SB 221 appears to be based on the 1993 federal Religious Freedom Restoration Act (“RFRA”). As a longtime religious freedom advocate, ADL supported the passage of RFRA. That support, however, was based on the law being used as a shield to protect the religious exercise of individuals and faith-based institutions from government infringement. RFRA was never intended as a sword to harm or discriminate against others. Yet in recent years, that is the interpretation the U.S. Supreme Court and the U.S. Department of Justice have given to RFRA.123

Our concern about SB 221 being used as a vehicle to discriminate is not hypothetical. As you are likely aware, there is an ongoing issue with Miracle Hill Ministries of South Carolina seeking to discriminate against prospective foster parents on the basis of religion. Indeed, last year Miracle Hill rejected a woman, who had been a foster parent in Florida, as a volunteer mentor for foster children under its care simply because she is

Ultimately, it is vulnerable children who will be most harmed by the SB 221. Like South Carolina, the number of foster children in well exceed the number of willing and

Greenblatt As a result, a business could use SB 221 as justification for refusing to sell goods or Deputy National Director Kenneth Jacobson services to a Jewish family arranging their son’s Bar Mitzvah party, a Catholic family planning a first communion celebration, or a Mormon or Episcopalian couple planning

their wedding. Indeed, it could be used to justify non-compliance with local anti- discrimination ordinances such as the City of Atlanta’s. And again, such discrimination in not hypothetical.14

We also point out the likely federal illegalities of SB 221 should it be used for discriminatory purposes. Federal post-civil war law prohibits discrimination on the basis of race in making and enforcing contracts.15 Based on 19th Century beliefs and understandings about race at the time of this law’s adoption, the U.S. Supreme Court ruled that the statute covers Jews.16 The law, however, does not protect Christians against discrimination. Given that foster care placement and the sale of goods or services all involve the formation of contracts, the discrimination against Jews sanctioned by SB 221 would most likely violate federal law.

In light of the harm to children, discrimination, religious divisiveness and illegalities that would result from enactment of SB 221, we urge you to withdraw this legislation.
