New Yorkers Wish They Had Spitzer Back FOR IMMEDIATE RELEASE October 8, 2010 INTERVIEWS: DEAN DEBNAM 888-621-6988 / 919-880-4888 (serious media inquiries only please, other questions can be directed to Tom Jensen) QUESTIONS ABOUT THE POLL: TOM JENSEN 919-744-6312 New Yorkers Wish They Had Spitzer Back Raleigh, N.C. – Former New York Governor Eliot Spitzer, co-host of a so-far poorly rated new CNN primetime talk show, is equally disliked as his replacement and former Lieutenant Governor, David Paterson, but Empire State voters still think things would have been better off for the past two years had Spitzer stayed in office. Spitzer has a negative 30-55 personal favorability rating, with Paterson’s job approval mark exactly the same. Paterson is in the bottom third of the 31 governors PPP has polled in 2010—ten are less popular, but 20 are better liked. Spitzer, at 40-42 to Paterson’s 30-53, is more popular with the two men’s own party members, but Paterson has more favor across the aisle, at 27-64 to Spitzer’s 18-72 among Republicans, and at 33-50 to Spitzer’s 24-60 with independents. But by a 45-28 margin, voters would have preferred Spitzer still be governor, despite the personal scandals that prompted his resignation. Though less liked with the GOP and unaffiliated voters, New York Republicans and independents evidently feel things are on such a bad track in the state that they still would have rather had Spitzer, albeit by narrow 37-34 and 38-33 margins. Democrats overwhelmingly choose Spitzer, 53-22. In a list of national figures who are current or former New York elected officials, Hillary Clinton is the best liked, with a 59-36 favorability grade to Rudy Giuliani’s 53-37, Mario Cuomo’s 51-35, Michael Bloomberg’s 43-37, and George Pataki’s 39-37. Giuliani is by far the best liked among independents and with his own base, though Clinton is close behind with her base. “Eliot Spitzer has been openly flirting with a possible future return to elective office, and he would probably fare well in a Democratic primary,” said Dean Debnam, President of Public Policy Polling. “But the numbers statewide are more an indication that New Yorkers overall would simply prefer anyone else to David Paterson than that they love Spitzer.” PPP surveyed 592 likely New York voters from October 1st to 3rd. The survey’s margin of error is +/-4.0%. Other factors, such as refusal to be interviewed and weighting, may introduce additional error that is more difficult to quantify. New York State Commissioner of Health New York State Department of Health Corning Tower Empire State Plaza Albany, NY 12237 Dear Governor-elect Spitzer and Commissioner Novello: We write on behalf of the memberships of four committees of the New York City Bar Association -- Corrections, Health Law, Mental Health Law, and Social Welfare Law -- to urge New York State to cease its current practice of terminating Medicaid eligibility for individuals incarcerated in state and local correctional facilities. We urge the State instead to suspend Medicaid eligibility. Suspension will allow incarcerated Medicaid beneficiaries to receive needed benefits promptly upon release, thereby promoting continuity of care. Under the present system, formerly eligible individuals must reapply for Medicaid upon their release from correctional facilities. This process typically results in a significant delay in these individuals’ ability to access needed care in their communities. Members of this population already are at high risk for physical and mental illnesses, including substance addiction. Additionally, many releasees have serious chronic conditions for which they received care while in prison. It is imperative that they receive swift access to adequate and affordable medical care upon release. Failure to receive such assistance can hinder their ability to become productive members of the community, and in fact, may threaten the safety and well-being of the communities to which formerly incarcerated individuals return. Moreover, while awaiting the reinstatement of Medicaid coverage, formerly incarcerated individuals frequently turn to emergency rooms and other costly forms of care for assistance.

Paterson, have some things in common: Both are African-American and both are disabled. Paterson is legally blind. Watson deals with the physical limitations of cerebral palsy. The similarities between the two New Yorkers pretty much end there. While he’s governor — and assuming his spate of questionable character revelations leaves him politically unscathed — whatever barriers Paterson may face in his new job likely will be dealt with by his staff. If he travels upstate, all necessary accommodations will be made. If he needs the latest reading technology to keep up with state business, he’ll get it. Watson, on the other hand, negotiates life far less smoothly. His off-campus transportation is usually a ride offered by a relative or friend. Conducting the daily business of classes and studying is difficult in the scooter he uses. Though the campus is billed as accessible, he says it is far from welcoming, with problems ranging from public bathrooms his scooter can’t fit into, to elevators that don’t work, classroom buildings with only one accessible entrance and snowy ramps that aren’t shoveled. “You’d think a state school would be [fully] accessible,” Watson says. “It gets state funds.” The 21-year-old and New York’s other citizens with disabilities — there are about 3.8 million of them — wonder if having Paterson in the Executive Mansion will make any difference in the quality of their lives.

    THE PENDING DETERMINATION OF THE LEGALITY OF INTERNET GAMBLING IN THE UNITED STATES Internet gambling has been targeted on many fronts in the United States, including Congress, the courts, the Bush Administration and credit card agencies. This iBrief details recent trends in the regulation of online gaming, and concludes that while absolute prohibitions may be ineffective, the combined resistance of these institutions will prevent the industry from expanding its customer base. An Overview There can be little doubt that Internet gambling means big business around the world. Online gaming sites have won $4.1 billion from bettors this year, and that number is expected to increase to an estimated $6 billion next year.1 Gamblers in the United States are responsible for between 50 percent and 65 percent of that amount.2 This iBrief will discuss four current developments that will determine the course of evolution of the Internet gambling industry: • First, the Internet Gambling Enforcement Bill3 passed last year in the United States House of Representatives.4 This bill sought to prevent online gambling sites from using credit card instruments in their transactions.5 The Senate never voted on the proposed legislation before the 107th Congress adjourned, so any attempt to regulate Internet gambling must begin again with the 108th Congress.
