Proskauer Rose LLP Alan S. Jaffe – Chairman Alan S. Jaffe is the chairman of Proskauer Rose LLP. Prior to assuming this position in January 1999, he served as a member of the firm’s six-person executive committee, which he now heads. Since becoming a partner in Proskauer’s Labor and Employment Law Department in 1973, he has spent most of his time engaged in collective bargaining negotiations and in counsel- ing clients on strategic labor law considerations affecting corporate mergers and acquisitions, reductions in force and redeployment of personnel, as well as generally advising clients on day-to-day labor relations matters. While Mr. Jaffe counsels clients in a variety of industries, including health care, publishing, manufacturing and human services, a significant portion of his time is concentrated in the entertainment industry, where he represents many of New York’s premiere institutions. Among the clients who rely upon his advice are the League of American Theatres and Producers, Inc., New York City Ballet, Lincoln Center for the Performing Arts, Madison Square Garden and Radio City Music Hall. The entertainment business is one of the nation’s most unionized industries and, as such, these and other clients have often presented him with complex challenging assignments. Mr. Jaffe is an honors graduate of Cornell University and Columbia Law School, where he was an editor of the Columbia Law Review. Treece on April 26, 2021 Posted in Coronavirus On April 21, 2021, the City of Chicago passed an ordinance (the “Ordinance”), here, prohibiting Chicago employers from: (i) retaliating against workers who receive the COVID-19 vaccine during working hours; and (ii) requiring that workers receive the COVID-19 vaccine only during non-working hours. The Ordinance takes effect immediately. The Ordinance applies to all employers who “engage the service of at least one individual for payment.” In addition, the Ordinance defines “worker” to mean “an individual that performs work for an employer, including as an employee or as an independent contractor.” Under the Ordinance, an employer cannot require that its workers receive the COVID-19 vaccine during non- working hours. If a worker elects to receive a COVID-19 vaccine, the employer must allow the worker to use any available paid sick leave or paid time off. In addition, if the employer has implemented a mandatory vaccine policy under which workers are required to receive a COVID-19 vaccine, the employer must compensate the worker for time spent receiving the vaccine, up to four hours per dose, if the dose is administered during working hours.
