EXECUTIVE SUMMARY The Oversight Group met on October 17, 2018 in Cheyenne and approved evaluation of creating a pedestrian mall at 24th Street and Capitol Avenue and expressed support for the City of Cheyenne to secure funding to extend a storm water interceptor at 26th Street to prevent flooding of the Capitol Square Project. The members approved three-percent shades for all office areas in the Herschler East and West buildings and one-percent shades for the conference rooms. The Oversight Group recommended the use of major maintenance monies for additional work on the dome and drum and for fire suppression and piping modifications in the Herschler Building garage.

CALL TO ORDER Co-Chairman Bebout called the meeting to order at 9:00 AM. The Oversight Group’s Meeting Agenda summarizes the Committee’s proceedings by topic (Appendix 1-01).

General construction update Mr. Paul Brown, MOCA Systems, reported the finish work within the Capitol is progressing and reviewed the decorative paint and trim work in the Senate Chamber (Appendix 1-03). Co-chairman Bebout inquired if part of the old paint would be preserved to showcase to a visitor the “before” and “after” the restoration. In response, Mr. Brown stated no old paint will be displayed, but the renovation history could be showcased through a photo exhibit. Mr. Brown also provided an update on the work in the Capitol Extension and the Herschler West Building.

OVERALL PROJECT ITEMS Consolidated Capitol Plan: Pedestrian Mall at 24th Street and Capitol Avenue

Mr. Michael O’Donnell, Attorney General’s Office, updated members on his meeting with Cheyenne Mayor Marian Orr. Mayor Orr responded favorably to the idea of looking into creating a pedestrian mall at 24th Street and Capitol Avenue (Appendix 1-03). Representative Nicholas moved the Oversight Group investigate and explore support for reducing and restricting traffic by creating a pedestrian mall with a drive-on plaza on 24th Street from Carey Avenue to Warren Avenue to portions of Capitol Avenue from the Supreme Court to 24th Street. Governor Mead and Co-Chairman Bebout expressed support for the motion and encouraged working with the Mayor and City Council to work through the details and asking citizens to weigh in on the idea. The motion was seconded and carried.

Consolidated Capitol Plan: Parking As a follow-up to a request by the Oversight Group at its last meeting, Mr. Brown explained the parking guideline in the consolidated Capitol plan, which recommends parking within 16 blocks of the Capitol Complex should be provided underground. He noted that parking could be provided underneath 24th Street and Capitol Avenue where the pedestrian mall would be located to provide parking adjacent to the Capitol and other buildings underground. Beyond the sixteen blocks, above-grade and surface parking is recommended (Appendix 1-03).

Consolidated Capitol Plan: Trees The Oversight Group also requested information about landscaping be included in the master plan at its last meeting. Mr. Brown described the planting guideline, which states plantings around the Capitol should be simple and respect view corridors. Existing trees should be preserved except those identified by the arborist as diseased or unsafe. He further explained new plantings should enhance vistas to the Capitol and support the long-term planning of the Capitol Complex (Appendix 1-03). Mr. Nicholas expressed the need to begin selecting replacement trees now, because of the age of many of the trees around the Capitol. In response,

Governor Mead suggested the State Building Commission discuss tree planting at their next meeting. Treasurer Gordon recommended providing a menu of options for memorial trees selected in the future that are appropriate for the location.

Storm Water Interceptor on 26th Street Mr. O’Donnell provided the Committee with an update on his conversation with Mayor Orr regarding the storm water work on 26th Street which would divert storm water from the central part of the City around the Capitol Complex. The original plan included extending the drain from where it currently ends on Thomes Avenue to Central Avenue, but the City does not have the funding to complete the extension. Mr. O’Donnell explained, with the heavy rain this past summer, water came close to flooding the new underground portions of the Capitol Square Project. He stated the Mayor’s plan is to seek funding to complete the project through a grant with the State Land and Investment Board. Governor Mead and Treasurer Gordon noted their role on the State Land and Investment Board and the need to weigh each request when presented.

Representative Nicholas moved the Oversight Group express to the City of Cheyenne the importance of ensuring the Capitol Square Project is protected from storm water and to further support the City’s efforts to secure funding through any available mechanism to install a 72-inch storm water pipe at 26th street on the north side of the Capitol Square Project to prevent flooding. The motion was seconded and carried. Governor Mead abstained.

Fallen Warriors Memorial update Mr. O’Donnell provided an update on the Fallen Warriors Memorial which will be located on the north corner of the Barret Building lawn. He explained HDR, JE Dunn, Straightline, and MOCA all donated their time and materials for the design and installation of the memorial. Governor Mead expressed gratitude for the donated services. The Veteran’s Commission will dedicate the monument on Veteran’s Day (observed), November 12, 2018 (Appendix 1-03).

Grand opening planning Mr. O’Donnell reported the Capitol Square Project should be finished by June 2019 and be ready for a grand opening on Statehood day in July. He recommended using the model for the 125th anniversary of statehood as a starting point for planning the grand opening celebration, which could include music, food, drinks, and fireworks. A barbeque is planned for the afternoon the day before the opening for all the workers, along with a donors and dignitary dinner that evening (Appendix 1-03).

Co-Chairman Bebout expressed support for celebrating the workers and donors but wanted to be mindful of the level of celebration held for the grand opening. Governor Mead stated there is a good opportunity to combine the anniversary of women’s suffrage with the grand opening. In response, Mr. O’Donnell explained conversations have taken place with the Department of State Parks and Cultural Resources and the Office of Tourism to partner in highlighting both events. Mr. Nicholas stated his belief that the budget for the grand opening should not be allocated out of the project budget, but through an appropriation from the Legislature. Members discussed whether the proposed date and whether the Fourth of July might be a better option. Representative Harshman stated the importance of the grand opening to appropriately celebrate the completion of this project and recommending including school children and honoring the State’s history. Representative Miller requested there be an opportunity for the media to tour the building before the grand opening to help get the word out about the celebration to the public.

Governor Mead inquired about the final punch list for the project and whether there will be enough funds to cover items that were not anticipated. In response, Mr. O’Donnell stated the contingency budget would be discussed in executive session.

CAPITOL DESIGN AND CONSTRUCTION Transom Windows In Capitol Mr. Nicholas explained there are a few interior spaces on the first floor and in the garden level of the Capitol that are not getting much natural light. The Subcommittee requested MOCA gather photographs and other supporting documentation for adding transom windows to interior walls in the garden level and first floor for consideration by occupants of the building in the future. The Subcommittee recognized that not all of the windows could be added to the project now because the cost is excessive, but requested MOCA evaluate options on the first floor.

HERSCHLER BUILDING AND CAPITOL EXTENSION DESIGN AND CONSTRUCTION Herschler window shade update Mr. Nicholas explained Subcommittee’s recommendation for three-percent transparent shades for all office areas in the Herschler East and West buildings and one-percent transparent shades for the conference rooms. Mr. Brown stated the manufacturer, architect, and the occupants all agree with the recommendation (Appendix 1-03). Treasurer Gordon inquired about the involvement of the occupants in the recommendation. In response, Mr. O’Donnell stated extensive conversations took place with occupants and all parties agree the three-percent shades for the office areas is the right solution. Representative Nicholas expressed frustration for not being able to view full-size mockups and stated the need for governance and policies to be created to provide oversight on the use of the shades. In response, Mr. O’Donnell stated occupants took the five-percent and ten-percent shade samples around the building as the sun moved throughout the day and concluded neither of the shades provided enough coverage.

Senator Emerich moved the Oversight Group approve three-percent transparent shades for all office areas in Herschler East and West buildings and one-percent transparent shades for the conference rooms. The motion was seconded and carried.

Relocation plan for Herschler East and West buildings Representative Nicholas moved to recommend the Oversight Group evaluate the pros and cons of relocation of the Wyoming Retirement System and the State Treasurer’s Office to create an Investment Center on the fourth floor of the Herschler West Building. He noted many synergies could be created by co-locating investment staff and that the WRS staff would be more accessible to state employees in this location. Co- Chairman Bebout and Governor Mead expressed concern about the Oversight Group recommending this action since it could have policy implications. Representative Harshman spoke in favor of evaluating the relocation. Treasurer Gordon suggested a full evaluation of the State Treasurer’s Office functions before any decisions are made. The motion was seconded and failed.

PUBLIC COMMENT No public comment was provided.

EXECUTIVE SESSION Representative Nicholas moved to resolve into executive session to discuss matters confidential by law. The motion was seconded and carried. The Oversight Group resolved into executive session at 10:33 a.m. The Oversight Group returned to open session at 11:42 a.m.

Additional dome and drum work Senator Emerich moved the Oversight Group recommend use of major maintenance funds not to exceed $780,000 for additional work on the dome and drum. Governor Mead noted that while it makes sense to use major maintenance monies for these additional issues that have been discovered, because it is better to fix these issues now than to come back a few years later to address the problems, it is also important to recognize that using these funds take away from other deferred needs across the state. In response, Mr. Nicholas stated from his years serving in the Wyoming Legislature and on the Joint Appropriations Committee, the largest driver of major maintenance funds had always been for the Herschler Building, the Capitol, and utilities supporting these buildings and those needs are being addressed through this project. The motion was seconded and carried.

Herschler garage fire suppression and piping modifications (PCI 156) Representative Nicholas moved the Oversight Group recommend major maintenance funds be used for PCI-156 not to exceed $263,955 for fire suppression and piping modifications in the Herschler Building garage. The motion was seconded and carried.

NEXT MEETING DATES AND ADJOURNMENT The next Oversight Group Subcommittee meeting will be held on November 13, 2018 at 2:00 p.m., and the next Oversight Group meeting is scheduled for November 15, 2018 at 1:00 p.m. There being no further business, Co-chairman Bebout adjourned the meeting at 12:08 p.m.
