I. GENERAL a. The Rules and Regulations specified herein apply to tbe intrastate services and facilities furnished by the Grand River Mutual Telephone corporation, hereinafter referred to as the Cornpany. Failure on the part of the customers to observe these Rules and Requlations of the Company, after due notice of such failure, the Conpany has the option to discontinue service. b. In the event of a conflict bet{een these General Rules and Regulations and any conilitions contained in the General Exchange Tariffs and the Local Exchange Tariffs, the rate and condition contained in the specific tariff shall pr eva i 1. c. These Tariffs cancel and supersede all other Tariffs of the Company issued and effective prior to the effective alates shown on i.ndivitlual sheets of this tariff.

B. OBLIGATION AND L]ABILITY OF TELEPHONE COMPANY i l. Availability of Facil i ties a. The Conpany's obligation to furnish exchange and toll telephone service is dependent upon its ability to secure and retain, without unreasonable expense, suitabLe facili.ties and rights for such facilities, except as provided for in Part V, Lj-ne Extensions. 2. Allowance for Failure of service a. The Conpany does not guarantee uninCerrupted working of i.ts lines or equiprnent. In case service is interrupted othernise than by the negligence or willfull act of the custoner, an adjustnent will be ftade in the arnount of the charges for that portion of the service rendereal lnoperable. Any adjustrnent shall apply only if the interruption continues beyond ti{enty-four l24t hours after first noteal by the Conpany. Adjustment witl be matle in the form of a bill credit. No other li-ability shall in any case attach to the Company. Adjustnent of Charges a. In the aaljustment of sharges for overbilling by the Conpany, a refund vri.l1 be rnaale of the futl amount of excess charges when such antount can be determinedt lrhen the period or anount for which overbilling cannot be fixed from availabte records, the naxinum refund r,i11 not exceeil an estinated anount equal to such overbilling for a three-year per iod.

Directory Errors and Omi ssions a. Claims for damages due to errors or onisgions 1n ilirectory listings vritl be limited to prorated charges for the directory listing that is affected. b. In the cases of extra Iistinqs in the alDhabetical- section of the directorv for which a charqe is natle. the Conpany's liability shall be timited to an-anount not to exceed the established rate for such listinq for the directory period in which the error or omission 5ccurs.

In establishing connections vrith the facilities of other conpanies, the Conpany does not assutne any liability for any action of the connecting cornpany. 7. Defaqenent of Proper ty a. The Company shall exercise care in all work alone on a customer-s property. No Iiability shalt attach to the qonpany by reason of any defacement or damage to the customer-s propertv resultinq from the existence of the Company's in!truments, apparatirs and associatedl wiring on such property, or by the installation or renoval thereof, unless such dlefacenent or alanage is the result of the negligence of the Conpany, or its enployees. Custoner Premises Equipnent a. The Conpany strait not be responsible for any loss or danage, nor for failure or irnpairment of service in sonnection rdith cus toner-provided facilities unless caused solely by the negligence of the Company. 2. Amount of Deposits

The amount of deposit required shall not be more than the maximum charge for two months local exchange service or as may reasonably be required by the Company in cases involving service for short periods or special occasions. The Company may require the customer to inqease the amount of the deposit at any time, ifthe charges billed against the customer are found to warrant G) such an increase. Qualified low-income applicants may apply for Life Line Assastance.

A deposit may be made at any Company business of{ice or authorized agent.

The Company will maintain records which show the name and address of each depositor, the amount and date of deposit and each transactaon concerning the deposit. Unclaimed deposits shall be disposed of in accordance with law.

d. A receipt of deposit will be furnished to each customer from whom a deposit is received. Upon customer request, duplicate receipts will be provided to customers who have lost their receipt if the deposit is substantiated by the Company records.

3. Deposits and Collection Practices

a. The facl that a deposit has been made in no way relieves the applicant or customer frcm complying with the Company's regulations as to advance payments and the prompt payment of bills; nor constitutes a waiver or modification of regular practices of the Company providing for the discontinuance of service for nonpayment of sums due the Company for services rendered. The Company may discontinue service lo any customerfailing to pay current bills regardless of the fact that such customer has made a deposit with the Company to secure payment of such bills, or has furnished the Company wath a guarantee in writing for such bills.

SPECIAL CONSTRUCTION

H. Special Construction

1. Excess Construction Charge

a. Where no facilities are in place, the Company will build one-third of a mile of circuits to any rural customer for business or residence use without excess construction charges.

b. For all distance over one-third mile an excess construction charge based on the time and materials used for construction may be charged.

c. The first 1000 feet of circuit on private property for local exchange service will be provided by the Company. Any distance beyond the first 1000 feet will be charged to the customer at time (loaded labor rate) and materials used for construction. An advance payment of the reasonable cost of construction will be required. The customer shall furnish suitable right-of-way to the Company.

d. For mobile homes, trailers, construction sheds, and other nonpermanent buildings, the customer may be required to pay in advance one year’s local service charges in addition to any excess construction charge. This credit may not be used to reduce the monthly bill for toll or taxes, and no portion will be refunded to the customer if service is discontinued before credit is entirely used.

e. Ownership of all facilities constructed under this section up to the demarcation point will remain with the telephone company.

2. Special Construction

When a special type of construction is desired by a customer, such as underground boring, an additional charge is made. This charge is equal to the difference between the estimated cost of the special type of construction and the average cost of standard construction.

Title to all facilities constructed and paid for wholly or in part by the subscriber is vested in the Company.

3. Temporary Service:

Where plant construction is required to provide exchange, extension line, etc., service, temporary in character, the Company may require the applicant to pay charges based upon the costs involved or to contract for service beyond the initial period or both.

In the event of a dispute conceming a bill, the Telephone Company may r€guire the customer pay a sum of money equal to ihe amount of the undisputed portion of the bill. Indicators of an especiat danger to heallh include, but a€ not limited to : age; infrrmity; mental incapacitation; serious illness; physical disability, including blindness and limited mobility; and any other factual circumstance which may indicate a severe or hazardous health situation. 2. Disconnection of Service by the Company.

Digital Centrex Service 0,I)

General

1. Digital Centrex Service (CENTREX) is an integrated business network system made up of ieature enhanced digital switching software and hardware located in the Telephone Company offices and customer provided equipment located at the customer premises

2. CENTREX service will be provided to business customers with a minimum of two access line and may be provided jointly at business and residence locations.

CENTREX service will only be available in those exchange areas where Company provided facilities exist.

A standard feature of CENTREX service, Virtual Facilities Group Control, which limits the number of hunks/lines available for outgoing and incoming calling will be provided to deiermine the number of End lJser Common Line charges fo. CENTREX lines as set forth in the NECA Tariff FCC No. 5 and icr any othercharges assessed on a per line basis

5. The minimum lines to be assessed in the Virtual Facilities Grcup will be two (2) per customer groLrp.

CENTREX customers will be provided with one directory listing in the alpha listing in the classified section at no chaee. All other additional listing willbe atthe.ates established in other sections of these tariffs.

7. CENTREX lines may be teminated at locations not considered the customers primary business location at the rates established in other sections of this tariff following, provided all locations are served by the same Company central ofiice.

L CENTREX service or lines of a customer which terminate interexchange, where possible, will be provided by agreement on an Individual Case BASES or according to tarifts in effect for the provision of interexchange private line services.

B. CONDITIONS 1. The minimum charge for CENTREX SERVICE is one month. 2. Customer premises equipment will be provided by the customer and must be compatible with the services and equipment provided by the Company. 3. All applicable features as described in following parts of this tariff are available to each CENTREX line of each customer group. 4. Intraexchange and interexchange calling services available to other classes of service within the exchange of the CENTREX customer such as: Extended Area Service, access to 911, access to operator, and Direct Distance Dialing, are available to CENTREX lines unless denied or restricted by the customer. 5. If CENTREX lines or services are ordered in conjunction with PABX or Key System Trunks the appropriate rates for PABX or Key System Trunks as found in other parts of these tariffs will apply as well as the rates for CENTREX lines. 6. All applicable Rules, Regulations, Rates and Charges found in other parts of the Tariffs of the Company are applicable to CENTREX Service. 7. Touch tone line charges as described in other parts of the Company’s tariff are required on each CENTREX access line to which a 2500 and/or analog type communications device is attached. 8. CENTREX service is not available in exchanges served by fiber.

C. DESCRIPTION OF FEATURES AND SERVICES 1. Standard Features a. Automatic Identification of Outward Dialing (AIOD): Records each outgoing, billable call against the CENTREX line originating the call. b. Automatic Line: This feature provides an automatic connection between a calling station that goes off-hook and a preassigned directory number. c. Call Forward: This feature allows a customer to have incoming calls to a station location automatically forwarded to a predetermined under any of the following three circumstances: 1. All Calls: Allows all incoming calls to be automatically forwarded to another preselected line. 2. Busy: This is a station option that automatically transfers incoming calls directed to a busy subscriber to an alternate subscriber within the same customer group.

A. GENEML

N. OFF-PREMISE EXTENSION (OPX) SERVICE

1. Off-premise extension circuits are provided to allow the customer the option of extending his telephone service to a second location within the wire center using the company’s cable or fiber distribution facilities. Off-premise extension circuits are furnished subject to the availability of circuits and provided when no unusual expense is involved. Distances for determination of rates shall be based on airline miles between the normal location and the location of the off-premise extension. Off-premise extension service is not available in exchanges served by fiber.

2. If a customer requests an OPX line at the same premise and: (a) the line goes back to the pedestal, and (b) a cable pair from an additional premise cable to a separate location is used, then the following OPX charges apply.

a. Mileage Charges*. Customers will be billed at $0.70/per ¼ mile of cable if cable is installed by and belongs to the Company.

i. Mileage is calculated by measuring the distance between the stations that are ringing the same number or the distance from pedestal to second location, whichever is applicable.

ii. If a customer pays for the materials and labor to have cable buried between two buildings on the same premise, OPX mileage is not charged. This is a customer owned OPX, and the maintenance of same is the customer’s responsibility.

b. Additional Local Service Charges and Simultaneous Ring Charges. If a customer requests an OPX line and a second cable pair or fiber is needed, then the customer will be billed for an additional local service line at the rates described elsewhere in this tariff. Simultaneous Ring Service may also be required at each additional location.

TEMPORARY OR VACATION SUSPENSION [1] (C)

A. GENERAL

Temporary Suspension of Service is available for vacation purposes at a reduced rate for all customers.

B. RATES

1. The monthly rate will be * % of the regular rate for the services suspended, with payment made in advance and the allowance applied after the service is restored.

2. No other service charges will apply for the suspension and subsequent restoral of service.

C. CONDITIONS

1. Temporary suspension of service may begin and terminate on any day of the month, provided notice is given sufficiently in advance for arrangements to be made.

2. The minimum period for which this service may be provided is one month.

3. No outward or inward service will be provided during the suspension period.

4. Bills shall continue to be rendered to the customer at the regular billing dates during the period of suspension.

[1] Effective January 1, 2014, Suspension of Service will no longer be available to new (C) customers. Existing customers will be allowed to complete or continue any prearranged suspended service until May 1, 2014 when the service shall sunset and no longer be available.

1. General

a. Integrated Services Digital Network (ISDN) – Primary Rate Interface (PRI) is a central office based service arrangement that is an alternative for individual access services, such as Direct Inward Dialing (DID), Direct Outward Dialing (DOD), 800/888 Services, Wide Area Telecommunications Services, and local business trunks.

b. ISDN-PRI is provisioned on a 1.544 megabit per second (Mbps) facility and uses the ISDN architecture of 23 “B” channels and one “D” channel to provide the customer with the capabilities of simultaneous access, transmission and switching of voice, data and imaging services via channelized transport. In addition, ISDN-PRI may be provided with fewer “B” channels on an individual case basis (ICB) depending on the special circumstances of the customer.

c. ISDN-PRI provides the capability to transport customer information in the form of circuit-switched voice or data up to 64 Kbps over any “B” channel.

d. ISDN-PRI and other local services are offered on an end user basis only. Use of such services for transmitting interexchange traffic that does not either originate and terminate at the customer premises is prohibited.

2. Regulations

a. ISDN-PRI service is only available from serving central offices equipped with the necessary facilities to provide ISDN-PRI service. Feature availability and service capabilities are dependent on the facilities and the digital technology providing the service.

b. Customer Provided Equipment (CPE) must be NI-2 compliant (meet the National Standard for PRI). Any CPE that requires custom switch features not supported in the NI-2 specification may be supported as an exception.

c. This Tariff provides for PRI switching capabilities only and additional services must be subscribed to under separate sections of this Tariff. Each ISDN-PRI facility is provided with one telephone number.

d. This tariff does not provide for the transmission of packet data on the “B” or “D” channels, but this service can be provided on an individual case basis.

3. ISDN-PRI Features

The following B-channel features are offered to the customer, at no additional charge.

a. Call-by-Call Service Selection provides an option to the dedicated channel configuration by allowing channels to be configured to access multiple services on a per call basis. With this feature, separate facilities are not required for individual services, such as DID, DOD, WATS, 800/888 services, and local switched access lines.

b. Clear Channel Capability allows the customer to transport 64 Kbps over the PRI channels with no constraint on the quantity or sequence of bits using the “Bipolar with Eight Zero Substitution” method of providing bit sequence independence.

c. Fractional DS1 ISDN-Originating allows the customer to set up N x 64 Kbps calls from an ISDN-PRI in real-time and in the same manner as any circuit switched ISDN call.

d. Fractional DS1 ISDN-Terminating allows the customer to receive N x 64 Kbps calls from an ISDN-PRI in real-time and in the same manner as any circuit switched ISDN call.

4. ISDN-PRI Rate Structure

a. ISDN-PRI Access

1. Non-recurring charges for the initial database configuration work and installation of the ISDN-PRI Interface at the Customer Premises apply per each 1.544-Mbps facility provisioned.

b. Channel Activations

1. Channel Activations will be provided at no charge during initial installment of ISDN-PRI access.

c. Channel Usage

1. Voice/Data channel usage rates will apply on a per channel basis.

d. Subsequent Activity

1. Non-recurring charges for database configuration work will apply for all subsequent activity related to changes in channel configuration or ISDN-PRI attributes. The database charges are applied per PRI.

d. Installation and configuration change charges are applicable as described elsewhere in this tariff and/or the NECA tariff. Current installation and configuration change charges include 10 hours at the current labor rate, 2 trip charges at the current trip charge rate, and 1 service order fee at the current service order rate.

e. Caller ID Number is a feature described elsewhere in this tariff, and an additional Caller ID charge will apply per each trunk.

1. Busy Veriflcation service is furnished to customers upon request to provide Line Status or Busy Interrupt for a requested line or trunk.

2. This service is provided where facilities exist for Line Status or Busy Interrupt through a Telephone Company operator.

3. The provision of Line Status involves an operator detemining the condition of a line or trunk line lhat a customer requests to be checked. The status of this line is verified to the customer for a charge as listed below.

The provision of Busy Interrupt involves an operator intenupting a line or trunk that a customer requests to be checked. Information conceming the Busy Interrupt to this line or trunk is passed to the customer for a charge as listed below.

5. No request will be processed on a collect or reversal of charge basis.

1. Undertaking of the Telephone conpany

the Cornpany provides 911 Service solely to and for the benefit ;f -the-customer operating the PsAP(s). The. provision of 911 service by the -conpani shall not be.interpreted, construed or regarded, either- expressly or inplied, as being for the benefit-of or creating any conpany obligation toward any third person or 1e9al entity other than lhe custoner. b. The Company does not undertake to answer and for"'ard 911 ca11s, Lut-furnishes the use of ics facilities to enable the custorner's personnel to respond to such ca11s at the custoner's prenises. c. Tenporary suspension of service is not provided for any Part of the 911 service. 911 Service is arranged for one-way incoming service to the appropriate PSAP. Outgoing calls can onl'y be nade on a transfer basis. e. where a 911 call i.s placed by the calling party vi.a interconnection !.tith- an inlerexchange carrier. o! operator service provider, the Coropany cannot guarantee che colnpletion of Eaid '911 ca1l, the qiallty of the call or any features that nay othervise be provided with 911 service. A central office that ls not currently equipped to tlansnit Autonatic Nunber rdentificacion (ANr) ltill not be modified to provide ANI only for D911 Eervice. The rates charged for 911 service do not contenplate the constant nonito;ing or inspection of facilities to discover errors, defects and nalfunciions in the service, nor does the conpany undertake such responsibi I i ty.

1. 2 1 1 Service-2'l 1 Service (21 1) is a three digit local dialing arrangement available in specialized areas for the delivery of community information and referral services via voice grade facilities. Pursuant to Order 00-256, issued by the Federal Communications Commission (FCC) in Docket 92-105, the 211 code is assigned for access to community information and refenal services.

2. 3'11 Services-3l1 Service (31'1) is a three-digit local dialing arrangement available in specitic areas for the delavery of non-emergency local government services via voice grade facilities. Pursuant to Order 00-256, issued by the Federal Communication Commission (FCC) in CC Docket 92-105, the 311 code is assigned lor non- emergency local government servrces.

4. 711 Service-7l1 Service (711) is a three digit local dialing arrangement for telephone transmission access to Telecommunications Relay Service (TRS) entities as a toll free call. Pursuant to Order 00-256, issued by the Federal Communications Commission (FCC) in docket 92-105, the 711 code is assigned for nationwide access to TRS entities.

B. Terms and Conditions

1. N 1 1 Service is available in Company Territory only. To provide N'l 1 access to end users in another company's territory, or to a Competitive Local Exchange Carier (CLEC) end user, the N11 subscriber must make appropriate arrangements with the Company or CLEC serving that territory.

2. This Service is provided subject to the availability of the N 1 '1 code.

3. N11 can be delivered via regular exchange access line (by individual business line, PBX trunks, etc.)

4. Access to N'|1 is not available to the lollowing classes of service:

5. The Nl'l subscriber is restricted from selling or transferring the N1'1 code to an unaffiliated entity, either directly or indirectly.

6. N1 1 will not provide calling information in real time to the N'l 1 subscriber' lf the N11 subscriber needs this type of information, the N1'1 subscriber must subscribe to a compatible Caller ldentifi cation Service.

7. Calls to the N 1 1 code that translate to a disconnected number will be routed to intercept of the announcement facilities for a maximum of 60 days, when the N1 1 provider is a Company subscriber. The announcement provided may refer the €ller to another lelephone number. Callers placing calls to N11 from areas where Nl1 Service is not provided will be advised that the service is not available from their numbef.

8. Disputes regarding geographic coverage by two or more N11 subscribers will be referred to the lowa Utilities Board.

9. The Company will provision the subscriber's order within a reasonable time, given the complexity of the order. The N11 subscriber will be billed the nonrecurring charge (if applicable) when the Company provisions the service.

lf during this period, the Nl '1 subscriber has failed to establish service or decides to discontinue service establishment, the N11 code will be recalled and the code will be considered available for reassignment. lf the network has been provisioned for the subsciber, the nonrecurring charges if applicable will not be refunded or waived.

'10. Only a single seven or ten-digit local number or a single ten-digit toll free number may be used as the point-to number.

't't. N11 Service is provided where facilities permit.

12. The N 1 '1 subscriber should work separately with cellular or wireless companies to ascertain whether cellular or wireless customers will be able to reach communily information and referral services, non-emergency local govemment services, travel information services. teleDhone transmission access to all Telecommunication Relay Service (TRS) entities as a toll free call, or access to One Call systems provided by dialing N11.

13. N'l1 will be provided under the following conditions:

a. The subscriber will subscribe to adequate telephone facilities, both initially and subsequently as required in the judgment of the Company, to handle calls to N'1 1 without impairing the Company's general telephone service or telephone plant.

b. The subscriber is responsible for obtaining all necessary permissions, licenses, written consents, waivers and releases, and allother raghts from all persons whose work, statemenls or performances and used in connection with the service' and from all holders of copy rights, trademarks, and palenls used in connection with the service.

13. Nl1 will be provided underthe following conditions: (Cont'd)

c. The N11 subscriber shall be liable for, and shall indemnify, protect, defend and save harmless the Company against all suits, action claims, demands and judgments, and of all costs, expenses and casual fees incurred on account thereof, arising out of and resulting directly or indirectly from the service or in connection therewith, including but not limited to, any loss, damage, expense or liability resulting from any infringement or claim of infrjngement, or any patent, trademark, copy right, or resulting from any claim of liable and slander.

d. Susoension of N11 service is not allowed.

e. The Nl1 subscriber will respond promptly to any and all complaints lodged with any regulatory authority against any service provided via N'l1. At the Company's request, the N1'1 subscriber will assist in responding to complaints made to the Company concerning the subscriber's N11 service.

The Company will provide both oral and written notification when a Nl1 subscribeds service unreasonably interferes with or impairs other services rendered to the public by the company or by other subscribers of N1'l. The Company reserves the right once notification is made to institute protective measures up to and including termination at any time and without further notice. The Company may take protective measure when the Nl'l subscriber make no modification or is unwilling to accept modification in method of operation, or continues to cause service impairments

14. The foiiowing condiiions apply ifihe N1'l subscriber provides a pre-recorded announcement.

a. The N11 subscriber will provide announcements. The Company will provide only delivery of the call.

b. The Company's provision of access the to the N11 network for transmission of announcements or recorded program services is subject to the availabilw of such facilities and the requirements of the local exchange network

c. The N11 subscriber assumes all tinancial responsibility for all costs involved in the providing announcement or recorded program services including but not limited to, the recorded-announcement equipment producing the recording, advertising and promotional expenses.

d. The Nl1 subscdber assumes all financial responsibility, according to other specific rates and charges under catalog, for all facilities required to connect the recorded-announcement equipment located on the subscriber's premises.

15. The Company may take legal and practical steps to disassociate it from the N11 subscribers whose business and/or Dublic conduct (whether demonstrated or proposed) generates unacceptable levels of complaints by end users.

16. The Company is not liable for any losses or damages of any kind resulting from the unavailability of its equipment, facilities or for any act, omission, or failure of performance by the Company, its employees or agents, in connection with this tariff. The Company will not be responsible for calls that cannot be completed as a result of repair or maintenance dif{iculties and equipment or on equipment owned or leased by the subscriber.

17 . Calls placed to the N1'l code will be routed to the point-to number based upon the central office switch and /or the Numbering Plan Area (NPA) of the calling party. Routing based upon NPA and NXX, tendigit telephone number orZlP Codes can be provided where technically feasible.
