FBI agents warn domestic terrorism poses 'threat to the American people' Politico | Quint Forgey The FBI Agents Association on Tuesday demanded that members of Congress codify domestic terrorism as a federal crime, warning it poses “a threat to the American people and our democracy.” “Acts of violence intended to intimidate civilian populations or to influence or affect government policy should be prosecuted as domestic terrorism regardless of the ideology behind them,” FBIAA President Brian O’Hare said in a statement. The association “continues to urge Congress to make domestic terrorism a federal crime,” O’Hare added — a designation that “would ensure that FBI Agents and prosecutors have the best tools to fight domestic terrorism.” Continue reading here. Intelligence Community Whistleblower Protections Updated June 22, 2021 Congressional Research Service https://crsreports.congress.gov R45345 SUMMARY R45345 Intelligence Community Whistleblower June 22, 2021 Protections Michael E. DeVine Intelligence community (IC) whistleblowers are those employees or contractors working in any Analyst in Intelligence and of the 18 elements of the IC who disclose their reasonable belief of a violation of law, rule, or National Security regulation; gross mismanagement; waste of resources; abuse of authority; or a substantial danger to public health and safety. The Director of National Intelligence (DNI) whistleblowing policy and guidance are publicly available and specifically address the process for making protected disclosures and identify whistleblower protections for IC contractors, members of the Armed Forces, and federal IC employees. IC whistleblower protections have evolved in response to perceptions of gaps that many observers believed left whistleblowers vulnerable to reprisal. The first whistleblower legislation specific to the IC, enacted in 1998, was limited to specifying a process for IC whistleblowers to make a complaint but offered no specific protections. Subsequent legislation, enacted in 2010, included only general provisions for protecting IC whistleblowers with no additional guidance on standards for implementation. Presidential Policy Directive (PPD)-19, signed in 2012, provided the first specific protections against reprisal actions for making a complaint. The Intelligence Authorization Act for Fiscal Year 2014 codified these provisions, which were further supported by IC implementation policy. In early 2018, Congress passed legislation to address perceived gaps in protections for IC contractors. Other provisions in Title 10 of the U.S. Code, along with DOD implementing guidance, provide protections for members of the Armed Forces, including those assigned to elements of the IC.

The Office of the Director of National Intelligence (ODNI) has recently undergone significant turmoil. This week, press reported that three senior career officials—Joseph Maguire, Jason Klitenic, and Andrew Hallman—would be stepping down from their leadership roles. Notably, press reports indicate that President Trump decided to remove Joseph Maguire, Acting DNI, from his position after Trump learned that the Intelligence Community had briefed Congress on Russian interference on his behalf in the 2020 elections.1 In his place, President Trump named Ambassador to Germany Richard “Ric” Grenell—a highly political ally of the president, with minimal experience in foreign policy or national security2—and reporting also indicates Grenell will take on Kash Patel, a former staffer of Representative Devin Nunes who worked to discredit the investigation into Russian interference during the 2016 election, as a senior advisor.3 This leadership 1 Ellen Nakashima, et al., Senior Intelligence Official Told Lawmakers that Russia Wants to See Trump Reelected, WASH. • Testimony of Liz Hempowicz, Director of Public Policy Project on Government Oversight Before the House Committee on Oversight An
Testimony of Liz Hempowicz, Director of Public Policy Project On Government Oversight before the House Committee on Oversight and Reform Subcommittee on Government Operations on “Protecting Those Who Blow the Whistle on Government Wrongdoing” January 28, 2020 Chairman Connolly and Ranking Member Meadows, thank you for inviting me to testify as part of this timely hearing on the importance of whistleblowers in our system of government. I am Liz Hempowicz, director of public policy at the Project On Government Oversight (POGO). In 1981, POGO was founded by Pentagon whistleblowers who were concerned about the Defense Department’s procurement of ineffective, overpriced weapons, and had faced roadblocks, inaction, and retaliation while reporting their concerns internally. POGO later expanded its mission to cover the entire federal government. As a nonpartisan independent watchdog, POGO investigates and exposes waste, corruption, abuse of power, and when the government fails to serve the public or silences those who report wrongdoing. We champion reforms to achieve a more effective, ethical, and accountable federal government that safeguards constitutional principles. Whistleblowers have always played an essential role in that work. Almost three years ago to the day, I testified before this subcommittee as part of a hearing reviewing the impact of the Whistleblower Protection Enhancement Act five years after its enactment.1 That hearing underscored the bipartisan consensus that whistleblowers are vital to ensuring our federal government operates as it should, and that whistleblowers’ disclosures, not the whistleblowers themselves, should be pursued. The hearing also signified a bipartisan commitment to continue to strengthen the channels for whistleblowers to come forward and the protections afforded them.
