STATUS OF COMPLIANCE WITH ADB COMMENTS AND SUGGESTIONS (ADB APPROVAL DATE 15-10-2014) SUB-PROJECT: REHABILITATION OF DAMAGED ROADS UNDER CONTRACT PACKAGES C36, C39, C41, C43, C44 and C45 ROAD SUB-PROJECT S.N. Comments/Suggestions Status of Compliance Remarks 1 We refer to the submission of initial environmental examination (lEE) report for the road sub-projects ……………….. ……………….. in Tehri district proposed for financing under UEAP. The scope includes restoration works (repairs and rehabilitation) of the damaged stretches including resurfacing; repair of pavement overlay; patch work; repairs of protection or retaining walls; repairs and restoration of culverts; and providing all necessary road furniture and roadside safety hardware for the following roads: a) Pratapnagar-Tehri Motor Road (Package No: UEAP/PWD/C36); b) Gaza-Nakot road (Package No: UEAP/PWD/C39); c) Kirtinagar-Dangdhari road (Package No: UEAP/PWD/C41); d) Tehri-Ghansali-Tilwara road (Package No: UEAP/PWD/C43); e) Chamba-Mussoorrie road (Package No: UEAP/PWD/C44); and f) Kirtinagar-Sorakhal road (Package No: UEAP/PWD/C45). 2 We note from the lEE report that the proposed works would be strictly confined within the existing ……………….. ……………….. right-of-way belonging to Public Works Department, Government of Uttarakhand; and no widening or realignment works would be undertaken under the proposed scope. 3 The lEE report prepared for the above works has confirmed that although some of the roads are ……………….. ……………….. passing through forest areas; none of the road sections proposed for undertaking restoration works were located inside or near designated core or buffer areas of national parks/sanctuaries/biosphere reserves, protected wetlands, or any other environmentally and/or ecologically sensitive areas. We note that lEE report has further confirmed absence of rare, threatened, and endangered species (flora and fauna) within the corridors of impact for these road sections. The lEE report has also confirmed that no archaeological and/or protected monuments were located in the vicinity of the proposed road sections to be restored. It is also noted that the proposed works are not expected to have any impact on the forests and do not involve any tree cutting. Based on the information furnished in the lEE report, the environment category of the sub-projects is assessed to be "8" in accordance with ADS's Safeguard Policy Statement (SPS) 2009. We observe that the lEE report has generally been prepared in line with SPS 2009 requirements. 4 We would like to reiterate that ADB SPS 2009 requires all ADB-financed activities to comply with ……………….. Will be ensured host country statutory environmental and forest related regulations applicable at national, state and local levels. We request you to ensure (a) compliance with (i) applicable statutory environmental and forest regulations prior to commencing with works including the provisions stipulated under EIA Notification 2006 (as amended) for state highways located at 1000 m above mean sea level; and (ii) the terms and conditions stipulated in the associated clearances and permits; and (b) timely renewal of statutory permissions as required. 5 We observe that the paragraphs 22, 24, 25, 26, 28, 29, 31, 32, 34, 35, 37, and 38 (under section Paragraphs 49, 50, ……………….. "Project description") are repeated again as paragraphs 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59 51, 52, 53, 54, 55, and 60 (under section "Description of environment") without any associated additional 56, 57, 58, 59 and 60 assessment. The repetition of data /information may please be avoided if no additional (under section assessment is being included. Source of data has been provided in the updated report. 6 Kindly ensure that (i) the corrected lEE reports including associated environmental management Being ensured. ……………….. and monitoring plans (EMMP) are disclosed to public in local language immediately; (ii) the EMMPs are made a part of the bid and the contract documents; (iii) the items of work towards the implementation of environmental management and monitoring by the contractor that are not a part of the technical specifications and the bill of quantities, are specified separately in the bill of quantities in the contract document; and (iv) the testing of baseline parameters at agreed locations is carried out by civil works contractor for developing a baseline data for ambient air quality and noise levels; surface and ground water quality; and soil characteristics prior to commencing with the civil works so that these can be monitored during the construction phase. 7 Kindly incorporate the observation under serial number 5 above, and resubmit the corrected lEE ……………….. The report has been report for our records. The corrected lEE report would then be disclosed on ADB website in corrected. All back up accordance with ADB Public Communication Policy, 2011 and SPS 2009. Please retain all back-up documents and documents, and photographs associated with this lEE report to respond to queries received if any. photographs associated with IEE are being maintained.
