Approved and ordered: Lieutenant Governor The Lieutenant Governor in Council (a) changes the status of Strathcona County from a municipal district to a specialized municipality, (b) makes the order in Schedule 1, and (c) establishes the wards for the specialized municipality as described in Schedule 2, effective ~anua&1, 1996. z-%- - 'c = /' -/ , -- /t. - --cZ-fzr- - - ( CHAIR Clerk of the Executive Councll For Information only Alborra Recommended by: Minister of Municipal Affairs Authority: Municipal Government Act (section 96) Schedule 1 Special Provisions for the Organization and Operation of Strathcona County Definitions: 1 In this order, (a) "Rural Service Area" means the territory of Strathcona County excluding the Sherwood Park Urban Service Area, (b) "Shehood Park Urban Service Area" means the territory described in Schedule 3. Specialized Municipality 2(1) The status of Strathcona County is changed to that of a specialized municipality to provide for the unique needs of a mur~icipalitythat includes both a large urban centre and a significant rural territory and population. (2) The provisions of the Municipal Government Act and other enactments are modified to the extent necessary to accomplish the intent of this order. , (3) Except as otherwise provided in this order, the enactments applicable to a city apply in the Shewood Park Urban Service Area and the enactments applicable to a municipal district apply in the Rural Service Area. Urban Service Area 3(1) The Sherwood Park Urban Service Area shall be recognized as equivalent to a city by the Government of Alberta for the purposes OF program delivery and grant eligibility. (2) Strathcona County shall provide to the Government of Alberta any information required to administer programs or to determine the amount of grants which the Shewood Park Urban Service Area would be eligible for if it were a city. (3) For the purposes of enactments affecting roads, culverts, ditches, drains and highways (excepting highways designated as primary highways under the Public Highways Development Act as of the date of this order) within the Shewood Park Urban Service Area, the Shewood Park Urban Service Area is deemed to be a city. (4) Strathcona County may amend the boundary of the Shewood Park Urban Service Area. Rural Service Area 4(1) Notwithstanding subsection (3), the Rural Service Area shall be recognized as equivalent to a municipal district by the Government of Alberta for the purposes of program delivery and grant eligibility, including, without limiting the generality of the foregoing, funding programs and grant eligibility under enactments affecting roads, including secondary roads. (2) Strathcona County shall provide to 'the Government of Alberta any information required to administer programs or to determine the amount of grants which the Rural Service Area would be eligible for if it were a m~.~nicipaldistrict. (3) For the purposes of enactments affecting roads, culverts, ditches, drains and highways (excepting highways designated as primary highways under the Public Highways Development Act as of the effective date of this order) within the Rural Service Area, the Rural Service Area is deemed to be a city. Council Structure 5(1) The council of Strathcona County shall consist of 8 councillors one of whom is the chief elected official. (2) 'The chief elected official shall be elected under section 150(1) of the Municipal Government Act. (3) Strathcona County is divided into 7 wards described in Schedule 2 with 1 councillor to be elected from each ward. (4) All councillors are to be nominated from and resident in the ward represented. (5) Only an elector who is resident in the ward may vote for a counciHor in that ward. Miscellaneous Matters 6(1) Sections 271 (l)(a) and 604(c) of the Municipal Government Act do not apply to Strathcona County. (2) Strathcona County shall be treated as a special municipal district for the purposes of the Agricultural Service Board Act. (3) Any fines or penalties imposed in the Shewood Park Urban Service area which would enure to a city shall enure to the benefit of Strathcona County and any fines or penalties imposed in the Rural Service Area which would enure to a municipal district shall enure to the benefit of Strathcona County. (4) Nothing in this order shall affect or deprive Strathcona County of any rights, privileges, benefits or commitments accruing to Strathcona County under any agreement or letter of intent between the Government of Alberta, or any agency or delegate of the Government of Alberta, and Strathcona County before it became a specialized municipality. SCHEDULE 2 ELECTORAL WARDS FOR STRATHCONA COUNTY All of the herein described lands located in the Province of Alberta and lying west of the Fourttl Meridian. Township 52 In range 23, all of the following: Block 1, Plan 882 2222; Lot 44, Block 2, Plan 882 2222; Lots 45 and 46, Block 2, Plan 892 2007; Lots 47 to 49 inclusive, Block 2, Plan 882 2222; Units 1 to 3 inclusive, Plan 942 4072; Lots 52A and 53A, Block 2, Plan 922 2858; Lot 39, Plan 882 2221 ; Lots 33,35, and 374, Plan 228 NY; and Plans 2590 ET, 681 HW, and 1239 HW in the northeast quarter of section 21. In section 27, all those portions lying north of the south limit of the right-of-way for She.hvood Drive, all of section 28, all those portions of sections 29 and 30 lying within the boundaries of Strathcona County, all those portions of sections 31 to 34 inclusive lying south of the south limit of the right-of-way for Baseline Road; Township 52 In range 23, all those portions of section 25 lying north and east of the south limit of the right-of-way for Granada Boulevard and west of the east lirr~itof the right-of-way for Cloverbar Road, all those portions of section 26 lyirrg north of the south limit of the right-of- way for Granada Boulevard, all those portions of sections 31 and 32 lying north of the south limit of the right-of-way for Primary Highway 16A, all those portions of sections 33 and 34 lying north of the south limit of the right-of-way for Baseline Road, all those portions of section 35 lying north of the south limit of the right-of-way for Granada Boulevard, and all those portions of section 36 lying west of the east limit of the right-of-way for Cloverbar Road; Township 53 In range 23, all those portions of section 1 lying west of the east liniit of the right-of-way for Cloverbar Road, all those portions of section 2 lying west a.nd south of the east limit of the right-of-way for Cloverbar Road, all of sections 3 to 5 inclusive, all those portions of sections 6 to 8 inclusive lying within the boundaries of Strathcona County, all of sections 9 and 10, all those portions of section 11 lying west .and north of the east limit of the right-of-way for Cloverbar Road, and all those portions of sections 15 to 17 inclusive lying ..withinthe boundaries of Strathcona County; All those portions of River Lot 45 of the Edmonton Settlement lying within the boundaries of Strathcona County; Township 52 In range 23, in section 22, all of the following: Lot 1, Plan 2833 MC; Lot 23, Plan 4382 MC; Lot 27, Plan 963 MC; Lot 28, Plan 4382 MC; Lot 28A, Plan 512 RS; and all those portions of Plans 2590 t and 1239 HW which abut the herein before mentioned Lots 1,27, and 28.
