Bed & Breakfasts Transient Guest Lodging Summary of Staff’s Proposed Regulations June 29, 2020 Short-Term Rental Data Analysis • 122 unique STR listings inside Oxford City limits; most outside the Mile Square • 148 unique STR listings in and around Oxford • 24 property owners with multiple listings in and around Oxford • Avg. nightly asking price & monthly revenue in 2019: $336/$3,893 • Total revenue since 2014: roughly $6.8 million • Peak occupancy on move-in/move-out weekends (up to 65%) • 32% of rentals are booked less than 30 days total per year • 64% of rentals are booked less than 100 days total per year • 21% of rentals are booked greater than 150 days total per year Short-Term Rental Locations Current Definitions Bed & Breakfast is defined as: Overnight accommodations, with or without meals, in a dwelling unit provided to transients for compensation. Short-Term Rental is defined as: A dwelling unit that is rented, leased or otherwise assigned for tenancy of less than 14 consecutive days duration, where no meals are served. Proposed Definitions Bed & Breakfast to be defined as: A building, sometimes the primary residence of the owner, where sleeping accommodations are offered for consideration, with or without meals, to transients occupying a room or rooms. Transient Guest Lodging to be defined as: A dwelling unit or portion thereof where sleeping accommodations are offered for consideration to transients occupying a room or rooms. What are Transients? Currently defined as: A person staying at a location such as a motel or bed and breakfast for less than 14 days per stay and does not use the location as his or her permanent address. Proposed to be defined as: A person staying at a location such as a hotel, motel, bed & breakfast, or other dwelling offering transient guest lodging for less than thirty (30) consecutive days and does not use the location as his or her permanent address. What are Transients? Currently defined as: A person staying at a location such as a motel or bed and breakfast for less than 14 days per stay and does not use the location as his or her permanent address. Proposed to be defined as: A person staying at a location such as a hotel, motel, bed & breakfast, or other dwelling offering transient guest lodging for less than thirty (30) consecutive days and does not use the location as his or her permanent address. Staff Proposal Bed & Breakfasts would continue to be permitted on a conditional basis (subject to review/approval by Planning Commission and Council) in residentially zoned areas.* Transient Guest Lodging would be permitted inside any single-family, two-family, or three-family dwelling in the City, in compliance with certain standards. *Exception: B&Bs would be prohibited in Neighborhood Conservation Overlay Districts Distinction Bed & Breakfasts are a principal use of property. Functioning primarily as a business, it deserves a special discretionary review and approval by the public authority. Transient Guest Lodging is an accessory use of property. For instance the principal use may be a single-family dwelling, primarily occupied by the owner, and is rented out on Airbnb a few weekends per year. Bed & Breakfast (B&B) Standards The following standards are proposed for B&Bs: New B&Bs to continue requiring Conditional Use approval in all residential zoning districts. During review of a Conditional Use, maximums for number of days booked annually and total guest occupancy would be set by Council. Each B&B would require an annual rental permit & registration, plus safety inspections once every 2 years. All previously approved B&Bs continue to be valid so long as permits are kept in good standing. Transient Guest Lodging (TGL) Standards The following standards are proposed for TGLs: No more than 1 TGL unit in a single-family, two- family or three-family structure. No more than 1 TGL booking at a time. TGLs are permitted administratively when booked no more than 90 cumulative days per year. TGLs booked more than 90 cumulative days per year require Conditional Use approval by City Council. Each TGL would require an annual rental permit & registration, plus safety inspections once every 2 years Occupancy Restrictions Dwelling units containing TGLs are limited to no more than 4 unrelated persons.* B&B occupancy limits are set during the Conditional Use process, and can be a number greater than 4. * Exception: In Neighborhood Conservation Overlays, occupancy is further restricted to no more than 2 unrelated persons. Ability to Revoke Registration For any registered B&B or TGL: The Community Development Director is given authority to revoke registration for any property that becomes subject to 2 or more civil and/or criminal citations. Civil citations may include violations of building, safety, property maintenance, nuisance, health and sanitation, fire, electrical, plumbing and mechanical codes.
