States Rights, Southern Hypocrisy, and the Crisis of the Union Paul Finkelman Albany Law School (Draft only, not for Publication or Distribution) On December 20 we marked -- I cannot say celebrated -- the sesquicentennial of South Carolina's secession. By the end of February, 1861 six other states would follow South Carolina into the Confederacy. Most scholars fully understand that secession and the war that followed were rooted in slavery. As Lincoln noted in his second inaugural, as he looked back on four years of horrible war, in 1861 "One-eighth of the whole population were colored slaves, not distributed generally over the Union, but localized in the southern part of it. These slaves constituted a peculiar and powerful interest. All knew that this interest was somehow the cause of the war."1 What Lincoln admitted in 1865, Confederate leaders asserted much earlier. In his famous "Cornerstone Speech," Alexander Stephens, the Confederate vice president, denounced the Northern claims (which he incorrectly also attributed to Thomas Jefferson) that the "enslavement of the African was in violation of the laws of nature; that it was wrong in principle, socially, morally, and politically." He proudly declared: "Our new government is founded upon exactly the opposite idea; its foundations are laid, its cornerstone rests, upon the great truth that the negro is not equal to the white man; that slavery subordination to the superior race is his 1 Abraham Lincoln, Second Inaugural Address, March 4, 1865. 1 natural and normal condition. " Stephens argued that it was "insanity" to believe that "that the negro is equal" or that slavery was wrong.2 Stephens only echoed South Carolina's declaration that it was leaving the Union because "A geographical line has been drawn across the Union, and all the States north of that line have united in the election of a man to the high office of President of the United States, whose opinions and purposes are hostile to slavery. -

Note to Readers: This paper is drawn from my book in progress (with Anthony P. Lombardo), Reparations to Africa, especially chapter 5 (“The Slave Trade: Law and Rhetoric”), chapter 6 “The Slave Trade: Debates,” and chapter 1, “Reparations to Africa: A New Kind of Justice.” Introduction This paper considers the call for reparations to Africa from the West, for the trans-Atlantic slave trade, as a form of transitional justice between regions (the West and Africa), which might result in better understanding—and less political resentment, between the two areas. The discussion below focuses especially on the 2001 United Nations World Conference against Racism in Durban, South Africa, and on the call for reparations by the Group of Eminent Persons (GEP) established by the Organization of African Unity in 1992. The two remaining active members of the GEP in the early twenty-first century were Ali Mazrui and Jacob Ajayi. -

Issued on October 15, 2019 Report Issued under Section 15A of the Authority’s Enabling Act on the Proposed 2020 Summer Operating Schedules of the Woods Hole, Martha’s Vineyard and Nantucket Steamship Authority Introduction Section 15A of the Enabling Act of the Woods Hole, Martha’s Vineyard and Nantucket Steamship Authority (the “SSA”) requires the SSA to post and advertise in newspapers with general circulation in Falmouth, Barnstable, Martha’s Vineyard, Nantucket and New Bedford all of its proposed schedule changes at least 60 days prior to their effective date. St. 1960, c. 701, §15A. Accordingly, the SSA placed advertisements of its proposed 2020 Summer Operating Schedules for the period from May 15 through October 20, 2020 in the following newspapers: . The Inquirer and Mirror and The Martha’s Vineyard Times on July 25, 2019; and . The Cape Cod Times, The Falmouth Enterprise, The Standard-Times and the Vineyard Gazette on July 26, 2019. The SSA’s Enabling Act also provides that, if the SSA receives a petition within 30 days of those advertisements that is signed by not less than 50 persons who are residents of any of those communities requesting a public hearing on the proposed schedule changes, the SSA is to conduct a public hearing within 14 days of receiving the petition. In addition, the hearing is to take place in the community where the greatest number of petitioners reside. On August 26, 2019, the SSA received a petition with respect to its proposed 2020 Summer Operating Schedules that was signed by 50 residents of the Town of Falmouth (Appendix A). -

The Freedom Center facility initially included the John Rankin Library, but funding issues eventually lead to the elimination of the librarian position and closing the library to the public. In the fall of 2007, the Public Library of Cincinnati and Hamilton County and The National Underground Railroad Freedom Center entered into an agreement for their John Rankin Library to be housed at the Main Library in downtown Cincinnati as a long‐term loan. The initial loan period is 10 years. The items from the Freedom Center have been added to the Library’s catalog and have been incorporated into the Main Library’s Genealogy & Local History collection. These materials are available for the public to check out, if a circulating item, or to use at the Main Library, if a reference work. The unique nature of the Freedom Center’s collection enhances the Main Library’s reference and circulating collections while making the materials acquired by the Freedom Center again available to the public. -

DESMOND THE ATTEMPT TO REPEAL MAINE’S PERSONAL LIBERTY LAWS Many issues divided the nation before the Civil War. One in particular involved the passage of Per sonal Liberty laws in the northern states, which circum scribed the conduct of officials handlingfugitive slaves. While Maine was not a prominent destination for runaway slaves, its Personal Liberty laws, redrafted in 1857 by the state's new Republican majority, were particularly forceful and therefore particularly odious to Southern planters. As the secession crisis loomed, Maine reconsidered the constitutionality of the laws and their political expediency: Would the state bend to the needs of national reconciliation? Mr. Desmond, born in Island Falls, Maine, received M.A. degrees in education (1979) and History (1991) from the Uni versity of Maine and taught for twelve years in Maine public schools. -

By Margaret Sanborn. (Philadelphia: J. B. Lippincott Com- pany, x, 570 pp. Illustrations, bibliography, index. $8.95; boxed set $16.50.) Interest in the career of Robert E. Lee may be less intense and more localized than a corresponding concern for the life of Abraham Lincoln, but surely few other figures in American his- tory are better known than the famed Confederate general. A non-professional historian, but a good writer, is the latest bi- ographer of the Virginian. Her two volume study (the first volume ends in 1861 and the second with his death in 1870) is not a life and times approach to biography. -
The Fugitive Slave Act of 1850: the Tipping Point
The Fugitive Slave Act of 1850: The Tipping Point During the Antebellum period, tensions between the Northern and Southern regions of the United States escalated due to debates over slavery and states’ rights. These disagreements between the North and South set the stage for the Civil War in 1861. Following the end of the Mexican-American War in 1848, the United States acquired 500,000 square miles of land from Mexico and the question of whether slavery would be allowed in the territory was debated between the North and South. As a solution, Congress ultimately passed the The Compromise of 1850. The Compromise resulted in California joining the Union as a free state and slavery in the territories of New Mexico, Nevada, Arizona and Utah, to be determined by popular sovereignty. In order to placate the Southern States, the Fugitive Slave Act was put into place to appease the Southerners and to prevent secession. This legislation allowed the federal government to deputize Northerners to capture and return escaped slaves to their owners in the South. Although the Fugitive Slave Act was well intentioned, the plan ultimately backfired. The Fugitive Slave Act fueled the Abolitionist Movement in the North and this angered the South. The enforcement of the Fugitive Slave Act increased the polarization of the North and South and served as a catalyst to events which led to the outbreak of the Civil War. The Fugitive Slave Act of 1850 brought into sharp focus old differences between the North and South and empowered the Anti-Slavery movement. Prior to the Fugitive Slave Act of 1850, the Act of 1793 was passed and this allowed for slave owners to enter free states to capture escaped slaves.
