The DNR is already in violation of state law due, in part due to its failure to reconcile its wolf hunting regulations with state statute. The DNR must revise its regulations to come into compliance with statute prior to establishing or implementing any wolf hunt, and it may not legally establish a season that begins in January or February. I. DNR Regulations Conflict with Statute Before implementing any wolf season, the DNR must amend its regulations to comply with the wolf season dates mandated by Wis. Stat. § 29.185(5). The DNR’s current rule governing its implementation of a wolf hunting season is EmR1210—an emergency rule put in place in 2012 pursuant to the Legislature’s directive in 2011 Wisconsin Act 169.1 Although the DNR began the process of promulgating a permanent rule to replace EmR1210, as it was legally required to do, the DNR never completed that process, and EmR1210 is still in effect.2 1 2011 Wis.
