Bombay High Court passed orders, to shift abused elephant to rescue center but concerned Authorities failed to perform their duties. OIPA - Indian People for Animals issued NOTICE under section 55 of the Wildlife Protection Act, 1972 to take immediate custody of animal, for prompt shifting after booking Vinay Kore, MLA along with all offenders, complaint lodged with Delhi Police by Naresh Kadian and Celina Jaitley with Mumbai Police for FIR against all offenders. NOTICE under section 55 of the Wildlife Protection Act, 1972 before the Chief Wildlife Warden of Maharashtra: Sunder’s shocking beatings have been caught on videotape, and veterinarians and elephant experts who examined him found him scarred, wounded and chained so tightly that he couldn’t lie down. The Jyotiba temple came into possession of Sunder in 2007, but after constant chaining and beatings came to light, Maharashtra Minister of Forests Dr Patangrao Kadam and the Project Elephant division of the Ministry of Environment and Forests issued orders for Sunder’s release to a sanctuary on 21 August 2012 and 9 November 2012, respectively. However, those orders were never carried out, and Sunder was then whisked away at the behest of the Member of Legislative Assembly Vinay Kore and hidden in an old poultry shed, where he remained chained. In December 2013, PETA India obtained new video footage showing that his mahout was violently beating him. Now, at long last, it looks like Sunder’s suffering could be over. The next step will be to transfer Sunder to the Wildlife Rescue and Rehabilitation Centre in Bangalore, after the High Court orders dated April 7, 2014. As per our information PETA India have sufficient evidences to book all offenders for the violation of the section 3 and 11 of the Prevention of Cruelty to Animals Act, 1960 read with the section 39 of the Wildlife Protection Act, 1972. It would be pertinent to mention here that Hon'ble supreme Court of India passed an order on dated May 7, 2014 upholding animal rights, Abhishek Kadyan and Miss Sukanya Kadyan of OIPA - Indian People for Animals in the opinion that: 1. The Chief Wildlife Warden of Maharashtra failed to perform his official duties, while dealing Sunder baby elephant matter, where as Vinay Kore, MLA along with all other co offenders needs to be booked under law of the land. 2. Animal Welfare Board of India along with the Animal Welfare Division (Ministry of Environment and Forest) also failed to handle the said matter. 3. Vinay Kore, MLA does not abide with his fundamental duties, as defined under article 51 A (g) of Indian Constitution, while handling Sunder baby elephant, besides it he has violated the relevant section of OATH, which he has taken being MLA. Hon'ble Speaker of Maharashtra Assembly is here by requested to look in to and disqualify the membership of Vinay Kore being an animal abuser, violator of OATH as well. 4. Director General of Maharashtra Police is here by requested to please direct concerned Police officers to book all offenders including Vinay Kore, MLA for the violation of said legislation's. 5. Naresh Kadyan placed this notice under section 55 of the Wildlife Protection Act, 1972 before the Chief Wildlife Warden of Maharashtra for strict legal action against all offenders including Vinay Kore, MLA and rescue Sunder immediately for further rehabilitation, it is expected that Wildlife officials have taken charge of Sunder after High Court verdict and now Sunder be in their custody. Complaint before Election Commission of India: Shri Vinay Vilasrao Kore elected as a Member of Maharashtra Legislative Assembly on Jan Surajya Shakti party ticket and symbol, being elected MLA. he has taken OATH, to strictly abide Indian Constitution but he has traded Sunder named male Elephant and donated to Jyotiba temple, where as trading and donating elephant is an offense under the Wildlife Protection Act, 1972 and this Sunder elephant was maltreated by all his custodians, PETA India collected proof and evidences, on the basis of these evidences many concerned Authorities passed orders to rescue and rehabilitated Sunder, where as Bombay High Court also passed orders and confirmed the animal abuse but local Police failed to book all animal abusers including said MLA, who failed to perform his fundamental duties, as defined under article 51 A (g) of Indian Constitution. At present Sunder in the unsafe custody of abusers and Wildlife officials are not taking the custody of abused Sunder, MLA moved SLP before the Supreme Court of India, which was dismissed, where as in Jallikattu matter, Supreme Court of India uphold animal rights, hence Vinay Kore disqualify as MLA, hence necessary directions may kindly be given to the Speaker for further legal action, our moto: Sunder elephant badly abused by their custodians, due to toothless animal welfare legislation's, which needs immediate replacement by ordinance. We demands book and arrest of all abusers, take immediate custody of Sunder for further prompt rehabilitation.
