Table of Cases.................................................................................................297 Letter of Transmittal December 15, 2015 The Honourable Dr. Eric Hoskins Minister of Health and Long-Term Care Government of Ontario Since your appointment of this independent task force, which commenced on January 5, 2015, we have taken a patient-centred approach to reviewing the Regulated Health Professions Act, 1991 (RHPA) to assess whether it and related laws, policies and programs in Ontario uphold the standard of zero tolerance of sexual abuse of patients — as you requested. Soon after we began, the Honourable Roy McMurtry, regretfully, resigned for health reasons, reducing this expert panel from three to two. We appreciated the benefit of his contributions to developing our work plan, and we have been determined to deliver on the task you entrusted to us. We also wish to express our appreciation for the resources provided by your ministry to ameliorate some of the pressure on this task force. In the first six months of 2015, we heard from over 100 patients and presenters at public and private hearings, roundtables with experts in law, health policy and advocacy, faculty and students at five universities in Toronto, Hamilton, Ottawa and Thunder Bay. As well, we engaged with: • health regulatory colleges and professional associations representing regulated health care professionals, as well as individual professionals; • patients who have experienced sexual abuse by regulated health professionals; • organizations representing individuals who have experienced sexual abuse, sexual assault or other types of sexual violation; • institutions in which regulated health professionals are employed or hold privileges to practise. The sexual abuse of patients is a complex problem, and complex problems require complex solutions. Our recommendations to you are interlocking and multi-sectoral in nature, situated within an ecological human rights framework. Access to justice for all is a strong theme in this report. Letter of Transmittal i This task force was given the mandate to “examine the existing legislative scheme under the RHPA and provide advice and recommendations with respect to modernizing and reinforcing the province’s ongoing commitment to a zero tolerance policy for the sexual abuse of patients by regulated health professionals.” As well, the task force was asked to “undertake its work bearing in mind that patient experience is its primary focus, while also respecting the fundamental guiding principle set out in the RHPA regarding the self-regulatory model for all health regulatory colleges in the province.” In conveying our findings to you on “patient experience,” we are of the opinion that those from whom we did not hear from is also an important consideration. For example, although we consulted experts based in both urban and northern Aboriginal communities, we did not hear directly from any patients of Aboriginal origin. As well, we heard from very few patients who moved to Ontario from other countries, or patients living with disabilities. Nor did we hear from patients who self-identified as lesbian/gay/ bisexual/transgender/queer. Reform of the self-regulatory model as it pertains to the sexual abuse of patients is central to the substantive changes that this task force recommends as crucial for modernizing and reinforcing Ontario’s ongoing commitment to the zero tolerance of sexual abuse of patients by regulated health professionals. Upholding the standard of zero tolerance requires ongoing, courageous ministerial oversight with sustained silo-crossing within government and across various sectors of Ontario society. We believe that this government, under Premier Kathleen Wynne, with you as the Minister of Health and Long-Term Care and in cooperation with key Cabinet colleagues, can achieve what no other government has for patient safety and protection. The media’s freedom to question access to justice for sexually abused patients has alerted the public’s perception of the issue repeatedly in the 25 years since it was first raised in Ontario and the first task force was formed. The Central LHIN serves York Region and surrounding areas of the GTA. Province-wide this investment will help clients and caregivers most in need, including $80 million for enhanced home care and $20 million for caregiver respite. Home care patients and those who care for them will benefit from approximately: 350,000 additional hours of nursing care 1.3 million additional hours of personal support 600,000 additional hours of respite services for caregivers 100,000 additional hours of rehabilitation. The Central LHIN will work with the Central CCAC to allocate this funding to increase nursing care, personal support services and respite services to patients and families in our region. This additional funding is part of Ontario’s 2015 Budget commitment to increase investments in home and community care by more than $750 million over three years. These initiatives support the commitments made in Patients First: A Roadmap to Strengthen Home and Community Care , the province’s plan to improve and expand home and community care.

Specifically, we are delighted that the priority investments for the $15million Provincial Cycling Infrastructure include investments on HWY 17 and HWY 6 on Manitoulin Island as these both support the expansion of the Great Lakes Waterfront Trail to include the Georgian Bay Cycling Route. The completion of this Route will greatly enhance cycling tourism and provide an economic boost to the Parry Sound Area. However, to fully complete the Georgian Bay Cycling Route will require implementing a continuous Active Transportation corridor between Sudbury and Parry Sound. To that end we strongly urge that the MTO: Require that the design for 4-laning HWY 69 between Sudbury and Parry Sound has an active transportation corridor to accommodate pedestrians and cyclists – this corridor is part of the Georgian Bay Cycling Route, a proposed expansion of the Great Lakes Waterfront Trail, but is currently a major gap. MTO has presented two concepts for this corridor, one of which accommodates Active Transportation while the other (labelled the preferred concept) does not. The #CycleON strategy has the potential to transform Active Transportation in the Province. The Great Lakes Waterfront Trail has the support of hundreds of Ontario communities who have invested to become part of the trail network.

I have previously and on numerous occasions written to the ministers of Training, Colleges and Universities, and Economic Development to seek their support for Georgian College’s continued role in the delivery of MED training. I have also voiced my concern with the fact that if the training is not retained, it could threaten the future of the college, and subsequently result in direct and indirect job losses in our region. On a positive note, and to the best of my understanding, MTCU has expressed support for this proposal, and its deputy minister has accompanied Georgian College officials in meetings with Transportation Canada, as well as they were instrumental in helping to secure a one-time investment of $500,000 to transfer training equipment to Owen Sound. While I’m very pleased about this past support, I believe that we need to do more with regard to securing its long-term sustainability in Ontario. With the recent closure of Port Colborne’s training facility, Ontario – bounded by the Great Lakes – faces a loss of critical training opportunities in Marine Emergency Duties and marine firefighter training.

The province is also announcing that in 2016/17, the government will continue to support the hospital and local organizations by providing transitional funding to ensure the maintenance of key long-term care services, including: • $4.03 million to the North West CCAC to support clients in the community while they wait for placement in a long-term care home. • $3.89 million in targeted hospital funding to support patients in transitional beds or through nurse-led outreach services. Ontario continues to enhance the care and services provided to residents in long-term care homes. Investing in long-term care home redevelopment is putting the well-being and safety of our residents first.

    March 10th, 2017 To: Minister Eric Hoskins and Minister Jane Philpott cc: Premier Kathleen Wynne, Minister Michael Coteau, Minister Deb Matthews, Minister Yasir Naqvi, Minister Marie-France Lalonde, Irwin Elman (Provincial Advocate for Children and Youth), Susan Pigott – Chair, Mental Health and Addictions Leadership Advisory Council, Mayor John Tory Dear Ministers Hoskins and Philpott, Re: Youth Addiction Families for Addiction Recovery (“FAR”) is a new grassroots Canadian registered charity. It was founded in May, 2016 by families affected by addiction, mostly parents whose children struggle with addiction. We have supporters across Canada but our core is in Ontario. The needs of our families, in particular, our ability to get timely treatment for our children, are not being met. Instead, our children suffer the natural outcomes of untreated addiction and mental illness. These outcomes include dropping out of school, being involved in the drug trade and sex trade, criminalization, marginalization, homelessness, becoming involved with children’s aid societies and overdoses resulting in heart attacks, permanent brain damage and death. As I’m sure you are aware, there have been two reported overdose deaths of teenaged girls aged 14 and 18 in the last two months in Kanata, Ontario. Those of our youth who are the most severely affected and need residential treatment face two major barriers to treatment: 1. A lack of treatment facilities (beds) resulting in wait times of up to 16 months at Pine River Institute, the only long term residential treatment facility in Ontario for youth; and 2. An unwillingness on the part of youth to seek treatment which results in the progression of their addiction from Stage 1 through to Stage 4.
