3.1 Minutes of the Regular Council Meeting held July 29, 2014 July 29 Council Minutes 717/08/12/14 MOVED by Councillor Boisvert that Council approve the minutes from the regular Council meeting held July 29, 2014 with the following amendment:  Page 2; Clarify the Paragraph beneath Motion 689/07/29/14 to read “Sebastien Dutrisac reported that mowing has started in St. Isidore, and chemical application and spot control have been completed in the Three Creeks and Marie Reine areas. He noted that there are 60 fence line agreements in place, and 2,600 weed inspections completed. He stated that in the Non-Forestry area, 166 courtesy letters and 26 weed notices have been sent out. In the Forestry area, 113 courtesy letters and 145 weed notices have been sent out.” CARRIED

5.1 RFD: Reno Road (TWP 810) Overlay

Ian Cosh reviewed the request for decision. Reno Road Overlay 719/08/12/14 MOVED by Councillor Tomlinson that Council approve an allocation of $480,000 from the Road Project Reserve toward the overlay of the east bound lane of Reno Road (Township Road 810) from kilometre 8.4 to kilometre 12; AND THAT Council direct Administration to secure a contractor that can execute the work this season, within the requested budget amount. CARRIED

5.2 Dust Control on Township Road 804

Deputy Reeve Dyck stated that she received a concern from a resident that lives on Township Road 804 regarding dust control. The road is being used by industrial traffic and is causing dust issues, and there is no dust control on that road. Township Road 804 Dust Issue 720/08/12/14 MOVED by Deputy Reeve Dyck that Council direct Administration to investigate the dust control issue on Township Road 804. CARRIED

5.3 Natural Water Flows on Township Road 840

Reeve Kolebaba commented that there is technology that can detect ephemeral streams, and it may be a good idea to use the technology in the construction of Township Road 840. Doing this may aid in letting water follow the natural water flows in the area. Township Road 840 721/08/12/14 MOVED by Reeve Kolebaba that Council direct Administration to investigate mapping the ephemeral streams on Township Road 840 to incorporate them into the road construction plan. CARRIED

5.4 Garbage Collection in St. Isidore

Councillor Duval noted that grass clippings in the hamlet of St. Isidore were refused by staff providing residential garbage collection services. Mat Bergeron responded that grass clippings are at times too heavy for the staff to load in the garbage truck and that is why they were refused. Household Waste Management 722/08/12/14 MOVED by Councillor Duval that Council direct Administration to include information regarding household waste management in the next County newsletter. CARRIED

5.5 Signage at the Nampa Civic Centre Nampa Civic Centre Signage 723/08/12/14 MOVED by Deputy Reeve Dyck that Council direct Administration to work with the Nampa & District Historical Society, and the Village of Nampa to design and install signage at the Nampa Civic Centre. CARRIED

BEING A BYLAW OF NORTHERN SUNRISE COUNTY IN THE PROVINCE OF ALBERTA TO AMEND THE NORTHERN SUNRISE COUNTY LAND USE BYLAW (B088/02) BY REDISTRICTING LANDS FROM AGRICULTURAL DISTRICT 1 (A1) to RURAL INDUSTRIAL DISTRICT 1 (RM1)

WHEREAS, Northern Sunrise County has adopted the Northern Sunrise County Land Use Bylaw (B088/02) to regulate land use and development in the County;

AND WHEREAS, the Council of Northern Sunrise County, in the Province of Alberta, has deemed it desirable to amend the Northern Sunrise County Land Use Bylaw to re-designate certain lands to regulate the control of a complex development proposal;

NOW THEREFORE, THE COUNCIL OF NORTHERN SUNRISE COUNTY, IN THE PROVINCE OF ALBERTA, DULY ASSEMBLED, HEREBY ENACTS AS FOLLOWS:

1. That the area shown in red within NW-12-85-20-W5M; on attached Schedule A be re- designated from Agricultural District 1 (A1) to Rural Industrial District 1 (RM1).

2. The adoption of this bylaw is effective upon the date of the passing of the third and final reading of this bylaw.

3. Should any provision of this Bylaw be invalid then such invalid provision shall be severed and the remaining Bylaw shall be maintained.

4. This Bylaw shall come into force and effect when it receives third reading and is duly signed.

PROJECT SCOPE

Northern Sunrise County requires engineering services for the completion of a study including preliminary engineering, detailed design and cost estimates addressing existing and future pedestrian movements along and across the Highway 986 corridor in and around the developed area of Cadotte Lake. Key stakeholders in this project are Woodland Cree First Nation, Cadotte Lake Métis Local # 1994, Alberta Transportation and Northern Sunrise County. Public consultation is an important element for the planning of this project.

ENGINEERING TASKS

 Develop a plan for public consultation for input into the planning and design of the proposed walking trails and a subsequent review of the recommended Option.  Identify the entry and exit point of pedestrians travelling along and across the Highway 986 corridor to access the community of Cadotte Lake and the destination of these individuals in the community.  Provide options for routes for all weather pedestrian trails off the highway right-of-way to accommodate the pedestrians and bicyclists and move this traffic off the highway surface.  Prior to proceeding to detailed design, the Consultant shall discuss the various options with Key Stakeholders. Type “B” cost estimates shall be presented for each of the proposed options discussed. Any foreseeable right-of-way issues and/or environmental issues shall be presented with the options discussed.  Suggest the design for the construction of a trail that can support the use of snow clearing equipment while discouraging the use of off-highway vehicles on the trails.  Identify suitable location(s) for creation of crosswalk(s) for the pedestrians crossing the highway using the standards of Transportation Association of Canada’s “Pedestrian Crossing Control Manual”.  The proposed study and planning will start from Cadotte River at the west (labeled as “Starting of the Project” on the Schedule A) and will end at the point on highway meets the east boundary of 2nd phase of Cadotte Lake Residential Development with Plan # 0526176 (labeled as “End of the Project” also on the Schedule A).  Assess the proposed crosswalks to see whether illumination is warranted using Alberta Infrastructure and Transportation’s “Highway Lighting Guide”.  Identify options for pedestrian crossing the Cadotte River and Martin River at kilometer 0.000 of Highway 986.  Provide cost estimates for all options with costs separated for those improvements occurring east and west of the Cadotte River.  Providing the same Consultant Firm is selected for the Construction Phase II, we recommend that they must keep the same Project Manager as provided in Phase I, in the full capacity identified in the Proposal, for as long as the individual remains in the employment of the Consultant. The Consultant must confirm that this Project will be the priority work for the Project Manager and that the Project Manager will have the time required to devote to this Project.

SCHEDULE

Milestone Dates: For the project to be implemented in a timely manner, we request that the following milestone dates be met unless agreed otherwise with the Project Sponsor. Please provide one Grant chart for each phase.

These meetings will be held at the Northern Sunrise County office east of Peace River. All administrative costs for these meetings shall be borne by the Consultant.

FEE SCHEDULE

The proposal will contain a spreadsheet identifying the resource budget for the charge-out rates, expenses and disbursements, and the allocated staff hours for each engineering task. Each task will be listed under the relevant engineering phase. Engineering phase subtotals shall then be added to provide a total cost estimate.

PAYMENT SCHEDULE

Payment for services rendered shall be made as follows:  Tasks 1 and 2 will be paid monthly on a percentage complete basis.  Task 3 will be paid upon submission of the completed final details.

These payments shall be the full compensation received by the Consultant for performing all work and shall include all fees, expenses, disbursements, sub-consultants and other costs.

It is my pleasure to announce that Alberta Municipal Affairs is providing $650,000 in grant funding for the 2014/15 Fire Services Emergency Preparedness Program (FSEPP). The FSEPP guidelines and project application form are available on the Office of the Fire Commissioner website at www.ofc.alberta.ca/grant-funded-training.cfm. Please forward this information to chief administrative officers, directors of emergency management, and fire chiefs.

The purpose of the grant is to facilitate training for fire service, municipal emergency response personnel and volunteers needed to protect Albertans during an emergency event. The approved courses for this grant are separate from other training provided directly through the ministry.

In order to maximize resources, regional collaboration of municipalities is requested with one municipality applying as the host. Please work closely with the fire rescue officers and/or Alberta Emergency Management Agency field officers in your area when applying. The officers can assist you during the application process.

Policy 1.18 ‘Schedule A’ Board and Committee Member Code of Ethics

The proper operation of democratic local government requires that persons appointed by Northern Sunrise County Council to its Boards and Committees be independent, impartial, and duly responsible through Council to the people of Northern Sunrise County.

Accordingly, it is the purpose of this Code of Ethics to outline certain basic rules for persons appointed to Boards and Committees so that they may carry out their entrusted duties with impartiality and dignity, recognizing that the function of Board or Committee members is, at all times, service to their community and the public.

To further these objectives, certain ethical principles should govern the conduct of persons appointed to Boards and Committees in order that they shall maintain the highest standards in public office and faithfully discharge their duties.

Persons appointed to the (name of Board or Committee) shall: 1. Govern their conduct in accordance with the requirements and obligations set out in the municipal legislation of the Province of Alberta and the bylaws and policies of Northern Sunrise County. 2. Not use confidential information for the personal profit of themselves or any other person. 3. Not communicate confidential information to anyone not entitled to receive it. 4. Not use their position to secure special privileges, favours, or exemptions for themselves or any other person. 5. Disclose the general nature of any pecuniary (financial) interest in any matter coming before the Board or Committee, if that interest is not a common interest held by other members of the body, and abstain from any discussion or voting on the issue. 6. Preserve the integrity and impartiality of their Board or Committee and of County Council. 7. For a period of twelve months after leaving a Board or Committee, abide by the Code of Ethics listed above, except those related to confidential information which shall apply in perpetuity. 8. Ensure all deliberations regarding a decision before the Board or Committee is undertaken during a Board or Committee meeting using information presented before the entire Board or Committee.

Persons appointed to Boards or Committees should not assume that any unethical activities not covered by or specifically prohibited by this Code of Ethics, or by any legislation, are therefore condoned. If in doubt about actions they may be contemplating, appointees are encouraged to seek advice from the Chair of their Board or Committee or from the Chief Administrative Officer of Northern Sunrise County.

Peter,

I met with Principal Bryan Dewar, School Board members and residents over the weekend and through this evening. In a unanimous vote at an emergency meeting of the Little Buffalo School Board on Friday the following motion was carried unanimously: "to close the Little Buffalo School until all the remediation and discrepancies are address and fixed. 3FY" Principal Dewar forwarded the following list of discrepancies for our information:

"1. THIS IS HUGE THE MOLD IN THE Grade 6 room and the hallway ceilings has not been remediated. 2. Modus finishing in new end especially in the kitchen 3. Whiteboards not installed 4. Smart boards not installed 5. Gravel for areas where trucks were stuck not replaced 6. No locks for under school areas in new portables 7. No fencing done for new end (especially dangerous for bus supervisions) 8. Kitchen mouse runs still not filled in 9. Modus doors still have seals on them 10. Modus doors not installed correctly need to be redone 11. Fencing at entrance not replaced 12. Fencing at back of school not done 13. Playground not fixed for safe use need grader 14. Front doors not sealing properly and front lobby full of water from rain 15. Where is the CTS trailer? It was removed over the summer and has not been returned nor has anyone told me what is going on with this trailer."

Upon a walk through of the school it is clear that water has been leaking through the ceiling joints throughout the summer and has caused further damage to the school buildings far beyond what was observed last year. The overpowering stench of mould and rot was unmistakable and caused severe headaches for all involved after only ~20 minutes in the building. Despite patchwork linoleum replacement in two areas of the hallway, the floor has become rotten, soft and unstable in a number of areas of the hallway. Rodent activity is evident throughout the building including in the new portable areas which have not been sealed around pipes and do not have properly functioning door hardware. Further, over the course of the last school board meetings questions have again been raised over the soil testing studies and lagoon and the board members have all indicated that Northland School Division has still yet to forward any results or response to these queries. Also questions have been raised regarding a report issued to Northlands School Division on January 30, 2013 indicating that building materials within the school (specifically flooring) contain 20-30% asbestos as material content. This raises further concern given the deterioration of the flooring material and the potential hazard this poses for skin, respiratory and carcinogenic conditions among the faculty and student body.

I have attached a number of photos showing:

- Extensive areas of water damaged ceilings and walls which have not been replaced or remediated. - Small patches held and sealed with "tuck tape" in place of replacing water damaged ceilings. - An area of collapsed ceiling which was pushed back into place and screwed together with narrow strips of drywall without addressing the root problems. - Flooring in the hallway in which the linoleum has stretched as a result of rotting sub-floor beneath in which is giving way. - Opened vent cover with extensive rodent droppings. These were found throughout the building. - Stacks of unbuilt, boxed classroom furniture. Apparently the teachers are supposed to assemble their own prior to the beginning of school.

The local residents as well as school board members I have spoken with all share one opinion in common, they are absolutely at the end of their patience on this issue and would like help from NSC in any form possible.

1. Emergency Meeting called to order at 7:00 PM

2. Ceiling issues in the old grade 6 room and hallway on the east end.

The Board was informed that the promise from Northland School Division No. 61 was not fulfilled. The roofs that were promised to be remediated in May, then June, then the summer were still not done.

Dewar presented the list of items from his letter of August 18, 2014 to the Board with all discrepancies noted, including issues from Modus.

Board did a walkthrough of all the concerns and found other areas of concern not mentioned in the letter.

Board instructed Dewar to make sure all their concerns were addressed immediately and that he is not to make promises that he can’t keep.

To that end the Board unanimously agree to close Little Buffalo School until all remediation is complete. Motion Carried

The Board also instructed Dewar to contact Kelly and inform him of this decision and that our children are not third class citizens and deserve to have this situation rectified. It has been three years of neglect.

In regards to the Recreation study, we applied under the old Regional Collaboration grant. That program is gone and they have shifted our application to the new Alberta Community Partnership grant. We await word on the outcome of that.

We are awaiting word from the Focus consultant on the St. Isidore Land Development Project Conceptual Plan and Cost Estimate Phase Agreement.

In regards to the Drainage study, we are reviewing the draft of the report and preparing comments for the consultant. We are hoping to have this together for the consultant by the end of August and have a final copy ready for Council by the end of September. We expect to have this ready for presentation to Council this fall as a part of the budget review meetings.

After the meeting with Chief Isaac at WCFN, we received a cheque to pay for their outstanding Protective Services bill. We sent a breakdown of the water bill to AANDC for their consideration for payment.

Council needs to pick a day for a CAO Planning meeting. Agenda items will include update on the Strategic Plan.

Council needs to set dates for the Christmas Open House (last year Mon Dec 16; suggest Wed December 17) and the Christmas party (last year Sat Dec 14; suggest Sat’s December 6 or 13). It looks like Whitemud Catering will be slowly closing down, and that will be a consideration for catering the Christmas Open House event.

Dear Mr. Prentice,

Friends of the Lubicon Lake Nation have advised me that you have been questioned about the ongoing situation at Lubicon while travelling on your campaign to become Alberta's next Premier. Let me be one of many to wish you luck in this endeavour as I trust your vast experience federally will no doubt assist you in your efforts provincially. As we have been apprised in our offices of your responses during these questions I felt it necessary to provide some additional information for your review and hopefully benefit as we work together to resolve this long outstanding issue that has plagued our people, this province and the country.

First, a recurring theme in your responses regarding the Lubicon issues at hand seem to indicate that you believe the Lubicon are "a people divided"; likely as a result of advice from current Aboriginal Relations Minister, Frank Oberle. Although this line has long been propagated by the Alberta PCs(as far back as AI Adair) and successive Federal governments, it is not an accurate picture of our community. The Lubicon Lake Nation held general elections on May 30, 2013 using the exact same election code, governing documents and process that has been in place for three decades. The outcome was certified by AFN Chief Electoral Officer Loretta Pete Lambert and the results forwarded to both AAND-C and Alberta Aboriginal Relations. The results of that election continue to be ignored by both AAND-C and Alberta, in favor of a federally sponsored election held at another First Nation in February, 2013 which was organized by an AAND-C contracted agent, Lorne Ternes after he organized a provincial society to unilaterally alter our governing documents and election code without our knowledge or involvement and loudly rejected by the Lubicon community for lack of transparency and engagement. This is not a case of disgruntled factions within the community but the result of overt interference by AAND-C to continue to create a perception of division within our Nation which does not exist. Enclosed with this letter is a brief point form chronology of events regarding the Lubicon Lake Nation and our interactions with the Crown to give you a brief overview of our situation.

Secondly, Minister Oberle is aware of these issues as well as a number of issues regarding consultation with the Lubicon Lake Nation and has been aware of them since he was Solicitor General and Minister of AESRD.His willful intent to ignore these outstanding issues and to support the tactics of AAND-C officials to once again interfere with our community and undermine our rightful government shows a clear misunderstanding of Aboriginal issues as a whole and especially the issues of the Lubicon. This damaging obliviousness is exacerbated by his continued refusal to meet with us as the Nation's government or even as Aboriginal community members to discuss these issues. As recently as August 14 a letter (postdated to August 18, 2014) was sent to a Lubicon supporter, once again refusing to address the bulk of Lubicon concerns raised by the supporter. That letter is attached for your information. Frank's ignorance was also highlighted in his public comments on a Calgary radio station on July 2, 2014 where he stated that

Given your experience with the Indian Affairs file, as well as your legal background, I trust that you understand why such a statement is incorrect on many levels.

I was pleased to hear that in your address to a local municipal official you indicated that you are willing to sit down once again to try and resolve the outstanding Lubicon issues. We too remain willing to come to the table to have that discussion and find agreement which suits the needs of our Nation, the Province and Canada. I would like to make it absolutely clear: we are and represent the Aboriginal Title holders of Lubicon territory. We are and represent those individuals who are continuing to exercise their Aboriginal rights within Lubicon territory. We are the only authority with whom negotiations can and should be carried out regarding Lubicon Aboriginal Title and land rights. We maintain that until the Crown enters into a Treaty or agreement with the lawful Government ofthe Lubicon Lake Nation, our Aboriginal Title supersedes the right of the Crown and industry to enter onto and make use of our lands and resources. We as a Nation, outside of Treaty with the Crown as required by the Constitution, are likewise not bound by the Indian Act or its authorities as we have never ceded our own authorities either knowingly or unknowingly. In light of this, we strongly maintain the position, as affirmed by the Supreme Court of Canada in Tsilhqot'in, that all industry proponents who intend to develop resources within Lubicon lands must first consult with us as representatives of Lubicon Lake Nation Aboriginal Title holders, make accommodations where necessary and make every attempt to secure our consent prior to engaging in development of Lubicon lands and resources. We would hope that the Aboriginal Relations ministry would support us in this position. Instead they have become a barricade, directing industry to consult solely with non-Aboriginal Title holders who do not represent us or understand our relationship with our land. Further, the department has, in an abhorrent act, directed industry not to work with Lubicon owned businesses or hire Lubicon citizens who are supportive of the Lubicon Lake Nation Government or face licencing difficulties, placing an even greater burden on our community economically than we have seen in over a decade.

Many things have changed since you and I last spoke, but most strikingly the conditions in our community have not. I firmly believe we could work together to resolve these issues in a way that is supportive of the community as a whole that is in line with the agreements laid out in the Grimshaw Accord. It would be our pleasure as the Nation's government to sit with you in person to discuss these matters in more detail at your convenience in our offices in Little Buffalo. Thank you for your July 15, 2014 email concerning Alberta's relationship with the Lubicon Lake Band.

Since the election last year of Chief Billy Joe Laboucan and his Couneil, and in particular their subsequent recognition by the federal government, we have been working with the duly elected leadership group on a number of initiatives. One example includes the provision of trailers, intended to improve the lives of all community members. In this regard, Alberta will continue to work with the duly elected Chief and Council regardless of assertions made on behalf of or by Mr. Ominayak.

Contrary to your last statement, it is my understanding that the trailers are being offered to residents of Little Buffalo based on a priority basis, namely: a) elders, b) health and safety, and c) overcrowding, and not affiliation as you suggest. All decisions concerning allocation were made by the Housing Committee and not Chief and Council.

Whether negotiations can resume on the land claim will be determined by the federal government and the duly elected Chief and Council. In the event discussions resume, and Alberta is invited to participate, we are ready and willing to return to the table and are prepared to meet our constitutional obligation to Canada and provide land for the creation of reserve(s) for the Lubicon Lake Band.
