If upon written intimation to me/us by the MANAGING DIRECTOR KALLAKURICHI COOP SUGAR MILLS LTD., MOONGILTHURAIPATTU 605 702 office, I/we fail to attend the said office before the end of the period specified in such intimation, the tender will not be considered and if upon intimation, being given to me/us by the MANAGING DIRECTOR KALLAKURICHI COOP SUGAR MILLS LTD., MOONGILTHURAIPATTU 605 702 of acceptance my/our tender, I/We fail to make the additional security deposit or to enter into the required agreement as defined in clause 4 of the Tender Notice, then I/We agree to the forfeiture of the Earnest Money. 1. A copy of the recently tender registration in Government Department/ Government Undertaking., as a contractor shall be attached with the tender. 2. Current income tax and Sales Tax clearance certificate shall be enclosed with the tender. 3. Bank Guarantee will not be accepted towards Earnest Mone Deposit. Additional Security and withheld amount etc. The EMD should be remitted only Demand Draft or Banker’s cheque or small Savings Instruments in favour of Kallakurichi Coop Sugar Mills Ltd., Moongilthruraipattu 605 702 4. The following particulars shall also be furnished by the contractor along with the tender. (a) List of details of works executed by the contractor with their value. (b) A list of details of work under execution by the contractor, with their values. (c) Annual turn over of the contractor for the last fill Years. Necessary certificate to the effect issued the respective Ban shall be attached.

CONTRACTOR 5. The Lowest tenderer when informed that his tender is under consideration shall have to furnish PERT CHART in the proper form WITHIN A WEEK from the date of receipt of letter calling for PERT CHART. THE PERT CHART should conform the departmental time schedule for the completion of the work furnished in the TENDER NOTICE. If the PERT CHART is not received within a week from the date of receipt of communication his tender will not be considered. SPECIAL INSTRUCTIONS TO THE TENDERERS 1. The tenderes should carefully go through the tender schedule and quote their rates for all items and alternative item also. 2. The rates should be filled in neatly in figures and word taking into account the metric units specified in the tender. Scribbling, Over-writings and era sings should be avoided. 3. The amount of each item of work should be worked out Proper care must be taken in working out the amount of each item of work taking into account the unit for which the rate is quoted and the quantity of work to be done under the item. 4. The total from each page should be arrived at the carriage over at every page and the grand total value of work should be worked out and shown at the end. 5. The tenders should be submitted along with a covering letter giving full details as called for in the tender notice and with particular care to the following items and if they are registered contractors, together with the copy of letter registering them in the appropriate class (classes). i. Details of the earnest money deposit remitted by “Demand Draft” Banker’s Cheque/Small Savings Instruments in favour of Kallakurichi Co-operative Sugar Mills Ltd., on any Nationalised Bank . ii. In case the tenderers are eligible for concessional Earnest Money Deposit and accordingly they have remitted the reference number and date in which the concession was granted should be specified and a copy of the aforesaid reference should be enclosed along with the tender for ready reference. iii. Latest Income tax and Sales Tax Clearance Certificates should be submitted along be submitted along with the tender.

CONTRACTOR iv. Details of previous work done by the Tenderers covering the cost of the work, for Rs.25 lakhs in single Tender the agreement number and date, the department in which the work was carried our, etc. v. List of various machinery and other equipments at the disposal of the tenderer for use in the execution of the work. vi. The tender forms should be filled in while submitting the tender. The tenders submitted without filling up the tender form are liable to be rejected. vii. The tender must be submitted in a fullscape cover duly signing all the conditions, plans and schedule issued as Tender documents. viii. Only the rates for alternative items should be quoted and the amounts of these should not be included while arriving at total value tendered. When a tender is to be accepted the tenderer whose tender is under consideration shall attend THE KALLAKURICHI COOP-SUGAR MILLS LTD., MOONGILTHRURAIPATTU 605 702, VILLUPPURAM DISTRICT before the end of the period specified by written intimation to him. If the tenderer fails to attend THE VILLUPPURAM DT. KALLAKURICHI CO-OP.SUGAR MILLS LTD., MOONGILTHURAIPATTU -605 703. Office before the end of the period specified, his tender will not be considered. He shall upon intimation being given to ltd., Moongilthuraipattu 605 702 of acceptance of his tender make as security deposit the difference between 2% of the contract. This amount will be recovered from the First three consecutive bills at equal installments. The Contractor should sign an agreement in the proper departmental form for together with the earnest money and the amount withheld according to clause 68 of the Standard preliminary Specifications of the Tamil Nadu. Detailed standard Specifications shall be retained as Security for the due fulfillment of his contract. If a cash security deposit is made by the contractor he shall follow the procedure laid down on the proceeding paragraph for payment of earnest money and such deposit will not bear interest. Failure to enter into the required agreement or to make the security deposit as defined in this paragraph shall result in forfeiture of the earnest money. The written agreement to be entered into between the contractor and the mill shall be the foundation of the rights of both, until the agreement has first been signed by the contractor and them by the proper officer authorized to enter into contract on behalf of the VILLUPPURAM DT. KALLAKURICHI CO-OP.SUGAR MILLS LTD., MOONGILTHURAIPATTU 605702. CONTRACTOR The tenderer shall examine closely the Tamil Nadu. Detailed Standard Specification and also the Standard Preliminary Specifications contained therein and sign the Office copy of the Tamil Nadu Detailed Standard study before submitting his tender. Unit rates shall be for finished work in site. He shall also carefully study the drawings and additional specifications to be entered into before tendering. The Tamil Nadu Detailed Standard Specification sheet regarding materials, etc., can be seen at any time during office hours from 10.00 a.m. and 5.00 pm on office days in the office. The tenderer’s attention is directed to the requirements for materials under the clause ‘Materials and Workmentship’ in the ‘Preliminary Specifications’. Materials confirming to the Indian Standard Specification and approved by the Engineer in charge of the work shall only be used on the work and the tenderer shall quote his rates accordingly. Every tenderer is expected before quoting his rates to inspect the site of the proposed work. He should also inspect the quarries and satisfy himself about the quality and availability of materials. The name of quarries, kilns, etc, wherefrom certain materials are to be obtained are given in the Descriptive Specification sheet. The best Class of materials to be obtained from the quarries or other source defined shall be used on the work. In every case the materials must comply with the relevant standard specification. Samples of materials as called for in the standard specification, or in this tender notice, or as required by the Engineer in any case, shall be submitted for the Engineer’s approval before the supply to site is befun. If the contractor after examination of the source of materials defined in the Descriptive specification sheet is of opinion that materials complying with the standard or quality or sufficient quantity from the source defined in the Descriptive Specification sheet, he shall so state clearly in his tender and state where from the intends to obtain materials subject to the approval of the THE MANAGING DIRECTOR, THE KALLAKURICHI CO-OP SUGAR MILLS LTD., MOONGILTHURAIPATTU. Sugar Mills will not, however, after acceptance of a contract rate pay any extra charges for any lead or for any other reason in case the contractor is found later on to have misjudged the materials available. Attention of the contractor is directed to the standard ‘Preliminary Specification’ regarding payment of seignior age tolls, etc.

CONTRACTOR The tenderer's particular attention is drawn to the sections and clauses in the standard Preliminary Specification' dealing with; 1. Test inspection and rejection o-f detective material, and work 2. Carriage. 3. Construction plant. 4. Water and lighting 5. Cleaning up during progress and for delivery 6. Accidents. 7. Delays. 8. Particulars of payment. The contractor should closely persue all the specification classes which govern the rates which he is tendering. A schedules of quantities accompanies this tender notice. It shall be definitely understood that the Mills does not accept any responsibility for the Correctness or completion of this schedule and that this schedule is liable to alteration by omissions, deductions or additions at the discretion of the TENDER SCRUTINY COMMITTEE, OFFICE OF THE DIRECTOR OF SUGAR, PERIYAR E.V.R. BUILDING, 6909 ANNASALAI, CHENNAI- 600035. or as set forth in the conditions of contract. The tenderer will, however base his lumpsum tender on this schedule of quantities. He should quote specific rates for each item in the schedule, and the rates should be in rupees and naye paise. The rates should be written both in words and figures and the units in words. The tenderer should also show the totals of each items and the- grand total of the whole contract and quote in the tender a lumpsum for which he will undertake to do the whole work subject to the condition of contract, such lumpsum agreeing with the total amount of Schedule-A. This schedule accompanying the lumpsum tender shall be written legibily and figure from erasures, over writings or conversion of figure. Corrections, where unavoidable, should be made by crossing out, Initialing, dating and rewriting. Tenders offering a percentage deduction from or increase on the estimate amount and those not submitted in proper form or in due time will be rejected. Rates or lumpsum amounts for items not called for shall not be included in the tender. No alteration which is made by the tenderer in the contract from, the conditions of contract, the drawings specifications, or quantities accompanying same will be recognised, and if any such alterations are made, the tender will be void.

CONTRACTOR The tenderer should work out his own rates without reference being made to the, Public Works Department current schedule of rates or to the Sugar Mills estimate rates which are not open for inspection by tenderers.

The price at which and the source from which certain particular materials shall be obtained by the contractor are given at the end of the schedule accompanying the tender form„ Tenderers must accept the materials at these prices, and shall quote their prices for finished work accordingly. Notwithstanding any subsequent change in the market value for these materials the charge to the contractor will remain as originally entered in the written contract. No cartage or incidental charges will be borne by Government in connection with this supply.

The work shall be completed within FOUR Months from the date of handing over the site.

The attention of the tenderers is directed to the contract requirements as to the time of beginning work 9 the rate of progress and the dates for the completion of the whole work and its several parts - The following rate of progress should be maintained from the date of handing over of the site to the Contractor.

CONTRACTOR No Part of the contract shall be sublet without written-permission of the MANAGING DIRECTOR, VILLUPPURAM DISTRICT COOPERATIVE SUGAR MILLS LTD., MOONGILTHURAIPATTU 605 702. nor shall transfer be made by power of attorney authorising others to receive payment on behalf of the contractors.

If further necessary information is required, the The Managing Director, Kallakurichi Coop. Sugar Mills Ltd., Moongilthruaipattu. Villuppuram District will furnish such information. The sanctioning authority reserves the right to reject any tender or all the tenders without assigning any reason therefor.

Preference in the selection from among the tenderers will be given, other things being equal, to those who are themselves professionally qualified or who undertake to employ qualified men at their cost to look after the work. The tenderers should therefore state in clear terms whether they are professionally qualified or whether they undertake to employ technical staff and if so to give the professional qualifications of the staff to be employed. In case the selected tenderer is one who has undertaken to employ technical staff under him, he should see that one of the staff is always |at the site of the work during working hours, personally checking all items of works- and paying extra attention to such works as may be and special attention e.g., reinforced concrete works, etc.

CONTRACTOR

In case the contractor who is professionally qualified not in a position to remain always at the site of the work during the working hours, he should employ technically qualified staff (as prescribed) for the work.

It will not be incumbent on the part of the contractor to employ technical assistant / assistants when the work is kept in abeyance due to valid reasons and if during such period in the opinion of the Managing Director of the Mills / Asst. Exec. Engineer, Sugar Mills Technical Assistant / assistants is not required for the due fulfilment of the contract.

The contractor shall comply with the provisions of the Apprentices Act 1961 and the Rules and orders issued, there under from time to time. If he fails to do so the competent authority may, in his discretion cancel the contract or revoke any of the penalties for breach of contract provided in the agreement- The contractor shall also be liable for any pecuniary liability, arising on Account of any violation by him of the provision of the Act.

A tenderer submitting a quotation which the tender accepting authority considers excessive and indivative of the insufficient knowledge of current prices or definte attempt at profiteering will render himself liable to be debarred permanently from tendering for such period as the tender accepting authority may decide. The tender rates should be based on the controlled price for materials, if any, fixed by Government or the reasonable price permissible for the tenderer to charge a private purchaser under the provision of clause 8 of the Hoarding and Profiteering and on similar principles* in regard to labour and supervision in the construction.

CONTRACTOR The contractor should otter employment to ex-toddy tapers as far as possible.

The fact of submitting the tender implies that the tenderers have actually inspected the site of work and have examined before tendering the nature and extent of various kinds of solid at various depths and have based their tender in such examination by them and no -future representation in this regard will be considered.

A statement giving brief particulars of equipment and resources that will be put at the disposal of the work under the following classification should accompany the tender.

a. Equipments Transport for materials vis. lorries and carts, concrete mixers, vibrators, etc.) b. Organisation (i) Technical (ii) Unskilled c. Resources in materials like teakwood, etc. and extent, to which departmental help, is required for procurement of materials and transport of same. d. Methods that will be adopted to speed up the work to ensure completion with or less than the time fixed for completion.

The MANAGING DIRECTOR OF THE MILL reserves to himself the right to allotting the different sub works to the different contractors or to one and the same contractor as he may decide after the receipt of tenders.

The rates quoted must be inclusive of all taxes and duties. All tenders carrying counter conditions will be summarily rejected at the time of opening of tenders.

Each tenderer must pay as Earnest Money, a sum of Rs.25000/- (Rupees Twenty Five thousand only) only in the shape of in Demand Draft in the favour of the Managing Director, Villuppuram Dist, Co-op. Sugar Mills Ltd, payable on any Nationalised Bank at . The Earnest Money will be refunded to the unsuccessful tenderer on application after intimation is sent of rejection of the tender or at the expiration 01 four months from „the date of tender, whichever is earlier.

The Earnest Money will be retained in the case of the successful tenderer and will not carry any interest. It will be dealt with as provided in the tender.

Tenders received without specified Earnest Money will be summarily rejected.

5. Above Rs.50.00 Lakhs To be examined in individual cases depending on the nature of work and the technical skill involved and defined in the tender notice regarding the number of qualified technical personnel to be employed by the Contractor.

If the tenderer (who is not professionally qualified) fails to employ the technical staff as indicated above for works, a penalty of Rs.500/- per mensum for Diploma holders and Rs.1000/- per mensum for degree holder, shall be levied during the period of such non-employment of technical staff.

INSTRUCTIONS TO TENDERERS PARTICULAR CONDITIONS OF CONTRACT INSTRUCTIONS FOR FILLING / SUBMITTING TENDERS:

1. The tenderer should study all the tender documents carefully and understand the tender contract conditions, drawings, specifications, etc., before quoting. If there are any doubts, they should get clarifications in writing but this shall not be a justification for belated submission of tender or extension of opening date. Tender should be strictly in accordance with approved drawings, specifications and other tender documents.

2. The tenderer should visit the site and acquaint himself with the conditions before quoting. He is also expected to know about the availability of water supply, electricity supply approach road, construction materials as per approved specifications and any other ancillary facilities since these are to be provided / arranged by him (unless other wise specified) at his cost to execute the works. All the above factors must be taken into account in the rates.

CONTRACTOR 3. The tenderer should quote his rates tor all items in the tender schedule. All the rates given in the tender schedule should be expressed both in -figures and words, and where there is a difference between the two the lowest rate will be taken as authenticate- Should there be any discrepancy between unit rate and amount, the unit rate will be considered as the correct one.

4. As per the agreement clause No. 14 contractors shall be bound to pay all taxes. Contractros shall indicate the sales tax chargeable against the various items wherever applicable in the tender form only.

5. All tenders and subsequent communications if any should be submitted in cover (sealed with lac) boldly super scribed on the outer cover, Tender Number, closing date and time and sent by Registered Post so as to reach the concerned authority as laid out in the tender -form' be-fore the closing date and time or handled in person to the concerned authority's office as laid out in the tender -form be-fore closing date and time with the permission of the concerned authority.

6. All entries in tender documents should be in INK/TYPED. All corrections should be attested under the full signature of the contractor. Corrections where necessary should be made by scoring the wrong words / figures by drawing a line across them and attesting these with the full signature. These shall not be erased or overwritten.

7. Every page of the tender documents shall be signed by the tenderer at the end of last entry thereon. One complete set of drawings should be signed and returned by the contractors along with tender documents.

8. No upward revision of rates will be accepted after opening of the tender. If a tenderer withdraws, modifies, alters or otherwise changes his quotation at any time before the Mills intimated him in writing that his tender is either accepted or rejected, the Earnest Money paid by him shall be forfeited. If, after his quotation is accepted and work order placed on him, the successful tenderer backs out or fails and neglects to complete the formalities stipulated in the work order or fails or neglects or refuse to accept the work order to take up the work he shall be deemed to have committed breach of contract and there upon

CONTRACTOR the / Sugar Mill shall be entitled at its absolute discretion to award the work in favour of the tenderer who quoted next lowest rate at his public tender or call for fresh tenders, whether public limited or single as the / Sugar Mills may at their absolute discretion decide and accept any quotation in response to any such tender and get the work done at the risk and cost o-f the said de-faulting tenderer, holding him responsible -for all extra expenditure damages or loss that may be suffered or sustained by the / Sugar Mills. Once the quotation is accepted and the work order placed on the successful tenderer, the rates shall be valid till the entire work is 100% completed.

9. Tenderer shall quote his rates tor all items of work described in the bills of quantities irrespective of whether they are main items or alternate items- The sugar Mills reserve to themselves the right to adopt any o-f the alternate items, either in scrutinising and deciding upon the tender or later when the works are being executed.

10. The tenderer shall submit along with his tender, a list mentioning the names of manufacturers of specialised items like steel windows, patented waterproofing, flush doors, tiles, false ceiling etc., which he proposes to use in the work if his tender is accepted. Tenderer shall submit along with his tender a list mentioning the names of manufacturers of items like sanitary fixtures water pipes, stopcocks Asbestos sheets and bitumen washers or other manufactured items which he proposed to use in the work if his tender is accepted.

ACCEPTANCE OF TENDER

11. Incomplete tenders, conditional tenders, tenders received late or tenders not conforming to the terms and conditions prescribed in the tender documents or not accompanied by the requisite earnest money will be rejected. Requests for adjustment of pending bills or any other amount towards EMD will not be entertained* Sugar Mills / are not bound to accept the lowest tender and reserve right to reject any or every tender without assigning any reason whatsoever and or to carry out negotiations with the tenders in the manner Sugar Mill.

12. Tenderers have to attend the office of the Special Officer, Ammundi for negotiations / clarifications required by them in respect of their quotations without any commitment on the part of the of the Special Officer.

CONTRACTOR 13. In case of negotiation, the tenderer should send the confirmation o-f such negotiati on to the Special Officer Mills within 15 days from the date of negotiation, tailing which the Special Officer, VCSM, Ammundi reserve the right to ignore the Tenders.

EXECUTION OF AGREEMENTS

14. On acceptance of the tender the successful tenderer shall execute an agreement with / Sugar Mills, covering all aspects of the contract in the Standard form forming part of tender documents. The intending tenderers should acquaint themselves with the provisions of enclosed standard agreement before quoting.

15. When, the party signing of the tender is not be the sole proprietor, the necessary power of attorney authorising the party to act on behalf of the proprietor or organisation should be produced before signing the agreement.

IMPORTANT NOTE: 1. On Evaluation of the tender, if it is found that if the over all quoted amount of the Tender is less than 5 to 15; of the estimate amount, the Contractor shall pay additional Security at 2% of the estimate value. If the tender discount exceeds 15%. The contractor shall pay at additional Security at 50% of the difference between the quoted amount and estimated amount. Failure to furnish the additional Security, and execute the agreement shall lead into cancellation of award of contract besides forfeiture of EMD furnished.

2. The validity of tender should be for 120 days from the date of tender.

3. In case of any dispute on differences between the portion of contract either during the progress of work (or) after the completion of work of after the determination abandment of breach of contract as to any matter arising there under an claims exceeding monetary value of more than Rs.2.00 lakh (Rupees two lakhs only) the same shall be fixed before civil court having jurisdiction of the division.

4. The firm is liable to the penalised for non completion o the work at the rate of Rs.1000/- per 15 days for the maximum of 5%. of the value of work done. This penalty will be calculated after the completion of SIX months period an until the actual date of completion of the work.

CONTRACTOR 5. The lowest tenderer when informed that his tender is under consideration shall, have to furnish PERT CHART in the property form WITHIN A WEEK from the date of receipt of calling for PERT CHART. THE PERT CHART should confirm the departmental time schedule for the completion of work furnished in the TENDER NOTICE. If the PERT CHART not received within a week from the date of receipt communication his tender will not be considered.

SPECIAL INSTRUCTIONS TO THE TENDERERS 1. The tenderers should carefully go through the tender schedule and quote their rates for all items and alternate item also.

2. The rates should be filled in neatly in figures and word taking into account the metric units specified in the tender, Scribblings, over writings and erasings should be avoided.

3. The amount of each item of work should be worked out Proper care must be taken in working out the amount of earn item of work taking into account the unit for which the rank is quoted and the quantity of work to be done under the item.

4. The total from each page should be arrived at and carried over at every page and the grand total value of work should be worked out and shown at the end.

5. The tenders should be submitted along with a covering letter giving full details as called for in the tender notice, all with particular care to the following items and if they a registered contractors, together with the copy of letter registering them in the appropriate class (classes).

i. Details of the earnest money deposit remitted by Demand Draft / Banker’s Cheque/Smal1 Savings Instruments favour of Kallakurichi Cooperative Sugar Mill Ltd., on any Nationalised Bank payable at Tiruvannamalai ii. In case the the tenderers are eligible for concessior Earnest Money Deposit and accordingly they has remitted the reference number and date in which was granted should be specified and a code of the aforesaid reference should be enclosed also with the tender for ready reference. iii. Latest Income tax and bales Tax clearance should be submitted along with the tender.

SCHEDULE OF RATES AND APPROXIMATE QUANTITIES

(a) The quantities here given are those upon which the lump sum tender cost of the work is based but they are subject to alteration, omissions, Deductions or additions as provided for the conditions of this contract and do not necessarily show the actual quantities of work to be done. The unit rates noted below are those governing payment for extras or deductions of omissions according to the condition of the contract as set forth In the preliminary specifications of the Tamil Nadu Detailed Standard Specifications and other conditions or specifications of this /contract.

(b) It is to be understood that the measured work is to be taken nett not withstanding any custom or practice to the contrary according to the actual quantities when placed and finalized according to the drawing or as may be ordered from time to time by the Assistant Executive Engineer (CIVIL), and the cost calculated to measurement or weight at the respective prices without any additional charge for any necessary or contingent works connected therewith.

Note: Wherever the term Tami1 Nadu Detailed Standard Specification occurs it means the Tamil Nadu Building Practice latest edition.

Preliminary specification means the general condition of contract specified in the Tamil Nadu Building Practice.

SPECIAL CONDITIONS

SPECIAL CONDITIONS

a) Any amount falls as due from the Contractor on account of even after effecting recoveries from the bill for this work and other works entrusted to the contractor arranged to foe recovered from the contractor under vision of the Revenue Recovery Act.

b) An amount equal to 5% of the total value of work done shall withheld from each running bills. In final bill 2.5% of the withheld amount shall be released and balance 2.5% of the withheld amount retained under deposits for a period of six months from the date of completion of the work in order if watch the effect of all seasons on the work. If there are no defects or if defects noticed within this period of six months are rectified, the withheld amount will be refunded, after obtaining an indemnity bond in the prescribed form for the same withheld amount for further period of four years for the same purpose. Any defect noticed during the above period of six months from the date of completion of the work shall be rectified by the Contractor at his own cost within the time specified and stipulated under clause 68 of Standard Preliminary Specification of M.D.S.S. / TNBP.

c) Earnest Money Deposit amount will be refunded to the Contractor after the six months from the date of completion of the work.

d) An amount equal to 1% of the contract value shall be recovered in three equal installments from the first three consecutive bills as Additional Security Deposit and this Additional Security Deposit will be released in final bill.

e) The progress of work should be maintained strictly as per the PERT CHART and failure will entail penalization at the rate (maximum 5% of the value of work done) decided by the Special Officer of the Special Officer of the Mills.

CONTRACTOR In delays in commencement or progress or neglect of works b the Contractor, it shall be lawful for the Special Office of the Mills, to terminate the Contract and action shall be taken as per the clause 57 of Sec.XIX, Vol.1 of Tamil Nadu Building Practice.

f) SALES TAX: All rates quoted in the tender, shall be inclusive of Tax, payable under the General Sales Tax Act as amended from time to time (including amended Act 2S/B4) and that Contractor is responsible to file the Sales Tax Return pay the amount of tax as demanded by the Commercial Department. No request for payment of Sales Tax separately in addition to tendered rates due to any plan of subsequent. levy or increase in tax will be entertained vide also clauses 39(2) of general conditions to contract. The work contract tax will be recovered from the running bills at the rates prescribed in the TNGST Act. g) INCOME-TAX : Income Tax shall be recovered from the running bills as per the I.T. rules. h) The work executed by the Contractor under these contract shall be maintained at the Contractor's risk until the work is taken over by the Special Officer of the Mills. Sugar Mill shall not be liable to pay for any loss or damages occasioned by or arising out of fire, flood, volcanic eruption, earth quake, other convulsions of nature and all other natural calminities, risks arising of acts of God during such period and that the option whether to take insurance coverage or not to cover such risks is left to the Contractor.

i) DAMAGE TO PERSON / PROPERTY : The Contractor shall be responsible for all structural and decorative damages to property and for injury caused by the works or workmen to persons, animals or things and shall hold the mills harmless in respect thereof.
