INTRODUCTION The 2016 presidential campaign defied the conventional wisdom in virtually every regard. Donald Trump’s surprise victory disproved the polls and embarrassed the pundits in the biggest election upset since the 1948 Truman-Dewey race.1 But the 2016 election was more than a political earthquake. The campaign also made it starkly apparent that federal campaign finance law has become woefully outdated in the age of the internet, social media, and non-stop fundraising. A vestige of the post- Watergate reforms of the 1970s, the Federal Election Campaign Act (“FECA”) no longer adequately regulates the campaign finance world of twenty-first century American politics. The time has come for a sweeping reform and restructuring of the law. Since FECA’s adoption in the 1970s, federal campaign finance law has been built on four pillars. The first is contribution limits on donations to candidate campaigns and political party committees. Contribution limits are designed to reduce the role of money in politics by preventing large donors from corrupting elected officials. The second is the ban on foreign contributions to American political campaigns. The prohibition is intended to prevent foreign influence on American elections and to ensure that * Professor of Law, Drake University Law School; J.D. YALE LAW & POLICY REVIEW Law as Source: How the Legal System Facilitates Investigative Journalism Roy Shapir Legal scholarshave long recognized that the media plays a key role in assuring the proper functioning of political and business markets Yet we have understudied the role of law in assuring effective media scrutiny. This Article develops a theory of law as source. The basicpremise is that the law not only regulates what the media can or cannot say, but also facilitates media scrutiny by producing information. Specifically, law enforcement actions, such as litigationor regulatory investigations, extract information on the behaviorofpowerfulplayers in business or government. Journalists can then translate the information into biting investigative reports and diffuse them widely, thereby shapingplayers' reputationsand norms. Levels of accountabilityin society are therefore not simply a function of the effectiveness of the courts as a watchdog or the media as a watchdog but rather a function of the interactions between the two watchdogs. This Article approaches, from multiple angles, the questions of how and how much the media relies on legal sources. I analyze the content of projects that won investigative reportingprizes in the past two decades; interview forty veteran reporters; scour a reporters-onlydatabase of tip sheets and how-to manuals; go over * IDC Law School. Investigative Reporting Eric Lipton is an investigative reporter in the Washington bureau of The New York Times, where he writes about lobbying, ethics and corporate agendas. He joined the Washington bureau in 2004, initially to cover terrorism and homeland security. From 1999 until 2001, Mr. Lipton was a reporter for the Metro section of The Times covering City Hall and Mayor Rudolph W. Giuliani. In September 2001, he was assigned to write exclusively about the attack on the World Trade Center, a topic he covered for two years; he ultimately co-wrote a book on the topic, “City in the Sky: The Rise and Fall of the World Trade Center” (Times Books, 2003). In 2002, a package of articles Mr. Lipton wrote with James Glanz and other science reporters at The Times about ground zero was a finalist for the Pulitzer Prize in explanatory journalism. Before joining The Times, Mr. Lipton spent five years at The Washington Post as a Metro reporter. From 1989 until 1994, Mr. Lipton worked at The Hartford Courant. While at The Courant, he and a colleague won the 1992 Pulitzer Prize for explanatory journalism for their stories about the flaw in the main mirror of the Hubble Space Telescope. Mr. Lipton started his daily newspaper career in 1987 at a small New Hampshire paper, The Valley News. -

With a few exceptions, CREW has focused primarily on the ethics of federal government officials. In 2006, however, CREW launched the state-based Colorado Ethics Watch (CEW), which concentrates on public integrity at the state level. In 2009, CREW turned greater attention to state government ethics by publishing its Directory of State-based Government Watchdogs, which covers all 50 states and the District of Columbia. CREW’s Worst Governors delves further into state ethics. CREW reviewed the job performance of all 50 of our nation’s governors to determine which are the worst. CREW considered whether governors had violated ethics, campaign finance and personal financial disclosure rules as well as whether they had complied with state transparency laws. It is nearly impossible to compare governors’ adherence to the laws because state rules and laws vary so widely. Each state has its own ethical rules and standards. Requirements regarding disclosure of campaign contributions and expenditures and personal finances differ significantly as do state open records laws. -
