Witkowski Marquette University, 2010 What was the legal status of women in early colonial Maryland? This is the central question answered by this dissertation. Women, as exemplified through a series of case studies, understood the law and interacted with the nascent Maryland legal system. Each of the cases in the following chapters is slightly different. Each case examined in this dissertation illustrates how much independent legal agency women in the colony demonstrated. Throughout the seventeenth century, Maryland women appeared before the colony’s Provincial and county courts as witnesses, plaintiffs, defendants, and attorneys in criminal and civil trials. Women further entered their personal cattle marks, claimed land, and sued other colonists. This study asserts that they improved their social standing through these interactions with the courts. By exerting this much legal knowledge, they created an important place for themselves in Maryland society. Historians have begun to question the interpretation that Southern women were restricted to the home as housewives and mothers. -

THE COURT HOUSES OF PLYMOUTH by Rose T. Briggs Pilgrim Society Note, Series One, Number 17, May 1966 Plymouth, the county seat of Plymouth County, was also the capital town of Plymouth Colony, and thus has a judicial history which antedates the establishment of Plymouth County in 1685, and goes back to the founding of Plymouth Colony in 1620. Plymouth Colony had a well established judicial system before 1685. The first entry in its Book of Laws, dated December 27, 1623, provided that: all crimynall facts; and also all maters of trespass; and debts between man & man should be tried by the verdict of twelve honest men, to be impaneled by Authoryty in the forme of a jurie upon their oaths. The entry is in the handwriting of Governor Bradford. Before 1623, trials had taken place before the whole body of freemen, sitting as a General Court, the Governor and Assistants presiding. This General Court elected officers, passed ordinances, and took what judicial action was necessary. Its first recorded meeting was in the spring of 1621. The meeting was held in the Common House, the site of which, at the foot of Leyden Street, is marked with a tablet by the Commonwealth of Massachusetts. When the Fort was built on Burial Hill in 1622, the lower chamber was used as a meeting place, not only for Sunday services, but for Colony business, which presumably included the meetings of the General Court. In 1637, a Meeting House, for both religious and secular meetings, was built on the north side of what is now Town Square. -

Colonial America: Pilgrims, the Mayflower Compact, and Thanksgiving BY TIM BAILEY UNIT OVERVIEW Over the course of three lessons the students will analyze primary and secondary sources on the voyage of the Pilgrims to America aboard the Mayflower, the writing of the Mayflower Compact, and the origin of Thanksgiving. The texts are a modern secondary source about the journey of the Mayflower and two primary sources: The Mayflower Compact (1620) and a letter by a colonist, Edward Winslow (1621). Students will closely analyze these materials, draw conclusions, and demonstrate their understanding through classroom activities as directed in each lesson. One of the earhest was Augustine Clemens, who began painting in Reading, England, in 1623. He came to Boston in 1638 and probably did the portrait of Dr. John Clarke, now at Harvard Medical School, about 1664.' His son, Samuel, was a member of the next generation of Boston painters which also included John Foster and Thomas Smith. Foster, a Harvard graduate and printer, may have painted the portraits of John Davenport, John Wheelwright and Increase Mather. Smith was commis- sioned to paint the President of Harvard in 1683.^ While this portrait has been lost, Smith's own self-portrait is still extant. When the eighteenth century opened, a substantial number of pictures were painted in Boston. The artists of this period practiced a more academic style and show foreign training but very few are recorded by name. Perhaps various English artists traveled here, painted for a time and returned without leaving a written record of their trips. These artists are known only by their pictures and their identity is defined by the names of the sitters. Two of the most notable in Boston are the Pierpont Limner and the Pollard Limner. These paint- ers worked at the same time the so-called Patroon painters of New York flourished. -

Island Studies Journal, 15(1), 2020, 151-168 The sovereignty of the Crown Dependencies and the British Overseas Territories in the Brexit era Maria Mut Bosque School of Law, Universitat Internacional de Catalunya, Spain MINECO DER 2017-86138, Ministry of Economic Affairs & Digital Transformation, Spain Institute of Commonwealth Studies, University of London, UK [email protected] (corresponding author) Abstract: This paper focuses on an analysis of the sovereignty of two territorial entities that have unique relations with the United Kingdom: the Crown Dependencies and the British Overseas Territories (BOTs). Each of these entities includes very different territories, with different legal statuses and varying forms of self-administration and constitutional linkages with the UK. However, they also share similarities and challenges that enable an analysis of these territories as a complete set. The incomplete sovereignty of the Crown Dependencies and BOTs has entailed that all these territories (except Gibraltar) have not been allowed to participate in the 2016 Brexit referendum or in the withdrawal negotiations with the EU. Moreover, it is reasonable to assume that Brexit is not an exceptional situation. In the future there will be more and more relevant international issues for these territories which will remain outside of their direct control, but will have a direct impact on them. Thus, if no adjustments are made to their statuses, these territories will have to keep trusting that the UK will be able to represent their interests at the same level as its own interests. For more information, please contact [email protected]. “SO LONG AS THE WORK IS DONE”: RECOVERING JANE GOODWIN AUSTIN by KARI HOLLOWAY MILLER Under the Direction of Janet Gabler-Hover, PhD ABSTRACT The American author Jane Goodwin Austin published 24 novels and numerous short stories in a variety of genres between 1859 and 1892. Austin’s most popular works focus on her Pilgrim ancestors, and she is often lauded as a notable scholar of Puritan history who carefully researched her subject matter; however, several of the most common myths about the Pilgrims seem to have originated in Austin’s fiction. As a writer who saw her work as her means of entering the public sphere and enacting social change, Austin championed women and religious diversity. The range of Austin’s oeuvre, her coterie of notable friendships, especially amongst New England elites, and her impact on American myth and culture make her worthy of in-depth scholarly study, yet, inexplicably, very little critical work exists on Austin. -

General 1.1 Before 1 January 1949, the principal form of nationality was British subject status, which was obtained by virtue of a connection with a place within the Crown's dominions. On and after this date, the main form of nationality was citizenship of the UK and Colonies, which was obtained by virtue of a connection with a place within the UK and Colonies. 2. Meaning of the expression 2.1 On 1 January 1949, all the territories within the Crown's dominions came within the UK and Colonies except for the Dominions of Canada, Australia, New Zealand, South Africa, Newfoundland, India, Pakistan and Ceylon (see "DOMINIONS") and Southern Rhodesia, which were identified by s.1(3) of the BNA 1948 as independent Commonwealth countries. Section 32(1) of the 1948 Act defined "colony" as excluding any such country. Also excluded from the UK and Colonies was Southern Ireland, although it was not an independent Commonwealth country. 2.2 For the purposes of the BNA 1948, the UK included Northern Ireland and, as of 10 February 1972, the Island of Rockall, but excluded the Channel Islands and Isle of Man which, under s.32(1), were colonies. 2.3 The significance of a territory which came within the UK and Colonies was, of course, that by virtue of a connection with such a territory a person could become a CUKC. Persons who, prior to 1 January 1949, had become British subjects by birth, naturalisation, annexation or descent as a result of a connection with a territory which, on that date, came within the UK and Colonies were automatically re- classified as CUKCs (s.12(1)-(2)). -

William Bradford's life and influence have been chronicled by many. As the co-author of Mourt's Relation, the author of Of Plymouth Plantation, and the long-term governor of Plymouth Colony, his documented activities are vast in scope. The success of the Plymouth Colony is largely due to his remarkable ability to manage men and affairs. The information presented here will not attempt to recreate all of his activities. Instead, we will present: a portion of the biography of William Bradford written by Cotton Mather and originally published in 1702, a further reading list, selected texts which may not be usually found in other publications, and information about items related to William Bradford which may be found in Pilgrim Hall Museum.
