I situate certain modes, discourses, and texts produced by prisoners—scientific research, jailhouse legal work, letter-writing, revolutionary polemic, and testimonial writing—within a larger rubric of what I call “productive intellectual labor.” The project draws on Marxist debates to define each part of that term and employs the work of Michel Foucault to contextualize prevailing historical notions regarding penal labor, the evolution of punishment, and discursive trends of those writing back to power. I argue that all these forms of writing are legitimate forms of intellectual labor, produced in an institution historically marked by convict illiteracy and under-education on the one hand and powerful administrative and state discourses on the other. I situate this writing to the other kinds of labor, such as manual and industrial work, that are routinely undertaken by prisoners; I do so to consider the effects of mandatory, coercive prison-labor schemes and the value derived from autonomously assumed labor that is experienced by imprisoned intellectual laborers. The project shows how the work of three 20th century prison writers (Robert Stroud, Caryl Chessman, and George Jackson) and the anthologies Couldn’t Keep it to Myself and I’ll Fly Away (published by women prison writers incarcerated at York Correctional Institution in Connecticut) demonstrate the many ways that prisoners use non-literary forms of writing to produce counter-narratives and iv discourses about themselves; fight against the oppressive, stultifying effects of incarceration; and critique administrative and state penal practices, among many other motives for writing. v TABLE OF CONTENTS ACKNOWLEDGMENTS ........................................................................................................... When attempting to write a cultural history of white settlers, Ngugi found nothing of value. He observed only garish paintings in upscale Nairobi bars featuring scenes of colonial life: scrawny Africans pulling whites in rickshaws, a "long bull-necked, bull-faced settler" holding a sjambock (Afrikaans: whip) and his loyal (and well-fed) dog at his side. It was just such a scene, Ngugi refiected, that summed up white settlement: "The rickshaw. The dog. The sjambock. The ubiquitous underfed, wide-eyed, uniformed native slave."2 In the end, as Ngugi put it, "Reactionary violence to instill fear and silence was the very essence of colonial settler culture."3 As is so often the case, Ngugi cut to the heart of the matter: one cannot envision the settler without the sjambock, or in Kenyan parlance, the kiboko (hippopotamus-hide vvhip).'^ Often settlers considered beatings as part and parcel of life in Africa, almost akin to milking the cows or cleaning the kitchen (if, in fact, Europeans ever performed such menial tasks). In the flrst several decades of colonial Kenya, settlers certainly did not hesitate to discuss their use of the lash.     PHYSICAL INVIOLABILITY AND THE DUEL pUNCH OR STAB: THE RUSSIAN DUELIST’S DILEMMA The Russian duel was a surprisingly and consistently violent affair. I do not imply that Russian duels were more deadly than those in the West (the fatality rate in Russia never approached that in France in the late sixteenth and early seventeenth centuries or in Germany at the end of the nineteenth century).1 I mean rather that conflicts over honor were frequently resolved in unregu lated spontaneous physical confrontations rather than in formal en- counters . Furthermore, those confrontations differed from rencontres in that they involved direct physical contact—hand-to-hand fighting or the use of weapons unrecognized by the dueling ritual, such as walking sticks or whips. The use of standard dueling weapons— swords or pistols—appears to have been optional. In other words, from the introduction of the duel in Russia to its demise, a conflict over honor was as likely (and at times more likely) to result in an im mediate and violent hand-to-hand fight as in a formal duel of honor. This happened so frequently that physical force seems to have been an accepted alternative to the duel. Garden plants that had been tended during the federal penitentiary years grew into dense thickets of cover for sensitive birds. Nests are even tucked within the rubble and concrete pipes left over from the era when correctional officers and their families lived here. They conclude that Chessman was accorded all of his rights under the law, that the com- plexity of the legal issues did not warrant twelve years of litigation,and that judicialindecision was the principalfactor which accounted for the years of delay. In 1948 Caryl Chessman, having been sentenced to suffer the pun- ishment of death by lethal gas, was confined to a cell on San Quen- tin's death row. The events which had brought Caryl Chessman to death row, while sensational, were not unlike those which had placed many criminals in the same plight.
