sufi masters. By the end of his life he had written around thirty-five books related to Gurdjieff’s teaching.1 Maurice Nicoll (1884–1953) studied science at the University of Cambridge before travelling through Vienna, Berlin, and Zurich, eventually to become an eminent psy- chiatrist and colleague of Carl Gustav Jung. Nicoll was a member of the Psychosynthesis group, which met regularly under A.R. Orage, and this connection led Nicoll to Ouspensky in London in 1921.

The first part outlines two conceptions of religious experience that can be found in the last three philosophical books of Michel Henry: the first, broad conception of religious experience is connected with the transcendental relation of human self to God as proposed by Henry; the second, narrower conception concerns the story of salvation as told in Henry’s Christian trilogy, and acquires the form of the “second birth.” Yet the transcendental disposition of Henry’s phenomenology prevents it from developing hermeneutical tools that would guide the understanding of religious experi- ence. The second part of the article deals with the critique of Dominique Janicaud, who questioned the phenomenological methodology of Michel Henry precisely because of its religious overtone, and with the subsequent discussion incited by Janicaud’s criticism. The article defends the phenomenological status of Henry’s work by arguing that Henry’s thinking could not be rightly accused from being theological or metaphysical at the time of the publication of Janicaud’s first critique. Yet it is true that the later Christian trilogy identified the general structures of appearing with the inner life of the God of the Christian Bible, and the experience of Christian faith thus became the presupposition of Henry’s phenomenology. The article also argues that religious experience belongs to the field of phenomenological research.
