1. The complainant gave a written report stating that the Government of lndia with an objective to make the States drought proof by better water conservation and ensure its optimum utilization by providing minimum employment to unskilled workers to create durable and sustainable assets in rural areas introduced Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS). The Government of Andhra Pradesh vide G.O.Ms.No.20 Planning (Vll) Department, dated 26.09.2014 and G.O Ms.No.70, (l & CAD) (WRG-GRC), Department, dated 04.12.2014 issued guidelines for implementation of conservation of Water Resources. The implementation of the scheme is entrusted to Water Resources Department (WRD) of Government of Andhra Pradesh.

2. The nature of works to be taken up under the MGNREGS are (a)) Excavation of peripheral trench along boundary of the tank in foreshore (b) Repairs to surplus weirs. (c) Repairs to sluices, and (d) Closing of breaches. 3. The District Collector, Vizianagaram accorded Administrative Sanction to Minor irrigation tanks works for about 1 16 in Ramabhadrapuram (M) at the cost of Rs.842.48 lakhs during the year 2015-16 under MGNREGS Programme in convergence with Water Resources Department vide Proceedings No.3279/15, dt.22.06.2015 in Vizianagaram District. The Executive Engineer, WRD, Paravathipuram accorded technical approval/sanction for the 100 works. 4. During the year 2016, several allegalions in respect of execution works of MGNREGS relating to Ramabhadrapuram Mandal of Vizianagaram District were rec€ived by the District Collector and other administrative authorities including criminal complaint in the court of law. The District Collector, Vizianagaram ordered enquiry into the matter and the Superintending Engineer, WRD Circle, Bobbili had conducted enquiry in Kotasirlam G.P. of Ramabhadrapuram (M) and submitted enquiry report substantiating the allegation. Basing on the enquiry report, the Distict Collector initiated disciplinary proceedings against the concerned. The then Executive Engineer Sri G.V. Ramana filed a criminal complaint before the jurisdictional court with allegations of misappropriation of iunds and forgery of his signatures in M.Books and bills relating to MGNREGS in Mamidivalsa, Naiduvalsa, Tarapuram & Kotasirlam Gram Panchayats and the Hon'ble court was pleased to order investigation U/Sec.'156 (3) of Cr.P.C. and the same is pending. 5. The above circumstances led the concerned department to request the Government of AP to entrust the case to Vigilance & Enforcement Department to probe into all the irregularities of MGNREGS works. ln turn, the Principal Secretary to the Government, WRD, Vijayawada had requested the Director General, V&E for detailed enquiry. Consequently the V&E department conducted enquiry into the irregularities and submitted detailed report by recommending disciplinary and criminal action against the persons involved in the matter. 6. The findings in the V&E department enquiry report revealed that the officials of WRD department, staff of MGNREGS including representatives of village Panchayats and others had all conspired together and committed several malalide acts during the execution of works under MGNREGS and criminally misappropriated the funds of MGNREGS. During the execution of these works, committed offences such as forgery of measurement books, recording of excess measurements and granting technical sanction certificates without approval of the concemed authorities with a view to receive illegal gratification by using various forms of modus operandi, conspiring with contractors, private persons and Sarpanches of villages in the process of execution of works, resulting in huge amount of wrongful loss to the State exchequer. 7. The V&E and departmental enquiries revealed the involvement of public servants together with private persons in criminal misappropriation of public funds and causing wrongful loss of huge amounts to the State exchequer to tune of Rs.246.69 lakhs . Prasad, the then Technical Officer (Presently Retired) and others. 8. ln the course of misappropriation of funds, the following persons had assisted the public servants to gain wrongfully and to ensure the accrual of undue advantage to the beneficiaries of ftaud (1) Sri M. Vasudeva Rao, A.E., (Rtd.), Srikakulam (2 )Sri S. Rambabu, S/o Chinna Rao (late), Kakinada, East Godavari District (3, Sri M. Hari Hara Rao, s/o Si Vasudeva Rao, Srikakulam (4) Si Podugu Srinivasa Rao, S/o Sri Janaradhana Rao, Amadalavalsa, Srikakulam District. The above said persons were unauthorisedly dealt with the execution of works and preparation of recording the measurements in M.Books and other records relating to MGNREGS and they also acted as benamidars for transferring amounts via illegal channels which resulted in criminal misappropriation of Government funds and the above said persons willfully abetted the offences committed by the public servants and also commifted fraud. 9. ln addition to the above, the following representatives of Grampanchayat i.e., Sarpanches and others had conspired together with the aforesaid officers and staff of the WRD/MGNREGS along with others to swallow the funds of the Government and they acted contrary to the rules and guidelines framed in this regard and misappropriated the funds of MGNREGS. They habitually influence the public servants with intent to gain wrongfully by illegal means and they had resorted to manipulations in execution of MGNREGS worfts and they ensured that the benefits of illegal transactions are transiened to the public servant and their benamidars by way of online transfers' cash payments and arso through unauthorized rerease of funds. consequenfly they gained undue advantage, which resulted in wrongful loss to the State exchequer and huge amount of Government funds were misappropriated. 10. The above mentioned public servants,vho were duty-bound to protect the interest of the State and safe guard the public funds , had deliberately, with intention to gain wrongfully, committed malafide acts such as execution of works without proper sanction from the concerned authorities, handing over the M.Books to unauthorized persons to make entries, making \rvrong entries in the records of the WRD department committing gross negligence in attending supervisory works and in maintaining records of the execution of works, forging the signatures of the competent authorities in the M.Books, recording excess measurements in the M.Books contrary to the work done on ground, payment of bills without recording measurements and manipulating NMRs, engaging/allowing unauihorized persons in dealing with execution of works, conspiring \ryith the private persons and Sarpanches to obtain i'egar gratification in the process execution of of works to deriver undue favour to the beneficiaries of the fraud. These acts of the aforesaid pubric servants are a crear indacation of their active invorvement in the process of misappropriation of funds with the hsrp of others and they are liable for prosecution on account of their criminal misconduct and other offences.
