1. Message from the Chief Electoral Officer

June, 2013 This report of annual disclosure of political contributions for the calendar year 2012 is published in accordance with Section 240 of the Elections Act.

This is the first year of reporting under Nova Scotia’s new Elections Act which came into effect on January 1, 2012. It includes reported political contributions to registered parties, electoral district associations and candidates during the 2012 calendar year. The report reproduces the disclosure statements as originally filed or as originally filed and subsequently amended by the official agents and identifies areas where the legislative regime continues to present significant challenges. Elections Nova Scotia does not have the mandate to undertake a detailed review of the reports required to be filed.

There are no prescribed standards for the quality of the information disclosed and, aside from the deregistration process applicable to registered parties and electoral district associations under the Elections Act, there are no direct or effective consequences for failure to fully comply within the time limits prescribed for filing reports.

During this reporting period, there were no general or by-elections held.

This annual report reflects the level of compliance with the Elections Act and its regulations, that is, the timeliness of filings and quality of reports filed, by those filing for the reporting year. Complete and timely disclosure and reporting as prescribed by the Elections Act are intended to provide transparency respecting the financial activities of those filing.

Timeliness of filing remains problematic but overall, continues to improve. The quality of reports filed has also improved.

Elections Nova Scotia provides support to official agents of candidates and registered parties, including financial support to electoral district associations, to assist them in record keeping and in meeting their reporting obligations.

Handbooks and training materials were updated to reflect the newAct and published in 2012 to clarify the reporting requirements for all official agents. We gratefully acknowledge the assistance of the official agents of the registered parties in the revision of these materials.

2. Elections Nova Scotia Review Process

2.1 Political Contributions Rules The Elections Act establishes the rules under which registered parties, electoral district associations and candidates may accept political contributions, make or receive loans, and issue tax receipts. The Act also provides the Chief Electoral Officer with the authority to prescribe forms and establishes deadlines by which these reports are to be filed.

2.2 Contribution Limit Review and Eligibility Review Under subsection 236(1) of the Elections Act a contribution limit of $5,000 per eligible individual Nova Scotian resident applies to all contributions made to a registered party, its electoral district associations and its candidates combined in a calendar year. Compliance with the contribution limit can be a challenge for a registered party, electoral district association or candidate endorsed by that party because each associated entity can accept contributions independently. Even with collaboration, it can be difficult to track contributions cumulatively in real time.

Elections Nova Scotia conducted a compliance review of the contribution limit by consolidating all political contributions disclosure statements for each registered party, its electoral district associations and its candidates on a contributor basis. There were no instances identified where a contributor exceeded the $5,000 contribution limit during the 2012 calendar year.

2.2.1 Registered Parties Contributor eligibility respecting political contributions disclosure statements filed by each registered party was reviewed. Eligible contributors during the 2012 reporting year were limited to individuals residing in Nova Scotia. No evidence of ineligible contributors was found during the review.

2.2.2 Electoral District Associations Contributor eligibility respecting political contributions disclosure statements filed by each electoral district association was reviewed. Either the official agent of the electoral district association or the official agent of the registered party that endorsed the electoral district association addressed all queries made by Elections Nova Scotia. Amended disclosure statements were filed upon clarification where appropriate.

2.2.3 Candidates Contributor eligibility respecting political contribution disclosure statements filed by the official agent of each registered candidate was reviewed. None of the reports filed required disclosure.

3. Registered Parties

Annually, by April 30th, the official agent of a registered party is required to file a disclosure statement detailing political contributions received by the official agent during the previous calendar year. While this statement discloses the name and full residential address of each contributor whose contributions received by the official agent during the calendar year exceeded $200 and the total amount of the contributions, ENS discloses the community name only of the contributor as per Section 251(3) of the Elections Act.

For the reporting period January 1, 2012 to December 31, 2012, there were four registered parties in Nova Scotia:

• the Green Party of Nova Scotia (GPNS), • the Nova Scotia Liberal Party (NSLP), • the Nova Scotia New Democratic Party (NSNDP), and • The Progressive Conservative Association of Nova Scotia (PC).

All four registered parties filed their statutory reports on or before the prescribed deadline.

4. Electoral District Associations

In 2012, there were 52 electoral districts in Nova Scotia and the Nova Scotia Liberal Party, the Nova Scotia New Democratic Party and The Progressive Conservative Association of Nova Scotia each had 52 electoral district associations. The Green Party of Nova Scotia had one registered electoral district association.

An electoral district association, with the endorsement of the leader of the registered party, must register in the prescribed form with the chief electoral officer. The information contained in this registration must be confirmed annually under Section 196(2) of the Elections Act. All 157 registered electoral district associations filed Form 4-3, Electoral District Association’s Financial Statements and Supporting Schedules. Several electoral district associations did not complete the forms in full and did not sign the forms appropriately. For example, a treasurer may have signed instead of the official agent. This is problematic for Elections Nova Scotia as the official agent is the legislated person responsible for completing the annual filings and signing the declarations. In general, there were far fewer mistakes of this nature than in 2011.

Elections Nova Scotia reviewed all disclosure statements filed by official agents of electoral district associations and found no contributions failed to meet the eligibility criteria under the Elections Act.

During the course of the review of electoral district association disclosure statements Elections Nova Scotia identified several issues. There were instances where an electoral district association had contributions in excess of $5,000 but did not file the required audit report triggered by subsection 227(4) of the Act. It is worthy of note that when Elections Nova Scotia uncovered issues in its review, the official agents of electoral district associations were generally very cooperative in addressing problems and appreciative of the guidance provided.

The Tariff of Fees and Expenses under the Elections Act provides an annual allowance up to $357.70 toward the cost of bookkeeping services or for the purchase of accounting software incurred by an electoral district association. Of the 157 electoral district associations registered in 2012, only 32 (21%) presented claims for services rendered in 2012. In 2011, this number was 42 or 27%. Payments of this allowance are payable in June and December of each year, and ENS encourages those who did not claim for the first payment cycle to consider taking the opportunity to attain assistance available to them.

All electoral district associations would benefit from this support, particularly those who are challenged by the reporting requirements or failed to file reports on a timely basis in the past. Accounting errors were found in many of the EDA reports, such as differences in the 2012 closing bank balance, or surplus/deficit opening balances compared to 2011 closing balance reported. These reporting deficiencies indicate that the reporting regime continues to present significant challenges for some electoral district associations.

Elections Nova Scotia has issued revised handbooks and forms in 2012. The updated documents reflecting the new Elections Act were well received by the users.

5. Candidates

The official agent of a registered candidate is required to file a statement of political contributions disclosing the name and residential address of each contributor who, during the calendar year, exceeded $200 in total. The report is filed with the Chief Electoral Officer pursuant to Section 240 of the Elections Act and is due on March 31 following the year being reported, where an election was not held in the electoral district. In an election year, the financial report is due at the same time the official agent files their reports of election expenses and tax receipts.

Five candidates were registered in 2012; the official agents of all filed Financial Statement and Supporting Schedules.

Subsection 230(1)(f) of the Elections Act requires the official agent of a candidate to provide a written loan agreement respecting all loans for their candidate’s campaign. The loan agreement must be filed at the same time as the official agent files their disclosure statement of political contributions. The Act requires the official agent to report the outstanding balance of a loan and any changes to the loan agreement in years subsequent to the original loan contact. This requirement was met by all official agents to whom this applied in 2012.

The Chief Electoral Officer published Elections Nova Scotia Circular #1301 datedApril 12, 2013, Candidate Loans, to assist official agents in meeting their loan reporting requirements under the Act. The circular is available on the ENS website at www.electionsnovascotia.ca.
