Otzman Independent Editor Last week, the Van Buren Township Board of Trustees voted in favor of a plan by Supervisor Kevin McNamara to lower Belleville Lake so residents and the township can repair docks and seawalls and clean up the lake. It is tentatively planned for September or October, 2019, when the Dam will close off the flow of the into Belleville Lake and French Landing Dam will open its gates to let the water empty out. Matthew Best, deputy director of the VBT planning and economic development department, said the plan would be to lower the lake three to seven feet and maybe more. Best is the township’s environmental expert. Belleville Lake was formed in 1925 when Detroit Edison dammed up the river at French Landing. It has been lowered several times over the years and always with problems of shifting shorelines caused by the drying up of the soil. In September of 1973, the Department of Natural Resources lowered the lake as part of its plan to poison the “trash fish” (mainly carp) in the lake that were crowding out game fish. To protect the public health, safety and welfare. Sec. 42-276. - Definitions. This section contains the definitions used in Article VI. Sec. 42-277. - Imminent danger. (a) Tree removal required. The owner shall remove a dangerous tree that poses an imminent danger causing injury to persons or property from falling or blowing over due to physical damage, disease, infestation, deterioration or decay. (b) Regulated woodland, wetland and/or environmental features area. A request to remove a dangerous tree(s) located within a regulated woodland, wetland, and/or environmental features area(Continued which presentson page 20) an imminent danger, shall be made in person or in writing provided to the building department. The tree(s) shall be inspected and the request approved by the ordinance department prior to removal. Failure to comply with the applicable ordinances may subject the owner to additional fines, fees and penalties as authorized by those applicable ordinances Sec. 42-278. - Trimming, pruning or removal of encroachment onto public property. Owners are responsible to maintain trees, shrubs, or plants which overhang or encroach onto public property. Sec. 42-279. - Stump removal. The owner shall remove a stump below the surface of the ground unless in a wooded area, a wetland, or an environmental features area where stumps may be left no higher than twenty-four (24) inches above grade. Sec. 42-280. - Maintenance, treatment and removal. (a) Maintenance. An owner is responsible for the trees, shrubs and plants located on the owner’s property. (b) Regulated woodland, wetland or environmental features area. Owners shall comply with all township policies and applicable ordinances in these areas. Sec. 42-281. - Owner’s cost and expense; ownership disputed.

(a) Cost. The owner bears the cost of compliance with this Article. (b) Ownership disputed. A person disputing ownership bears the responsibility of obtaining a survey to show he or she is not the owner. Sec. 42-282. - Notice and order of abatement. When the township discovers an imminent danger, the township shall serve written notice, by first class mail and posting the property, on the owner of the subject property. The notice shall describe the tree, its location, the nature of the danger and order the owner to abate the danger within 30 days. The owner shall comply unless a certified arborist can establish that abatement is unnecessary. Sec. 42-283. - Warrant to perform work; costs become a lien. If the owner fails to abate the dangerous condition, the township abate the dangerous condition and will bill the owner for said costs. The owner must pay costs within thirty days or the township can place a lien on the property. Sec. 42-284. - Emergency removal. If emergency removal is necessary, the township may enter upon a lot or parcel of land, perform the work required, and assess the cost to the owner.

Sec. 42-285. - Penalty. Effective Date This amendment shall become effective 30 days after the first publication in a newspaper of general circulation within the Charter Township of Van Buren. In multiple-family, condominium, and non-residential developments, permits are issued at the same time as the applicable permit for construction and must be removed when the project is completed or the occupancy permit is issued. Sec. 66-35. - Penalty for violation of article. Violation is a civil infraction with a $150 fine for a first offense, $250 fine for a second offense, and $500 fine for a third or subsequent offense. Each day the violation exists is a separate offense. Sec. 66-36. - Declaration of nuisance. (a) Any disposal or transporting of garbage or rubbish in the township in violation of any provisions of this article is hereby declared to be a nuisance per se, and the person committing such violation shall be judged guilty of maintaining a nuisance per se. (b) The township supervisor or any member of the township board or the township ordinance enforcement officer shall institute any appropriate action or proceedings in law or equity to prevent, restrain, correct or abate any such nuisance. On July 21 the Michigan Department of Education announced the two dozen teachers from K-12 public schools across the state who will serve on the newly created Michigan Teacher Leadership Advisory Council developed with a $10,000 grant from the national Council of Chief State School Officers. “Their collective talents and experience will be an asset to the council as we collaborate on the state’s plan to implement Michigan’s ESSA plan and work to become a Top 10 education state within 10 years, said State Superintendent Brian Whiston. “Based on the leadership these educators have demonstrated in our schools and communities, we know that Michigan’s students are in great hands.” ESSA is the new federal law that replaced the previous No Child Left Behind Act. Every state is to develop a plan that it will use to improve educational outcomes for children and hold schools accountable and transparent for that success. The new advisory council members were selected from a pool of more than 310 applicants from 10 Prosperity Regions across the state, following an application process open to all Michigan teachers. A competitive preference was given to those with experience or interest in teacher leadership positions. The members will attend the panel’s only mandatory, in-person meeting on Aug. 9 in Bath. Otherwise, they mostly will participate in online meetings where they can provide feedback on the state’s ESSA and Top 10 in 10 plans. Council activities will be held outside of school hours. Members will receive a $500 honorarium for the 2017-18 school year. Members will also serve as ambassadors of the #proudMIeducator campaign (www.michigan. gov/poudmieducator) .
