Beard' ABSTRACT This article explores a developing technology-the creation of digi- tal replicas of individuals, both living and dead, as well as the creation of totally imaginary humans. The article examines the various laws, includ- ing copyright, sui generis, right of publicity and trademark, that may be employed to prevent the creation, duplication and exploitation of digital replicas of individuals as well as to prevent unauthorized alteration of ex- isting images of a person. With respect to totally imaginary digital hu- mans, the article addresses the issue of whether such virtual humans should be treated like real humans or simply as highly sophisticated forms of animated cartoon characters. The Familiar Uncommon Spectator: Jack London's Female Watchers In The Game and the Abysmal Brute Scott Emmert In recent decades, Jack London's significant contributions to American literature have gained an increasing amount of critical recognition. Among these acknowledged contributions is his status as the first "serious" writer of sports fiction in America. Biographer James Lundquist, for example, notes that London "was one ofthe first writers to take sports seriously as the raw material for novels and stories" (179), and critic Michael Oriard goes further, identify ing London the "father of American sports fiction" meant for adult readers (Dreaming 9). Specifically, London's accomplishments as a writer ofsports lit erature rest mainly on his boxing fiction. 1 As one biography puts it, "London virtually invented the modern prizefight story" (Labor and Reesman 157 n.7), this invention being represented by the short stories "A Piece ofSteak (1909) and "The Mexican" (1910) and by the short novels The Game (1905) and The Abysmal Brute (1913). Always mindful of his audience and of his sales, how ever, London crafted this inventive prizefight fiction so as not to offend his readers with the brutality ofboxing, a sport so violent and decadent that it was deemed unfit as a subject of serious literature until London "gave it literary respectability" (Oriard, Dreaming 9). When describing what happens inside the square ring, London seeks a measure of respectability for boxing by tempering his descriptions ofviolent action with a compassionate depiction ofhumanity. London's naturalistic box ing fictions, in the way of most naturalist stories, seek to evoke the reader's sympathy for protagonists at the mercy of fo~ces beyond their control. -

İşçi sınıfının sermaye sınıfı karşısında takındığı tavır, örgütlenme; sendikalaşma ve grevleri yaratarak çeşitli toplumsal hareketlere neden olmuştur. Bu iki sınıfın yüz yıllar boyunca çatışmasına neden olan faktörler London’ın eserlerinde, kapitalist sistem eleştirisi temeline dayandırılarak anlatılmıştır. Murasaki Shikibu’s romantic novel, The Tale of Genji, provides a fascinating insight into the Japanese imperial court of the 10th and 11th centuries. As a noblewoman, Shikibu was ideally situated to write about court life and the loves and losses of the men and women in it. She lived and wrote at the height of Japan’s classical age and was, therefore, a witness to a flourishing of art and literature and to the rise of the samurai and the beginning of Japan’s feudal period. Shikibu’s original audience would have been other court ladies to whom she would have distributed each chapter as she finished it, and so while the novel definitely has a central and unifying plot, it also has an episodic or serial presentation. The novel consists of 54 chapters and covers the rise and fall of the eponymous hero and the adventures of his children. This novel, one of the first ever written, was well known in the west to those who were interested in Japanese culture and politics, but it was not widely available to English readers until over 800 years after it was written, when in 1882 a Japanese politician, The Viscount Suyematz Kenchio (Suematsu Kenchō), while studying law at Cambridge, translated the first 17 chapters of Genji into English.
