43/2002 Declaration by the Presidency on behalf of the European Union on the Zhakiyanov case Brussels, 31 March 2002

The EU expresses its support to the efforts of the collocated Embassies aimed at finding a positive solution to the situation created by the decision of one the members of the political Board of the Democratic Choice of Kazakhstan, Mr. Galimzhan Zhakiyanov, to remain at the premises of the French Embassy in Almaty.

Hoping that the discussions conducted with the Kazakh authorities continue to be held in a friendly atmosphere and eventually result in a satisfactory outcome, the EU will not allow that its representation and the Member States Missions in Kazakhstan should be used as a political platform.

The EU reiterates its wish to maintain its excellent relations with Kazakhstan and its resolution not to obstruct the Kazakh justice and not to interfere in Kazakhstan’s internal affairs.

Declaration by the Presidency on behalf of the European Union on the parliamentary elections in Ukraine on 31 March 2002 Brussels, 10 April 2002

The European Union has taken cognisance of the international observer mission's preliminary report and notes the progress which Ukraine has made towards complying with international requirements as regards the parliamentary elections held on 31 March. It regards the presence of a large number of national and international observers as a positive development.

The European Union would also draw attention to the major flaws noted by the observers. It gives notice that, like the international observer mission, it will continue to monitor the electoral process in Ukraine until the final results have been certified before coming to any final conclusion on the extent to which these elections have been in compliance with the international undertakings and standards for democratic elections.

The European Union reiterates its readiness to cooperate with Ukraine to strengthen the strategic partnership between the two parties, on the basis of democratic principles and the rule of law. It is confident that these elections and the configuration of the new Verkhovna Rada (parliament) will help to strengthen institutions and the process of consolidating democracy and of reform in Ukraine.

The European Union expresses its satisfaction with the formal signature by the Government of Angola and UNITA of a memorandum of understanding in complement to the Lusaka Protocol for a cease-fire and other pending military issues.

The EU congratulates all parties involved in the process and the people of Angola for this agreement, and reiterates its solidarity commitment to assist the efforts made to consolidate, in a culture of dialogue and tolerance, the social and economic development of the country.

46/2002 Statement by the Presidency on behalf of the European Union Madrid, 11 April 2002

1. Today, at the United Nations headquarters in New York, the requirement of 60 ratifications for the entry into force of the Rome Statute, creating the International Criminal Court has been met. The European Union salutes this event, which is a step of great importance for the defense of fundamental rights of human beings and for the affirmation of law and justice in the world.

2. The European Union congratulates those States whose ratifications have made possible the establishment of the International Criminal Court and makes an appeal to other States to join the Statute so that the Court promptly reaches universality.

3. The European Union, which has actively contributed to the drafting, development and entry into force of the Rome Statute, reaffirms its commitment to support the early operation of the International Criminal Court in its seat at The Hague.

4. The International Criminal Court, the first great institution to come to life in the new millennium, will be an essential component in the struggle against impunity for acts of genocide, crimes against humanity and war crimes, which are serious crimes of concern to the international community. It deserves the wholehearted support of all of us.

Declaration by the Presidency on behalf of the European Union on the recent visit to Pyongyang of the South Korean Special Presidential Envoy, Mr Lim Dong-Won Brussels, 11 April 2002

The EU welcomes the positive outcome of the recent visit to Pyongyang (3-5 April) by the South Korean Presidential envoy, Mr Lim Dong-Won. The agreements that have resulted from this visit are encouraging and should be implemented in order to relaunch the inter-Korean dialogue process. Special importance should be attached to co-operation projects such as the fourth round of exchange of separated families, the next economic survey mission from the DPRK and the Seventh Round of the Ministerial Meeting.

The EU also expreses its satisfaction at welcome indications on the willingness of DPRK authorities to resume talks in the near future both with the United States and Japan.

The European Union is committed to helping enhance peace, security and freedom on the Korean Peninsula. It will continue to contribute further to the success of the current dialogue process between the DPRK and the Republic of Korea, which remains a key factor for the promotion of these ends.

Declaration by the Presidency on behalf of the European Union on Ethiopia/Eritrea (Boundary Commission Decision) Brussels, 15 April 2002

The EU welcomes the decision of the Boundary Commission announced in The Hague on 13 April. The final legal settlement of the position of the Ethiopia/Eritrea border is a central element of the comprehensive peace agreement signed by the leaders of Ethiopia and Eritrea on 12 December 2000 and the peace process between the two countries.

The EU stresses the need for the implementation of all the provisions of the comprehensive peace agreement and the cessation of hostilities agreement. In this regard, the EU pledges its full support to the UN mission to Ethiopia and Eritrea (UNMEE) which has an important role to assist Ethiopia and Eritrea in implementing the decision of the Boundary Commission. The EU also expresses its support to the Special Representative of the Secretary General, Ambassador Legwaila. The EU underlines that in order to fulfill their facilitation role, UNMEE and, particularly, the SRSG, require permanent access to the appropriate government authorities.

The EU urges both sides to safeguard the peace on the ground by fully respecting the temporary security zone and maintaining continued separation of forces and ensuring there is no unilateral movement of population or troops as these arrangements will set the conditions necessary for the process of demarcation to begin.

The war between Ethiopia and Eritrea had a devastating impact on both countries. The Boundary Commission Decision provides an opportunity for both parties to move forward and take the necessary steps to assist the normalisation of relations.

In this regard the EU calls upon the parties to further intensify dialogue with each other and other parties involved in the peace process, to ensure an orderly transfer of territorial control in line with the decision of the Boundary Commission.

The EU urges both parties to respect the rights of the individuals affected by the delimitation and demarcation of the border and to ensure that any movement of population will be carried out on a voluntary basis.

The European Union remains committed to support the peace process, especially through the Special Representative of the Presidency, Senator Serri. The EU also recognizes that international assistance is still required to address the immediate needs of civilians directly affected by the conflict, and declares its willingness to assist in both countries, within the context of implementation of the decision of the Boundary Commission, as well as to support all efforts towards normalization and lasting reconciliation between Ethiopia and Eritrea.

The European Union is concerned at the deterioration of the situation in Madagascar and condemns the outbreaks of violence and the human rights violations which have recently occurred there.

The European Union reiterates the urgent need for the senior Malagasy figures concerned to seize the opportunity afforded by their presence in Dakar to resume the dialogue under the aegis of the OAU in order to find a way out of the political crisis rocking the country and posing a potential serious threat to the future of the island.

The European Union urges the setting up of a government of national reconciliation, with the holding of new elections within six months as its chief objective.

The EU reiterates its readiness to provide political and technical support for such elections, inter alia by sending international observers.

The EU condemns the deliberate attempts to disrupt the running of the economy of the entire country and the free movement of goods and persons, and calls for a return to conditions conducive to an immediate resumption of economic and social activities.

Finally, the European Union confirms its willingness to continue implementing its assistance and cooperation programmes on the island, but notes that if there is no political agreement the worsening situation will affect the partnership between the European Union and Madagascar.

Declaration by the Presidency on behalf of the European Union concerning Madagascar Brussels, 22 April 2002

The European Union notes with satisfaction that Mr Ratsiraka and Mr Ravalomanana signed an agreement in Dakar on 18 April, under the auspices of the OAU and the UN and with the assistance of Presidents Wade, Kerekou, Gbagbo and Chissano.

The results achieved are in keeping with the objectives of the European Union: - pursuit of civilian peace; - respect for the principles of democracy; - political solution to the crisis.

The agreement is in line with the principles set forth by the European Union in its declaration of 17 April.

It is important that this agreement be applied in full with due regard for current Malagasy constitutional law and for public opinion. The European Union is prepared for its part to offer political and technical support for the implementation of the agreement and to assist in organising any elections, inter alia by sending international observers.

The agreement will enable the European Union to continue implementing its assistance and cooperation programmes.

Declaration by the Presidency on behalf of the European Union on constitutional reforms in Bosnia and Herzegovina

Brussels, 23 April 2002

The European Union welcomes the completion of the process of amendment of the constitutions in both entities of Bosnia and Herzegovina, in compliance with the Constitutional Court's decisions on the equal status of its constituent peoples throughout BiH.

The European Union commends those political leaders in both entities whose efforts have brought this constitutional reform process to a successful closing, in accordance with the 27 March Sarajevo Agreement. It also commends the efforts undertaken by the High Representative to facilitate those efforts. Other political actors of BiH, however, have cast some serious doubts on their abilities to engage as responsible partners of the International Community.

Bosnia and Herzegovina has taken an important step forward in terms of its democratic development and commitment to rule of law. The constitutional reform was indeed crucial for the future stability of Bosnia and Herzegovina and for the development of the country according to modern European standards. It signifies progress in BiH´s approximation to European structures. The European Union encourages all leaders of Bosnia and Herzegovina to fully embrace this outcome and to engage in a swift implementation of the constitutional reforms.

Declaration by the Presidency on behalf of the European Union on Bosnia and Herzegovina's accession to the Council of Europe Brussels, 24 April 2002

The European Union welcomes the decision by the Council of Europe inviting Bosnia and Herzegovina to become a member. It congratulates the authorities and the people of Bosnia and Herzegovina for the progress that has made this landmark achievement possible.

This is an important step forward on the road to European integration. With its admission into the Council of Europe, Bosnia and Herzegovina will commit itself to fulfil basic post-admission criteria in order to meet the standards of a modern democracy as a multiethnic, multicultural and united society. The International Community will follow closely this process.

Now that a major step has been accomplished, Bosnia and Herzegovina must make every effort to ensure the fulfilment of all the conditions included in the European Union road map as it moves forward to further rapprochement to Europe and towards the perspective of a Stabilisation and Association Agreement.

Declaration by the Presidency on behalf of the European Union to mark the fourth anniversary of the murder of Bishop Gerardi

Bulletin 13.05.2002 - EN - PE 313.430 48 GENERAL INFORMATION

Brussels, 24 April 2002

On 26 April 2002 it will be four years to the day since the brutal murder of Bishop Gerardi, co-ordinator of the Recovery of Historic Memory (REMHI) report documenting human rights violations committed during Guatemala's internal conflict.

On that anniversary the EU wishes to honour the memory of Bishop Gerardi. It welcomes the holding of the initial trial, but regrets that the crime has not yet been fully cleared up and that not all of the culprits, including the murder's instigators, have been brought to justice. The European Union will be keeping a particularly close watch on the appeal proceedings, which it hopes to see open shortly, as scheduled.

At the same time, the EU would reiterate to the Guatemalan State its concern at the persistent intimidation, threats and aggressions continuing to be suffered by members of human rights organisations, journalists and law officers. Over the last two months, too, threats have been received by members of the Guatemalan Forensic Anthropology Foundation (FAFG) and the Centre for Forensic Anthropology and Applied Sciences (CAFCA) as well as by members of the Catholic Church, including the priest at Santa Cruz del Quiché, Rigoberto Pérez, and Bishop Alvaro Ramazzini and Father Juan J. Aldaz of San Marcos Diocese, and an arson attack carried out on a parish church in Nebaj. All those recent occurrences are directly related to the work of those concerned or their support for efforts to establish the truth of past events or to exhume remains.

March 2002 also brought the murder of Jorge A. Rosal Zea, a Patriotic Party militant. In view of the nature of the crime and the victim's membership of a political party, that incident needs to be effectively investigated.

However, the European Union wishes to express its satisfaction at the convening of the Government's Security and Human Rights Cabinet and its offer to work with human rights organisations, in co-ordination with the judiciary, in order to have the issue seriously addressed.

The European Union again calls on the Guatemalan State to show, by its deeds, its resolve to investigate, prosecute and punish those responsible for such human rights violations and to put a stop to the impunity with which they continue to be committed. The EU would point out that the cessation of human rights violations, the proper administration of justice and national reconciliation were conditions set by the EU for future co-operation with Guatemala, at the last meeting of the Contact Group for the country (Washington, February 2002).

Brussels, 24 April 2002

The European Union urgently calls for medical and humanitarian organisations to have immediate access to the Palestinian population as called for in Resolution 1405 adopted last night by the United Nations Security Council, which stated its concern at the "dire humanitarian situation" of that population.

It stresses the importance of the initiative taken by the Secretary-General of the United Nations to obtain detailed information on the events that took place in the Jenin refugee camp; this initiative was endorsed by the Security Council and favourably received by the parties concerned.

The European Union calls upon all parties to make every effort to bring about a peaceful end to the siege of the Church of the Nativity in Bethlehem.

It warns against any use of force against the headquarters of the Palestinian Authority in Ramallah, which could endanger the physical safety of President Arafat and others on the premises.

The European Union is prepared to assist in finding a legal solution to the question of persons detained by the Palestinian Authority who are in the Palestinian presidential complex.

The European Union repeats the need for concerted and sustained international action to implement the Joint Declaration of the Quartet of 10 April 2002 and, in particular, the immediate application of Security Council Resolution 1402, as called for in Resolution 1403.

They will ensure that their national policies conform to that common position.

The European Union strongly condemns the recent arbitrary detention and degrading mishandling of prominent Liberian Human Rights lawyer, Tiawan Gongloe.

The EU calls upon the Government of Liberia to take immediate action to have the perpetrators of this serious abuse of Human Rights brought to justice.

The EU recalls the Government of Liberia’s recent commitment in the framework of consultations of the Cotonou Agreement to ensure improved respect for Human Rights, upholding of the Rule of Law and an end to the culture of impunity.

The EU has also noted with concern the closure by the police, on Thursday 28th April, of the newspaper The Analyst. Such acts are in clear contradiction with the Government of Liberia’s engagements to promote democracy and freedom of expression.

Declaration by the Presidency on behalf of the European Union on the situation in Burundi Brussels, 3 May 2002

Almost six months after the transitional institutions began to be set up, the European Union is extremely concerned by the continuing violence and worsening humanitarian situation, particularly in rural Bujumbura. Once again it urges all warring factions to respect the civilian population in the name of international humanitarian law, and all parties to respect human rights.

The European Union condemns once again the logic of war, still apparently being followed by the armed groups. It urges all armed factions to continue current talks with the firm intention of bringing them to a successful conclusion. At the same time the EU calls on the Burundian Government to pursue a transparent and coherent policy of reintegrating armed groups into the Burundian army. It encourages the efforts to negotiate a definitive and permanent ceasefire which are continuing under Gabonese/South African facilitation and with the support of Tanzanian mediation. The European Union is ready to support this process, provided that a timetable and precise objectives are announced.

The European Union also encourages the Government and all the transitional institutions to consolidate the reform process which has already begun by implementing the transition programme in accordance with the planned timetable, so as to construct a Burundian society which complies with the contents of the agreement and caters for all Burundians. Within this framework, the European Union expresses its willingness to continue to support this process.

The European Union notes the beginning of the operation for the voluntary repatriation of Burundian refugees in Tanzania under the Tripartite Agreement between the UNHCR and the Burundian and Tanzanian Governments. It points out that, in accordance with the Arusha Agreement, the return of refugees must be voluntary and take place in dignity with guaranteed security, taking into account the particular vulnerability

of women and children. The EU urges the armed groups to do everything possible to guarantee the security of refugees returning to Burundi. Reception mechanisms must be put in place before their return.

The Arusha Agreement also provides that preparatory activities are to be undertaken with a view to the rehabilitation and resettlement of refugees and displaced persons, such as the establishment of a National Commission for the Rehabilitation of Sinistrés, a Sub-Commission on Land and a National Fund for Sinistrés (Protocol IV, Chapter 1, Article 2(2)(c) and (d) and Articles 3 and 9). The EU calls on all the parties involved to deal with the question of the Burundian refugees' return home in unhurried fashion and with all the desired guarantees. It also asks that equal attention should be paid to all the victims of the Burundian crisis, including the internally regrouped and displaced.

The Central and Eastern European countries associated with the European Union, the associated countries Cyprus, Malta and Turkey, and the EFTA countries, members of the European Economic Area align themselves with this declaration.

- Key points: The broad economic policy guidelines for 2002 are being formulated at a time when the EU's constitutional convention is meeting and when euro notes and coins have been successfully introduced.

There is a discrepancy between the success of the monetary union, on the one hand, and the EU's failure up to now to exploit its tremendous potential for employment and growth. Consequently, economic policy procedures and the content of economic policy need to undergo thorough reappraisal. The impending enlargement of the EU also makes it urgently necessary to reconsider the procedures for coordinating economic policy. For these reasons, the ESC has put forward, in this opinion, a number of initial suggestions covering the coordination procedures and the content of economic policy.

A consistent policy should also include targets for reforming pensions systems so as to allow for the ageing population and financing public investments in key areas in accordance with the conclusions of the Lisbon summit. As to public finances, in the Committee's view a policy for high growth rates is the best debt reduction policy.

In order to ensure that statistics are more neutral, the Committee also thinks that the activity of private agencies working directly or indirectly within the ESS should be monitored.

Lastly, the Committee thinks that Eurostat's funding should be increased, with greater involvement of Member States' governments and a coherent role for the Commission.

- Key points: The concept of integration put forward in the present opinion is defined as "civic integration", and is based on bringing immigrants' rights (including access to nationality and citizenship and the right to vote) and duties, as well as access to goods, services and means of civic participation progressively into line with those of the rest of the population, under conditions of equal opportunities and treatment.

The European Commission must take the initiative and prepare a wide-ranging Community framework programme to promote the social integration of immigrants and refugees in the EU.

The role of civil society and its various components, including the European Economic and Social Committee in its capacity as representative body of organised civil society, is very important. During 2002, the European Economic and Social Committee plans to hold a conference in conjunction with the Commission on immigration and social integration in order to consolidate its role.

• Criteria and mechanisms – asylum requests Rapporteur: Mr Sharma (Various Interests – UK)

- Key points: The Committee's conclusion is that this Regulation is bringing into Community law the main features of a substantially flawed Dublin Convention. Even after the improvements proposed by the Commission, we will not have a Regulation that is clear, workable, effective, fair and humane.

The Committee does accept, however, that there may well be a political imperative to proceed with this Regulation at this moment in time. It therefore notes the greater emphasis which is put on the principle of a Member State’s responsibility for illegal entrants into its territory and those who have been resident illegally for a considerable length of time. The Committee also welcomes the greater importance attached to family unity, although this falls well short of the Commission’s proposals on family reunification. The Committee welcomes the much shorter procedural deadlines which it hopes will lead to earlier determination of asylum applications.

• Compensation – crime victims Rapporteur: Mr Melícias (Various Interests – P)

- Reference: COM(2001) 536 final – CES 353/2002

- Key points: Given that the main issue here is the best way to deal with the situation of cross- border victims, the Committee reiterates the view that in order to avoid the difficulties raised it is necessary to strive for the most stringent common standard possible, setting different starting levels and establishing subsequent steps to bring about a gradual alignment.

A strong emphasis must be placed on the principle of solidarity and equal treatment for people throughout the common area. The adoption of a maximum reference standard must mean that the Member States reach a minimum common denominator. To this end, the progressive development targets must be defined in terms of both content and timescale, and penalties must be devised for those who fail to meet them.

The proposal to apply a complementarity principle might prove difficult in practice, as most State compensation decisions are based not on objective legal criteria but on principles of fairness. This could lead to a dual assessment. It is just one point for discussion, as is the possibility of achieving complementarity by setting up a European fund in which the Member States would – via their respective contributions – converge towards the standard and to the agreed level of compensation.

• Hospice work – an example of voluntary activities in Europe Rapporteur: Ms zu Eulenburg (Various Interests – D)

– Reference: Own-initiative opinion – CES 350/2002

–Key points: The opinion focuses on hospice work as an example of voluntary commitment, in order to illustrate the kind of work volunteers do and the conditions necessary for this. Voluntary work is a major force in shaping social solidarity and participative democracy. It is unpaid and creative, entailing commitment and personal involvement. On the basis of an analysis of voluntary work and experience in hospices, thought needs to be given to ways in which society can specifically promote voluntary work.

The Committee makes the following general proposals: Policy to promote voluntary work must promote dialogue between the supporting associations, authorities and social facilities. Forums and/or exchanges for volunteers must be established, providing detailed information on the many opportunities and areas of voluntary work at regional, national and European level. Financial and staffing provision must be made for the basic and further training and supervision of volunteers during their service. Research should be carried out into the basic conditions for voluntary work. Continuity of organisation, administration and basic counselling of volunteers must be ensured by a minimum presence of full-time professional staff. Statutory cover for risks to life and limb should be available to protect the livelihoods of the volunteers themselves and their families.

3. LISBON STRATEGY

- Key points: Social responsibility together with economic success contribute to a company's sustainability. It is therefore important to see social responsibility as a long-term undertaking, as a strategic investment.

Corporate social responsibility (CSR) is not just about creating and safeguarding employment; it is also about developing better jobs with adequate health and safety at work, taking the needs of people with disabilities into account and promoting a culture of lifelong learning. Socially responsible behaviour means companies applying existing social rules in a committed way and endeavouring to build up a spirit of partnership. This also means developing labour relations and promoting negotiations with and participation of workers. The principles of CSR at global level are often enshrined in ILO agreements.

The principle that CSR measures are voluntary is particularly important in the EESC's view. Establishing detailed, binding pan-European rules would not be appropriate. Uniform, detailed CSR standards create a risk of companies, especially SMEs and companies in the social economy, being forced into a straitjacket. Companies should have the option of developing tailored, sector-specific and particularly efficient approaches that are appropriate to their specific situation. General European principles agreed by the social partners could help to promote more widely the CSR practices that many companies are already applying. The EESC therefore explicitly welcomes action by the social partners to flesh out certain aspects of CSR, e.g., in the spheres of occupational health and safety or promotion of equal opportunities. The specific EU context of CSR could be developed on the basis of joint initiatives and voluntary agreements between the social partners. The Commission could enhance transparency, coherence and good practice in this sphere by promoting partnership between the key CSR players.

CSR has both qualitative and quantitative aspects, varying according to sector and business situation, which means that monitoring and evaluation must also be managed differently.

The EESC believes it is particularly important to invest in civic pride. Businesses can improve the climate for civic commitment by rewarding socially responsible behaviour and providing incentives to encourage staff to be socially committed.

• The Future of the CAP Rapporteur: Mr Ribbe (Various Interests – D)

- Reference: Own-initiative opinion including two referrals from the European Parliament: – "Rural development in the framework of Agenda 2000" – ref. T07301 – "Interim situation concerning reform of common market organisation in respect of Agenda 2000" – ref. T07464 – CES 362/2002

- Key points: The own-initiative opinion on the Future of the CAP responds to the referrals from the EP on the intermediate re-examination of the CAP in the framework of Agenda 2000. The opinion, which is the outcome of intense dialogue between environmentalists, farmers and consumers and was also the subject of a hearing in London, sets out a series of innovative suggestions.

Following a detailed discussion of the CAP's history and a wide-ranging analysis of its ups and downs, the EESC closely examines the concept of "multifunctional agriculture" and points out how European farmers will have to provide additional services (quality of foodstuffs, environmental protection, animal welfare). Compensation – in the form of direct payments - for these additional services might form the socially acceptable basis for income-support measures for EU farmers.

The Committee would ask the Commission to consider whether, in future: a) a multi-tiered and varied system of direct payments is feasible, which is directed at active farmers who produce to harmonised European environmental standards; b) the first pillar of the CAP could be enhanced with new forms of support which enable each Member State to strengthen its support for those farms which accept additional commitments with regard to quality improvement, environmental protection and the safeguarding of jobs.

The Committee calls on the Commission to examine the possibility of making direct payments in the form of a standard per hectare premium to all farmers practising multifunctional agriculture.

The Committee would stress that in order to bring about overall progress in rural areas, Structural Fund measures must also be adequately applied.

The Committee considers it essential that research be conducted into the possible impact of the abolition of milk quotas and other quota systems on regional economies.

6. CONSUMER AND ENVIRONMENTAL PROTECTION

- Reference: COM(2001) 182 final – 2001/0180 COD – CES 358/2002

- Key points: The use of GMOs has led to a great debate in society, in the course of which extreme positions lacking any serious scientific foundation have frequently been adopted. The Committee therefore recommends that the Commission carry out a public information campaign publicising the advantages and risks of the use of GMOs, in relation to food for human consumption, animal feed and the environment. Information produced by independent bodies is essential to help people make informed choices about the food they eat, including on an environmental and ethical basis, and concerning the technologies by which they are produced.

The proposed regulation for the labelling and traceability of products containing or consisting of GMOs at all stages in the food chain takes account of the precautionary principle and enhances transparency as a prerequisite for the consumer's freedom of choice.

However, for foods and feed products in which genetically modified material is no longer present but has been used, the traceability and labelling requirements are difficult to verify, which could lead to unfair practices and fraud. Appropriate additional resources should be allocated at Community and national level to ensure the effective implementation and control of the proposed legislation, so as to avoid diverting such resources from their fundamental mission: to monitor the safety of food and feed products. The Committee underlines that the costs of the new technology should fall on GM producers and products rather than on the traditional products through 'GM free' labelling. National governments in Europe and the EU's political bodies must ensure that more stringent requirements are also brought in at international level to protect humans and the environment.

It is unacceptable in the view of the Committee that neither this proposal nor the proposal for a Directive which has been submitted on environmental liability clarifies the issue of liability for GMOs.

• Consumer protection Rapporteur: Ms Davison (Various Interests – UK) - Reference: COM(2001) 531 final – CES 344/2002

- Key points: The Committee welcomes the Commission's initiative which responds in part to EESC proposals for simplification of legislation and a greater commitment to consumer protection1.

The Committee has been exploring the options for self regulation and co-regulation and considers that a general requirement for fair commercial practices could provide a basis for a more flexible approach to the detail of consumer protection in this area, although not for contract law.

However, the Committee would like to emphasise that the proposal for a framework directive and a general clause cannot be fully assessed on the basis of the Green Paper. In particular, further details are needed on mechanisms to be put in place to guarantee unified application and a level playing field across the EU. The Committee would propose the use of Article 153. The Committee points to

a shortage of coordinated EU research on consumer issues and asks the new Framework Programme on Research to address this.

The general clause should be complemented by a series of definitions of practices, which should be considered as unfair.

A "grey" list of practices should also be included, which require vigilance because they could involve unfair practices, under certain defined and precise circumstances. Guidelines should be produced.

The Commission should consider the establishment of minimum EU standards of enforcement, based on a number of key principles such as efficacy and independence, and monitored by the Commission. The Commission should also establish a periodical evaluation of co-regulation and self-regulation schemes each two to three years, drafting a report on the experiences of self regulation in the member states and suggesting improvements.

The Commission could consider a scoreboard on implementation of consumer legislation similar to that of DG Markt on the Single Market.

There is also a need to develop European consumer education so that consumers themselves take action to secure their rights. The Committee regrets that the Commission tends to limit the concept of "consumer protection" solely to "economic interests".

7. INTERNAL MARKET

• European Company Statute for SMEs Rapporteur: Mr Malosse (Employers– F)

- Key points: In its own-initiative opinion the Committee calls for the setting-up of a simplified European statute for SMEs, as a complement to the European Company Statute.

An analysis of needs confirms the necessity for a European company project for SMEs, above all so that they can be treated on an equal footing with bigger companies - which are more concerned by the European Company statute - and to offer them a European label to facilitate their activities in the internal market.

To make it attractive, the new statute will have to remove the risk of multiple taxation and provide considerable legal flexibility, as well as facilities regarding setting-up formalities, advice and support for enterprise partnerships

The ESC would set this project in the context of the conclusions of the European Council in Lisbon, i.e. improving European competitiveness and entrepreneurship and creating new activities and jobs. It must also promote employee participation at European level, a factor on which the success of integration depends.

- Key points: The Committee approves most of the initiatives contained in the Commission’s Communication. It agrees that there is a need to inculcate new habits and working methods and to develop a new administrative and political culture, welcomes the Commission’s intention to achieve a 25% reduction in the volume of existing legislation by the end of the current mandate and anticipates that this will produce a commensurate improvement in their quality.

The Committee fully agrees with the Commission’s commitment to strengthen and intensify the consultation process, reiterates the approval which it has previously expressed for the Commission’s plan to promote the use of co-regulation, and agrees with the Commission on the need for Member States to ensure that Community acts are transposed into national legislation correctly and within the set deadlines.

The Committee stresses the importance of introducing Regulatory Impact Analysis as part of an integrated decision support process, at both European and Member State level, and considers that the Council should create a Regulatory Assessment Office at European level and that the Member States should replicate this organisation in their national territories.

As its contribution to the finalisation by June 2002 of an action plan for improving and simplifying the regulatory environment, the Opinion sets out a plan of 59 specific points, directed not only towards itself, but also towards the Commission, the Council, the European Parliament, the Committee of the Regions, and the Member States.

It also considers that in order to meet further strong growth in personal and goods traffic more targeted investment in both the rail and shipping sectors needs to be made.

It also stresses the importance of combined, integrated modes of transport and points to the increasing significance of intelligent traffic management systems and considers that too little consideration has been given to links with the applicant countries. All projects must take into consideration a series of aspects such as economic viability, environmental law, spatial and land-use planning and sustainability. Finally, it supports raising the minimum rate of Community financing for certain projects, which make an important contribution to TEN objectives, from 10% to 20%.

The Cooperation Council should establish a permanent consultative forum which is composed of the main components of organised civil society. The task of this forum would be to advise the cooperation bodies at different levels;

The ESC expresses its preparedness to participate and assist in forthcoming EU actions to achieve a dynamic EU-Russia partnership. Relations between Russian and European civil society organisations should be improved. The ESC would therefore penetrate appropriate ways to create and encourage regular contacts and dialogue with main actors of Russian organised civil society.

Changed Web and E-Mail Addresses The introduction of the .eu domain also required the web and e-mail addresses of the European institutions to be adapted. Below please find a list of addresses found in the document at hand which have been changed after the document was created. The list shows the old and new address, a reference to the page where the address was found and the type of address: http: and https: for web addresses, mailto: for e-mail addresses etc.
