Paulson: Some Issues in the Exchange between Kelsen and Kaufmann 1 Introduction: Four Rounds in the Exchange Unlike Hans Kelsen, Erich Kaufmann (1880-1972) is not a household name in juridico-philosophical circles. Kaufmann was, however, a prominent figure in the legal community in Wilhelmine and Weimar Germany, and his work in constitutional law and public international law was well known in his own day.2 What is more, he is generally credited with having in effect launched the extraordinary Weimar public law debates,3 from 1926 to the end of the Weimar Republic, seven years later. -

Botticelli Past and Present Ever, the Significant and Continued Debate About the Artist
The recent exhibitions dedicated to Botticelli around the world show, more than and Present Botticelli Past ever, the significant and continued debate about the artist. Botticelli Past and Present engages with this debate. The book comprises four thematic parts, spanning four centuries of Botticelli’s artistic fame and reception from the fifteenth century. Each part comprises a number of essays and includes a short introduction which positions them within the wider scholarly literature on Botticelli. The parts are organised chronologically beginning with discussion of the artist and his working practice in his own time, moving onto the progressive rediscovery of his work from the late eighteenth to the turn of the twentieth century, through to his enduring impact on contemporary art and design. Expertly written by researchers and eminent art historians and richly illustrated throughout, the broad range of essays in this book make a valuable contribution to Botticelli studies. Ana Debenedetti is an art historian specialising in Florentine art, artistic literature and workshop practice in the Renaissance. She is Curator of Paintings at the Victoria and Albert Museum, responsible for the collections of paintings, drawings, watercolours and miniatures. She has written and published on Renaissance art and Botticelli philosophy. Caroline Elam is a Senior Research Fellow at the Warburg Institute, University of London. She specialises in architecture, art and patronage in the Italian Renaissance and in the reception of early Italian art in the late nineteenth and twentieth century. Past She has held academic positions at the University of Glasgow, King’s College, Cambridge and Westfield College, University of London. -

But he also proposed an agenda to transform legal science by increasing the role of empiri- cal insights in legal reasoning. In this article, we argue that whereas Ehrlich’s contribution to sociology of law is overrated by its separation from the theoretical and academic context of legal science, by the same token his contribution to the history of legal science is underrated as a result of his association with sociology. It is our thesis that the key to understanding Ehrlich’s proposition and its subse- quent failure is the role assigned to sociology in his undertaking: sociology was for Ehrlich an instrument to make law more scientifi c. Even though it is not easy to propose any precise measure of success or failure in this case, we argue that while Ehrlich was undoubtedly more successful than most of his contemporaries to become an internationally recognisable name and a lasting scholarly reference, this recognition is primarily due to a re-appropriation of Ehrlich’s ideas by the emergent sub-discipline of sociology of law, even though, as Roger Cotterrell put it, “Ehrlich created his legal sociology as a by-product of juristic inquiries”2. -

Germa« Lega/ Defcöles on f/ie .S'mm.v o/Merfira/ /r;7erve«aVm.s' wzf/zoat Convent, c. 7<§90-7 97<7 Anclreas-Holger Maehle Summary In response to cases of high-handed medical interventions and treatments, a debate on the legal justification of operations and the relevance of patients' consent developed among German-speaking jurists in the 1890s. The view that surgery was objectively physical injury or battery, which went merely unpunished through the patient's consent, was highly contested among legal experts and firmly rejected by doctors. Various proposals to justify indicated medical treatment without consent were discussed. German jurisdiction, however, endorsed the battery theory of medical interventions and thus prepared the way for the concept of informed consent in medicine. Introduction In German jurisdiction, medical interventions constitute factually assault and battery /<örp erve/7etzw«gcm) in the sense of criminal and civil law'. In order to go unpunished they require a special justification, which is recognized in the consent of the patient or his legal representative. This conception of legality was established about a century ago, but was at the time highly contested among leading jurists. Moreover, it earned forceful protests from the medical profession.
