Provided however, should the property fail to be used by the Grantee for public purposes, title shall revert to the State of Illinois; (d) take steps to preserve, landscape, memorialize and protect unmarked historic cemetery grounds located by archeological survey on the grounds of Chicago Read Mental Health Center. This subsection shall also allow the relocation of the remains pursuant to regulations and procedures established by the Historic Preservation Agency when deemed necessary by the Director of

Central Management Services. For the purpose of the relocation of such remains, the Secretary of Human Services is designated next of kin when it is not possible to definitively establish the identity of any such remains; (e) (the General Assembly finds and declares that the authorization under this subsection (e) as originally enacted by Public Act 91-824 was never acted upon; and, therefore, the provisions of that originally enacted subsection (e) are rescinded by this amendatory Act of the 95th General Assembly) in order to facilitate the conveyances referenced in subsections (a) and (b) after consultation with the Secretary of Transportation, the Secretary of Human Services, and the Director of Commerce and Community Affairs and upon obtaining necessary appraisals, surveys, and environmental reports, and in accordance with and in coordination with any pre-existing redevelopment agreement, convey title by quit claim deed to Chicago Read Joint Venture, Limited Partnership to surplus property located within the area bordered by Harlem Avenue, West Irving Park Road, North Narragansett Avenue, West Montrose Avenue, and Forest Preserve Drive, Chicago, Illinois, but excluding the area comprised of the property of the former Henry Horner School and the property referred to as the "Phase Three Property" under the Chicago Read-Dunning Redevelopment Agreement, at fair market value and on such terms and conditions necessary to bring about the orderly redevelopment of such surplus property, provided however that "surplus property" as described in this Section shall not include buildings and grounds currently under the jurisdiction of the Department of Human Services unless specifically consented to by the Secretary of Human Services; and (f) accept replacement State facilities constructed in order to relocate State operations located in facilities to be replaced or otherwise transferred to coordinate with necessary

The Director of Central Management Services shall obtain a certified copy of this Act within 60 days after its effective date, and shall record the certified document in the Recorder's Office in the county in which the land is located. (ii) At the time of the sale of the bonds, the school board determines, by resolution, that (A) the building and equipping of a new school building and additions to existing school buildings are required as a result of a projected increase in the enrollment of students in the district and (B) the altering, repairing, and equipping of existing school buildings are required because of the age of the existing school buildings. (iii) The bonds are issued, in one or more bond issuances, on or before December 31, 2012; however, the aggregate principal amount issued in all such bond issuances combined must not exceed $30,000,000. (iv) The bonds are issued in accordance with this Article. (v) The proceeds of the bonds are used to accomplish only those projects approved by the voters at an election held in 2008. The debt incurred on any bonds issued under this subsection (p-30) shall not be considered indebtedness for purposes of any statutory debt limitation.".

AMENDMENT NO. 3 . Amend House Bill 1969, AS AMENDED, in Section 5, Sec. 19-1, immediately below subsec. AMENDMENT NO. 1 . Amend House Bill 1960 by replacing everything after the enacting clause with the following: "Section 5. The Illinois Pension Code is amended by changing Section 14-104 and by adding Section 14-152.2 as follows: (40 ILCS 5/14-104) (from Ch. 108 1/2, par. 14-104) Sec. 14-104. Service for which contributions permitted. Contributions provided for in this Section shall cover the period of service granted. Except as otherwise provided in this Section, the contributions shall be based upon the employee's compensation and contribution rate in effect on the date he last became a member of the System; provided that for all employment prior to January 1, 1969 the contribution rate shall be that in effect for a noncovered employee on the date he last became a member of the System. Except as otherwise provided in this Section, contributions permitted under this Section shall include regular interest from the date an employee last became a member of the System to the date of payment. These contributions must be paid in full before retirement either in a lump sum or in installment payments in accordance with such rules as may be adopted by the board. (a) Any member may make contributions as required in this Section for any period of service, subsequent to the date of establishment, but prior to the date of membership. (b) Any employee who had been previously excluded from membership because of age at entry and subsequently became eligible may elect to make contributions as required in this Section for the period of service during which he was ineligible. (c) An employee of the Department of Insurance who, after January 1, 1944 but prior to becoming eligible for membership, received salary from funds of insurance companies in the process of rehabilitation, liquidation, conservation or dissolution, may elect to make contributions as required in this Section for such service. (d) Any employee who rendered service in a State office to which he was elected, or rendered service in the elective office of Clerk of the Appellate Court prior to the date he became a member, may make contributions for such service as required in this Section. Any member who served by appointment of the Governor under the Civil Administrative Code of Illinois and did not participate in this System may make contributions as required in this Section for such service. (e) Any person employed by the United States government or any instrumentality or agency thereof from January 1, 1942 through November 15, 1946 as the result of a transfer from State service by executive order of the President of the United States shall be entitled to prior service credit covering the period from January 1, 1942 through December 31, 1943 as provided for in this Article and to membership service credit for the period from January 1, 1944 through November 15, 1946 by making the contributions required in this Section. A person so employed on January 1, 1944 but whose employment began after January 1, 1942 may qualify for prior service and membership service credit under the same conditions. (f) An employee of the Department of Labor of the State of Illinois who performed services for and under the supervision of that Department prior to January 1, 1944 but who was compensated for those services directly by federal funds and not by a warrant of the Auditor of Public Accounts paid by the State Treasurer may establish credit for such employment by making the contributions required in this Section. An employee of the Department of Agriculture of the State of Illinois, who performed services for and under the supervision of that Department prior to June 1, 1963, but was compensated for those services directly by federal funds and not paid by a warrant of the Auditor of Public Accounts paid by the State Treasurer, and who did not contribute to any other public employee retirement system for such service, may establish credit for such employment by making the contributions required in this Section. 23 [May 17, 2007]

(g) Any employee who executed a waiver of membership within 60 days prior to January 1, 1944 may, at any time while in the service of a department, file with the board a rescission of such waiver. Upon making the contributions required by this Section, the member shall be granted the creditable service that would have been received if the waiver had not been executed. (h) Until May 1, 1990, an employee who was employed on a full-time basis by a regional planning commission for at least 5 continuous years may establish creditable service for such employment by making the contributions required under this Section, provided that any credits earned by the employee in the commission's retirement plan have been terminated. (i) Any person who rendered full time contractual services to the General Assembly as a member of a legislative staff may establish service credit for up to 8 years of such services by making the contributions required under this Section, provided that application therefor is made not later than July 1, 1991. (j) By paying the contributions otherwise required under this Section, plus an amount determined by the Board to be equal to the employer's normal cost of the benefit plus interest, but with all of the interest calculated from the date the employee last became a member of the System or November 19, 1991, whichever is later, to the date of payment, an employee may establish service credit for a period of up to 2 years spent in active military service for which he does not qualify for credit under Section 14-105, provided that (1) he was not dishonorably discharged from such military service, and (2) the amount of service credit established by a member under this subsection (j), when added to the amount of military service credit granted to the member under subsection (b) of Section 14-105, shall not exceed 5 years. The change in the manner of calculating interest under this subsection (j) made by this amendatory Act of the 92nd General Assembly applies to credit purchased by an employee on or after its effective date and does not entitle any person to a refund of contributions or interest already paid. (k) An employee who was employed on a full-time basis by the Illinois State's Attorneys Association Statewide Appellate Assistance Service LEAA-ILEC grant project prior to the time that project became the State's Attorneys Appellate Service Commission, now the Office of the State's Attorneys Appellate Prosecutor, an agency of State government, may establish creditable service for not more than 60 months service for such employment by making contributions required under this Section. (l) By paying the contributions otherwise required under this Section, plus an amount determined by the Board to be equal to the employer's normal cost of the benefit plus interest, a member may establish service credit for periods of less than one year spent on authorized leave of absence from service, provided that (1) the period of leave began on or after January 1, 1982 and (2) any credit established by the member for the period of leave in any other public employee retirement system has been terminated. A member may establish service credit under this subsection for more than one period of authorized leave, and in that case the total period of service credit established by the member under this subsection may exceed one year. In determining the contributions required for establishing service credit under this subsection, the interest shall be calculated from the beginning of the leave of absence to the date of payment. (m) Any person who rendered contractual services to a member of the General Assembly as a worker in the member's district office may establish creditable service for up to 3 years of those contractual services by making the contributions required under this Section. The System shall determine a full-time salary equivalent for the purpose of calculating the required contribution. To establish credit under this subsection, the applicant must apply to the System by March 1, 1998. (n) Any person who rendered contractual services to a member of the General Assembly as a worker providing constituent services to persons in the member's district may establish creditable service for up to 8 years of those contractual services by making the contributions required under this Section. The System shall determine a full-time salary equivalent for the purpose of calculating the required contribution. To establish credit under this subsection, the applicant must apply to the System by March 1, 1998. (o) A member who participated in the Illinois Legislative Staff Internship Program may establish creditable service for up to one year of that participation by making the contribution required under this Section. The System shall determine a full-time salary equivalent for the purpose of calculating the required contribution. Credit may not be established under this subsection for any period for which service credit is established under any other provision of this Code. (p) By paying the contributions otherwise required under this Section, plus an amount determined by the Board to be equal to the employer's normal cost of the benefit plus interest, a member may establish service credit for a period of up to 8 years during which he or she was employed by the Visually Handicapped Managers of Illinois in a vending program operated under a contractual agreement with the Department of Rehabilitation Services or its successor agency. This subsection (p) applies without regard to whether the person was in service on or after the effective [May 17, 2007] 24 date of this amendatory Act of the 94th General Assembly. In the case of a person who is receiving a retirement annuity on that effective date, the increase, if any, shall begin to accrue on the first annuity payment date following receipt by the System of the contributions required under this subsection (p). (q) By paying the required contributions under this Section, plus an amount determined by the Board to be equal to the employer's normal cost of the benefit plus interest, an employee who was laid off but returned to State employment under circumstances in which the employee is considered to have been in continuous service for purposes of determining seniority may establish creditable service for the period of the layoff, provided that (1) the applicant applies for the creditable service under this subsection (q) within 6 months after the effective date of this amendatory Act of the 94th General Assembly, (2) the applicant does not receive credit for that period under any other provision of this Code, (3) at the time of the layoff, the applicant is not in an initial probationary status consistent with the rules of the Department of Central Management Services, and (4) the total amount of creditable service established by the applicant under this subsection (q) does not exceed 3 years. For service established under this subsection (q), the required employee contribution shall be based on the rate of compensation earned by the employee on the date of returning to employment after the layoff and the contribution rate then in effect, and the required interest shall be calculated from the date of returning to employment after the layoff to the date of payment. (r) A member who participated in the University of Illinois Government Public Service Internship Program (GPSI) may establish creditable service for up to 2 years of that participation by making the contribution required under this Section, plus an amount determined by the Board to be equal to the employer's normal cost of the benefit plus interest. The System shall determine a full-time salary equivalent for the purpose of calculating the required contribution. Credit may not be established under this subsection for any period for which service credit is established under any other provision of this Code. (Source: P.A. 94-612, eff. 8-18-05; 94-1111, eff. 2-27-07.) (40 ILCS 5/14-152.2 new) Sec. 14-152.2. New benefit increases. The General Assembly finds and declares that the amendment to Section 14-104 made by this amendatory Act of the 95th General Assembly that allows members to establish creditable service for certain participation in the University of Illinois Government Public Service Internship Program (GPSI) constitutes a new benefit increase within the meaning of Section 14-152.1. Funding for this new benefit increase will be provided by additional employee contributions under subsection (r) of Section 14-104. Section 99. Effective date. This Act takes effect upon becoming law.".

WHEREAS, The members of the Illinois General Assembly join together in honoring the memory of Donald E. Stephens, Mayor of the Village of Rosemont, who passed away on April 18, 2007; and WHEREAS, Donald Stephens was the first and only chief executive of Rosemont; he was serving his 13th term as mayor, believed to be the longest serving incumbent mayor in the country; under his 27 [May 17, 2007] leadership the Rosemont community became one of the most progressive and successful municipalities in the State of Illinois; and WHEREAS, Donald Stephens was elected president of the homeowner's association in the 1950s and began to see the potential in living close to O'Hare Airport; he was able to incorporate the village in 1956; and WHEREAS, He oversaw the building of one of the first Hyatt Regency hotels in his community; eventually 14 hotels would make Rosemont their home; he oversaw the creation of the O'Hare Exposition Center in 1975 (changed in 2000 to the Donald E. Stephens Convention and Conference Center), now one of the top ten centers in the country, the Rosemont Horizon in 1980 (now the ), home to the DePaul Blue Demons, the Chicago Wolves, and the Chicago Rush sports teams, as well as a venue for major music concerts and festivals, and the , a 4,000 seat venue that is home to the Chicagoland Pops Orchestra of Rosemont; and WHEREAS, At the time of his passing Mayor Stephens was creating Rosemont Walk, a $500 million entertainment district that will include a movie theatre megaplex, three new hotels, the biggest water park in the State, nationally famous restaurants, and many more businesses for the community; and WHEREAS, The passing of Mayor Donald Stephens will be deeply felt by those who knew and loved him, especially his wife, Katherine; his brother, Arthur; his son, Donald E. Stephens II, his son, Mark Stephens; his daughter, Gail Stephens; his son, Bradley Stephens; his grandchildren, Donald E. Stephens III, Christopher R. HOUSE BILL 2254. Having been read by title a second time on May 17, 2007, and held on the order of Second Reading, the same was again taken up. Representative Hannig offered the following amendment and moved its adoption.

AMENDMENT NO. 1 . Amend House Bill 2254 by replacing everything after the enacting clause with the following: "Section 5. The Illinois Procurement Code is amended by changing Section 30-30 as follows: (30 ILCS 500/30-30) Sec. 30-30. Contracts in excess of $250,000. For building construction contracts in excess of $250,000, separate specifications shall be prepared for all equipment, labor, and materials in connection with the following 5 subdivisions of the work to be performed: (1) plumbing; (2) heating, piping, refrigeration, and automatic temperature control systems, including the testing and balancing of those systems; (3) ventilating and distribution systems for conditioned air, including the testing and balancing of those systems; (4) electric wiring; and (5) general contract work. The specifications must be so drawn as to permit separate and independent bidding upon each of the 5 subdivisions of work. All contracts awarded for any part thereof shall award the 5 subdivisions of work separately to responsible and reliable persons, firms, or corporations engaged in these classes of work. The contracts, at the discretion of the construction agency, may be assigned to the successful bidder on the general contract work or to the successful bidder on the subdivision of work designated by the construction agency before the bidding as the prime subdivision of work, provided that all payments will be made directly to the contractors for the 5 subdivisions of work upon compliance with the conditions of the contract. A contract may be let for one or more buildings in any project to the same contractor. The specifications shall require, however, that unless the buildings are identical, a separate price shall be submitted for each building. The contract may be awarded to the lowest responsible bidder for each or all of the buildings included in the specifications. Until a date 3 years after the effective date of this amendatory Act of the 95th General Assembly, the requirements of this Section do not apply to a construction project for which the Capital Development Board is the construction agency if: (i) the project budget is at least $20,000,000; (ii) the Capital Development Board has submitted to the Procurement Policy Board a written request for a public hearing on waiver of the application of the requirements of this Section to that project, including its reasons for seeking the waiver and why the waiver is in the best interest of the State; (iii) the Capital Development Board has posted notice of the waiver hearing on its procurement web page and on the online Procurement Bulletin at least 15 working days before the hearing; (iv) the Procurement Policy Board, after conducting the public hearing on the waiver request, reviews and approves the request in writing before the award of the contract; (v) the successful low bidder has prequalified with the Capital Development Board; (vi) the bid of the successful low bidder identifies the name of the subcontractor, if any, and the bid proposal costs for each of the 5 subdivisions of work set forth in this Section; and (vii) the contract entered into with the successful bidder provides that no identified subcontractor may be terminated without the written consent of the Capital Development Board. With respect to any construction project described in this paragraph, the Capital Development Board shall: (i) provide to the Auditor General an affidavit that the waiver of the application of the requirements of this Section is in the best interest of the State; (ii) specify in writing as a public record that the project shall comply with the disadvantaged business practices of the Business Enterprise for Minorities, Females, and Persons with Disabilities Act and the equal employment practices of Section 2-105 of the Illinois Human Rights Act; and (iii) report annually to the Governor and the General Assembly on the bidding, award, and performance. On and after the effective date of this amendatory Act of the 95th General Assembly, the Capital Development Board may award in each year contracts with an aggregate total value of no more than $100,000,000 with respect to construction projects described in this paragraph. Until a date 2 years after the effective date of this amendatory Act of the 93rd General Assembly, the requirements of this Section do not apply to the construction of an Emergency Operations Center for the Illinois Emergency Management Agency if (i) the majority of the funding for the project is from federal funds, (ii) the bid of the successful bidder identifies the name of the subcontractor, if any, and the bid proposal costs for each of the 5 subdivisions of work set forth in this Section, and (iii) the contract entered [May 17, 2007] 32 into with the successful bidder provides that no identified subcontractor may be terminated without the written consent of the Capital Development Board. Until a date 5 years after the effective date of this amendatory Act of the 94th General Assembly, the requirements of this Section do not apply to the Capitol Building HVAC upgrade project if (i) the bid of the successful bidder identifies the name of the subcontractor, if any, and the bid proposal costs for each of the 5 subdivisions of work set forth in this Section, and (ii) the contract entered into with the successful bidder provides that no identified subcontractor may be terminated without the written consent of the Capital Development Board. WHEREAS, The personal prosperity of Illinois citizens and the economic security of our nation will require uniting our workforce development, education, and economic development strategies in a common effort to provide our citizens with higher skills and supply our businesses with qualified workers; and 49 [May 17, 2007]

WHEREAS, The economic security of Illinois citizens will enhance the quality and productivity of people and businesses and provide effective economic development strategies for the workforce needs of the future; and WHEREAS, The Illinois Local Workforce System and One-Stop Centers must be able to offer more programs and services to a wider customer base; and WHEREAS, The Illinois Workforce Development System must continue to recognize the value of local decision making, which is key to the success of the future workforce; and WHEREAS, The local workforce investment boards, which are comprised of a majority of business leaders and who have worked effectively in partnership with chief elected officials, should continue to be the cornerstone of the Workforce Development System; and WHEREAS, The One-Stop System must have sufficient resources to offer comprehensive services, universal access, and lifelong learning options for both business and individuals; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, That we recognize the importance of workforce development and designate the week of August 26, 2007, as "Workforce Development Week" in the State of Illinois to showcase the Illinois workforce system.

HOUSE RESOLUTION 426

Offered by Representative Feigenholtz:

WHEREAS, More than 100 million Americans suffer from persistent pain; and WHEREAS, Pain is the primary reason for persons to seek medical care; and WHEREAS, More than one-half of hospitalized patients experience moderate to severe pain in the last days of their lives; and WHEREAS, Inadequately managed pain diminishes a person's quality of life; and WHEREAS, Most pain can be relieved or greatly eased with existing therapies; and WHEREAS, Certain barriers exist that inhibit the effective management of pain, including fears about pain relieving medications, lack of knowledge among health care professionals on how to properly assess and treat pain, poor communication between patients and their health care providers, the low priority given to pain control in our health care system, and government policies which do not promote effective pain management; and WHEREAS, Illinois compared poorly to other states for its public policies that affect pain management according to a national study published in 2006 by the Pain & Policy Studies Group at the University of Wisconsin; and WHEREAS, Pain management should be recognized, supported and encouraged as part of general medical practice; and WHEREAS, All individuals with pain would benefit from having their pain thoroughly assessed and promptly treated; and WHEREAS, Appropriate application of pain management practices improves the quality of life for those who suffer from pain while reducing the morbidity and cost associated with untreated or inappropriately treated pain; and WHEREAS, Education of all healthcare practitioners is essential to improving care; and WHEREAS, Healthcare providers in many settings, such as acute, chronic, long-term and end of life, care daily for patients in pain and have the professional responsibility to promote improved patient care; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the Illinois Department of Public Health, the Illinois Department of Healthcare and Family Services, and the Illinois Department of Human Services are encouraged to address pain as a public health problem by making information available to consumers and health care providers through their respective web sites; and be it further RESOLVED, That the Illinois Department of Financial and Professional Regulation solicit from its various health related professional boards a joint resolution that recognizes the importance of effective pain management in the treatment and care of patients; and be it further RESOLVED, That the Illinois Department of Financial and Professional Regulation solicit from the Medical Licensing Board and the Medical Disciplinary Board their advice and counsel regarding the [May 17, 2007] 50 feasibility of adopting by rule standards of professional conduct in providing effective pain management treatment in the general practice of medicine and that the Department disseminate to Illinois physicians information regarding the rule once adopted; and be it further RESOLVED, That public and private sources are encouraged to promote better pain management education to both Illinois health care professionals and consumers; and be it further RESOLVED, That the Illinois General Assembly evaluate Illinois' public policies that have the potential to affect pain management and take the necessary steps to improve them; and be it further RESOLVED, That suitable copies of this resolution be delivered to the Governor, the Director of Public Health, the Director of Healthcare and Family Services, the Secretary of Human Services, and the Secretary of Financial and Professional Regulation.

HOUSE RESOLUTION 429

Offered by Representative Munson:

WHEREAS, Shelter Alliance is a national organization that offers domestic violence shelters and social service organizations cash for collecting old cell phones, creating an easy and essential fundraising tool for domestic violence programs; and WHEREAS, Organizations involved in domestic violence prevention and safety programs collect used cell phones and deliver them to Shelter Alliance, which pays between $0.50 and $30 per cell phone; and WHEREAS, Shelter Alliance has contributed over $2,500,000 to social service organizations nationwide; and WHEREAS, There are nearly 300,000,000 cell phone users in the United States and it is predicted that wireless users switch phones every 18 months on average; and WHEREAS, The State of Illinois has announced its intention to recycle electronic waste, including cell phones discarded by the government; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the State to recycle cell phones through a program that will benefit and raise funds for domestic violence prevention and victims; and be it further RESOLVED, That a suitable copy of this resolution be presented to Governor Blagojevich and the Director of Central Management Services.

HOUSE JOINT RESOLUTION 61

Offered by Representative Coulson:

WHEREAS, Patients are at greater risk of injury, including skin tears, falls, and musculoskeletal injuries, while being lifted, transferred, or repositioned manually; and WHEREAS, Safe patient handling can reduce skin tears suffered by patients by threefold and can significantly reduce other injuries to patients as well; and WHEREAS, Health care workers are reported to lead the nation in work-related musculoskeletal disorders; and WHEREAS, Between 38% and 50% of nurses and other health care workers will suffer a work-related back injury during their career; 42% of these workers will be unable to return to work in their pre-injury job; and WHEREAS, The use of proper body mechanics by health care workers does not eliminate the risk of injury; and WHEREAS, Assistive patient handling equipment and devices have essentially rendered the act of strict manual patient handling unnecessary as a function of nursing care; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIFTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that the Illinois House of Representatives and the shall convene an 11-member Safe Patient Handling Task Force; this task force shall study safe patient handling policies and create recommended policy guidelines for all health care facilities to eliminate the manual lifting of patients by direct-care registered nurses and other health care providers through the use of mechanical devices, except in life-threatening situations or in 51 [May 17, 2007] an emergency; the recommended policy guidelines shall provide protection for registered nurses and health care providers for refusal of assignment and a whistleblower provision; and be it further RESOLVED, That the Safe Patient Handling Task Force shall be comprised of the following members appointed by the Majority and Minority Leaders of the House of Representatives and the Senate: 2 members of the House of Representatives, 2 members of the Senate, one member of a statewide organization representing registered professional nurses, one direct care nurse currently practicing in a hospital, one direct care nurse currently practicing in a long-term care setting, one physician licensed to practice medicine in all its branches, one physical therapist, one member of a statewide organization representing hospitals, and one member of a statewide organization representing long-term care facilities; and be it further RESOLVED, That the Safe Patient Handling Task Force shall submit a report to the General Assembly detailing its recommendations and findings by January 1, 2008.
