ORDINANCE NO. 189

AN ORDINANCE OF THE OF KENHORST, BERKS , , AMENDING THE ZONING CODE AND THE ZONE PLAN OF THE BOROUGH OF KENHORST, AS SAID ZONING CODE WAS ADOPTED BY ORDINANCE NO. 180 APPROVED THE 3RD DAY OF AUGUST, 1961, AND AS SAID ZONE PLAN WAS ADOPTED BY ORDINANCE NO. 183 APPROVED THE 19TH DAY OF OCTOBER, 1961, BY RE-ZONING A CERTAIN AREA IN SAID BOROUGH FROM A MULTIPLE FAMILY TO A BUSINESS DISTRICT AND BY RE-ZONING ANOTHER AREA IN SAID BOROUGH FROM A TWO-FAMILY DISTRICT TO A MULTIPLE FAMILY DISTRICT, AND REPEALING CERTAIN ORDINANCES.

WHEREAS, the borough Council of the Borough of Kenhorst, after proper and legal advertising, adopted a Zoning Code by Ordinance No. 180, approved the 3rd day of August, 1961; and

WHEREAS, the said Borough Council, after proper and legal advertising, by Ordinance NO. 183 approved the 19th day of October, 1961, approved the Zone Plan; and

WHEREAS, the said Borough Council desires to modify, change and amend said Zone Plan.

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Borough Council of the Borough of Kenhorst, situate in Berks County, Pennsylvania, and it is hereby ordained and enacted by the authority of the same, as follows:

SECTION 1. The Zone Plan of the Borough of Kenhorst, being Plan No. 323-25- S of Spotts Engineering Associates, Inc., Borough Engineer, is hereby amended as follows:

(a) All lands situate within the area hereinafter described are changed from a Multiple Family District to a Business District:

BEGINNING at a point in the Division line between the Borough of Kenhorst and the of Cumru, said point being one hundred fifty feet (150’) north of the northern topographical building line of Philadelphia Avenue; thence along said division line, in a northerly direction, a distance of one thousand seventy-two feet (1,072’), more or less, to a point in the center line of a one hundred twenty feet (120’) wide right-of-way; thence along the center line of the aforesaid one hundred twenty feet (120’) right-of-way in an easterly direction, a distance of seven hundred seven feet (707’), more or less, to a point two hundred feet (200’) west of the western topographical building line of New Holland Road; thence in a southerly direction by a line of New Holland Road; thence in a southerly direction by a line being two hundred feet ORDINANCE # 189 – CONTINUED

(200’) west of the aforesaid western topographical building line of New Holland Road, a distance of six hundred forty-five feet (645’), more or less, to a point one hundred fifty feet (150’) north of the northern topographical building line of Philadelphia Avenue; thence in a westerly direction by a line one hundred fifty feet (150’) north of the aforesaid northern topographical building line of Philadelphia Avenue, a distance of nine hundred feet (900’), more or less, to the place of Beginning.

(b) All lands situate within the area hereinafter described are changed from a two- family district to a multiple family district:

BEGINNING AT the northeastern intersection of Commonwealth Boulevard and New Holland Road; thence in a northeasterly direction along the eastern topographical building line of New Holland Road, a distance of three hundred ninety seven feet (397’), more or less, to a corner, said corner being the southeastern topographical building corner of New Holland Road and a twenty four feet (24’) wide street; thence in a southeasterly direction along the southwestern side of the aforesaid twenty four feet (24’) wide street, a distance of three hundred twenty feet (320’), more or less, to a point in the northeastern topographical building line of Commonwealth Boulevard; thence in a southwesterly direction along the aforesaid northwestern topographical building line of Commonwealth Boulevard, a distance of two hundred eighty four feet (284’), more or less, to the Place of Beginning.

SECTION 2. The Zone Plan of the Borough of Kenhorst, being Plan No. 323-25- S of Spotts Engineering Associates, Inc., Borough Engineer, as revised by said Engineer on June 26, 1961 and as revised by this Ordinance, is hereby adopted as the Zone Plan of the Borough of Kenhorst.

SECTION 3. The Borough Engineer is hereby authorized and directed to make said changes in the Zone Plan of the Borough of Kenhorst as hereinbefore set forth.

SECTION 4. The Borough Solicitor is hereby authorized and directed to take all necessary and proper steps to put this Ordinance into effect.

SECTION 5. This Ordinance and said Zone Plan as modified herein, shall remain available for public inspection at the Office of the Borough Secretary, Borough Hall, 339 South Kenhorst Boulevard, Kenhorst, Pennsylvania.

SECTION 6. All Ordinance or parts of Ordinances inconsistent with the provisions of this Ordinance are hereby repealed, insofar, buy only insofar, as they are inconsistent herewith.

Finally ordained and enacted this 5th day of April, 1962, after due advertisement of a summary of the provisions hereof and of a public hearing hereon in the Reading Eagle and the Reading Times on Monday, March 19,1962 and Monday, March 26, 1962.
