The first will be a great and total eclipse, on Friday March 15th, at 9h. 28m. morning, but by reason of the moon's south latitude, her shadow will not touch any part of North America. The course of the general eclipse will be from southwest to north- east, from the Pacific Ocean a little west of Chili to the Arabian Gulf and southeastern part of the Mediterranean Sea. The termination of this grand and sublime phenomenon will probably be witnessed from the summit of some of those stupendous monuments of ancient industry and folly, the vast and lofty pyramids on the banks of the Nile in lower Egypt. The principal cities and places that will be to- tally shadowed in this eclipse, are Valparaiso, Mendoza, Cordova, Assumption, St. Salvador and Pernambuco, in South America, and Sierra Leone, Teemboo, Tombucto and Fezzan, in Africa. At each of these places the duration of total darkness will be from one to six minutes, and several of the planets and fixed stars will probably be visible. 2. The other will also be a grand and beautiful eclipse, on Satur- day, September 7th, at 5h. 35m. evening, but on account of the Mnon's low latitude, and happening so late in the afternoon, no part of it will be visible in North America. -

Why Federal Rule of Civil Procedure 4(B) Is Unconstitutional
SYMPOSIUM ARTICLE TWOMBLY IN CONTEXT: WHY FEDERAL RULE OF CIVIL PROCEDURE 4(B) IS UNCONSTITUTIONAL E. Donald Elliott Abstract Rule 4(b) of the Federal Rules of Civil Procedure delegates to private parties state authority to compel a person to appear and answer civil charges in court without any preliminary state review or screening for reasonableness. This is argued to be unconstitutional as a unreasonable seizure of the person, a deprivation of private property without due process, and a standardless delegation of state power to a private party with a financial interest. The history of the writ of summons is reviewed. From the Founding until 1938, federal courts reviewed the grounds proposed for suit prior to service of a summons ordering someone to come to court to answer charges. It is argued that unless courts routinely award full economic costs after the fact to make someone whole who has been sued wrongfully, they must satisfy themselves in advance that there is a reasonable basis for suit before ordering the persons sued to appear and answer. Rule 4(b) is argued to be unconstitutional as (1) a seizure of the person and property of the defendant without any attempt by the state to verify that it is reasonable to do so; (2) an unconstitutional deprivation of property without due process of law; (3) an unconstitutional delegation of state power to issue a court order to a private party with a financial interest, and (4) an unconstitutional repeal of a statute providing for judicial control over process without following constitutionally required procedures. -

Some Reflections on Judge Learned Hand*
SOME REFLECTIONS ON JUDGE LEARNED HAND* JEom N. FRANK I WAS ASKED, originally, to speak of Great Judges. I objected. What, I queried, does one mean by "great"? I remembered my dispute with Professor Thorne and Justice Frankfurter about Lord Coke, once Chief Justice of England. I said Coke was a nasty, narrow-minded, greedy, cruel, arrogant, insensitive man, a time-serving politician and a liar who, by his adulation of some crabbed medieval legal doctrines, had retarded English and American legal development for centuries.1 Thorne and Frankfurter replied that I proved their case, that the duration of his influence, no matter whether good or bad, made him a great judge. I think I lost that argument. But if that be the test, then we must put on our list of "greats" such men as Attila, Robespierre, and Hitler, although most of us consider them evil. And so too as to the great among legal thinkers, lawyers, and judges. Consider Tribonian who contributed importantly to the Justinian codification of Roman law which mightily affected the legal systems of the western world. Who was Tribonian? A brilliant scholar but a corrupt judge. I concede, indeed I insist, that great men, good or evil, have often helped to shape history. Carlyle's theory of history-that all history results from the deeds or thoughts of great men-is nonsense, of course. But I think equally nonsensical what I call the No-Man Theory of history, according to which men are but puppets of "social forces," or economics, or geography, or the "spirit of the times"-in short, non-human or un-individual factors which wholly account, deterministically, for all human events. -

PHILOSOPHICAL ISSUES IN CONTEMPORARY LAW* F. S. C. Northrop PHILOSOPHY is the name for the basic methodological and theoretical assump- tions of a subject. Since every science uses some method of investigation and any scientist who reports facts to his colleagues must express these facts in words and, hence, introduce concepts and theory, it follows that any science whatever is also a philosophy. When no facts arise, however, to bring the traditional theory or methods of a subject into question, its problems are not philosophical. Then to be a scientist one need not also be a philosopher. Mathematics and physics were in such a state during the two hundred years following the publication of Newton's Principia in 1686. American law thought it was in a similar condition when, following Langdell, it introduced the case method and identified its science with the empirical study of cases. But whenever facts arise in any subject which bring its traditional theory or methods into question, at that moment its problems become philosophical. -

FRANK Hidden in musty obscurity behind the forbidding covers of three hundred and more volumes of court reports, the Justices of the United States Supreme Court seldom emerge into public view. Deaths and retirements, new appointments, and occasional opinions attract fleeting attention; all else is unnoticed. But to the political scientist, to the historian, and, above all, to the lawyer, the Supreme Court is an object of vital concern. To the political scientist, the Court matters because it is the chief juggler in maintaining the Balance of Powers. To the historian, the Court matters because of its tre- mendous influence on the policies of federal and state governments. -

Chief Justice John Appleton (1804-1891) DAVID M . GOLD CHIEF JUSTICE JOHN APPLETON At a banquet celebrating the seventy-fifth anniversary of the Maine Historical Society, one of the speakers, George F. Talbot, expressed his desire someday to see biographies of two of Maine’s most eminent public figures, William Pitt Fessenden and John Appleton.1 The fame of Fessenden, Civil War senator and secretary of the treasury under Lincoln, has been revived in recent years because of his key role in Reconstruction politics. Appleton, however, remains relatively unknown; the only substantial essay on him is now more than seventy years old.2 An ardent legal reformer, Appleton served with distinction for thirty-one years on the Supreme Judicial Court of Maine, published many articles in leading law journals attacking anachronistic and unjust rules of evidence, and gained renown for his successful struggle to make the accused in a criminal case competent to testify in his own behalf.
