Appendix B (Anglo-Saxon Gilds) could not be dispensed with, inasmuch as many writers confuse Anglo-Saxon gilds with the Gild Merchant. The Scotch Gild Merchant and the Continental Gild Merchant (App. D and F) require separate treatment, because their development was different from that of the corresponding English institution, although most writers fail to notice this distinction. INTRODUCTION Prior articles have asserted that English criminal law is very fragmented and that a considerable amount of the older law - especially the common law - is badly out of date.1 The purpose of this article is to consider the crime of public nuisance (also called common nuisance), a common law crime. The word 'nuisance' derives from the old french 'nuisance' or 'nusance' 2 and the latin, nocumentum.3 The basic meaning of the word is that of 'annoyance';4 In medieval English, the word 'common' comes from the word 'commune' which, itself, derives from the latin 'communa' - being a commonality, a group of people, a corporation.5 In 1191, the City of London (the 'City') became a commune. Thereafter, it is usual to find references with that term - such as common carrier, common highway, common council, common scold, common prostitute etc;6 The reference to 'common' designated things available to the general public as opposed to the individual. For example, the common carrier, common farrier and common innkeeper exercised a public employment and not just a private one. -

Just over a hundred years ago Mr. Serjeant Mere- wether and Mr. Stephens had The History of the Boroughs Municipal Corporations of the United Kingdom, in three volumes, ready to celebrate the sweeping away of the medieval system by the Municipal Corporation Act of 1835. It was hardly to be expected, however, that this feat of bookmaking, good as it was for its time, would prove definitive. It may seem more surprising that the centenary of that great change finds the gap still unfilled. For half a century Merewether and Stephens' work, sharing, as it did, the current exaggera- tion of early "democracy" in England, stood in the way. Such revision as was attempted followed a false trail and it was not until, in the last decade or so of the century, the researches of Gross, Maitland, Mary Bateson and others threw a fiood of new light upon early urban development in this country, that a fair prospect of a more adequate history of the English borough came in sight. Unfortunately, these hopes were indefinitely deferred by the early death of nearly all the leaders in these investigations. -

Party Representation in English and Welsh Constituencies, 1690-1740 Dan Bogart Department of Economics, UC Irvine, [email protected] And Robert Oandasan Compass Lexecon, [email protected] This Draft June 2013 Abstract The Whig and Tory parties played an important role in British politics in the decades following the Glorious Revolution. Scholars have used The History of Parliament series as a key source for data on political parties, yet most editions omit tabular data on the party affiliation of individual MPs. In this paper, we introduce newly created data on the political affiliation of all MPs serving in England and Wales between 1690 and 1740. We then measure the strength of Whig Party representation across English and Welsh constituencies and for the first time present maps of party representation. The Whigs are shown to be more strongly represented in municipal boroughs compared to counties and they were stronger in small and oligarchical boroughs compared to large and more democratic boroughs. We also find that the Whigs were stronger in southeastern boroughs and counties. The patterns are broadly similar during the Rage of Party (1690 to 1721) and the Walpole Era (1722 to 1740). The main difference is that the Whigs lost strength in the North during the Walpole Era and they were weaker in constituencies with contested elections under Walpole. How Merchant Towns Shaped Parliaments: From the Norman Conquest of England to the Great Reform Act∗ Charles Angelucci Simone Meraglia Nico Voigtländer (Columbia) (Exeter) (UCLA, NBER, and CEPR) This version: 28 October 2018 Abstract After centuries of stagnation in the “Dark Ages,” the Commercial Revolution led to a boom in economic activity and urbanization across Western Europe. The surge in trade and commerce that began in the 11th century was followed by the emergence of self-governing merchant towns. Soon after, these merchant towns gained representation in regional and national parliaments. This paper establishes the mechanism by which trade led to parliamentary representation, via municipal auton- omy. We focus on England after the Norman Conquest of 1066 and build a novel comprehensive dataset of 554 Medieval towns (boroughs), tracking their institutional development over eight cen- turies. We document a two-step process: First, inefficiencies in the king’s centralized system of tax collection became increasingly distortive to trading towns. In a mutually beneficial solution, mer- chant towns paid higher annual taxes in exchange for Farm Grants – the right of self-governed tax collection, cutting out royal officials. Second, Farm Grants were stepping stones towards represen- tation in the English Parliament: To raise extra-ordinary taxes (e.g., for wars) from self-governed towns, the king had to negotiate with them – and negotiations took place in Parliament. We also show that Medieval self-governance had important long-term consequences and interacted with nationwide institutional changes. Boroughs with Medieval Farm Grants continued to have broader voting rights in the 17th to 19th centuries, they raised troops to back Parliament against the king during the Civil War in 1642, and they supported the Great Reform Act of 1832 that extended the franchise. -

W. Maitland. The first sketch of this essay took the form of six public lectures delivered in London in Lent Term 1913, which were expanded into fifteen lectures given on the Goldwin Smith foundation at Cornell University and else- where in the United States in the following spring. The manuscript was completed, save for some notes and refer- ences, in August 1915, when the increasing tension of the war put a stop to remoter studies. During these seventeen years the history of the English parliament has attracted the labour of several learned historians, and particular acknowledgement is due to Pro- fessor C. H. McIlwain's High Court of Parliament, which, coming into my hands at the end of 1912, confirmed the trend of my investigations and supplied me with fresh ideas and illustrations. Another American book, Professor Bald- win's King's Council in the Middle Ages, published in 1914, threw valuable light on a collateral subject. Volume 2 of 2 Mark Pack submitted for the degree of DPhil York University History Department June1995 Appendix 1: Borough classifications ' There are several existing classifications of boroughs by franchise type. I have preferred to construct my own as there are clear problems with the existing classifications, such as inconsistencies and some errors (e.g. see Malton below). In this context, it is more satisfying to delve into the issue, rather than simply pick one of the existing classifications off the shelf. This is particularly so given the existence of a much under-used source of evidence: post-1832 electoral registers (or sources that contain information about them). Under certain conditions pre-1832 franchises were allowed to continue after 1832. As electoral registers listed what qualifications people had registered under, post-1832 registers can reveal the pre-1832 franchise. That at least is the theory; there are some complicating factors. First, the description in an electoral register may be less than a complete description of the pre-1832 franchise. For example, if a register says "freemen" one does not know if there had been additional requirements, such as having to be resident. Second, not all pre-1832 constituencies survived, and so there are no electoral registers for these. Third, compilers of electoral registers may have got the pre-1832 franchise wrong. This is unlikely as when the first registers were being drawn up in the 1830s there was a wealth of local and verbal knowledge to consult. -

The impact of these is addressed through an examination of the national system of parliamentary representation applying from 1832 and then 1868. This reveals the importance to achieving a Commons majority, particularly for the Conservative party, of winning a majority of seats in small English boroughs. Winchester is shown to be representative of these boroughs. ‘Winchester Man’ is advanced as the archetypal elector of this era. His environment and nature are then addressed. He is found to have a relatively short life as an elector. This is found to correspond with the peak of his socio-economic standing during his lifecycle. Increased mobility of the population and ‘Winchester Man’s’ short ‘elector life’ are shown to add to uncertainty amongst party officials as to his political loyalty. This challenges the somewhat deterministic views of earlier writers on the subject who see the revision courts as absolutely deciding the outcome of future contests. The increasing incidence of contested elections is claimed to arise from this level of uncertainty.
