2 1 EXECUTIVE SUMMARY

1.1 Introduction

The Asian Development Bank (ADB) approved Loan 3536-PRC: Hebei Elderly Care Development Project (the project) for $100 million and its attached capacity development technical assistance (TA) for the Establishment of an Integrated Comprehensive Three-tier System for Elderly Care (TA 9326-PRC) for $0.670 million on 6 June 2017. The loan agreement was signed on 17 July 2017 and became effective on 26 October 2017. The physical completion and the financial closing of the project are expected on 30 June 2022 and 31 December 2022, respectively.

The project comprises six subprojects, five of which will establish integrated three-tier elderly care service systems in local cities and counties across Hebei Province, and the rest one, a provincial level subproject with Yanshan University (located in Qinghuangdao City in northeast Hebei), will strengthen human resources in the elderly care sector and will conduct specialized research relevant to it. The five cities and counties that will create the integrated elderly care services are Shuangluan , Municipality; Li County, Municipality; City (provincially governed); Julu County, Municipality; and She County, Municipality.

1.2 Scopes and Impacts

Table 1-1 lists the implementation agency of the subproject in six cities/counties. Table 1-2 summarizes the scope and impacts of those six subprojects.

1.3 Due Diligence Report on LA&R for Julu County Subproject

The construction of Julu County Integrated Health and Elderly Care Service Center, a total building area of 20,945 m2, and a day-care center will require 27.64 mu of land, located in Xiwangyang Village, Julu County. The land for these centers had been acquired by the Julu County Government and related compensation had been paid. Since the land has convenient access to developed transport infrastructure, power supply, water supply, sewage facilities, and communication networks and there is no ground attachment on acquired land, this due diligence report has finalized conclusions as below:

The subproject is located in Julu Economic Development Zone, on which many enterprises located, created enormous non-agricultural employment opportunities. 87.84% of the affected laborers worked in the nonagricultural sector while most of the remaining laborers stay at home to take care of old people and children. On average, a person will lose 0.13 mu of land, which has almost no impact on their household income. The affect persons have utilized the cash compensation to start personal businesses or to improve their household income as well as living conditions. According to the survey, the per capita annual net income has risen by 32.35% since the acquisition of land for the subproject, which is a significant improvement.

The compensation rates, resettlement schedule, and compensation distribution program of the subproject have been widely discussed through repeated public consultations. The compensation for acquired land has been paid to the affected household timely and in full. As a result, there are no complaints regarding the grievance redress mechanism. The compensation rates and resettlement program comply with the applicable state and provincial regulations and policies, and ADB’s involuntary resettlement safeguard principles. The affected persons are satisfied with resettlement policies and their income has increased, demonstrating that the resettlement program of the subproject has been implemented effectively.

1.4 Due Diligence Report on LA&R for Yanshan University Subproject

Yanshan University Medical Care Training Center Subproject is one of the ADB-financed Hebei Elderly Care Development Project. The project is mainly to construct one training center that covers a total area of 4.7 mu and the proposed site for construction is located in the west campus of Yanshan University, where the land is used for education. The compensation for land acquisition has been completed in 2004 and the certificate for the use of state-owned land has been obtained in 2007. The site is presently unoccupied, which can be directly reported to the planning agencies and then put into construction conditions after the approval.

As of the current date, the compensation work for land acquisition of the project has been completed and all compensation fees have been paid off. The certificate for the use of state-owned land has already been obtained. The land acquisition of Yanshan University West Campus followed relevant Chinese laws and regulations and compensation activities for land requisition and resettlement has been carried out in accordance with the laws and regulations. The land acquisition procedure, compensation standards, and resettlement plans were all in line with national laws and regulations. There is no complaint from affected persons about compensation and payment in the process of implementation.

After the land acquisition, the affected village also encountered other processes of demolition from certain projects, which are to satisfy the needs of urban development. As the government implements measures such as compensation for land acquisition, pension insurance for landless farmers, job training, etc., the income of resettled residents are not affected but increases year-over-year.

2 IMPACTS OF THE PROJECT

In the project, there are four subprojects, ones in Li County, She County, Xinji City, and Shuangluan District, have prepared the resettlement plan. Based on those four resettlement plans, the project will acquire land with a total area of 168.75 mu, which comprises 32.37 mu of farmland and impacts 4 communities (villages), 2 enterprises, 91 households, and 310 persons. The total expenses for resettlement are CNY2.846 million. See Table 2-1 for details. 9 3 LEGAL FRAMEWORK AND POLICIES

The resettlement policy of this project is mainly based on the relevant laws and policies of ADB and the People’s Republic of China. The goal of resettlement is to ensure that the income level and living standards of the affected people are not reduced and even may be improved. Chinese laws and regulations comprise the Land Administration Law of the PRC (2004), the Decision of the State Council on Deepening the Reform and Rigidly Enforcing Land Administration (SC [2004] No.28), Guidelines on Improving Compensation and Resettlement Systems for Land Acquisition (MLR [2004] No.238), and Some Opinions of the State Council on Accelerating the Development of the Elderly Care Industry (SC [2013] No.35). Besides, Shuangluan District, Li County, Xinji City, Julu County, and She County have published related laws and regulations, which served as principal guidelines for the construction of subprojects. All affected persons will receive resettlement compensation and necessary assistance, which will be announced to them in a timely manner. Through the full communication with the project implementation agencies, local governments, and affected people, and in conjunction with local realities, the principles and rights matrix of immigration has been established.

The goal of land acquisition and resettlement is to ensure living standards of affected persons are improved and are not reduced by project implementation. The compensation principles and interests of affected persons are as follows: (1) Ensure that the affected persons’ rights and compensation are sufficient to restore their living standard to the level before the implementation and there is also room for improvement; (2) The compensation and provided benefits are priced based on market value or replacement value and must be sufficient; (3) Temporarily occupied land and the time for occupation should be minimized as much as possible; (4) Those occupied land and buildings or attachments will not be available for compensation if they were affected after the deadline set by the local government (5) Sufficient compensation shall be paid to the affected

10 personnel in time; (6) All affected persons shall be informed of the compensation rate and standards, livelihood and income recovery plan and project progress time; (7) Close monitor and timely take action to ensure that any problems occurred can be resolved.

Table 3-1 summarized the policies implemented. Hebei Runqinyuan Elderly Care Industry Development Co., Ltd., has paid in total CNY3,005 thousand as acquisition fee to She County Land and Resources Bureau, who is scheduling the disbursement of the compensation to affected households.

11 4 RESETTLEMENT IMPLEMENTATION PROGRESS

As of 31 December 2018, the resettlement progress of each subproject are as below:

The Yanshan University subproject is located on the west campus of Yanshan University, where the land is used for education. The compensation for land acquisition has been completed in 2004 and the certificate for the use of state-owned land has been obtained in 2007. DDR has been prepared in the preliminary stage.

The Julu County subproject has obtained the certificate for the use of state- owned land in 2018. DDR has been prepared in the preliminary stage.

The Shuangluan subproject has completed the land inventorying and acquisition process. As of 31 December 2018, the land transfer agreement is still under negotiating.

The area of acquired land in Li County has reduced to 60 mu from 75 mu as original since a pit on the site was excluded from the calculation of total area. The compensation has been paid and affected villagers have received the compensation fee. The Beiguan Wangtao Novel Material Factory has been appraised and has been compensated based on the appraisal value. All compensations have followed the standard rate set by the resettlement plan.

Hebei Runqinyuan Elderly Care Industry Development Co., Ltd., has signed the confirmation for the transaction of land transfer with the land auction company. The land transfer process is currently in progress.

Land use permission of Xinji subproject was approved by Li county in the 2nd and the 3rd batch of construction land in 2018. Compensation for land acquisition and house demolition has been paid

The land acquisition procedures for this project are as follows:

(1) Pre-announcement of land acquisition;

(2) Surveys of Land acquisition and land attachment;

(3) Prepare an announcement of the land acquisition plan and report it to the government for approval, and notify the land acquisition schedule in the village;

(4) Conduct a socioeconomic survey of land acquisition;

(5) Implement the compensation and resettlement plan for land acquisition, pay compensation; implement the housing compensation and resettlement plan;

(6) Clean up the attachments on the ground and deliver the land to the construction unit.

As of 31 December 2018, 129.75 mu of land has been acquired by the project, 77% completed. The demolition of houses is 1277.65 square meters, 107% completed. The construction of daycare centers has not yet been launched. See Table 6-1 for details.

5 ORGANIZATION AND ADMINISTRATION

To ensure the successful implementation of the project, the People's Government of Hebei Province set up the project management office (PMO) within the Provincial Department of Finance, which is responsible for the leadership and coordination of project implementation. Six counties (cities/universities) have also established their own project management offices to take responsibility for the leadership and coordination of the implementation of each subproject. The organization chart of the resettlement implementation organization of this project is shown in Figure 5-1.

6 FORMALITIES OF LAND USE

The Li County subproject was approved in the first batch of urban and rural construction land of Li County on 2 June 2018.

The preliminary opinion on the land use for the She County subproject has been obtained from She County Land and Resources Bureau on 10 December 2016. And the one book with four programs is still in progress.

The land for the Xinji City subproject was approved and listed in the second batch on 29 October 2017, and the third batch on 17 December 2017, of urban and rural construction land of Xinji City. Land compensation fees and house demolition fees have been paid.

The land for the Shuangluan subproject was approved and listed in the seventh batch of urban and rural construction land of Chengde City.

16 7 ALLOCATION AND UTILIZATION OF COMPENSATION

As of 31 December 2018, the total amount of paid compensation for resettlement has reached CNY2,138.953 thousand, all of which have been paid to affected parties. The payment of each item in the project is shown in Table 8-1. The cost of land acquisition and resettlement can meet the needs of project construction. The owner of She County subproject has paid the land transfer fee to the county land bureau and is preparing to distribute it to affected households.

Chengde Haoren Elderly Care Industry Co., Ltd., Hebei Runqinyuan Elderly Care Industry Development Co., Ltd., Li County Veterans Home, and Xinji Juyou Leyuan Elderly Care Services Co., Ltd have separately signed the external M&E agreement with Shanghai Yiji Construction Consultants Co., Ltd. (the Company), which clearly stated that the Company will conduct 3 external monitoring. As of 31 December 2018, all external monitoring surveys have been completed by Shanghai Yiji Construction Consultants Co., Ltd.

19 9 CONCLUSIONS AND SUGGESTIONS A. Conclusions

(1) The land acquisition and house demolition of the project are progressing smoothly, which can satisfy the needs for construction.

(2) In She County, land compensation has not been paid to the AHs, for other subprojects, compensations have been paid in accordance with the criteria set up by the resettlement plan. Affected persons are satisfied with the compensation.

(3) The level of income of the affected people has not been negatively affected. They all accepted the compensation and will keep working to acquire a stable income.

(4) Implementation agencies of each subproject paid attention to the procedures of formalities handling for land acquisition.

(5) The organization, arrangement, and results of physical surveys on land and houses to be required have been approved by affected villagers and can be used as the basis for the compensation for land acquisition and house demolition. Affected villagers are satisfied with the surveying process.

(6) Village cadres and affected villagers jointly surveyed the land and houses to be acquired by each subproject. They have signed their name on the surveying results. The face-to-face interview showed that the affected persons were willing to take responsibility for surveying results.

(7) Persons engaged in the process of land acquisition and house relocation of this project have certain relevant experience.

(8) Public participation has been highly emphasized and the channel for appeal is smooth.
