COMPETITION LAW AND TELEVISION BROADCASTING REGULATION IN THE UNITED KINGDOM Paul Smith De Montfort University, Leicester Paul Smith is a Senior Lecturer in Media and Communication at De Montfort University, Leicester. His research focuses mainly on contemporary media policy and he has published articles in a number of leading journals, including Media, Culture & Society and Convergence, as well as a research monograph on the introduction of digital television in Britain. His most recent significant publication is a book (jointly authored with Petros Iosifidis and Tom Evens) on the political economy of television sports rights (Palgrave Macmillan, 2013). [e-mail: [email protected]] Using the United Kingdom as a case study, this article examines the application of competition regulation to the contemporary television industry. The article begins with a brief overview of the nature of competition law. It then moves on to consider the growing importance attached to competition regulation within the UK television industry. Using a range of recent examples, the main part of the article analyses the application of competition regulation to UK television broadcasting in four main areas, namely: (1) mergers and acquisitions; (2) monopoly/market dominance; (3) cartels; and (4) state aid and public service broadcasting. The article highlights two key points: first, the difficulty of applying competition law principles to the television industry, most notably in relation to key concepts, such as ‘market definition’ and the ‘abuse’ of market dominance; and, second, the inherently political nature of competition law.

This definition is consistent across the periods referred to in this release. 1 RECAPITALIZATION UPDATE We announced on 8 May 2002 that we had filed our previously announced Chapter 11 “prearranged” plan of reorganization under U.S. law. As set forth in our plan of reorganization, the Company, a steering committee of our lending banks and an unofficial committee of our public bondholders (holding over 50% of the face value of NTL and our subsidiaries’ public bonds) have reached an agreement in principle on implementing the terms of the recapitalization plan to strengthen our balance sheet, reduce debt and put an appropriate capital structure in place for our business.
