PETERMAN* In this Note I argue that the Federal Election Campaign Act’s $5000 limitation on individual contributions to political committees should be removed. I advance two main arguments. First, in light of recent campaign finance decisions, the limitation appears to be unconstitutional as it imposes a limit on First Amendment rights without being tailored to the government’s interest in preventing quid pro quo cor- ruption. Second, eliminating the contribution limitation will have previously unrec- ognized normative benefits. Smaller PACs representing a variety of viewpoints will be more able to compete with established corporate and union PACs, and the volume of accountable political speech may increase as more money is channeled through PACs to candidates’ hands. INTRODUCTION The modern campaign finance system is praised by few and maligned by many. At the center of the criticism lies the seminal 1976 Supreme Court decision Buckley v. Valeo,1 which requires any regula- tion of political speech to be closely related to preventing corruption. Buckley holds that the risk of corruption justifies regulating contribu- tions given to candidates but not independent expenditures made in support of candidates by unaffiliated individuals and groups.2 The presence of limits on direct contributions to candidates in the absence of restrictions on independent expenditures makes it easier for money to flow to independent expenditure groups.3 This outcome is worri- * Copyright 2011 by Jeremy R. Erin Ainsworth Fish Summer 2016 Independent Study Course An overview of my internship with Congressman David Skaggs and how this set a course for my career in political campaigning. By my senior year at CU I had changed my major twice and had gone from dreaming of a career as a journalist and traveling the world working for National Geographic, to serving in the Peace Corp and teaching English in West Africa. I was all over the map as far as picking out a career for myself and couldn’t hone in on one area of interest. I excelled in foreign languages and history but there didn’t seem to be a job which I could envision in those areas and my father wasn’t too subtle about what he’d like me to pursue by sending me articles on beginning salaries for lawyers. He was a maritime lawyer and felt that the law was a perfect career. I had settled on a major in Political Science as I had always been interested in government and my mother was particularly active in local politics. She had a heavy influence on my knowledge of current affairs and our dinner conversations were about the war in Iran and the Ayatollah Khomeini, the Civil Rights movement which she was passionate about, or we’d discuss the Kennedy assassinations and what that meant to her generation. Politics and American Government felt familiar to me and it seemed like a natural progression to major in political science. However I knew I didn’t want to pursue a career in the law and yet nothing stood out as an “aha!” job for me and with that came a constant level of anxiety. -

CAMPAIGN FINANCE: LIFE AS A POLITICAL CONSULTANT David Keene* Although being a political consultant is not nearly as exciting as Dick Morris' would have us believe, over the years it has proven very interesting. Therefore, when Joel Gora called and asked me to come here today, I agreed because we have both been involved in campaign reform policy discussions for many, many years. I do not wish to recount with you my perspectives "from the trenches," but instead, wish to discuss my personal biases. I was executive assistant to Senator Jim Buckley2 in the 1970s when we won an amendment allowing expedited review of the 1974 Campaign Finance Act and, subsequently, took the issue to the Supreme Court with the assistance of some of the people here. What I feel we accomplished at the Supreme Court was to force policymakers at that time, and even now, to realize that the First Amendment means something. -

Gehl, a business leader and former CEO with experience in government, began, in the last decade, to participate actively in politics—first in traditional partisan politics. As she deepened her understanding of how politics actually worked—and didn’t work—for the public interest, she realized that even the best candidates and elected officials were severely limited by a dysfunctional system, and that the political system was the single greatest challenge facing our country. She turned her focus to political system reform and innovation and has made this her mission. Michael E. Porter, an expert on competition and strategy in industries and nations, encountered politics in trying to advise governments and advocate sensible and proven reforms. As co-chair of the multiyear, non-partisan U.S. Competitiveness Project at Harvard Business School over the past five years, it became clear to him that the political system was actually the major constraint in America’s inability to restore economic prosperity and address many of the other problems our nation faces. Working with Katherine to understand the root causes of the failure of political competition, and what to do about it, has become an obsession. Agency Problems in Political Campaigns: Media Buying and Consulting∗ Gregory J. Martin† and Zachary Peskowitz‡ October 30, 2017 Abstract Advertising expenditures in congressional campaigns are made not directly by cam- paigns themselves but indirectly though intermediary firms. Using a new dataset of revenues and costs of these firms, we study the markups that these firms charge can- didates. We find that markups are higher for inexperienced candidates relative to experienced candidates, and PACs relative to candidates. We also find significant dif- ferences across the major parties: firms working for Republicans charge higher prices, exert less effort, and induce less responsiveness in their clients’ advertising expendi- tures to electoral circumstances than do their Democratic counterparts. We connect this observation to the distribution of ideology among individual consulting firm em- ployees, arguing that these higher rents incentivize consultants to work against their intrinsic ideological motivations. The internal organization of firms reflects an attempt to mitigate this conflict of interest; firms are composed of ideologically homogeneous employees, and are more likely to work for ideologically proximate clients. ∗We received valuable comments from seminar audiences at Caltech, Stanford GSB, Emory, the University of Houston Political Economy Conference, and MPSA.
