II) CPLA NO. 213-P/2010 AITISAM – UL – MULK VS CHITRAL SCOUTS AND OTHERS.

Requirement To consider grant of loan amounting to Rs. 96,000/- (in cash) for filling subject appeals before the Supreme Court of Pakistan, Islamabad as requested by the MEO, Peshawar vide letter No. PESH/L-E/2007-08/Psc dated 12-11-2019. The said amount / loan will be refunded reimbursed after approval from the Competent Financial Authority.

Authority Ministry of Defence, Govt: of Pakistan vide letter No. 3/36/LE&H/ML&C/09/Loan/ 2/11/D-12/16, dated 11-02-2016 and ML&C Deptt: letters No. 3/30/LE&H/ML&C/ 2000/Atd, dated 08-12-2016 & No. 14/44/LE&H/ML&C/ 2003/Gen, dated 07-03-2003 the Competent Authority (i.e. DG ML&C) directed that the Cantt Boards/CEOs will honor the MEOs’ request for loan in such cases as a first priority without delay to avoid financial loss to the State.

Budget Provision Budget Provision exists in Head N-4 of the Sanctioned Budget Estimates 2019-20.

Points to be considered Whether grant of loan to MEO, Peshawar be approved or otherwise.

RESOLUTION The Board considered and approved the grant of loan amounting to Rs. 96,000/- (in cash) to MEO Peshawar for filling subject appeals before the Supreme Court of Pakistan, Islamabad as requested vide MEO Psc letter dated 12-11-2019.

SCHOOL FEE CONCESSION / EXEMPTION TO DESERVING STUDENTS

Reference: Recommendations of Principal, CPHS & College Khadim Hussain Road Peshawar Cantt

Requirement To consider recommendations of the Principal, Cantt Public High School & College Khadim Hussain Road Peshawar Cantt regarding grant of concession/exemption/relaxation in

monthly fee of students of different classes who are found default in payment of their monthly school fee, however, their academic performance are satisfactory, therefore, keeping in view their best academic performance, their cases may be considered for relaxation / exemption in school fee, as these students are un-able to pay their school fees being poor / orphan /deserving:-

The case file is placed on the table for Board’s consideration.

RESOLUTION The Board considered and approved in principle the relaxation/exemption in school arrears/default fee accumulated until revision of school fee, for those deserving students who have secured 80% and above marks. The Board further resolved that the revised fee shall be payable by them accordingly.

SANITATION BRANCH

ITEM 4

SANITARY REPORT

Requirement To read and note the monthly sanitary report for the month of October 2019.

Legal Provision: Section 129 of the Cantonments Act, 1924.

(1) The Health Officer shall exercise a general sanitary supervision over the whole cantonment, and shall submit monthly to the [Board] a report as to the sanitary condition of the cantonment, together with such recommendation in connection therewith as he thinks fit.

(2) The Assistant Health Officer shall perform such duties in connection with the sanitation of the cantonment as are, subject to the control of the 1 [Board], allotted to him by the Health Officer.

The case file is placed on the table for Board’s consideration.

RESOLUTION: The Board read and noted. The Board resolved that the instructions/observations as contained in the Sanitary Report furnished by the Health Officer be complied with and steps should be taken for improvement of sanitary position of Cantt area.

ITEM 5

CIVIC AWARENESS PROGRAM & BAN OF POLYTHENE / PLASTIC BAGS

Requirement To consider: -

a) Imposition of ban on use of all kind of plastic / polythene bags in Cantt limits. The Board vide CBR No.21 dated 30-4-2019 & CBR No.5 dated 28-6-2019 approved the proposal for imposition of fine in case of noncompliance of order of the Board regarding ban on use of polythene bags and fines was imposed w.e.f. 10 June 2019. However, it has been observed that different microns of biodegradable bags are being used by the shopkeepers as well as fake stamped bags were also identified during course of inspection. It is, however, proposed to completely ban the single use of plastic bags and encourage usage of paper / cloth bags for shopping.

b) Launching of awareness campaign “Civic Awareness Campaign” Launching of Civic Awareness Program regarding disposing off house hold waste through technical methods to prevent environment from pollution initially as a pilot project

 to prevent and reduce the rapidly increasing environmental pollution in Pakistan, and to technically dispose of the waste generated within our villages, cities, and populations

 to reduce the growing temperature of Pakistan, which is also caused by burning of waste/garbage, to prove to be a good citizen

Legal Provision Rates were called from the firms vide Quotation Notice as required under Rule 42(b) of the Public Procurement Regulatory Authority (PPRA) Rules, 2004.

As per ML&C Deptt: instructions and PPRA Rules 2004, Rule 40 says “Save as otherwise provided there shall be no negotiations with the bidder having submitted the lowest evaluated bid or with any other bidder”.

Budget Provision exists under head F-4(b) of the Budget Estimates 2019-20.

Recommendations of Procurement Committee: Rates as mentioned in column 4 above have been found lowest and reasonable (as compared to the local market rates) as verified by the Procurement Committee.

Point(s) to be considered: Whether to approve the lowest rates mentioned in column 4 above or otherwise?

RESOLUTION: The Board considered and approved the following: -

a) Imposition of ban on use of all kind of plastic / polythene bags in Cantt limits and implementation of fine (approved vide CBR No.5 dated 28-6-2019) w.e.f 15th December, 2019. Awareness campaign be launched to encourage usage of paper/cloth bags for shopping.

b) Approval of lowest rates of Rs. 476,250/- offered by M/s Swift Suppliers, Peshawar for provision & installation of banners and carrying out awareness campaign regarding anti polythene & Civic Awareness Program as mentioned on agenda side.

APPROVAL UNDER SECTION 25 OF THE CANTONMENTS ACT, 1924

APPROVAL OF NOTE UNDER SECTION 25 OF THE CANTONMENTS ACT 1924 – APPOINTMENT OF REGIONAL EDUCATIONAL COORDINATOR

Reference: Interview held on 29-10-2019.

Requirement To note / confirmed action taken by the Cantonment Executive Officer, Peshawar with the prior approval of President Cantt Board Peshawar under section 25 of the Cantonments Act, 1924 regarding contract appointment of Ms Huma Alam as Regional Educational Coordinator (Peshawar Region) for a period of one year which will be extendable on requirement as well as satisfactory performance, on fixed pay of Rs. 120,000/- per month.

This office invited applications for filling the post of Regional Educational Coordinator for Peshawar Region, Peshawar vide publication in Daily “The News” dated 29-8-2019, Daily “Nawa-e-Waqt” Rawalpindi / Islamabad dated 30-8-2019, Daily “Express” Peshawar dated 29-8-2019 and Daily “Mashriq” dated 29-8-2019 and 29 candidates submitted application/documents for the subject post who were interviewed on 29-10-2019 by the Interview Committee comprising (i) President Cantt Board Peshawar / Sta Comd Peshawar (2) Director ML&C Peshawar Region, (3) Cantonment Executive Officer, Peshawar Cantt (3) Addl: Cantonment Executive Officer, and (4) Rep of HQ ML&C (Education Consultant HQ ML&C).

The interview committee has selected the following candidate: -

RE-HIRING OF CANTT BOARD PROPERTY NO.06 FOR THE OFFICE ACCOMMODATION OF DML&C AND MEO PESHAWAR

Reference: CBR No. 5 dated 31-7-2018.

Requirements To consider re-hiring of Cantt Board Bungalow No.06 for the office accommodation of (DML&C and MEO Peshawar) situated at Sahibzada Gul Road Peshawar for the next triennial period w.e.f. 1-12-2018 to 30-11-2021. The Board vide CBR No. 5 dated 31-7-2018 considered and resolved to revise / rationalize the monthly rent of Cantt Board Bungalow No.06 for the office accommodation of (DML&C and MEO Peshawar) situated at Sahibzada Gul Road Peshawar Cantt @ 10% enhancement of building rent for the three years w-e-f 01-12-2015 to 30-11-2018.

CANCELLATION & RE-AUCTION OF CANTT FUND UNITS

Requirement To consider cancellation of the tenancy rights of the following Cantt Fund Properties owing to default in payments on account of (premium & income tax) in the light of CBR No. 16 dated 28-6-2019 wherein the Board resolved to cancel and re-auction of Cantt Fund Units i.e. UG-06, Al-Nafa Markaz Block A, and Flats No.01, 02, & 03, SF CB Plaza Fakhr-e-Alam Road Peshawar Cantt after 15-7-2019 owing to non-deposit of premium/income tax for the long outstanding period and even after grace period allowed by the Board from time to time. The Board further resolved that already deposited sums by the highest bidders in respect of these units be forfeited towards Cantt Fund as a penalty for wasting time & money of Cantt Board Peshawar after giving an opportunity for additional period of 15 days i.e. till 15-7-2019. However, the following amounts are still outstanding: -

Earlier the case for cancellation and re-auction of the tenancy rights of the following Cantt Fund shops owing to non-recovery of premium & income tax in the light of CBR No.15 dated 31-1-2019. The Board vide CBR cited above considered and deliberated the case at length that various notice were served and notices also published in newspapers for remittance of balance amount, but due to non-provision of electricity connection to the Cantt Fund premises the highest bidders have not deposited the bid / balance amount. The Board directed that immediate measure should be adopted for provision of electric connection to Cantt Fund premises. The Board further resolved that three months-time be given to the highest bidders of Cantt Mall (S.No. 6 to 15) and one month time be given to the highest bidders of other Cantt Fund properties (S.No. 1 to 5 & 16 to 19) as mentioned on agenda side. The Final Notice in this behalf be served immediately with no exception beyond given timeline and in case of non-compliance re-auction notice be published and already deposited amount be forfeited towards Cantt Fund Account at their risk and cost.

Point to be considered Whether the tenancy rights of above referred shops be cancelled and put the same for re-auction or otherwise.

The case is placed before the Board for consideration.

RESOLUTION The Board considered and resolved to cancel and re-auction of the above said Cantt Fund Units after 15-12-2019 owing to non-deposit of premium/income tax for the long outstanding period and even after grace period allowed by the Board from time to time. The Board further resolved that already deposited sums by the highest bidders in respect of

these units be forfeited towards Cantt Fund as a penalty for wasting time & money of Cantt Board Peshawar after giving an opportunity for additional periods.

ITEM 9

AUCTION OF COLLECTION RIGHTS OF 2 x GROUP LATRINE (ARBAB ROAD & SHABA BAZAR), CANTT BOARD PESHAWAR

Reference: Auction proceeding held on 06/11/2019.

Requirement:- To consider approval of auction of collection rights of newly constructed 2 x Group Latrine situated at Arbab Road & Shoba Bazar Peshawar Cantt held on 06-11-2019.

Legal Provision All measures of publicity i,e. notices was published in newspapers i.e. Daily “Aaj” Daily “Paighamat” & Daily “Ausaf” each dated 19-10-2019 and also displayed on Cantt Board Peshawar website.

The major terms & conditions of auction were as under: - a. Tenure of the above mentioned contract w.e.f 07th November, 2019 to 30 June 2020. b. Every person / individual will deposit earnest money Rs. 3,00,000/- in the shape of CDR in favour of CEO alongwith CNIC copy.

c. The successful bidder will deposit 04 months of the bid money along with Income Tax in advance and also deposit 02 x post-dated cheques for 2nd and 3rd installment (02 months each).

d. Successful bidder will be bound to collect the fee as per rates approved by the Board.

e. Contractor will be bound to produce a non-judicial stamp paper for the execution of necessary agreement in this respect.

f. Contractor will collect fee through his own staff.

g. The CEO / Cantt: Board is authorized to reject or accept any bid on technical/administrative grounds.

h. Owing to current security condition in the region, Cantt Board will not be responsible for any loss.

i. That the contractor will have to abide by all Cantt Board Rules/Bye Laws/ instructions, in case of non-compliance the Board has the rights to cancel the agreement.

Rule 98 of Cantonment Account Code, 1955 is reproduced as under: “98 Conduct of Auction.- Every auction of lease of land and buildings, and of sale of movable and immovable property, trees and stores, etc., belonging to the Board,

shall be held in presence of the Executive Officer or such other Officer as he may depute in this behalf”.

Auction was held in the presence of the representative of Station Headquarter and Addl: CEO, Cantt Board Peshawar.

AUCTION OF CANTT BOARD SHOPS, CANTT BOARD PLAZA WARSAK ROAD & F.A ROAD, PESHAWAR CANTONMENT

Reference: Auction proceeding held on 08-11-2019

Requirement To consider the auction proceeding of Cantt Board shops and flat in Cantt Board Plaza, Warsak Road, Arbab Road & Fakhar-e-Alam Road in Peshawar Cantonment held on 08-11-2019.

Legal Provision All measures of publicity i,e. notices were published in newspapers i.e. “Daily Jang” , “Daily Mashriq” dated 11-05-2018 & “Daily Nawa-i-Waqt” dated 16-10-2019 and displayed on Cantt Board Peshawar website.

The major terms & conditions of auction were as under: - 1. Every person / individual will deposit Rs. 5,00,000/- for 1st floor in the shape of CDR in favour of CEO in respect of Cantt Board shops situated at Warsak Road, Arbab Road and Fakhre Alam Road alongwith CNIC copy.

2. If a Person appears on behalf of other person, then the original bidder will provide a copy of authority letter.

3. The successful bidder will be bound to deposit 50% premium amount of the highest bid alongwith entire Income Tax should be deposited on the next day of auction & the remaining 50% amount should be paid within 30 days from the dated of auction.

4. Monthly rent will start from the date of possession.

5. All those people who are defaulter of Cantt: Board Peshawar will not be allowed to participate in auction

6. That the monthly rent shall be payable in advance on or before 5th of each month in the office of the Cantonment Board Peshawar, without any notice of demand.

7. That the tenant shall use and occupy the premises in a fair and reasonable manner and to keep the same along with the ground in front of the premises in a sanitary condition.

8. That the tenant shall carry out periodical maintenance/repairs such as white wash/ distemper, painting etc of the premises at his own expense/cost.

9. That the tenant shall not assign, underlet, transfer of part –with possession of the said premises or any part there of any of his right or interest therein under present not even to a partner in business without prior permission of the Lessor/Board.

10. That the tenant shall peaceably hand over the premises in reasonable state of repair on the expiration of lease if not renewed as per conditions as laid down in the pre- amble above.

11. That the tenant shall not put the property to any other use except for the using as originally allotted.

12. That the Lessor has the right of re-entry into the premises at any time to take possession of the same for the specific / purpose by giving 30 days notice and the tenancy rights shall be deemed to have been determined at the end of the period of the notice. The tenant shall not be entitled to any compensation whatever.

13. That the tenant shall on the expiry of the term, as above or sooner determination of tenancy period peacefully, hand over the premises in good state vide conditions above. If the tenant fail to do so and continuously hold over the premises he shall be liable (beside the forfeiture of security, Clause (1) to pay ten times increased rent reserved hereinbefore, with effect from the date of such holding over till vacates the premises or is ejected there from.

14. That the tenant shall not install, construct, remove or cause to be constructed or removed any pipe or electricity connections, chappers or any other structure in the premises hereby demised without the specific sanction of the Lessor without the consent in writing of the Cantonment Executive Officer. Any addition / alteration made to the premises by the tenant with or without the consent in writing of the

Executive Officer shall be deemed the property of the Cantonment Board Peshawar.

15. That if the tenant shall die before the expiry or determination of the tenancy period, the legal heir or heirs of the persons so dying shall, if so permitted by the Lessor under the Rules become entitled to hold the said premises for the remaining period of the tenancy on the condition of this lease and if there shall be no person who shall so become entitled to this lease shall be deemed to have been determined as from the date of the death of the original tenant.

16. That from time to time and at all time, during the said term the tenant shall pay and discharge all rates, taxes, charges and assessment of every description which are now or may at any time hereafter during the said term be imposed, charged or assessed with regards to the said premises.

17. That if and whenever any part of the rent hereby reserved shall be in arrear or unpaid for the seven days next day’s next after any of the days on which the same shall become due whether Cantonment Executive Officer, Peshawar any breach on the part of the tenant, his heirs and assigns of any of the covenants or conditions herein contained, then and in such cases the Cantonment Executive Officer, Peshawar shall be at liberty at any time thereafter to seal and close the said premises without determining the lease till the amount of the rent due has been paid and cleared by the tenant or to enter into possession of the said premises where upon this demise shall absolutely determine and the tenant shall not be entitled to any compensation.

Force Majeure; Neither party, hereto, shall be held responsible for any delay or failure to perform any or all of the obligations imposed upon such party by the case of “Force Majeure” shall means cause of causes beyond the control of the either party that may intervene after the formation of the agreement and includes the acts of God, natural calamities (flood, storm, earthquake, fire, epidemic etc), industrial disturbance, lock-outs, strikes, terrorism, acts of public enemy, wars, riots and any other similar event which by the exercise of due diligence neither party is able to overcome.

23. All the bidders will be bound to follow the terms & condition of auction notice.

24. In case of non-compliance of the above mentioned terms & conditions, the already deposited amount (Call Deposit / Cheques) will be forfeited in Cantt: Fund.

25. The CEO/Cantt Board is authorized to reject or accept any bid on Technical / Administrative grounds.

REVISION OF ANNUAL VALUATION TABLE

Reference: CBR No.113 dated 5-5-2009, CBR No.33 dated 12-11-2015, CBR No.43 dated 21-12-2015 and CBR No.15 dated 29-3-2019.

Requirement: To consider proposal regarding revision of annual valuation table in respect of Peshawar Cantonment for the purpose of calculation of TIP Tax etc from 1st January 2020 onwards.

In this connection, it is mentioned that Annual Valuation Table was prepared by the Evaluation Committee for the year 2007 in Peshawar Cantonment on residential & commercial basis which was revised by the Board vide CBR under reference and the following increases on the rates of 2007 were made; -

1) Residential 25 % increase on existing rates. 2) Commercial 50 % increase on existing rates.

However, these rates are on extremely lower side as compared to the current market rates. Furthermore the DC rates have also been revised, thus, the same needs rationalization.

It is pertinent to mention that 5 % enhancement / increase for each year made as per ML&C Deptt: letter No.555/111/Lands/ML&C/2003 dated 22-11-2003.

CBR No.43 dated 21-12-2015 The Board considered the proposal regarding revision of annual valuation table in respect of Peshawar Cantonment and approved the proposed rates as mentioned in column-7 of the TOV mentioned on agenda side for a period of one year w.e.f. from January 2016. The Board further resolved that in case the DC rates are revised at any subsequent stage in the aforementioned period, the TOV be placed before the Board for re-consideration of rates accordingly.

Requirement To consider application dated 08-10-2019 submitted by the M/s Mascot Consultants requesting therein for payment of final bill regarding consultancy charges for planning / designing of CB Commercial Building named “Cantt Mall”, Saddar Road / Fakhr-e-Alam Road, Peshawar Cantt.

History of the case M/s Mascot Consultants was awarded the planning / designing of Cantt Board Commercial Building named “Cantt Mall” situated at Saddar Road / Fakhr-e-Alam Road, Peshawar @ Rs. 1.89% of the total estimated cost of the project.

An estimate amounting to Rs. 257.450 (m) was sanctioned by the Competent Financial Authority for construction of the said commercial project and an amount of Rs. 4.530 (m) was sanctioned in the estimates on account of consultancy charges. Out of which an amount of Rs. 4.149 (m) has already been paid to M/s Mascot Consultants.

During the course of construction, the estimate was revised from Rs. 257.450 (m) Rs. 307.910 (m) and thus an amount of Rs. 0.953 (m) was also increased in the consultancy which comes to Rs. 5.819 (m). The balance consultancy charges i.e. Rs. 1.670 (m) has not been carried over in the last two financial year of the Budget Estimates. The detail is as under;

In response of the above mentioned letter, M/s Mascot Consultants submitted only preliminary design which is placed in the file and as per Article 7 of the contract agreement only 25% of the total estimated cost is required to be paid to consultant firm. The detail is as under:-

 Total covered area of the plot = 7680.00 Sft.  Estimated Cost @ Rs.2500/- per sft. (cost of const) = Rs.49,31,22,392/-  Total consultancy charges @ Rs.1.89% = Rs.93,20,013/-  25% consultancy charges payable = Rs.23,30,003/-

Requirement To consider application 14-11-2019 submitted by M/s Nayatel requesting therein for waiving off the restoration charges on the basis that the restoration of civil work to be carried out by them to the entire satisfaction of CBP and adding of remaining area in the 2nd Phase.

The completion of Phase-I is satisfactory as verified by the Engineering Branch.

CBR No. 33, dated 30-09-2019. The Board considered and approved to grant NOC for Phase-II for installation of fiber optic network cable by M/s Nayatel Pvt Ltd, subject to payment of re-instatement charges and ROW charges as follows:-

1) IRC = Rs.82,48,160/- 2) ROW Charges = Rs.38,41,020/- Grand Total = Rs.1,20,89,180/-

In pursuance of the CBR under reference, M/s Nayatel were intimated vide CBP letter dated 07-11-2019 to execute a contract and agreement for execution of Phase-II and deposit IRC & ROW charges.

In response thereof, M/s Nayatel vide application dated 14-11-2019 requesting therein for issuance of fresh demand note by adding the areas missed out and waiving off the restoration charges.

Fresh Survey has been carried out by the Engineering Branch and calculated the following charges as per rates approved by the Board:-

1) Re-instatement Charges of underground cables o Total length = 15762.00 Mtrs. OR 51715.00 Ft. o Total Charges @ Rs. 160/Rft = Rs.82,74,419/-

RESOLUTION The Board considered and discussed the matter at length. The Board was apprised that the restoration work of Phase–I was executed successfully and to the satisfaction of the Board, the Board, therefore, resolved that instead of recovery of re-instatement charges, M/s Nayatel (Pvt) be allowed for restoration of civil work of Phase–II, to the satisfaction of Board and clear timeline by Engineering Branch. The Board, however, approved recovery of ROW charges as per already rates approved by the Board.

History of the case The tenants of Flat No. 5 at 3rd Floor, Flat No. 3 at 4th Floor & Flat No. 5 at 5th Floor carried out un-authorized / illegal constructions and addition / alteration without obtaining prior permission by CBP. The details are as under:-

History of the case Pre-qualification notice was published in dailies “Mashriq”, Peshawar dated 30-6-2018, “The News” Islamabad, dated 1-7-2018 & “Jang” Rawalpindi, dated 3-7-2018 and displayed on PPRA website vide Tender Notices No. TS 359414E, No. TS359413E & No. TS359415E. The pre-qualification of firms / contractors were approved by the President Cantonment Board under Section 25 of the Cantonments Act, 1924 and confirmed by the Board vide CBR No. 35, dated 31-07-2018.

Rates were called were called from the CB’s approved/pre-qualified contractors/firms on MES Schedule of Rates, 2014 for execution of the work i.e. “construction of CB Medical College at Regilalma Nasir Bagh Road, Peshawar Cantt, at an estimated cost of Rs. 336.036 (M)” vide CBP letters No. 14/2/Pre-qualification/E.B/86900, 86901, 86902, 86903, 86904, 86905, 86906, 86907, 86908, 86909, 86910, 86911, 86912, 86913, 86914 & 86934, dated 27-7- 2018. The same were opened on 7-8-2018 in the presence of Vice President & contractors / authorized representatives.

The lowest rates i.e. 24.60% Above on MES Schedule of Rates, 2014 of M/s M. Younas Builders were placed before the Board for consideration. The Board vide CBR No. 41(1), dated 28-09-2018 approved the same and resolved that work order be issue after final approval of the project.

It is pertinent to mention that case for allocation of land for construction of the college is still pending with the QMG’s Branch (Qtg & Lands Dte), GHQ Rawalpindi.

Now the contractor M/s M. Younas Builders vide application under reference has requested for the release of CDR deposited by them at the time of tenders as 5% earnest money.

FIXATION OF FINE / PENALTIES FOR CAUSING NUISANCE

Requirement To consider proposal for fixation of fine / penalties for causing nuisance in any street or other public place within a cantonment i.e.

(a) carries night-soil or other offensive matter or rubbish at any hour prohibited by the Board by public notice, or in any pattern of cart or receptacle which has not been approved for the purpose by the Board, or fails to close such cart or receptacle when in use; or

(b) carries night-soil or other offensive matter or rubbish along any route in contravention of any prohibition made in this behalf by the Board by public notice; or

(c) deposits, or causes or permits to be deposited, earth or materials of any description. or any offensive matter or rubbish.. in any place not Intended for the purpose in any street or other public place or waste or unoccupied land under the management of the Board; or

(d) eateries / hotels / bakeries / shops dealing with food items for their un- hygienic condition compromising the health and hygiene standards.

Shall be punished: -

(a) for a first time offence, warning shall be issued;

(b) for a second offence, with fine not less than five thousand or more than ten thousand rupees;

(c) for a third offence, with fine not less than ten thousand rupees or more than twenty five thousand rupees final warning;

(d) for repeated offence or for offences of large scale adulteration or adulteration with injurious substances, with fine which shall not be less than twenty five thousand rupees or more than fifty thousand rupees and sealing of respective shop / property premises.
