    MINUTES Legislative Education Study Committee New Mexico State Capitol House Chamber and Virtual Meeting Santa Fe, New Mexico September 23-25, 2020 Wednesday, September 23 The following voting and advisory members were present: Voting: Chair Christine Trujillo, Vice Chair Mimi Stewart, Senators Craig W. Brandt and William P. Soules, and Representatives Alonzo Baldonado, Rebecca Dow, G. Andrés Romero, and Sheryl Williams Stapleton; Advisory: Senators Roberto “Bobby” J. Gonzales, Linda M. Lopez, Michael Padilla, and Shannon Pinto, and Representatives Kelly K. Fajardo, Joanne J. Ferrary, Natalie Figueroa, Joy Garratt, Susan K. Herrera, D. Wonda Johnson, Raymundo Lara, Willie D. Madrid, Patricia Roybal Caballero, Tomás E. Salazar, Debra M. Sariñana, and Elizabeth “Liz” Thomson. The following voting and advisory members were absent: Voting: Senator Candace Gould and Representative Derrick J. Lente; Advisory: Senators Daniel A. Ivey-Soto, Gay G. Senator Stewart made a motion to approve the agenda with one edit to move item 8, Early Childhood Education Funding and Performance, to the November meeting. Representative Romero seconded the motion, and the committee approved the motion with no opposition. On a motion by Senator Stewart and a second by Representative Romero, the committee approved the minutes from the August LESC meeting. FY21 School Budgets Post Solvency. Adan Delgado, deputy secretary of finance and operations, Public Education Department (PED), provided an overview of the budget development and review process for FY21. He said recent school finance litigation has led to increased expectations of school budget transparency and has led to a shift in how formula funding is viewed.

Our leaders made many difficult choices to ensure that students remained a priority. Higher education did not take a cut in funding and remained stable, and most importantly, the TOPS floor was reset and fully funded. This session has restored my hope and trust in our leaders. They have proven themselves as friends to students, and for that we are grateful. However, the last decade has not been so friendly to higher education. According to the State Higher Education Executive Officers’ annual report, Louisiana has led the country in percent reduction of public funding per FTE at -33.1%, from 2011-2016. Last year culminated with cuts to TOPS, to the alarm of students and the public. Years of budget cuts directly affected our institutional quality and transferred costs to students; this cut to TOPS was a direct cut to our students and was devastating for many. Our lawmakers went back on their promise to Louisiana’s best students to provide them with an invaluable postsecondary educational experience. In 2015, after eight years of constant cuts and budget reductions, LSU Student Government decided to launch this annual Higher Education Report Card to hold legislators accountable to us, the students. The mission of the Report Card remains clear: to hold our leaders accountable for higher education policy in the most objective way possible.

The answers provided do not denote any affiliation or endorsement by Trust Women, nor does a candidate’s choice to participate in our questionnaire signify affiliation or endorsement. The endorsements we have included along with our questionnaire responses are those given by the anti-choice organization Kansans for Life and the pro-choice organization Planned Parenthood. PLAINTIFFS’ MEMORANDUM BRIEF IN RESPONSE TO THE EGOLF, MAESTAS AND JENNINGS/LUJAN PARTIES’ FEBRUARY 22, 2012 MOTIONS AND BRIEFS REGARDING JURISDICTION, ABSTENTION, PRECLUSION AND DEFERRAL ISSUES In accordance with the Court’s February 22, 2012 Scheduling Order (Doc. 31), the Plaintiffs submit the following memorandum in response to the Egolf Intervenors’ Motion to Dismiss and supporting briefs (Doc. 36 and 37); the Maestas Parties’ Brief Regarding the Court’s Authority (Doc. 27); and the Jennings/Lujan Parties’ Motion to Dismiss or, in the Alternative, to Stay (Doc. 29).1 The Plaintiffs incorporate by reference their Memorandum Brief Regarding the Court’s Authority (Doc. 30) and the Governor’s and Secretary of State’s Opening Brief on Jurisdiction, Abstention, Preclusion and Deferral Issues (Doc. 28), which demonstrate as well that the non-merits defenses and arguments that these Democrat parties raise lack merit. 1 The Plaintiffs oppose the New Mexico Attorney General’s intervention.     Week of January 14, 2019 State Issues Legislative Analyst This week, the Legislative Analyst’s Office (LAO) released its overview of Governor Newsom’s budget proposal for FY Report on State 2019-20 that was presented last week, and saw a new leader selected to lead this non-partisan organization. The Budget Legislature appointed a new state Legislative Analyst to fill the role Mac Taylor has held for 10 years. They named Gabriel Petek to the post, who most recently worked for Standard and Poor’s Global Ratings San Francisco Office where he is currently the state’s primary credit analyst. He takes the reins on February 4. In addition to getting a new chief, the LAO released its overview of the Governor’s January budget highlighting that that state’s budget position continues to be strong. They also focus on the fact that the Governor’s proposed budget prioritizes the repayments of state debts and a great deal of one-time funding. Nearly half of the discretionary spending is earmarked to pay down state liabilities, including unfunded retirement liabilities and budget debts. Twenty-five (25) percent of the discretionary spending is for one time or temporary funding proposals, and 15 percent for discretionary reserves. The LAO applauds the Governor’s decision to focus on the repayment of state debts. The LAO points out one thing that many took note of – the Governor has outlined many priorities for budgetary spending. And at least some of the proposals are not fully fleshed out or reflected in the budget document. The LAO was not critical of this but pointed out that these un-finalized proposals give the Legislature the opportunity to weigh in with the Administration and have their say in its development.
