Allowance for leakage and Breakage. Two per cent allowed on the gauge on all merchan- dize, paying duty by the gallon, contained in calks. Ten per cent on all beer, ale, and porter, in bottles, and five per cent on all other liquors in bottles, to be dedu<5ted from the invoice quantity, in lieu of breakagej or it fhall be lawful to compute the dixies on the actual quantity by tale, at the option of the importer at the time of entry. Terms of Credit. When the duties on ad valorem articles are lefs than 50 dollars, it mufi be paid immediately ; if fpe< ;iic, a depofit mufi be made to fecure the fame, which when afcertained, will be immediately fettled. When the duties on goods imported (where the fum payable by one perfon or co-pa rtnerfhip) fhall amount to more than fifty dollars, the following credit is allow- - 40 ed by law, except where any bond on which the perfon, or co-partnerfhip entering fuch goods, wares, or mer- chandize, are either principal or fecurity, and which being due remains undifcharged. On all articles the produce of the Weft-Indies (fait excepted) the one half in three months and the other half in fix months. On fait, in nine months. On Madeira, and all other wines, twelve months. On all goods, tkc. from Europe, (wines, fait and teas excepted) the one third in eight, one third in ten, and one third in twelve months. On allsgoods, &:c. (.vines, fait and teas excepted) from any other place than Europe and the Weft-Indies, oiae half in fix months, one fourth in'nine months, and ©ne fourth in twelve months. On teas " from China or Europe, may be depofited at trie option of the importer or importers (to be determin- ed at the time of making entry therefor) either to fe- eure the duties thereon, on the fame terms and ftipula- tions as on other goods, wares and merchandize import- ed, or to give his or her or their bond, to the colle&or of the diftrivft, where any fuch teas fhall be landed, in double the amount of the duties thereupon, with condi- tion for the payment of the faid duties in two years from the date of fuch bond; which bond lhall be accepted by fuch cclle&or .without furety, upon the terms follow- ing ; that is to fay. The teas,'-for the duties whereof fich bond fhall be accepted, lhall be depofited at the exnenee and rifk of the faid importer or importers, in one or moreftore houfe or ftorehoufes, as the cafe may require, to be agreed upon/' &fc. The faid teas to be tieliveved upon bond being given with one or more fure- ty'or fureties', to the fatisfa&lon of the collector " if the fame fhali not exceed 100 dollars, in four months; if above 100 dollars, and not exceeding $oo dollars in eight months ; or if the fame fhall exceed 500 dollars, in twelve months ; fo that the term of credit lhaU not extend t»e period beyond two years from the time of depoiiting the faid teas: any teas remaining after the term of two years, to be fold by the colled or, who fhall return the fur pi us (after paying the duties) to the own- er or owners thereof. When the bonds given for duties fhall become due, and not difcharged, the collector toprofecute without delay; and in cafe of insolvency or death the United States to be the firft creditor, u and if*any executor, adminiftra- tor, affignee, or any other perfon, ihall pay any debt due by the perfon or eflate, from whom, or for which they are a&ing, previous to the debt or debts due to the Uni- ted States, being fully fatisfied and paid, fhall become anfwerable in their own perfon and eftcite for the fame, or part thereof remaining unfatisfied. Sureties on all the bonds given for duties, fhall in cafes ol infolve«cy or death of the principal, have and en- jay the like advantages, priority or preference for the recovery and receipt of the faid money out of the eflate and eife&s of fueh infolvent, or deceafed principal, as are referved to the United States." When bonds are profecuted for the recovery ef duties to the United States, judgment to be granted at the return term, " unlefs the defendant ihall in open court, the United .States Attorney being prefent, make oath or affirmation, that an error has been committed in the li- quidation of the duties demanded upon fuch bono, fpeci- fyifig the errors alle ged to have been committed, and that the fame have been notified, in writing, to the col- lector of the diftriffc prior to the commencement of the return term aforefaid." The want of certificates of diftilled fpirits, wines or teas, fubje&s fuch articles to feizure, and fifty dollars fine, if fuch certificates are not delivered to the purcha- fer; and if any cafk, cheft, veffel or cafe, containing fuch articles, fhall be found in the poflellion of any per- fon, without being marked and not being accompanied with a certificate, tfee faias is liable to fsizwrc, 44 On tHe fale of any cafks, See. which hare been marked, the marks to be defaced in pre fence of fome officer of infpection or cuftora; and the certificate of the fame to be delivered up, under penalty of one hundred dollars •with coils of fuit. Officers may feize within or without their diftrifts ; perfons refilling or impeding them, forfeit four hundred hilars.
