The complainant gave a written report stating that the Government of lndia with an objective to make the States drought proof by better water conservation and ensure its optimum utilization by providing minimum employment to unskilled workers to create durable and sustainable assets in rural areas introduced Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS). The Government of Andhra Pradesh vide G.O.Ms.No.20 Planning (Vll) Department, dated 26.09.2014 and G.O Ms.No.70, (l & CAD) (WRG-GRC), Department, dated 04.12.2014 issued guidelines for implementation of conservation of Water Resources. The implementation of the scheme is entrusted to Water Resources Department (WRD) of Government of Andhra Pradesh. 2. The nature of works to be taken up under the MGNREGS are (a)) Excavation of peripheral trench along boundary of the tank in foreshore (b) Repairs to surplus weirs. (c) Repairs to sluices, and (d) Closing of breaches. 3. The District Collector, Vizianagaram accorded Administrative Sanction to Minor irrigation tanks works for about 1 16 in Ramabhadrapuram (M) at the cost of Rs.842.48 lakhs during the year 2015-16 under MGNREGS Programme in convergence with Water Resources Department vide Proceedings No.3279/15, dt.22.06.2015 in Vizianagaram District. The Executive Engineer, WRD, Paravathipuram accorded technical approval/sanction for the 100 works. 4. During the year 2016, several allegalions in respect of execution works of MGNREGS relating to Ramabhadrapuram Mandal of Vizianagaram District were rec€ived by the District Collector and other administrative authorities including criminal complaint in the court of law. The District Collector, Vizianagaram ordered enquiry into the matter and the Superintending Engineer, WRD Circle, Bobbili had conducted enquiry in Kotasirlam G.P. of Ramabhadrapuram (M) and submitted enquiry report substantiating the allegation. Basing on the enquiry report, the Distict Collector initiated disciplinary proceedings against the concerned. The then Executive Engineer Sri G.V. Ramana filed a criminal complaint before the jurisdictional court with allegations of misappropriation of iunds and forgery of his signatures in M.Books and bills relating to MGNREGS in Mamidivalsa, Naiduvalsa, Tarapuram & Kotasirlam Gram Panchayats and the Hon'ble court was pleased to order investigation U/Sec.'156 (3) of Cr.P.C. and the same is pending. 5. The above circumstances led the concerned department to request the Government of AP to entrust the case to Vigilance & Enforcement Department to probe into all the irregularities of MGNREGS works. ln turn, the Principal Secretary to the Government, WRD, Vijayawada had requested the Director General, V&E for detailed enquiry. Consequently the V&E department conducted enquiry into the irregularities and submitted detailed report by recommending disciplinary and criminal action against the persons involved in the matter. 6. The findings in the V&E department enquiry report revealed that the officials of WRD department, staff of MGNREGS including representatives of village Panchayats and others had all conspired together and committed several malalide acts during the execution of works under MGNREGS and criminally misappropriated the funds of MGNREGS. During the execution of these works, committed offences such as forgery of measurement books, recording of excess measurements and granting technical sanction certificates without approval of the concemed authorities with a view to receive illegal gratification by using various forms of modus operandi, conspiring with contractors, private persons and Sarpanches of villages in the process of execution of works, resulting in huge amount of wrongful loss to the State exchequer. 7. The V&E and departmental enquiries revealed the involvement of public servants together with private persons in criminal misappropriation of public funds and causing wrongful loss of huge amounts to the State exchequer to tune of Rs.246.69 lakhs
