Condominiums and Shared Sovereignty | 1 Condominiums And Shared Sovereignty Abstract As the United Kingdom (UK) voted to leave the European Union (EU), the future of Gibraltar, appears to be in peril. Like Northern Ireland, Gibraltar borders with EU territory and strongly relies on its ties with Spain for its economic stability, transports and energy supplies. Although the Gibraltarian government is struggling to preserve both its autonomy with British sovereignty and accession to the European Union, the Spanish government states that only a form of joint- sovereignty would save Gibraltar from the same destiny as the rest of UK in case of complete withdrawal from the EU, without any accession to the European Economic Area (Hard Brexit). The purpose of this paper is to present the concept of Condominium as a federal political system based on joint-sovereignty and, by presenting the existing case of Condominiums (i.e. Andorra). The paper will assess if there are margins for applying a Condominium solution to Gibraltar. Condominiums and Shared Sovereignty | 2 Condominium in History and Political Theory The Latin word condominium comes from the union of the Latin prefix con (from cum, with) and the word dominium (rule). Watts (2008: 11) mentioned condominiums among one of the forms of federal political systems. As the word suggests, it is a form of shared sovereignty involving two or more external parts exercising a joint form of sovereignty over the same area, sometimes in the form of direct control, and sometimes while conceding or maintaining forms of self-government on the subject area, occasionally in a relationship of suzerainty (Shepheard, 1899). -

Location: Tibet lies at the centre of Asia, with an area of 2.5 million square kilometers. The earth's highest mountains, a vast arid plateau and great river valleys make up the physical homeland of 6 million Tibetans. It has an average altitude of 13,000 feet above sea level. Capital: Lhasa Population: 6 million Tibetans and an estimated 7.5 million Chinese, most of whom are in Kham and Amdo. Language: Tibetan (of the Tibeto-Burmese language family). The official language is Chinese. Tibet is comprised of the three provinces of Amdo (now split by China into the provinces of Qinghai, Gansu & Sichuan), Kham (largely incorporated into the Chinese provinces of Sichuan, Yunnan and Qinghai), and U-Tsang (which, together with western Kham, is today referred to by China as the Tibet Autonomous Region). The Tibet Autonomous Region (TAR) comprises less than half of historic Tibet and was created by China in 1965 for administrative reasons. It is important to note that when Chinese officials and publications use the term "Tibet" they mean only the TAR. Tibetans use the term Tibet to mean the three provinces described above, i.e., the area traditionally known as Tibet before the 1949-50 invasion. Today Tibetans are outnumbered by Han Chinese population in their own homeland, there are est. 6 million Tibetans and an estimated 7.5 million Chinese, most of whom are in Kham and Amdo. The official language is Chinese. But those Tibetans living in exile still speak, read and write in Tibetan (of the Tibeto-Burmese language family). -

Overview Tibet is ruled by the Chinese Communist Party (CCP) government based in Beijing, with local decision-making power concentrated in the hands of Chinese party officials. Residents of both Chinese and Tibetan ethnicity are denied fundamental rights, but the authorities are especially rigorous in suppressing any signs of dissent among Tibetans, including manifestations of uniquely Tibetan religious belief and cultural identity. State policies encourage migration from other parts of China, reducing the ethnic Tibetan share of the population. Key Developments in 2019 Tibetans faced intensified restrictions on movement due to a series of politically sensitive anniversaries, including the 70th anniversary of the establishment of the People’s Republic of China in October, which featured a large-scale military parade and political rallies in Lhasa. Chinese officials continued a multiyear campaign to consolidate control over major centers for Tibetan Buddhist learning in Sichuan Province, reportedly evicting more than 7,000 residents from Yachen Gar, returning many of its monks and nuns to the Tibet Autonomous Region (TAR) for political “reeducation,” demolishing monastic dwellings, and installing 600 Chinese officials at the center to monitor residents and visitors. -

China’s growing economic influence, internecine rivalries, and over-reliance on the West have hurt the decades-old movement In mid-October, on the day before the 19th National Congress of the Communist Party of China opened in Beijing, some 60 Tibetans gathered in front of the steel-gray facade of the Chinese Consulate in Midtown Manhattan. Waving the blue-and-yellow striped flag of Tibet, which is banned in China, they chanted for Tibet to be freed from nearly 70 years of Chinese rule. “We are here to voice our opinions, to express our concerns, not that they are going to listen, but we have to keep trying,” said Sonam Wangdu,75, a leading activist. Tibetans have been mounting such protests around the world since China first occupied Tibet in 1950. After a failed uprising in 1959, the Dalai Lama, leader of the Tibetan people, fled to India, where he has been based since. Tens of thousands of Tibetans followed him into exile, slowly spreading around the world and starting a movement that gradually soared to global prominence. -

SMITH 1 TIBET UNDER CHINESE COMMUNIST RULE A Compilation of Refugee Statements 1958-1975 Tibet Under Chinese Communist Rule is a collection of twenty-seven Tibetan refugee statements published by the Information and Publicity Office of His Holiness the Dalai Lama in 1976. At that time Tibet was closed to the outside world and Chinese propaganda was mostly unchallenged in portraying Tibet as having abolished the former system of feudal serfdom and having achieved democratic reforms and socialist transformation as well as self-rule within the Tibet Autonomous Region. Tibetans were portrayed as happy with the results of their liberation by the Chinese Communist Party and satisfied with their lives under Chinese rule. The contrary accounts of the few Tibetan refugees who managed to escape at that time were generally dismissed as most likely exaggerated due to an assumed bias and their extreme contrast with the version of reality presented by the Chinese and their Tibetan spokespersons. The publication of these very credible Tibetan refugee statements challenged the Chinese version of reality within Tibet and began the shift in international opinion away from the claims of Chinese propaganda and toward the facts as revealed by Tibetan eyewitnesses. As such, the publication of this collection of refugee accounts was an important event in the history of Tibetan exile politics and the international perception of the Tibet issue. The following is a short synopsis of the accounts. -

INTRODUCTION 1. A brief history of the Bon tradition in Tibet 1-1. Buddhist, modern and traditional views on Bon The Bon religion is generally considered to be the oldest spiri- tual tradition of Tibet but what should be properly understood as Bon differs quite widely according to individuals. If one follows the opinion of most Buddhist masters, Bon was a relig- ion centered around sacrifices and sanguinary rituals and was banned by Tibetan Buddhist kings in the last part of the 8th century.1 With the exception of very few masters in the relig- ious history of Tibet,2 this opinion shared by many Buddhist hierarchs on Bon is not based on actual knowledge either of Bon history or its literature but on poorly documented polemi- cal works filled with partisan opinions.3 With such a defective approach, critical views on Bon are usually mechanically re- peated without studies of any Bon text at all and, most dra- matically, simply without the curiosity to do so. This may not be the case only for Bon, since the blind sectarian behavior of many Buddhists in Tibet has often created tensions between monasteries and patrons of rival sects, based on a quasi- hysterical approach to “orthodoxy”. However, such a reduc- tionist attitude is counterbalanced by largely ecumenical indi- viduals who have either discovered or received Bon teachings proper and who can therefore discuss Bon in their own rights. To this group of people belong some of the most interesting minds in the religious history of Tibet, including the actual 14th Dalai Lama who installed Bon as the fifth religious tradition of Tibet and who officially received some of its most important 1 I don’t think that Buddhists reject the possibility that Bon was an orga- nized religion prior to the arrival of Buddhism in Tibet and that Bon pos had monasteries, etc. -

Unfortunately, per- hapAs even more in this latest essay than in most of his other publi- cations, the narrowly focussed jurist, painstakingly gathering precedent, gets in the way of the more widely oriented historian, alert to the total pattern of historie forces and careful to consider the context of each utterance and action. The essay under discussion also contains (pp. 331—332, note 56) a reply to an earlier criticism,2 which I had already occasion to make of Resink's work, and so I may perhaps be permitted to cast this rejoinder in terms of a more comprehensive objection to the purport of Resink's latest paper. There are three points in Professor Resink's essay which, I think, require consideration and to which this rejoinder is addressed. First there is an interpretation of certain statements made by Margadant, Colijn, Verbeek, and others, which leads to the assertion (p. 332, note 56) that these statements question the principle of Dutch sover- eignty in the Indonesian archipelago, specifically in relation to the Indonesian states. Secondly, there is the analysis of how (what Resink calls) the "myth" of a three centuries long présence Nêerlandaise in Indonesia came into being, a process reflected in the work of Stapel and — implicit in Resink's view — further aided and abetted by that historian and others who in the 1930's, under the threat of international developments and of "communistic and nationalistic movements" (p. -
