Fine Principal Deputy Inspector General, Performing the Duties of the Inspector General, Department of Defense for a Hearing on Protecting Those Who Blow the Whistle on Government Wrongdoing Before the Subcommittee on Government Operations Committee on Oversight and Reform U.S. House of Representatives January 28, 2020 Chairman Connolly, Ranking Member Meadows, and members of the subcommittee, thank you for inviting me to appear before you today for this hearing on the contributions of federal whistleblowers and the need to protect them from reprisal. I. INTRODUCTION My testimony will focus on the important work of the Department of Defense Office of Inspector General (DoD OIG) relating to whistleblowers. I am the DoD Principal Deputy Inspector General, Performing the Duties of the Inspector General, and have been serving as the head of the DoD OIG for over 4 years. Prior to this position, in addition to working as an attorney in private practice, I was the Inspector General of the Department of Justice for 11 years, from 2000 to 2011. In my testimony today, I will discuss the significant contributions of whistleblowers, why the protection of whistleblowers is so important, how the DoD OIG evaluates and investigates whistleblower disclosures and complaints of reprisal, and several best practices we have implemented at the DoD OIG to improve our timeliness and efficiency in whistleblower investigations. Specifically, my testimony discusses: • the mission and responsibilities of the DoD OIG, • the importance of whistleblowers and the need to protect them from reprisal, • examples of cases resulting from whistleblower disclosures, • the DoD OIG’s investigative processes, • best practices that the DoD OIG has implemented to improve the timeliness and efficiency of reprisal investigations, 1 • the need for DoD management to take timely corrective action on substantiated whistleblower reprisal investigations, and • the need for adequate resources to handle these important responsibilities. -

October 18, 2012 M E M O R A N D U M I. INTRODUCTION This is a product liability action in which plaintiff David S. Tatum alleges that the PREVACID designed, manufactured, and marketed by defendants weakened his bones, ultimately leading to hip fractures. The defendants filed a motion to dismiss many of the claims in Tatum’s First Amended Complaint. For the reasons that follow, the Court grants in part and denies in part defendants’ motion. II. After taking PREVACID, Tatum began feeling pain in his left hip, and he was later diagnosed with Stage III Avascular Necrosis. (Id. at 7.) Tatum’s bones became weakened or brittle, causing multiple fractures. -

ASHCROFT: THE CONSTITUTIONALITY OF THE COPYRIGHT TERM EXTENSION ACT By MichaelJones On January 15, 2003, the Supreme Court upheld the constitutionality of the Copyright Term Extension Act ("CTEA"), which extended the term of copyright protection by twenty years.2 The decision has been ap- plauded by copyright protectionists who regard the extension as an effec- tive incentive to creators. In their view, it is a perfectly rational piece of legislation that reflects Congress's judgment as to the proper copyright term, balances the interests of copyright holders and users, and brings the3 United States into line with the European Union's copyright regime. However, the CTEA has been deplored by champions of a robust public domain, who see the extension as a giveaway to powerful conglomerates, which runs contrary to the public interest.4 Such activists see the CTEA as, in the words of Justice Stevens, a "gratuitous transfer of wealth" that will impoverish the public domain. 5 Consequently, Eldred, for those in agree- ment with Justice Stevens, is nothing less than the "Dred Scott case for 6 culture." Beyond Authorship Refiguring Rights in Traditional Culture and Bioknowledge Martha Woodmansee and Peter Jaszi An “author” in the modern sense is the creator of unique literary, or artistic, “works” the originality of which warrants their protection under laws of intellectual property -- Anglo American “copyright” and European “authors’ rights.” This notion is so firmly established that it persists and flourishes even in the face of contrary experience. Experience tells us that our creative practices are largely derivative, generally collective, and increasingly corporate and collaborative. Yet we nevertheless tend to think of genuine authorship as solitary and originary. This individualistic construction of authorship is a relatively recent invention, the result of a radical reconceptualization of the creative process that culminated less than two centuries ago in the heroic self-presentation of Romantic poets. In the view of poets from Herder and Goethe to Wordsworth and Coleridge genuine authorship is originary in the sense that it results not in a variation, an imitation, or an adaptation, and certainly not in a mere reproduction, but in a new, unique -- in a word, “original” -- work which, accordingly, may be said to be the property of its creator and to merit the law’s protection as such.1 With its emphasis on originality and self-declaring creative genius, this notion of authorship has functioned to marginalize or deny the work of many creative people: women, non-Europeans, artists working in traditional forms and genres, and individuals engaged in group or collaborative projects, to name but a few.
