A PARENT’S GUIDE WHERE IS UNABLE TO MAKE AN OFFER OF A PLACE FOR YEAR 7 ADMISSIONS 2015

Parents considering an appeal for a place at John Cabot Academy should carefully consider the following points before completing an appeal form. About John Cabot Academy We are an Academy run independently from South Gloucestershire Local Authority (LA) with both state funding and sponsorship. The LA operates co-ordinated admissions arrangements for schools in South Gloucestershire and neighbouring areas. These arrangements are explained in the LA guide. John Cabot Academy has its own Admissions Policy, Over Subscription Criteria and Process which has been agreed by the Secretary of State. A summary is set out in the prospectus, on the Academy website and in the South Gloucestershire LA guide.

Why has my child not been offered a place at John Cabot Academy? John Cabot Academy has an admissions number of 160 in each year group. When more children apply than there are places available, the over subscription criteria in the John Cabot Academy admissions procedure is used to determine allocation of places. John Cabot Academy received 882 on time applications and was able to offer160 places.

ADMISSIONS CRITERIA & WAITING LIST INFORMATION

As John Cabot Academy was oversubscribed, the oversubscription criteria have been applied to allocate the places that are available at the school. From the 882 applications received the 160 places have been allocated as follows:

• Eleven (11) students with Statements of Special Educational Need. • Three (3) students defined as a 'Looked After Child' (in Public Care). • Two (2) students, non statemented, where the child has a physical or mental impairment that has a substantial and long term adverse effect on his or her ability to carry out normal day to day activities, and this requires admission to John Cabot Academy. All students who were considered under this criterion and not granted a place were included within the random allocation of places in Zone A or Zone B as applicable below. • Seventy Five places, (75) to those with siblings currently at John Cabot Academy who are in Years 7 to 12. A Year 12 student at Post 16 within the Cabot Learning Federation must have taken GCSEs at John Cabot Academy in Year 11 to be classed as a sibling. • In the random selection, Sixty Eight` places, (68) to those who live within Zone A. One place, (1) to students who live within Zone B.

We aim to offer an 80%/20% split of places to Zone A and Zone B students in the random selection of each ability band but this was not possible as there were too few students in Zone B. Our Admissions Policy requires us to fill the remaining places from Zone A students of the same band to keep the ability spread.

Any applicant who attended the assessments and has not been offered a place at John Cabot Academy, if this was a higher preference, has the option to be placed on a waiting list which will be kept open at least until the end of Year 7.

John Cabot Academy Appeals – Historically over the last 5 years: 2010 Admissions: we received 52 Appeals; 3 withdrew, 49 hearings were held, 3 Appeals were upheld. 2011 Admissions: we received 50 Appeals; 10 withdrew, 40 hearings were held, 5 Appeals were upheld. 2012 Admissions: we received 45 Appeals; 10 withdrew, 35 hearings were held, 2 Appeals were upheld. 2013 Admissions: we received 28 Appeals; 2 withdrew, 26 hearings were held, 1 Appeal was upheld. 2014 Admissions: we received 41 Appeals; 11 withdrew, 30 hearings were held, 0 (Nil) Appeals were upheld.

John Cabot Academy will arrange for an independent Appeals Panel to consider the Academy not being able to offer a place and the reasons for a parent wanting their child to attend the Academy. The Panel consists of 3 people who have no connection with John Cabot Academy or the LA. One of them acts as Chair of the Panel and runs the appeal hearing. The Panel will consider the case put forward by the parent and what the allocated or other schools can offer; they must consider the admission arrangements for the Academy. The Panel will exercise its discretion by balancing the weight of the parent’s case (for wanting their child to attend John Cabot rather than an alternative school) against the Academy’s reasons for not being able to offer a place. i.e. taking into account the Academy’s published admissions policy and arrangements, the prejudice that an additional student would cause to the education of the students already offered a place and the Health and Safety of all the students in the Academy. WHAT NEXT?

Transfer to Secondary Stage Education September 2015

This information is in addition to the Admission to Secondary Schools in South Gloucestershire booklet.

Although you have not been offered your preferred school(s), there are still a number of options which are open to you. You can:

 Accept the offer of the alternative school; or  Ask to be considered for a place at a different school for which you have not applied before; or  Remain on the waiting list for any vacancies that may occur at your preferred school(s), until the end of December 2015; and/or  Appeal for your preferred school(s).

ACCEPTING THE OFFERED SCHOOL

What do I have to do if I want to accept the offered school? To do this just complete Section (A) of the green response form in the pack sent to you and return it to the address printed on the form. You need to do this no later than 5.00pm on 16 March 2015. The appropriate Admission Authority will then inform the Head Teacher of the offered school on your behalf.

If I accept the offered place now, can I change my mind later on if I decide to appeal or apply for a different school? Yes, however, if you wish to make an appeal, it may not be possible to hear your appeal at the same time as the other appeals for that school if they have already been timetabled. Your appeal will still be heard, but it may be at a later date.

Sometimes, particularly where parents move house to a different area, it is not possible to fit their application into the normal admissions or appeals timetable. However, if you find yourself in this position you still have the same rights as all other parents. Although your application may be dealt with later you have exactly the same right to ask for a preferred school, and if this application is not successful, to use the independent appeal process.

If you do not wish to proceed with a formal appeal your child can still be considered for any places that may become available. You are able to indicate your wish to be included on a waiting list by completing Section B of the green form.

APPLYING FOR A DIFFERENT SCHOOL

If I do not want the place at the school I have been offered, can I apply for a different school even if I have not indicated a preference for it before? Yes, the offer of a school place may be a parent's lower ranked preference, but in some cases it may be the appropriate "area" school for where you live or the nearest school to the home address that has a place available. Whichever applies to you, you do not have to accept the decision at this stage.

If there are other schools which you would prefer your child to be considered for please confirm in a separate letter detailing your child’s name, address, date of birth and the schools to be considered in rank order.

Please note that you may only apply for a total of three schools. If you have been offered one of your preferred schools this counts as one of the three.

If I express a new preference can I expect a place at that school? Only if there are enough places at that school to meet the demand for them.

All applications on the waiting lists along with late applications and changes of preference received by 14 April 2015 will be considered in the second round of allocations where places have become available. The second round of allocations will commence from 5 May 2015.

If the school is full you will be able to remain on the waiting list. If you decided to appeal for a place you will still remain on the waiting list.

If the school has only a limited number of places which cannot meet the demand, then the Admission Authority’s published criteria will be used to decide which children can be offered places. It is important to note that the published criteria can only be applied where there is a place available within the school's Admission Number (Admissions Level) for the appropriate Admissions Authority to allocate. If a school remains full i.e. no places become available within the school's Admission Level, then all further applications can expect to be refused.

If you have indicated that you wish to make an appeal, or if you have asked that your child remain on the waiting list, your child will continue to be considered for any further places that may become available up until the end of December 2015.

ASKING FOR YOUR CHILD TO REMAIN ON A WAITING LIST FOR A PLACE AT YOUR PREFERRED SCHOOL(S)

Parents/carers can ask the appropriate Admission Authority to continue to consider their child for any vacancies arising until the end of December 2015 at their preferred school(s).

All places which become available within the school’s admission level will be allocated using the appropriate Admission Authority’s published admission criteria. These are the same criteria that were used to fill the school at the time of the first allocation of places for September. All outstanding applications will be considered in this way, including applications received after the closing date of 31 October 2014.

Where a school has been over-subscribed and applications for places have been refused, a waiting list will be maintained, for any vacancies which occur, until the end of December 2015 and then discarded. Priority order on the waiting list will be determined by the over-subscription criteria, not by the date of joining the waiting list.

Can my child's name be considered for more than one school? Yes. It is important to rank clearly your order of preference (ie, first, second or third preference) if you wish to do this. This will help the Authority to ensure that your application is considered for your highest preference school possible, depending on the availability of places.

If I ask for my child to be considered for a place at another school will I lose the place which has been offered for my child at an alternative school? No. The place which has been offered for your child will be kept for you. This place would only be withdrawn if you were offered a place at a higher ranked/new preference school, or you inform your home Local Authority that you have made alternative arrangements.

If I name a second and third preference, will this prejudice my application for the school that I want as my first preference? No, if you are offered a place at a second or third preference school, you can still make an appeal or remain on a waiting list for any available places for your higher ranked preference school. An Appeal Panel will want to hear your reasons for appeal for that particular school, and why you feel that an extra place should be made available for your child at that school.

APPEALS

What is an Appeal? By law, an Admissions Authority has to enable parents to appeal to an independent body if their school application is unsuccessful.

The Appeal Panel must be independent of the Admission Authority and the decision it takes is binding on that Authority. This means that whatever decision an Appeal Panel takes, neither the Admission Authority nor the school can reverse it except in a court of law where the appellant or Admission Authority are successful in applying for Judicial Review of that decision.

For further information regarding the appeals process contact the secondary school direct (except for and Mangotsfield School when the Admissions and Transport Team should be contacted at South Gloucestershire Council).

How do I make an Appeal? You will have to set out your reasons for appealing in writing. You can appeal for more than one school, but each school must have its own appeal letter. If my preferred school is already full what is the point of an appeal? An Appeal Panel can offer places over and above a school's Admission Number if it feels that parents have put a strong enough case to them. They are not bound by the same criteria as the Admission Authorities who can only offer places in accordance with the published admission criteria.

How many places can an Appeal Panel offer? As many, or as few, as they feel is appropriate in the circumstances of the appeal. They are not 'given' a particular number of places to allocate to parents who are making appeals.

If I make an appeal for my preferred school, will I lose the place which has been offered to me at an alternative school? No, the place which has been offered for your child will be kept for you. The original offer of a school place will not be withdrawn unless a place is offered at a higher ranked/new preference school.

What reasons should I give for my appeal? This depends on your own particular reasons for appealing, but there are some specific circumstances where you should provide evidence. The two most common circumstances where this applies are: a) Change of Address – If you have made an appeal because of a change of address, proof of the address should be submitted with your appeal letter. If you have made an appeal because you are buying a property, a Solicitor's letter confirming exchange of contracts and completion date is needed. If your appeal is based upon a new address which is a council or rented property, a rental agreement or a Solicitor's letter is needed. In some cases, we may ask for proof of occupation of a particular property. b) Medical – parents may feel that the medical condition of their child is an important part of their appeal. If you wish an Appeal Panel to consider medical/psychological evidence for your child you should submit a supporting letter from the Doctor/Specialist, before your appeal is due to be heard.

Please note that if your letter(s) of appeal are received after the deadline your appeal may not be heard with the other on-time lodged appeals.

TRANSFER TO SECONDARY SCHOOL - SEPTEMBER 2015 APPLICATIONS FOR THE RIDINGS’ FEDERATION WINTERBOURNE INTERNATIONAL ACADEMY

677 applications were received by 31 October 2014 for Winterbourne International Academy which has an Admission Level of 300 for the Year 7 intake in September 2015. Unfortunately, it has not been possible to meet all the requests for places at Winterbourne International Academy and it has, therefore, been necessary to use The Ridings’ Federation of Academies Trust’s published admission criteria to decide which applicants should be offered the available places.

1 place was required for a child with a Statement of Special Educational Needs which names Winterbourne International Academy. The remaining 299 places have been offered to applicants in the following priority order:

103 local siblings.

113 children for whom Winterbourne International Academy was indicated as a preference who live within the area for which Winterbourne International Academy has first responsibility.

82 children for whom Winterbourne International Academy was indicated as a preference who live within the consortium area for which Downend School, King’s Oak Academy, Mangotsfield School and Winterbourne International Academy have equal responsibility who live closest to Winterbourne International Academy. Distances from home to school are measured in a direct line between the address point of the child’s home and a central point within the main school buildings using the Local Authority’s computerised mapping system. The farthest child from Winterbourne International Academy offered a place under this criterion is measured to a distance of 3.029 miles from the school.
