2012 -- S 2178 SUBSTITUTE A AS AMENDED ======= LC00810/SUB A ======= STATE OF RHODE ISLAND IN GENERAL ASSEMBLY JANUARY SESSION, A.D. 2012 ____________ A N A C T RELATING TO REDISTRICTING OF THE GENERAL ASSEMBLY Introduced By: Senators McCaffrey, Bates, Lanzi, Pichardo, and Goodwin Date Introduced: January 19, 2012 Referred To: Senate Judiciary It is enacted by the General Assembly as follows: 1 SECTION 1. Section 22-1-2 of the General Laws in Chapter 22-1 entitled "Composition 2 of Senate" is hereby amended to read as follows: 3 22-1-2. Districts. -- The state is hereby divided into thirty-eight (38) senatorial districts 4 bounded and described as follows: 5 (1) It is understood and intended that for the purpose of this section a line described as 6 running on, along, to or through any street (including road, avenue, lane, way, parkway, 7 expressway, divided highway, state route or interstate route, or trail), stream or river, is intended 8 to mean the center line of that street, stream or river, and a line described as the shoreline is 9 intended to mean the line along the mean low water level, and a feature extension is intended to 10 mean the imaginary straight-line extension from the end of a map feature, usually a street or road, 11 to another feature, as for example, from the end of a dead-end street to a nearby river, in all 12 instances, unless it shall be otherwise specified. 13 (2) It is further understood and intended that for the purpose of this section, the districts 14 described in this section shall be composed of United States census geography (tracts and blocks), 15 as defined by the 2000 2010 version of the "TIGER" files from the United States Census Bureau, 16 whose boundaries correspond to the below metes and bounds set forth in this section and which 17 are hereby made a part of this chapter. A listing of which census blocks are contained within each 18 district shall be deemed to be incorporated by reference. 19 (3) (i) It is further understood and intended that for the purpose of this section, the 1 districts will be depicted on thirty-nine (39) maps, compiled by Election Data Services, Inc. for 2 each city and town, and hereinafter may be referred to as town maps. 3 (ii) The secretary of state shall keep a copy of each set of the foregoing maps and a copy 4 of the census tract and block listing available for inspection during ordinary business hours at his 5 or her office. The secretary of state shall furnish each city and town a copy of the town map 6 covering that particular city or town within ten (10) days from the passage of this act. 7 (iii) For purposes of this title, references to "tract" or "CT" shall mean "census tract", as 8 that demographic unit is established by the United States Bureau of the Census for the 2000 2010 9 census as described by maps and publications of the bureau. References to "block", "blocks", or 10 "block groups", "enumeration district", or "enumeration districts", refer to those demographic 11 units as established by the United States Census Bureau for the 2000 2010 census as described by 12 maps and publications of the bureau. 13 (iv) Any reference to a "city or town", "city or town boundaries", or "city or town limits" 14 shall refer to the boundaries or limits of the particular city or town as they existed on January 1, 15 2000 as defined by the 2010 version of the “TIGER” files from the United States Census Bureau . 16 (v) In the census tract and block listing, the first two (2) digits of a census description 17 shall refer to the state of Rhode Island (44), the next three (3) digits of a census description shall 18 refer to the county in which the district lies. Bristol county carries the code 001; Kent county 19 carries the code 003; Newport county carries the code 005; Providence county carries the code 20 007 and Washington county carries the code 009. The next six (6) digits refer to the census tract 21 within the county set forth in the description. The last four (4) digits refer to the census block 22 within the census tract. "TIGER" is an acronym for the computer readable geographic data base 23 that automates the mapping and related geographic activities required to support the United 24 States' Census Bureau's census and survey programs and stands for "Topologically Integrated 25 Geographic Encoding and Referencing." 26 (vi) If any census tract, block, block group, or enumeration district is omitted, listed 27 more than once, or is only partially provided for, it is intended that the districts be defined in such 28 a manner as to not omit any area of Rhode Island from a district and to comply with the standard 29 of Articles VII and VIII of the Rhode Island Constitution requiring that districts be reasonably 30 equal. In order to carry out the intent of the general assembly as expressed in this section the 31 secretary of state, shall if necessary, undertake measures to insure compliance with this section. 32 (vii) In the event of a discrepancy between the metes and bounds description, the 33 description of census tracts and blocks, and the maps which shall be on file with the secretary of 34 state, then the listing of census tracts and blocks shall take precedence and be controlling.     FINAL DETERMINATION OF THE U.S. ENVIRONMENTAL PROTECTION AGENCY'S ASSISTANT ADMINISTRATOR FOR WATER PURSUANT TO SECI'ION 404(c) OF THE CLEAN WATER ACT CONCERNING THE PROPOSED BIG RIVER WATER SUPPLY IMPOUNDMENT KENT COUNTY, RHODE ISLAND March 1, 1990 d section m(cj of the lean Water ~ct(33 U.S.C.Section IZSI et seq.) provider that, if the Administrator of the U.S. Environmental Protection Agency (EPA) determines, after notice and opportunity for public hearing, that unacceptable adverse effects on municipal water supplies, shellfish beds, fishery areas (including spawning and breeding areas), wildlife, or recreational areas will result from the discharge of dredged or £illmaterial, he may exercise his authority to withdraw or prohibit the specification, or deny, restrict or withdraw the use for spec~ficatian,of any defined area as a disposal site for dredged or fill material. The Section 404(c) regulations state that, before making such a determination, the Administrator must consult with the Chief of the Army Corps of Engineers (Corps), the property owner(,), and the applicant where there has been an application for a Section 404 permit. The procedures for - implementation of Section 404(c) are set forth in the Code of Federal Regulations, 40 CFR Part 231. EPA's regulations for implementing Section 404(c) establish procedures to be followed in exercising the Administrator's authority pursuant to that Section. Three major steps in the process are: 1) the Regional Administrator's proposed decision to withdraw, deny, restrict or prohibit the use of a site (Proposed Determination); 2) the Regional Administrator's recommendation to the Administrator towithdraw, deny, restrict or prohiit the use of a site (Recommended Determination); and 3) the Administrator's final decision to affirm, mod@, or rescind the Regional recommendation (Final Determination).

I I PREFACE The Rhode Island Historical Preservation Commission, established by the General Assembly in 1968, is charged with the reponsibi1ity of safeguarding Rhode Island’s cultural heritage. In order to provide an overview of the physical record of this heritage, the Commission has initiated a "broadbrush" or preliminary planning survey of the rural and suburban towns of the state. The purpose of this initial inventory is to identify and record properties ofhistoric and architectural significance in each town. Presently, archeological resources are treated through a separate survey effort being conducted by the Commission. The preliminary surveys are designed to provide a catalogue of non-renewable cultural resources needed for a variety of planning purposes at the local, state and national levels. They identify sites, districts and structures eligible for nomination to the National Register of Historic Places Wand they become the basis for establishing preservation planning priorities basedon problems and po.tentials.discovéred as part of the survey process. * The preliminary surveys are accomplished by driving all public rights-of-way in a given town and noting on large-scale United States Geological Survey maps or other maps that may he more appropriate each building or ite of particulEr architectural, visual, cultural or historic significance.
