Main Issue: The appeal was allowed and the planning permission was varied by deleting condition no. 5, which required the rooflights in the side (north-east) elevation and the bathroom rear elevation to be fitted with Code level 3 or above obscure glass. The Inspector found that obscure glazing in the bathroom need not be a pre-requisite to protect the reasonable privacy of neighbours. The rooflights were at least 1.7m above internal floor level. There was no justification here for a practical need for obscure glazing, no overlooking or perception of overlooking. The condition was not necessary or reasonable and its deletion accords with Circular 11/95.
