The Legal Profession Faces New Faces: How Lawyers' Professional Norms Should Change to Serve a Changing American Population By Liwen Maht If a client earnestly asks a lawyer to participate in a cow-sacrificing ceremony to ensure a propitious legal outcome, should the lawyer sharpen her steak knives and attend?' The lawyer might first consult her own con- science. Assuming she has no irreconcilable, personal opposition to sacri- ficing animals, she might consider legal ethics and the social norms of the legal profession. Social norms about how to work with clients are embed- ded within the Model Rules of Professional Responsibility. Unfortunately, adherence to these norms more likely satisfies the expectations of other attorneys than the expectations of the client. The legal profession faces the challenge of meeting the needs of a changing American demographic and adapting to serving clients with different cultural norms. Serving a client with different cultural bearings presents both great peril and opportunity for a lawyer. The explosion of Latino and Asian American populations in recent years increases the likelihood that lawyers will encounter clients who subscribe to different social norms.2 A look at lawyers' own social norms reveals that the American bar is fixated on his- torical lawyering roles, rather than serving the rapidly changing American demographic. A local Southeast Asian autonym is borrowed into Chinese, undergoes sound changes affecting the Chinese language, and then returns to the original populations, or to other populations. The result is a coexistence of ethnonyms of highly different phonetic outlook but originating in the same etymon. We will examine four families of ethnonyms, mostly Austroasiatic and Tai-Kadai. Some of these ethnonyms are still in use today, others are known through Chinese texts where they are transcribed by phonograms. -

A festival, which attracts a great deal of interest in social life, is an integrated form of activities including spiritual and material aspects, religious beliefs, arts and culture, the sacred and everyday life, and so on. Out of more than 9000 festivals in Vietnam, about 7000 traditional festivals are widely scattered across the country. Studying changes in the spiritual life of Vietnamese people through traditional festivals contributes to building spiritual life and building an advanced Vietnamese culture imbued with national identity. In order to ensure the effective organization and management of festivals, promote the cultural identity and diversity of national festivals, a scientific and comprehensive survey is needed, clarifying origins, characteristics, values, scale, and financial sources for organizing festivals; identifying viewpoints, criteria and classification methods on traditional festivals and modern festivals in our country, chaired by a specialized agency for scientific research. On the basis of the survey findings, the state authorities study and consider which types of festivals need planning, management decentralization, and elaboration of management regulations, mechanisms and policies consistent with the characteristics of traditional festivals and modern festivals. -

BENGSTON USDA Forest Service, Northern Research Station, St. Paul, Minnesota, USA MICHELE SCHERMANN, MAIKIA MOUA, AND TOU THAI LEE Bioproducts and Biosystems Engineering, University of Minnesota, St. Paul, Minnesota, USA Natural resource managers need to understand the cultures and concerns of ethnic minority communities in order to serve them effectively. The Hmong are an Asian ethnic group that is heavily involved in natural resource-related activities but has been largely overlooked by social scientists. We conducted a series of five focus groups with Hmong Americans in Minnesota and Wisconsin, exploring their experi- ences and perspectives on public lands. Our participants revealed deep cultural and personal connections with the natural world and the importance of public lands to many Hmong. But we also heard about profound problems and concerns. Percep- tions of racism, discrimination, and harassment from public land managers and other agency personnel, recreationists, and private landowners are common. Participants had many suggestions for improvement and insights regarding the special needs of new refugees who arrived in the United States in recent years. A History of the Hmong Community in Banning
From the Hills of Laos to the San Gorgonio Pass; A History of the Hmong Community in Banning Banning has historically been a town of pioneering settlers. After original native peoples, principally the Cahuilla, settled in the area, White/European settlers began arriving in the late 1880s, followed closely by Mexican-American immigrants. The African-American community began developing in the 1950s, followed by Lao and Hmong people from Laos in the late 1970s. The Hmong have been a people without a country for thousands of years, forcefully driven from their homelands, first in China and more recently in Laos, a long sliver of a country situated between Vietnam and Thailand. The Hmong have lived in higher elevations because of their fear that the country they settled in would eventually turn against them and attempt to harm them. By living in higher elevations they could keep a lower and safer profile and not be perceived as a threat to the local communities of that country. During the Vietnam War the Hmong people of Laos were recruited by the U.S. Military as part of an anti-communist force in the hilly areas of Laos, where they farmed the fertile soil of the region. After the withdrawal of U.S. forces from Vietnam in 1975, the U.S. accepted more than 110,000 Laotian highlander Hmong as refugees. Many of the first Hmong who arrived in Southern California settled in the San Diego, Santa Ana and Long Beach areas. As they ventured outside of those areas they discovered Banning. The rocky hills bordering the north and south sides of the San Gorgonio Pass reminded them of some of the hilly areas of Laos, their former homeland, and the lower housing costs compared to Orange County were attractive. -

Vietnam is a developing country with an intermixture of cultural heritage and social-economic transformation. In order to achieve the goal of becoming a modernized and industrialized country, the Vietnamese government is setting the development of human resources as priority. In line with the enhancement of advanced industrial knowledge and skills, Vietnamese should be fulfilled with value codes to meet the requirements of the international labour market, to keep the specific ‘Vietnamese’ characters and to develop sustainably. The content of values education should be addressed to be promoted in families, schools and society. It is thus the aim of this paper to explore the Vietnamese values system. The first section of this paper discusses the notions of values and values education. The following section presents a brief outline of the Vietnamese cultural and historical context. -

Interviews with more than two dozen state and local officials and 170 ethnographic interviews identified state and local policies and the realities of immigrants' lives. The stories told by the diverse new immigrants reveal subtle differences in each group's adaptation to the new economic realities that make low-paying jobs harder to find and require that increasing numbers of women work. Among the many policy recommendations is a proposal for the reform of bilingual education programs. Universal access to bilingual education and monitoring and evaluation of existing programs are necessary to ensure that both children and adults have opportunities tolearn English without wasting public resources.
