This bill extends property and income tax breaks to a very mature and healthy sector of the economy. HB 2305 decouples Kansas from federal depreciation rules for a period of 10 years. Requiring a company to amortize one way for the federal government and another way for Kansas just adds complexity to the tax code. Most importantly, as we work to balance spending request with revenue streams, at some point we have to say no, no to the countless request for additional exceptions to our current state and local tax base.—KENNY WILK,STEPHANIE SHARP,KASHA KELLEY MR.SPEAKER: I support HB 2305. Kansas crude oil only supplies one third of the crude oil needed to keep Kansas refineries in operation. Two thirds of the crude oil consumed in Kansas refineries is imported into Kansas from sources out of state including off-shore, gulf, and overseas. When the hurricanes hit two years ago, several times the gasoline pipelines ran dry in the Kansas City area. This bill is about keeping gasoline and diesel fuel available during natural disasters for Kansas consumers. EXPLANATION OF VOTE MR.SPEAKER: I vote yes on HB 2316 to improve employee payment options. However, the attempted amendment to increase minimum wage is a complex issue. Evidence shows minimum wage increases can result in higher unemployment rates be- cause of the added cost of doing business. This can be systemic, forcing elevation of other salaries and prices of goods/services. The unintended consequence means entry-level work- ers pay more for essential goods, and some businesses engage in workforce reduction of the very people the amendment aims to help. He was a member of a quick reaction force, and was killed in Scania, Iraq by an IED that killed seven others. Sgt. Berry leaves behind a wife, Kathleen, Wichita, and parents, Carl and Jackie Berry of Anthony, KS. Sgt. Berry was a member of the Kansas National Guard. He served with the 161 Field Artillery Unit out of Kingman, KS. He had been stationed in Iraq since March, 2006. The House observed a moment of silence in honor of Sgt. (2) ‘‘Public safety officer’’ means a law enforcement officer or a firefighter or an emer- gency medical services attendant. (3) ‘‘Law enforcement officer’’ means a person who by virtue of office or public employ- ment is vested by law with a duty to maintain public order or to make arrests for violation of the laws of the state of Kansas or ordinances of any municipality thereof or with a duty to maintain or assert custody or supervision over persons accused or convicted of crime, and includes wardens, superintendents, directors, security personnel, officers and employees of adult and juvenile correctional institutions, jails or other institutions or facilities for the detention of persons accused or convicted of crime, while acting within the scope of their authority. (4) ‘‘Firefighter’’ means a person who is: (1) Employed by any city, county, township or other political subdivision of the state and who is assigned to the fire department thereof and engaged in the fighting and extinguishment of fires and the protection of life and property therefrom; or (2) a volunteer member of a fire district, fire department or fire company. (5) ‘‘Emergency medical services attendant’’ means a first responder, emergency medical technician, emergency medical technician-intermediate, emergency medical technician-de- fibrillator or a mobile intensive care technician certified by the emergency medical services board pursuant to the statutory provisions contained in article 61 of chapter 65 of Kansas Statutes Annotated. (6) ‘‘Dependent’’ means (A) a birth child, adopted child or stepchild or (B) any child other than the foregoing who is actually dependent in whole or in part on the individual and who is related to such individual by marriage or consanguinity. 304 JOURNAL OF THE HOUSE

(7) ‘‘State board’’ means the state board of regents. (8) ‘‘Military service’’ means any active service in any armed service of the United States and any active state or federal service in the Kansas army or air national guard or reserves. (9) ‘‘Prisoner of war’’ means any person who was a resident of Kansas at the time the person entered service of the United States armed forces and who, while serving in the United States armed forces, has been declared to be a prisoner of war, as established by the United States secretary of defense, after January 1, 1960. (10) ‘‘Resident of Kansas’’ means a person who is a domiciliary resident as defined by K.S.A. 76-729, and amendments thereto. (11) ‘‘Spouse’’ means the spouse of a deceased public safety officer or deceased member of the military service who has not remarried. (b) Every Kansas educational institution shall provide for enrollment without charge of tuition or fees for up to 10 semesters of undergraduate instruction, or the equivalent thereof, at all such institutions for: (1) Any dependent or spouse of a public safety officer who died as the result of injury sustained while performing duties as a public safety officer so long as such dependent or spouse is eligible; (2) any dependent or spouse of any resident of Kansas who died on or after September 11, 2001, while, and as a result of, serving in military service in Iraq or Afghanistan; and (3) any prisoner of war; and (4) any person: (A) Who graduated from high school in Kansas or who, as a resident of Kansas for at least two years, has received a general educational development (G.E.D.) credential; and (B) who either (I) has served in military service in Iraq or Afghanistan at least 90 days after September 11, 2001, or served less than such 90 days because of injuries received in Iraq or Afghanistan or (ii) has served in military service in international waters or on foreign soil in support of military operations in Iraq or Afghanistan for at least 90 days after September 11, 2001, or has served less than such 90 days because of injuries received during such service; and the person has received an honorable discharge from military service or is still in military service; and (D) the person has a DD-214 form or active duty orders that indicate the person has served after September 11, 2001, in one or more of the following military operations: (I) Enduring Freedom; (ii) Nobel Eagle; or (iii) Iraqi Freedom. Any such dependent or spouse and any prisoner of war shall be eligible for enrollment at a Kansas educational institution without charge of tuition or fees for not to exceed 10 semesters of undergraduate instruction, or the equivalent thereof, at all such institutions. (c) Subject to appropriations therefor, Any Kansas educational institution, at which en- rollment, without charge of tuition or fees, of a prisoner of war or a dependent or spouse is provided for under subsection (b), may file a claim with the state board for reimbursement of the amount of such tuition and fees, less any amounts received from federal military tuition assistance. The state board shall include in its budget estimates pursuant to K.S.A. 75-3717, and amendments thereto, a request for appropriations to cover tuition and fee claims pursuant to this section. The state board shall be responsible for payment of reim- bursements to Kansas educational institutions upon certification by each such institution of the amount of reimbursement to which entitled. Payments to Kansas educational institutions shall be made upon vouchers approved by the state board and upon warrants of the director of accounts and reports. Payments may be made by issuance of a single warrant to each Kansas educational institution at which one or more eligible dependents or spouses or prisoners of war persons are enrolled for the total amount of tuition and fees not charged for enrollment at that institution. The director of accounts and reports shall cause such warrant to be delivered to the Kansas educational institution at which any such eligible dependents or spouses or prisoners of war persons are enrolled. If an eligible dependent or spouse or prisoner of war person discontinues attendance before the end of any semester, after the Kansas educational institution has received payment under this subsection, the institution shall pay to the state the entire amount which such eligible dependent or spouse or prisoner of war person would otherwise qualify to have refunded, not to exceed the amount of the payment made by the state in behalf of such dependent or spouse or prisoner of war person for the semester. All amounts paid to the state by Kansas educational insti- tutions under this subsection shall be deposited in the state treasury and credited to the state general fund. There is hereby created in the state treasury the tuition waiver fund to be administered by the state board. Upon certification to the director of accounts and reports FEBRUARY 22, 2007 305 by the chief executive officer of the state board, or such officer’s designee, of amounts needed to pay claims pursuant to this section, the director of accounts and reports shall transfer the amount certified from the state general fund to the tuition waiver fund. (d) The state board shall adopt rules and regulations for administration of the provisions of this section and shall determine the qualification of persons as dependents and spouses of public safety officers or United States military personnel and the eligibility of such persons for the benefits provided for under this section. Sec. 3. (a) On and after the effective date of this act, the board of trustees is responsible for the management and investment of that portion of state moneys available for investment by the pooled money investment board that is certified by the state treasurer to the board of trustees as being equivalent to the aggregate net amount received for unclaimed property and shall discharge the board’s duties with respect to such moneys solely in the interests of the state general state treasurer operating expenses reimbursement fund and shall invest and reinvest such moneys and acquire, retain, manage, including the exercise of any voting rights 306 JOURNAL OF THE HOUSE and disposal of investments of such moneys within the limitations and according to the powers, duties and purposes as prescribed by this section. (b) Moneys specified in subsection (a) shall be invested and reinvested to achieve the investment objective which is preservation of such moneys and accordingly providing that the moneys are as productive as possible, subject to the standards set forth in this act. No such moneys shall be invested or reinvested if the sole or primary investment objective is for economic development or social purposes or objectives. (c) In investing and reinvesting moneys specified in subsection (a) and in acquiring, re- taining, managing and disposing of investments of the moneys, the board of trustees shall exercise the judgment, care, skill, prudence and diligence under the circumstances then prevailing, which persons of prudence, discretion and intelligence acting in a like capacity and familiar with such matters would use in the conduct of an enterprise of like character and with like aims by diversifying the investments of the moneys so as to minimize the risk of large losses, unless under the circumstances it is clearly prudent not to do so, and not in regard to speculation but in regard to the permanent disposition of similar moneys, consid- ering the probable income as well as the probable safety of their capital. (d) In the discharge of such management and investment responsibilities the board of trustees may contract for the services of one or more professional investment advisors or other consultants in the management and investment of such moneys and otherwise in the performance of the duties of the board of trustees under this act. (e) The board of trustees shall require that each person contracted with under subsection (d) to provide services shall obtain commercial insurance which provides for errors and omissions coverage for such person in an amount to be specified by the board of trustees. The amount of such coverage specified by the board of trustees shall be at least the greater of $500,000 or 1% of the funds entrusted to such person up to a maximum of $10,000,000. The board of trustees shall require a person contracted with under subsection (d) to provide services to give a fidelity bond in a penal sum as may be fixed by law or, if not so fixed, as may be fixed by the board of trustees, with corporate surety authorized to do business in this state. Such persons contracted with the board of trustees pursuant to subsection (d) and any persons contracted with such persons to perform the functions specified in subsec- tion (b) shall be deemed to be fiduciary agents of the board of trustees in the performance of contractual obligations. (f) (1) Subject to the objective set forth in subsection (b) and the standards set forth in subsection (c), the board of trustees shall formulate and adopt policies and objectives for the investment and reinvestment of such moneys and the acquisition, retention, manage- ment and disposition of investments of the moneys. Such policies and objectives shall be in writing and shall include: (A) Specific asset allocation standards and objectives; (B) establishment of criteria for evaluating the risk versus the potential return on a par- ticular investment; and (C) a requirement that all investment advisors, and any managers or others with similar duties and responsibilities as investment advisors, shall immediately report all instances of default on investments to the board of trustees and provide such board of trustees with recommendations and options, including, but not limited to, curing the default or withdrawal from the investment. (2) The board of trustees shall review such policies and objectives, make changes consid- ered necessary or desirable and readopt such policies and objectives on an annual basis. (g) Except as provided in subsection (d) and this subsection, the custody of such moneys shall remain in the custody of the state treasurer, except that the board of trustees may arrange for the custody of such moneys as it considers advisable with one or more member banks or trust companies of the federal reserve system or with one or more banks in the state of Kansas, or both, to be held in safekeeping by the banks or trust companies for the collection of the principal and interest or other income or of the proceeds of sale. All such moneys shall be considered moneys in the state treasury for purposes of K.S.A. 75-6704 and amendments thereto. FEBRUARY 22, 2007 307

(h) All interest or other income of the investments of the moneys invested under this section, after payment of any management fees, shall be deposited in the state treasury to the credit of the state general state treasurer operating expenses reimbursement fund. (I) On or after the effective date of this act and periodically thereafter, the state treasurer shall certify to the board of trustees a portion of state moneys available for investment by the pooled money investment board that is equivalent to the aggregate net amount received for unclaimed property. The state treasurer shall transfer the amount certified to the board of trustees. (j) As used in this section: (1) ‘‘Board of trustees’’ means the board of trustees of the Kansas public employees retirement system established by K.S.A. 74-4905 and amendments thereto. (2) ‘‘Fiduciary’’ means a person who, with respect to the moneys invested under this section, is a person who: (A) Exercises any discretionary authority with respect to administration of the moneys; (B) exercises any authority to invest or manage such moneys or has any authority or responsibility to do so; (C) provides investment advice for a fee or other direct or indirect compensation with respect to such moneys or has any authority or responsibility to do so; (D) provides actuarial, accounting, auditing, consulting, legal or other professional serv- ices for a fee or other direct or indirect compensation with respect to such moneys or has any authority or responsibility to do so; or (E) is a member of the board of trustees or of the staff of the board of trustees. (k) The state treasurer operating expenses reimbursement fund is hereby created in the state treasury and shall be administered by the state treasurer. All expenditures from the state treasurer operating expenses reimbursement fund shall be for operating expenses in- curred for issuing and processing unemployment insurance benefit warrants and conducting electronic transactions for unemployment insurance benefit payments from the employment security fund. ‘‘Sec. 2. On July 1, 2007, K.S.A. 2006 Supp. 44-705 is hereby amended to read as follows: 44-705. Except as provided by K.S.A. 44-757 and amendments thereto, an unemployed individual shall be eligible to receive benefits with respect to any week only if the secretary, or a person or persons designated by the secretary, finds that: (a) The claimant has registered for work at and thereafter continued to report at an employment office in accordance with rules and regulations adopted by the secretary, except that, subject to the provisions of subsection (a) of K.S.A. 44-704 and amendments thereto, the secretary may adopt rules and regulations which waive or alter either or both of the requirements of this subsection (a). (b) The claimant has made a claim for benefits with respect to such week in accordance with rules and regulations adopted by the secretary. (c) The claimant is able to perform the duties of such claimant’s customary occupation or the duties of other occupations for which the claimant is reasonably fitted by training or experience, and is available for work, as demonstrated by the claimant’s pursuit of the full course of action most reasonably calculated to result in the claimant’s reemployment except that, notwithstanding any other provisions of this section, an unemployed claimant otherwise eligible for benefits shall not become ineligible for benefits because of the claimant’s en- rollment in and satisfactory pursuit of approved training, including training approved under section 236(a)(1) of the trade act of 1974. For the purposes of this subsection, an inmate of a custodial or correctional institution shall be deemed to be unavailable for work and not eligible to receive unemployment com- pensation while incarcerated. (d) The claimant has been unemployed for a waiting period of one week or the claimant is unemployed and has satisfied the requirement for a waiting period of one week under the shared work unemployment compensation program as provided in subsection (k)(4) of K.S.A. 44-757 and amendments thereto, which period of one week, in either case, occurs within the benefit year which includes the week for which the claimant is claiming benefits. The waiting week requirement of this subsection (d) shall not apply to new claims filed during the period commencing July 1, 2007, and ending on June 30, 2009. No week shall be counted as a week of unemployment for the purposes of this subsection (d): (1) If benefits have been paid for such week; (2) if the individual fails to meet with the other eligibility requirements of this section; or (3) if an individual is seeking unemployment benefits under the unemployment compen- sation law of any other state or of the United States, except that if the appropriate agency of such state or of the United States finally determines that the claimant is not entitled to unemployment benefits under such other law, this subsection (d)(3) shall not apply. (e) For benefit years established on and after the effective date of this act, the claimant has been paid total wages for insured work in the claimant’s base period of not less than 30 times the claimant’s weekly benefit amount and has been paid wages in more than one quarter of the claimant’s base period, except that the wage credits of an individual earned during the period commencing with the end of a prior base period and ending on the date on which such individual filed a valid initial claim shall not be available for benefit purposes in a subsequent benefit year unless, in addition thereto, such individual has returned to work and subsequently earned wages for insured work in an amount equal to at least eight times the claimant’s current weekly benefit amount. (f) The claimant participates in reemployment services, such as job search assistance services, if the individual has been determined to be likely to exhaust regular benefits and needs reemployment services pursuant to a profiling system established by the secretary, unless the secretary determines that: (1) The individual has completed such services; or (2) there is justifiable cause for the claimant’s failure to participate in such services. (g) The claimant is returning to work after a qualifying injury and has been paid total wages for insured work in the claimant’s alternative base period of not less than 30 times the claimant’s weekly benefit amount and has been paid wages in more than one quarter of the claimant’s alternative base period if: (1) The claimant has filed for benefits within four weeks of being released to return to work by a licensed and practicing health care provider. (2) The claimant files for benefits within 24 months of the date the qualifying injury occurred. (a) As used in this section: (1) ‘‘Affected unit’’ means a specified department, shift or other unit of two or more employees that is designated by an employer to participate in a shared work plan. (2) ‘‘Fringe benefit’’ means health insurance, a retirement benefit received under a pen- sion plan, a paid vacation day, a paid holiday, sick leave, and any other analogous employee benefit that is provided by an employer. (3) ‘‘Fund’’ has the meaning ascribed thereto by subsection (k) of K.S.A. 44-703 and amendments thereto. (4) ‘‘Normal weekly hours of work’’ means the lesser of 40 hours or the average obtained by dividing the total number of hours worked per week during the preceding twelve-week period by the number 12. (5) ‘‘Participating employee’’ means an employee who works a reduced number of hours under a shared work plan. (6) ‘‘Participating employer’’ means an employer who has a shared work plan in effect. (7) ‘‘Secretary’’ means the secretary of labor or the secretary’s designee. (8) ‘‘Shared work benefit’’ means an unemployment compensation benefit that is payable to an individual in an affected unit because the individual works reduced hours under an approved shared work plan. (9) ‘‘Shared work plan’’ means a program for reducing unemployment under which em- ployees who are members of an affected unit share the work remaining after a reduction in their normal weekly hours of work. (10) ‘‘Shared work unemployment compensation program’’ means a program designed to reduce unemployment and stabilize the work force by allowing certain employees to collect unemployment compensation benefits if the employees share the work remaining after a reduction in the total number of hours of work and a corresponding reduction in wages. (b) The secretary shall establish a voluntary shared work unemployment compensation program as provided by this section. The secretary may adopt rules and regulations and establish procedures necessary to administer the shared work unemployment compensation program. (c) An employer who wishes to participate in the shared work unemployment compen- sation program must submit a written shared work plan to the secretary for the secretary’s approval. As a condition for approval, a participating employer must agree to furnish the secretary with reports relating to the operation of the shared work plan as requested by the secretary. The employer shall monitor and evaluate the operation of the established shared work plan as requested by the secretary and shall report the findings to the secretary. (d) The secretary may approve a shared work plan if: (1) The shared work plan applies to and identifies a specific affected unit; (2) the employees in the affected unit are identified by name and social security number; (3) the shared work plan reduces the normal weekly hours of work for an employee in the affected unit by not less than 20% and not more than 40%; (4) the shared work plan applies to at least 10% of the employees in the affected unit; (5) the shared work plan describes the manner in which the participating employer treats the fringe benefits of each employee in the affected unit; (6) the employer certifies that the implementation of a shared work plan and the resulting reduction in work hours is in lieu of temporary layoffs that would affect at least 10% of the employees in the affected unit and that would result in an equivalent reduction in work hours; 310 JOURNAL OF THE HOUSE

(7) the employer has filed all reports required to be filed under the employment security law for all past and current periods and has paid all contributions, benefit cost payments, or if a reimbursing employer has made all payments in lieu of contributions due for all past and current periods; and (8) (A) a contributing employer must be eligible for a rate computation under subsection (a)(2) of K.S.A. 44-710a, and amendments thereto, and is not a negative account employer as defined by subsection (d) of K.S.A. 44-710a and amendments thereto; (B) a rated gov- ernmental employer must be eligible for a rate computation under subsection (g) of K.S.A. 44-710d and amendments thereto. (e) If any of the employees who participate in a shared work plan under this section are covered by a collective bargaining agreement, the shared work plan must be approved in writing by the collective bargaining agent. (f) A shared work plan may not be implemented to subsidize seasonal employers during the off-season or to subsidize employers who have traditionally used part-time employees. (g) The secretary shall approve or deny a shared work plan no later than the 30th day after the day the shared work plan is received by the secretary. The secretary shall approve or deny a shared work plan in writing. If the secretary denies a shared work plan, the secretary shall notify the employer of the reasons for the denial. (h) A shared work plan is effective on the date it is approved by the secretary, except for good cause a shared work plan may be effective at any time within a period of 14 days prior to the date such plan is approved by the secretary. The shared work plan expires on the last day of the 12th full calendar month after the effective date of the shared work plan. (i) An employer may modify a shared work plan created under this section to meet changed conditions if the modification conforms to the basic provisions of the shared work plan as approved by the secretary. The employer must report the changes made to the shared work plan in writing to the secretary before implementing the changes. If the original shared work plan is substantially modified, the secretary shall reevaluate the shared work plan and may approve the modified shared work plan if it meets the requirements for approval under subsection (d). The approval of a modified shared work plan does not affect the expiration date originally set for that shared work plan. If substantial modifications cause the shared work plan to fail to meet the requirements for approval, the secretary shall deny approval to the modifications as provided by subsection (g). (j) Notwithstanding any other provisions of the employment security law, an individual is unemployed and is eligible for shared work benefits in any week in which the individual, as an employee in an affected unit, works for less than the individual’s normal weekly hours of work in accordance with an approved shared work plan in effect for that week. The secretary may not deny shared work benefits for any week to an otherwise eligible individual by reason of the application of any provision of the employment security law that relates to availability for work, active search for work or refusal to apply for or accept work with an employer other than the participating employer. (k) An individual is eligible to receive shared work benefits with respect to any week in which the secretary finds that: (1) The individual is employed as a member of an affected unit subject to a shared work plan that was approved before the week in question and is in effect for that week; (2) the individual is able to work and is available for additional hours of work or full-time work with the participating employer; (3) the individual’s normal weekly hours of work have been reduced by at least 20% but not more than 40%, with a corresponding reduction in wages; and (4) the individual’s normal weekly hours of work and wages have been reduced as de- scribed in paragraph (3) of this subsection (k) for a waiting period of one week which occurs within the period the shared work plan is in effect, which period includes the week for which the individual is claiming shared work benefits. The waiting week requirement of this sub- section (k)(4) shall not apply to new claims filed during the period commencing July 1, 2007, and ending on June 30, 2009. (l) The secretary shall pay an individual who is eligible for shared work benefits under this section a weekly shared work benefit amount equal to the individual’s regular weekly benefit amount for a period of total unemployment multiplied by the nearest full percentage FEBRUARY 22, 2007 311 of reduction of the individual’s hours as set forth in the employer’s shared work plan. If the shared benefit amount is not a multiple of $1, the secretary shall reduce the amount to the next lowest multiple of $1. All shared work benefits under this section shall be payable from the fund. (m) The secretary may not pay an individual shared work benefits for any week in which the individual performs paid work for the participating employer in excess of the reduced hours established under the shared work plan. (n) An individual may not receive shared work benefits and regular unemployment com- pensation benefits in an amount that exceeds the maximum total amount of benefits payable to that individual in a benefit year as provided by subsection (f) of K.S.A. 44-704 and amendments thereto. (o) An individual who has received all of the shared work benefits and regular unem- ployment compensation benefits available in a benefit year is an exhaustee under K.S.A. 44- 704a and 44-704b, and amendments thereto, and is entitled to receive extended benefits under such statutes if the individual is otherwise eligible under such statutes. (p) The secretary may terminate a shared work plan for good cause if the secretary de- termines that the shared work plan is not being executed according to the terms and intent of the shared work unemployment compensation program. (q) Notwithstanding any other provisions of this section, an individual shall not be eligible to receive shared work benefits for more than 26 calendar weeks during the 12-month period of the shared work plan, except that two weeks of additional benefits shall be payable to claimants who exhaust regular benefits and any benefits under any other federal or state extended benefits program during the period July 1, 2003 through June 30, 2004. No week shall be counted as a week for which an individual is eligible for shared work benefits for the purposes of this section unless the week occurs within the 12-month period of the shared work plan. (r) No shared work benefit payment shall be made under any shared work plan or this section for any week which commences before April 1, 1989. EXPLANATION OF VOTE MR.SPEAKER: HB 2390 was introduced in Committee as Real ID Act, and though we are not calling it that anymore, this still contains measures of the Real ID Act. HB 2390 adopts requirements from Real ID Act, and took out some problematic pieces, and took 318 JOURNAL OF THE HOUSE out any reference to Real ID Act. While at least 22 other states have filed legislation to denounce Real ID, we are moving the opposite direction. I find it hard to believe there was no fiscal note for the new training and implementation measures.
