Primary Election is March 3, 2020 General Election is November 3, 2020 Filing Deadline is December 6, 2019 California State Senate The California State Senate is the upper house of the California State Legislature. The Senate meets in the state capitol building. The Red Carpet Chamber. Democratic Party Control. Consists of 40 Senators elected for 4-year terms. 20 Senators with odd- numbered districts will have elections in 2020! Primary Election is March 3, 2020 General Election is November 3, 2020 Filing Deadline is December 6, 2019 Key Legislative Bill Updates Board of Registered Nursing AB 1364 (Rubio) Nursing Schools and Programs: Exemptions Board Position: Opposed Status: Moved to Suspense File This bill sought to exempt California nursing schools that met specified performance criteria from the requirement for the Board’s approvals for changes to faculty, enrollments, clinical simulation hours and clinical placements. The bill would prohibit a nursing school from providing payment to a clinical agency or facility in exchange for clinical experience placements. AB 890 (Wood) Nurse Practitioners: Scope of Practice: Unsupervised Practice Board Position: Opposed Unless Amended Status: Moved to Two Year Bill This bill seeks to create a new APRN Board to regulate advanced practice nurses, who by meeting specified criteria, are able to practice independently. The bill is not clear on whether it is applicable to Nurse Practitioners or all Advanced Practice Nurses. The fiscal impact would require DCA to build an agency from the ground up and be a huge revenue loss to BRN, not to mention duplication of regulatory services. AB 5 (Gonzalez) Worker Status: Employees and Independent Contractors Board Position: Not Previously Considered Status: Approved by the Governor 9/18/19 This bill codifies the California Supreme Court Dynamex ruling that presumes a worker is an employee unless a hiring entity satisfies a three-factor test known as the “ABC Test”. The bill allows certain occupations the ability to apply the “Borello Test” as specified. The passing of this bill impacts the Board’s Comprehensive Continuing Education Plan, which requires the Board to identify the need for content evaluators and hire these individuals as employees. AB 214 (Kamlager-Dove) Implicit Bias: Continuing Education: Requirements Board Position: Opposed Unless Amended Status: Enrolled/Governor’s Desk 9/11/19 This bill requires the Board to adopt regulations by 1/1/2022, requiring all CE courses to contain curriculum that includes specified instruction in the understanding of implicit bias in treatment. Providers would need to comply with these regulations by 1/1/2023 and the BRN would be required to audit providers for compliance. Coming Attractions At the Board of Registered Nursing New Office of Legislative Affairs Unit Legislation & Regulation Together Led by Chief of Legislation This new unit will oversee the promulgation of legislation and regulation to amplify the mission of the Board. The unit will educate and engage stakeholders and legislators on nursing education and practice throughout California. Combining both Legislation and Regulation together allows for continuity and relevancy of recent laws to keep BRN aligned with current trends and to ensure public protection.
