FOREWORD the Need to Prepare a Clear and Comprehensive Document
FOREWORD The need to prepare a clear and comprehensive document on the Punjab problem has been felt by the Sikh community for a very long time. With the release of this White Paper, the S.G.P.C. has fulfilled this long-felt need of the community. It takes cognisance of all aspects of the problem-historical, socio-economic, political and ideological. The approach of the Indian Government has been too partisan and negative to take into account a complete perspective of the multidimensional problem. The government White Paper focusses only on the law and order aspect, deliberately ignoring a careful examination of the issues and processes that have compounded the problem. The state, with its aggressive publicity organs, has often, tried to conceal the basic facts and withhold the genocide of the Sikhs conducted in Punjab in the name of restoring peace. Operation Black Out, conducted in full collaboration with the media, has often led to the circulation of one-sided versions of the problem, adding to the poignancy of the plight of the Sikhs. Record has to be put straight for people and posterity. But it requires volumes to make a full disclosure of the long history of betrayal, discrimination, political trickery, murky intrigues, phoney negotiations and repression which has led to blood and tears, trauma and torture for the Sikhs over the past five decades. Moreover, it is not possible to gather full information, without access to government records. This document has been prepared on the basis of available evidence to awaken the voices of all those who love justice to the understanding of the Sikh point of view. -

This response is not, and does not purport to be, conclusive as to the merit of any particular claim to refugee status or asylum. Questions 1. Is there any independent information about any current ill-treatment of Sindhi people in Maharashtra state? 2. Is there any information about the authorities’ position on any ill-treatment of Sindhi people? RESPONSE 1. Is there any independent information about any current ill-treatment of Sindhi people in Maharashtra state? Executive Summary Information available on Sindhi websites, in press reports and in academic studies suggests that, generally speaking, the Sindhi community in Maharashtra state are not ill-treated. Most writers who address the situation of Sindhis in Maharashtra generally concern themselves with the social and commercial success which the Sindhis have achieved in Mumbai (where the greater part of the Sindh’s Hindu populace relocated after the partition of India and Pakistan). One news article was located which reported that the Sindhi community had been targeted for extortion, along with other “mercantile communities”, by criminal networks affiliated with Maharashtra state’s Sihiv Sena organisation. -

Remembering Partition: Violence, Nationalism and History in India Gyanendra Pandey CAMBRIDGE UNIVERSITY PRESS Remembering Partition Violence, Nationalism and History in India Through an investigation of the violence that marked the partition of British India in 1947, this book analyses questions of history and mem- ory, the nationalisation of populations and their pasts, and the ways in which violent events are remembered (or forgotten) in order to en- sure the unity of the collective subject – community or nation. Stressing the continuous entanglement of ‘event’ and ‘interpretation’, the author emphasises both the enormity of the violence of 1947 and its shifting meanings and contours. The book provides a sustained critique of the procedures of history-writing and nationalist myth-making on the ques- tion of violence, and examines how local forms of sociality are consti- tuted and reconstituted by the experience and representation of violent events. It concludes with a comment on the different kinds of political community that may still be imagined even in the wake of Partition and events like it. GYANENDRA PANDEY is Professor of Anthropology and History at Johns Hopkins University. He was a founder member of the Subaltern Studies group and is the author of many publications including The Con- struction of Communalism in Colonial North India (1990) and, as editor, Hindus and Others: the Question of Identity in India Today (1993). Reflections on the Transfer of Power and Jawaharlal Nehru Admiral of the Fleet The Earl Mountbatten of Burma KG PC GCB OM GCSI GCIE GCVO DSO FRS Trinity College, University of Cambridge - 14th November 1968. This is the second Nehru Memorial Lecture. At the suggestion of the former President of India the first was given, most appropriately, by the Master of Jawaharlal Nehru’s old College, Trinity. Lord Butler was born in India, the son of a most distinguished member of the Indian Civil Service, who was one of the most successful Governors. As Parliamentary Under-Secretary of State for India he was one of those responsible for the truly remarkable 1935 Government of India Act, the Act which I used to speed up the transfer of power. Thus Lord Butler’ ties with India are strong and it not surprising that he gave such an excellent lecture, which has set such a high standard. He dealt faithfully with the life and career of Jawaharlal Nehru from his birth seventy-nine years ago this very day up to 1947. My fellow trustees of the Nehru Memorial Trust have persuaded me to deliver the second lecture. This seemed the occasion to give a connected narrative of the events leading up to the transfer of power in August 1947, and indeed to continue up to June 1948, when I ceased to be India’s first Constitutional Governor-General. It would have been nice to show how Nehru fitted into these events, but in the time available such a task soon proved to be out of the question, so I have deliberately confined myself to recalling the highlights of my Viceroyalty and to assessing Nehru’s relations to the principal men and events at the time, and to general reminiscences of him to illustrate the part he played up to the actual transfer of power. -

When used in this Act, unless the context otherwise requires- (a) The term "oil" means oil of any kind or in any form, including fuel oil, oil sludge, and oil refuse; (b) The term "person" means an individual, partnership, corporation, or association; any o':vner, master, officer or em ployee of a vessel; and any officer, agent, or employee of the United States; (c) The term "coastal navigable waters of the United States" means all portions of the sea within the territorial jurisdiction of the United States, and all inland waters navigable in fact in which the tide ebbs and flows; (d) The term "Secretary" means the Secretary of War. Country Policy and Information Note Afghanistan: Sikhs and Hindus Version 5.0 May 2019 Preface Purpose This note provides country of origin information (COI) and analysis of COI for use by Home Office decision makers handling particular types of protection and human rights claims (as set out in the basis of claim section). It is not intended to be an exhaustive survey of a particular subject or theme. It is split into two main sections: (1) analysis and assessment of COI and other evidence; and (2) COI. These are explained in more detail below. Assessment This section analyses the evidence relevant to this note – i.e. the COI section; refugee/human rights laws and policies; and applicable caselaw – by describing this and its inter-relationships, and provides an assessment on whether, in general: x A person is reasonably likely to face a real risk of persecution or serious harm x A person is able to obtain protection from the state (or quasi state bodies) x A person is reasonably able to relocate within a country or territory x Claims are likely to justify granting asylum, humanitarian protection or other form of leave, and x If a claim is refused, it is likely or unlikely to be certifiable as ‘clearly unfounded’ under section 94 of the Nationality, Immigration and Asylum Act 2002. Decision makers must, however, still consider all claims on an individual basis, taking into account each case’s specific facts.
